 1                    AMENDMENT TO SENATE BILL 1701
 2        AMENDMENT NO.     .  Amend Senate Bill 1701 by  inserting
 3    immediately above Section 900 the following:
 4        "Section  115.  Upon the payment of the sum of $30,000.00
 5    to the State of Illinois, the easement for  highway  purposes
 6    acquired  by  the People of the State of Illinois is released
 7    over and through the following described land in Will County,
 8    Illinois:
 9    Parcel 1WY0512:
10    That part of the Southwest Quarter of Section 9, Township  36
11    North,   Range  9  East  of  the  Third  Principal  Meridian,
12    described as follows:
13    Commencing at the southeast corner of the  Southwest  Quarter
14    of  said  Section  9;  thence  North  01 degree 29 minutes 22
15    seconds East, 42.50 feet (Bearings  assumed  for  description
16    purposes  only)  along the east line of the Southwest Quarter
17    of said Section 9, to a point on the centerline of  US  Route
18    30;  thence  Southwesterly  along said centerline and along a
19    curve to the left having a radius of  4583.80  feet  (record)
20    4585.79  feet (measured), the chord of said curve bears South
21    87 degrees 52 minutes 43 seconds West, 95.38 feet  (measured)
22    94.00  feet  (record)  along  said centerline of US Route 30;
23    thence South 87 degrees 16 minutes, 58 seconds West,  1535.41

 1    feet  along  said  centerline of US Route 30; thence North 02
 2    degrees 43 minutes, 02 seconds West, 85.00 feet to a point on
 3    the northerly right-of-way line of US Route 30, and the Point
 4    of Beginning; thence northwesterly along the  said  northerly
 5    right-of-way  line  of  US  Route  30 on a curve to the right
 6    having a radius of 1085.95 feet,  the  chord  of  said  curve
 7    bears  North  43  degrees 11 minutes 14 seconds West, 1313.49
 8    feet to a point 65.00 feet normally distant easterly from the
 9    centerline of US Route 30; thence southeasterly along a curve
10    to the left  having  a  radius  of  7523.86  feet  and  being
11    concentric  with  said  centerline,  the  chord of said curve
12    bears South 02 degrees 39 minutes  23  seconds  East,  467.21
13    feet;  thence  South  04  degrees 26 minutes 08 seconds East,
14    466.23 feet parallel with said centerline  of  US  Route  30;
15    thence  South  31  degrees  52 minutes 34 seconds East, 38.78
16    feet to a point on the  south  line  of  the  said  Southwest
17    Quarter  of  Section 9; thence South 88 degrees 57 minutes 38
18    seconds East, 490.39  feet  along  said  south  line  of  the
19    Southwest Quarter of Section 9, to a line 85.00 feet normally
20    distance  northerly  of the centerline of US Route 30; thence
21    North 87 degrees 16 minutes  58  seconds  East,  330.81  feet
22    parallel  with  the centerline of US Route 30 to the Point of
23    Beginning, in Will County, Illinois.
24    Said parcel containing 4.971 acres, more or less.
25        Section 120.  Upon the payment of the sum of $6,850.00 to
26    the State of Illinois,  the  easement  for  highway  purposes
27    acquired  by  the People of the State of Illinois is released
28    over and through the  following  described  land  in  Madison
29    County, Illinois:
30        Parcel No. 800X898:
31        Part of Lot 1 in "Rutz-Iberg Subdivision", as recorded in
32        the Recorder's Office of Madison County, Illinois in Plat
33        Book  36 on Page 11 being a part of the Northeast Quarter

