90_SB1701enr New Act Upon the receipt of specified consideration, authorizes the State to convey title to, release easements over, and restore access rights to, described parcels of land. Effective immediately. LRB9007990PTmbA SB1701 Enrolled LRB9007990PTmbA 1 AN ACT concerning property. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 4. The Director of Natural Resources, on behalf 5 of the State of Illinois, is authorized to convey and quit 6 claim to the Hamilton County Water District, its successors 7 and assigns, for and in consideration of $10 paid to the 8 Department of Natural Resources, a non-exclusive, 9 unobstructed, perpetual public utility easement for the 10 purpose of erecting, constructing, installing, and laying, 11 and thereafter using, operating, inspecting, repairing, 12 maintaining, replacing, and removing, an underground water 13 pipeline and miscellaneous appurtenances on, over, under, and 14 across the following described real property, together with 15 the right of ingress and egress over the adjacent lands of 16 the State of Illinois, its successors and assigns, for the 17 purpose of this easement, subject to such conditions as may 18 be determined by the Department, to wit: 19 A strip of land 20 feet in width centered on the 20 water pipeline installed or to be installed on and across 21 the Easterly part of the Southeast Quarter of the 22 Northeast Quarter and the Southerly part of the Southwest 23 Quarter of the Southwest Quarter in Section 27, Township 24 4 South, Range 5 East of the Third Principal Meridian, 25 and on and across the Westerly part of the West Half of 26 the Southwest Quarter of Section 20, Township 3 South, 27 Range 5 East of the Third Principal Meridian, all in 28 Hamilton County, Illinois. 29 The Director of Natural Resources shall obtain a certified 30 copy of the portions of this Act containing the title, the 31 enacting clause, the effective date, and this Section within 32 60 days after the effective date of this Act and, upon SB1701 Enrolled -2- LRB9007990PTmbA 1 receipt of payment required by this Section, shall record the 2 certified copy in the Recorder's Office in Hamilton County. 3 Section 170. Upon the payment of the sum of $252,000.00 4 to the State of Illinois, the easement for highway purposes 5 acquired by the People of the State of Illinois is released 6 over and through the following described land in DuPage 7 County, Illinois: 8 Parcel No. 1WY514A: 9 Those parts of Lots 91 and 92 and that part of the 10 vacated alley lying North and adjoining said lots in 11 Taylor and Powers Garden Acres, being a subdivision in 12 the North Half of Section 34, Township 39 North, Range 9 13 East of the Third Principal Meridian, according to the 14 plat thereof recorded September 19, 1929, as Document No. 15 286552, in DuPage County, Illinois, described as follows: 16 Beginning at the Northeast corner of said Lot 91; thence 17 northerly, 3.048 meters [10.00 feet] on an assumed 18 bearing of North 0 degrees 30 minutes 54 seconds East 19 along the northerly extension of the East line of said 20 Lot 91 to the North line of the South Half of said alley 21 vacated by Document No. 730256; thence North 89 degrees 22 31 minutes 41 seconds West, 45.016 meters [147.69 feet] 23 along said North line to a line that is 30.480 meters 24 [100.00 feet] East of, as measured perpendicular, and 25 parallel with the center line of Illinois Route 59 as 26 established by Document No. 321382; thence South 11 27 degrees 09 minutes 32 seconds West, 47.396 meters [155.50 28 feet] along said parallel line to a line that is 12.192 29 meters [40.00 feet] North of, as measured perpendicular 30 to, and parallel with the South line of said Lots 91 and 31 92; thence South 89 degrees 28 minutes 10 seconds East, 32 53.770 meters [176.41 feet] along said parallel line to 33 the East line of said Lot 91; thence North 0 degrees 30 SB1701 Enrolled -3- LRB9007990PTmbA 1 minutes 54 seconds East, 43.580 meters [142.98 feet] 2 along said East line to the Point of Beginning. 3 Said parcel contains 0.2303 hectare [0.569 acre], more or 4 less. 5 Reserving unto the State existing access control from the 6 tract described above: 7 and, 8 Parcel No. 1WY514B: 9 Lot 39 EXCEPT the Northerly 12.192 meters [40.00 feet], 10 measured perpendicular to the southerly right-of-way line 11 of Illinois Route 56; ALSO EXCEPT the easterly 7.620 12 meters [25.00 feet], measured perpendicular to the 13 westerly right-of-way line of Illinois Route 59, in 14 Robert Bartlett's Green Acres, being a subdivision in the 15 East Half of Section 33 and in the West Half of Section 16 34, Township 39 North, Range 9 East of the Third 17 Principal Meridian, according to the plat thereof 18 recorded October 20, 1943, as Document No. 454884, in 19 DuPage County, Illinois. 