90_SB1701ccr001 LRB9007990PTbdccr2 1 90TH GENERAL ASSEMBLY 2 CONFERENCE COMMITTEE REPORT 3 ON SENATE BILL 1701 4 ------------------------------------------------------------- 5 ------------------------------------------------------------- 6 To the President of the Senate and the Speaker of the 7 House of Representatives: 8 We, the conference committee appointed to consider the 9 differences between the houses in relation to House 10 Amendments Nos. 1, 2, 4, 5, 6, 7, 8, 9, and 10 to Senate Bill 11 1701, recommend the following: 12 (1) that the House recede from House Amendments Nos. 1, 13 2, 4, 5, 6, 7, 8, 9, and 10; and 14 (2) that Senate Bill 1701 be amended by replacing the 15 title with the following: 16 "AN ACT concerning property."; and 17 by replacing everything after the enacting clause with the 18 following: 19 "Section 4. The Director of Natural Resources, on behalf 20 of the State of Illinois, is authorized to convey and quit 21 claim to the Hamilton County Water District, its successors 22 and assigns, for and in consideration of $10 paid to the 23 Department of Natural Resources, a non-exclusive, 24 unobstructed, perpetual public utility easement for the 25 purpose of erecting, constructing, installing, and laying, 26 and thereafter using, operating, inspecting, repairing, 27 maintaining, replacing, and removing, an underground water 28 pipeline and miscellaneous appurtenances on, over, under, and 29 across the following described real property, together with 30 the right of ingress and egress over the adjacent lands of 31 the State of Illinois, its successors and assigns, for the 32 purpose of this easement, subject to such conditions as may 33 be determined by the Department, to wit: -2- LRB9007990PTbdccr2 1 A strip of land 20 feet in width centered on the 2 water pipeline installed or to be installed on and across 3 the Easterly part of the Southeast Quarter of the 4 Northeast Quarter and the Southerly part of the Southwest 5 Quarter of the Southwest Quarter in Section 27, Township 6 4 South, Range 5 East of the Third Principal Meridian, 7 and on and across the Westerly part of the West Half of 8 the Southwest Quarter of Section 20, Township 3 South, 9 Range 5 East of the Third Principal Meridian, all in 10 Hamilton County, Illinois. 11 The Director of Natural Resources shall obtain a certified 12 copy of the portions of this Act containing the title, the 13 enacting clause, the effective date, and this Section within 14 60 days after the effective date of this Act and, upon 15 receipt of payment required by this Section, shall record the 16 certified copy in the Recorder's Office in Hamilton County. 17 Section 170. Upon the payment of the sum of $252,000.00 18 to the State of Illinois, the easement for highway purposes 19 acquired by the People of the State of Illinois is released 20 over and through the following described land in DuPage 21 County, Illinois: 22 Parcel No. 1WY514A: 23 Those parts of Lots 91 and 92 and that part of the 24 vacated alley lying North and adjoining said lots in 25 Taylor and Powers Garden Acres, being a subdivision in 26 the North Half of Section 34, Township 39 North, Range 9 27 East of the Third Principal Meridian, according to the 28 plat thereof recorded September 19, 1929, as Document No. 29 286552, in DuPage County, Illinois, described as follows: 30 Beginning at the Northeast corner of said Lot 91; thence 31 northerly, 3.048 meters [10.00 feet] on an assumed 32 bearing of North 0 degrees 30 minutes 54 seconds East 33 along the northerly extension of the East line of said 34 Lot 91 to the North line of the South Half of said alley -3- LRB9007990PTbdccr2 1 vacated by Document No. 730256; thence North 89 degrees 2 31 minutes 41 seconds West, 45.016 meters [147.69 feet] 3 along said North line to a line that is 30.480 meters 4 [100.00 feet] East of, as measured perpendicular, and 5 parallel with the center line of Illinois Route 59 as 6 established by Document No. 321382; thence South 11 7 degrees 09 minutes 32 seconds West, 47.396 meters [155.50 8 feet] along said parallel line to a line that is 12.192 9 meters [40.00 feet] North of, as measured perpendicular 10 to, and parallel with the South line of said Lots 91 and 11 92; thence South 89 degrees 28 minutes 10 seconds East, 12 53.770 meters [176.41 feet] along said parallel line to 13 the East line of said Lot 91; thence North 0 degrees 30 14 minutes 54 seconds East, 43.580 meters [142.98 feet] 15 along said East line to the Point of Beginning. 16 Said parcel contains 0.2303 hectare [0.569 acre], more or 17 less. 18 Reserving unto the State existing access control from the 19 tract described above: 20 and, 21 Parcel No. 1WY514B: 22 Lot 39 EXCEPT the Northerly 12.192 meters [40.00 feet], 23 measured perpendicular to the southerly right-of-way line 24 of Illinois Route 56; ALSO EXCEPT the easterly 7.620 25 meters [25.00 feet], measured perpendicular to the 26 westerly right-of-way line of Illinois Route 59, in 27 Robert Bartlett's Green Acres, being a subdivision in the 28 East Half of Section 33 and in the West Half of Section 29 34, Township 39 North, Range 9 East of the Third 30 Principal Meridian, according to the plat thereof 31 recorded October 20, 1943, as Document No. 454884, in 32 DuPage County, Illinois. 