 1        of the Southwest Quarter of Section 32, Township 4 North,
 2        Range 5 West of the  Third  Principal  Meridian,  Madison
 3        County, Illinois, more particularly described as follows:
 4             Commencing  at  an  old stone found at the Northwest
 5        Corner of the  Southwest  Quarter  of  said  Section  32;
 6        thence east along the north line of the Southwest Quarter
 7        of  said  Section  32, a distance of 1,912.61 feet to the
 8        northerly extension of the east line of  said  Lot  1  in
 9        "Rutz-Iberg  Subdivision";  thence  South  00  degrees 47
10        minutes 35 seconds East along  said  northerly  extension
11        and  the  east  line  of said Lot 1, a distance of 601.10
12        feet to the Southeast Corner of said Lot  1,  said  point
13        being  on  the existing northerly right of way line of FA
14        Route 12 (marked U.S. Route 40), being also the Point  of
15        Beginning.
16             From  said  Point  of  Beginning;  thence continuing
17        South 00 degrees 47 minutes 35  seconds East, 53.40 feet;
18        thence around a curve to the  left  having  a  radius  of
19        4,607.75  feet, chord bearing South 70 degrees 49 minutes
20        58 seconds West, an arc distance of 167.01  feet;  thence
21        North  00  degrees 47 minutes 35 seconds West, 54.04 feet
22        to the Southwest Corner of  said  Lot  1  of  "Rutz-Iberg
23        Subdivision",  said point being on the existing northerly
24        right of way line of FA Route 12 (marked U.S. Route  40);
25        thence  along  said existing right of way, around a curve
26        to the right having a  radius  of  4,658.75  feet,  chord
27        bearing  North  71 degrees 02 minutes 28 seconds East, an
28        arc distance of 166.81 feet to the Point of Beginning.
29             Parcel 800X898 herein described contains  8,512  sq.
30        ft. (0.195 acre).
31             Basis  of  bearing is North 90 degrees 00 minutes 00
32        seconds East between  a  stone  found  at  the  Northwest
33        Corner  of the Southwest Quarter of Section 32 and a plug
34        found at the center of said Section 32, Township 4 North,

 1        Range 5 West of the Third Principal Meridian.
 2             And further, in consideration of the payment of  the
 3        amount  set  forth  above,  the  rights  or  easements of
 4        access, crossing, light, air and view  to  and  from  the
 5        following  described  land  and  FA Route 12 are restored
 6        subject to permit requirements of the State of  Illinois,
 7        Department of Transportation:
 8             Direct  access to FA Route 12 (marked U.S. Route 40)
 9        shall be restored to 166.81  lin.  ft.  of  the  existing
10        northerly  right  of  way  line  of  FA  Route  12 in the
11        Northeast Quarter of the Southwest Quarter of Section 32,
12        Township 4 North, Range 5 West  of  the  Third  Principal
13        Meridian,  Madison  County,  Illinois,  said right of way
14        line being described as follows:
15             Lot 1 of Rutz-Iberg Subdivision, a subdivision of  a
16        tract  of  land in the Northeast Quarter of the Southwest
17        Quarter of Section 32, Township 4 North, Range 5 West  of
18        the  Third  Principal  Meridian, as the same appears from
19        plat thereof recorded in the Recorder's Office of Madison
20        County, Illinois in Plat Book 36 on Page 11.  Situated in
21        the County of Madison and State of Illinois.
22        Section 125.  Upon the payment of the sum of  $400.00  to
23    the  State  of Illinois, the easement for highway purposes is
24    released over and through the following  described  land  and
25    the  rights  or easements of access, crossing, light, air and
26    view from, to and over the following described  land  and  FA
27    Route  12  are restored subject to permit requirements of the
28    State of Illinois, Department of Transportation:
29        Parcel No. 5X23712
30        Part of the Southwest Quarter of the Northwest Quarter of
31        Section 16, Township 10  North,  Range  14  West  of  the
32        Second  Principal  Meridian, Clark County, Illinois, also
33        being part of a dedication of right of way for a  freeway

 1        by  Charles  F.  Beaver, recorded in Right of Way Book 4,
 2        pages 447 and 448 in the Clark County Recorder's  Office,
 3        described as follows:
 4             Commencing  at the southwest corner of the Northwest
 5        Quarter of said Section 16; thence North  88  degrees  28
 6        minutes  14 seconds East (bearings based on F.A. Route 12
 7        surveyed  centerline  bearing  of  North  67  degrees  21
 8        minutes East from right of way  dedication  plat)  394.86
 9        feet  along  the  south line of said Northwest Quarter to
10        the Point  of  Beginning;  thence  North  67  degrees  21
11        minutes 00 seconds East 220.05 feet along a line parallel
12        with   and  35.00  feet  southerly  of  the  said  survey
13        centerline; thence South 22 degrees 39 minutes 00 seconds
14        East 85.00 feet  to  the  intersection  of  the  existing
15        southerly right of way line of said F.A. Route 12 and the
16        south  line  of  the  Southwest  Quarter of the Northwest
17        Quarter of said Section 16; thence South  88  degrees  28
18        minutes  14 seconds West 235.89 feet along the south line
19        of said  Quarter  Section  to  the  Point  of  Beginning,
20        containing 0.215 of an acre, more or less.".