20 Said parcel contains 0.7673 hectare [1.896 acres], more 21 or less. 22 It is understood and agreed that there is no existing 23 right of access, nor will access be permitted in the 24 future by the State of Illinois, Department of 25 Transportation, from or over the premises above described 26 to and from FA Route 131 (IL 56), previously declared a 27 freeway, nor will the Department of Transportation permit 28 access to FAP Route 338 (IL 59), except at the south 50 29 feet of the easterly line of parcel 1WY514B, subject to 30 the Department of Transportation's "Policy on Permits for 31 Access Driveways to State Highways." 32 Section 175. Upon the payment of the sum of $10,000 to 33 the State of Illinois, the rights or easements of access, SB1701 Enrolled -4- LRB9007990PTmbA 1 crossing, light, air, and view from, to, and over the 2 following described line and FA Route 12 are restored subject 3 to permit requirements of the State of Illinois, Department 4 of Transportation: 5 Parcel No. 800XA75: 6 Direct access to FA Route 12 (marked U.S. Route 40) shall 7 be restored to 79.04 feet of a tract of land abutting the 8 southerly right of way line of said highway from the 9 Northwest Corner of the existing easterly right of way 10 line of SA Route 1 (marked Troy-Lebanon Road) and said 11 southerly right of way line of FA Route 12 at Station 12 245+68, a distance of 75.00 feet right of the centerline 13 of said FA Route 12 easterly along said southerly right 14 of way line 200.00 feet to the Point of Beginning at 15 Station 247+49.68 easterly 79.04 feet to Station 16 248+28.72 in the Southeast Quarter of Section 9, Township 17 3 North, Range 7 West of the Third Principal Meridian, 18 Madison County, Illinois. 19 Stipulations on the above described Access Rights that a 20 25 ft. entrance that has right-in and right-out only 21 access to and from the property to FA Route 12 (marked 22 U.S. Route 40). 23 Section 900. The Secretary of Transportation shall 24 obtain a certified copy of the portions of this Act 25 containing the title, the enacting clause, the effective 26 date, the appropriate Section or Sections containing the land 27 descriptions of property to be transferred or otherwise 28 affected, and this Section within 60 days after its effective 29 date and, upon receipt of payment required by the Section or 30 Sections, if any payment is required, shall record the 31 certified document in the Recorder's Office in the county in 32 which the land is located. Upon the payment of the sum of $20,750 to 2 the Quincy Veterans Home Fund, the Director of the Department 3 of Veterans' Affairs is authorized to convey to Refreshment 4 Services, Inc., an Illinois corporation organized under the 5 laws of Delaware and registered to do business in Illinois, 6 by quit claim deed the following described real property: 7 A part of E. A. Dudley's Addition to the City of Quincy, 8 a subdivision of a part of the Southeast quarter of Section 9 26 in Township 1 South of the Base Line and in Range 9 West 10 of the Fourth Principal Meridian, in the City of Quincy, 11 Adams County, Illinois, being more particularly and described 12 as follows: 13 Commencing at the northeast corner of Block 36 of said E. 14 A. Dudley's Addition, said point being a point on the west 15 line of North 12th Street a record distance of 33 feet west 16 and 429 feet north of the southeast corner of said Section 17 26, thence westerly along the north line of said Block 36 a 18 distance of 16 feet to the Point of Beginning, thence from 19 said Point of Beginning continuing westerly along the north 20 line of said Block 36 a distance of 450.75 feet to the 21 northwest corner of said Block 36, thence southerly along the 22 west line of said Block 36 a distance of 216.00 feet to the 23 northeast corner of property conveyed to the City of Quincy 24 as recorded in Book 463 of Deeds at Page 705 and 706 in the 25 Office of the Adams County Recorder of Deed, thence westerly 26 along the north line of said City of Quincy property a 27 distance of 310.00 feet, thence northerly parallel with the 28 west line of said Block 36 a distance of 342.00 feet, thence 29 easterly parallel with the north line of said Block 36 a 30 distance of 655.15 feet to a point on a line which deflects 31 northwesterly from the west line of said North 12th Street at 32 an angle of 45 degrees, thence southerly parallel with the 33 west line of said North 12th Street a distance of 20 feet to 34 the Point of Beginning, containing 3.61 acres, more or less. Effective date. This Act takes effect upon 9 becoming law.