33 Said parcel contains 0.7673 hectare [1.896 acres], more 34 or less. 35 It is understood and agreed that there is no existing -4- LRB9007990PTbdccr2 1 right of access, nor will access be permitted in the 2 future by the State of Illinois, Department of 3 Transportation, from or over the premises above described 4 to and from FA Route 131 (IL 56), previously declared a 5 freeway, nor will the Department of Transportation permit 6 access to FAP Route 338 (IL 59), except at the south 50 7 feet of the easterly line of parcel 1WY514B, subject to 8 the Department of Transportation's "Policy on Permits for 9 Access Driveways to State Highways." 10 Section 175. Upon the payment of the sum of $10,000 to 11 the State of Illinois, the rights or easements of access, 12 crossing, light, air, and view from, to, and over the 13 following described line and FA Route 12 are restored subject 14 to permit requirements of the State of Illinois, Department 15 of Transportation: 16 Parcel No. 800XA75: 17 Direct access to FA Route 12 (marked U.S. Route 40) shall 18 be restored to 79.04 feet of a tract of land abutting the 19 southerly right of way line of said highway from the 20 Northwest Corner of the existing easterly right of way 21 line of SA Route 1 (marked Troy-Lebanon Road) and said 22 southerly right of way line of FA Route 12 at Station 23 245+68, a distance of 75.00 feet right of the centerline 24 of said FA Route 12 easterly along said southerly right 25 of way line 200.00 feet to the Point of Beginning at 26 Station 247+49.68 easterly 79.04 feet to Station 27 248+28.72 in the Southeast Quarter of Section 9, Township 28 3 North, Range 7 West of the Third Principal Meridian, 29 Madison County, Illinois. 30 Stipulations on the above described Access Rights that a 31 25 ft. entrance that has right-in and right-out only 32 access to and from the property to FA Route 12 (marked 33 U.S. Route 40). -5- LRB9007990PTbdccr2 1 Section 900. The Secretary of Transportation shall 2 obtain a certified copy of the portions of this Act 3 containing the title, the enacting clause, the effective 4 date, the appropriate Section or Sections containing the land 5 descriptions of property to be transferred or otherwise 6 affected, and this Section within 60 days after its effective 7 date and, upon receipt of payment required by the Section or 8 Sections, if any payment is required, shall record the 9 certified document in the Recorder's Office in the county in 10 which the land is located. 11 Section 905. Upon the payment of the sum of $20,750 to 12 the Quincy Veterans Home Fund, the Director of the Department 13 of Veterans' Affairs is authorized to convey to Refreshment 14 Services, Inc., an Illinois corporation organized under the 15 laws of Delaware and registered to do business in Illinois, 16 by quit claim deed the following described real property: 17 A part of E. A. Dudley's Addition to the City of Quincy, 18 a subdivision of a part of the Southeast quarter of Section 19 26 in Township 1 South of the Base Line and in Range 9 West 20 of the Fourth Principal Meridian, in the City of Quincy, 21 Adams County, Illinois, being more particularly and described 22 as follows: 23 Commencing at the northeast corner of Block 36 of said E. 24 A. Dudley's Addition, said point being a point on the west 25 line of North 12th Street a record distance of 33 feet west 26 and 429 feet north of the southeast corner of said Section 27 26, thence westerly along the north line of said Block 36 a 28 distance of 16 feet to the Point of Beginning, thence from 29 said Point of Beginning continuing westerly along the north 30 line of said Block 36 a distance of 450.75 feet to the 31 northwest corner of said Block 36, thence southerly along the 32 west line of said Block 36 a distance of 216.00 feet to the 33 northeast corner of property conveyed to the City of Quincy 34 as recorded in Book 463 of Deeds at Page 705 and 706 in the -6- LRB9007990PTbdccr2 1 Office of the Adams County Recorder of Deed, thence westerly 2 along the north line of said City of Quincy property a 3 distance of 310.00 feet, thence northerly parallel with the 4 west line of said Block 36 a distance of 342.00 feet, thence 5 easterly parallel with the north line of said Block 36 a 6 distance of 655.15 feet to a point on a line which deflects 7 northwesterly from the west line of said North 12th Street at 8 an angle of 45 degrees, thence southerly parallel with the 9 west line of said North 12th Street a distance of 20 feet to 10 the Point of Beginning, containing 3.61 acres, more or less. 11 The Director of the Department of Veterans' Affairs shall 12 obtain a certified copy of the portions of this Act 13 containing the title, the enacting clause, the effective 14 date, and this Section within 60 days after its effective 15 date and, upon receipt of the payment required by this 16 Section, shall record the certified document in the 17 Recorder's Office in Adams County. 18 Section 999. Effective date.
