92_HB2259enr HB2259 Enrolled LRB9203338DHmb 1 AN ACT in relation to motor carriers. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 adding Section 1-126.1 and changing Sections 15-101, 15-102, 6 15-103, 15-106, 15-107, 15-111, 15-112, and 15-316 as 7 follows: 8 (625 ILCS 5/1-126.1 new) 9 Sec. 1-126.1. Highway Designations. The Department of 10 Transportation may designate streets or highways in the 11 system of State highways as follows: 12 (a) Class I highways include interstate highways, 13 expressways, tollways, and other highways deemed 14 appropriate by the department. 15 (b) Class II highways include major arterials not 16 built to interstate highway standards that have at least 17 11 feet lane widths. 18 (c) Class III highways include those State highways 19 that have lane widths of less than 11 feet. 20 (d) Non-designated highways are highways in the 21 system of State highways not designated as Class I, II, 22 or III, or local highways which are part of any county, 23 township, municipal, or district road system. Local 24 authorities also may designate Class II or Class III 25 highways within their systems of highways. 26 (625 ILCS 5/15-101) (from Ch. 95 1/2, par. 15-101) 27 Sec. 15-101. Scope and effect of Chapter 15. (a) It is 28 unlawful for any person to drive or move on, upon or across 29 or for the owner to cause or knowingly permit to be driven or 30 moved on, upon or across any highway any vehicle or vehicles HB2259 Enrolled -2- LRB9203338DHmb 1 of a size and weight exceeding the limitations stated in this 2 Chapter or otherwise in violation of this Chapter, and the 3 maximum size and weight of vehicles herein specified shall be 4 lawful throughout this State, and local authorities shall 5 have no power or authority to alter such limitations except 6 as express authority may be granted in this Chapter. 7 (b) The provisions of this Chapter governing size, 8 weight and load do not apply to fire apparatus or equipment 9 for snow and ice removal operations owned or operated by any 10 governmental body, or to implements of husbandry, as defined 11 in Chapter 1 of this Code, temporarily operated or towed in a 12 combination upon a highway provided such combination does not 13 consist of more than 3 vehicles or, in the case of hauling 14 fresh, perishable fruits or vegetables from farm to the point 15 of first processing, not more than 3 wagons being towed by an 16 implement of husbandry, or to a vehicle operated under the 17 terms of a special permit issued hereunder. 18 (Source: P.A. 83-831.) 19 (625 ILCS 5/15-102) (from Ch. 95 1/2, par. 15-102) 20 Sec. 15-102. Width of Vehicles. 21 (a) On Class III and non-designated State and local 22 highways,Except as otherwise provided in this Section or23this Code,the total outside width of any vehicle or load 24 thereon shall not exceed 8 feet. 25 (b) Except during those times when, due to insufficient 26 light or unfavorable atmospheric conditions, persons and 27 vehicles on the highway are not clearly discernible at a 28 distance of 1000 feet, the following vehicles may exceed the 29 8 feet limitation during the period from a half hour before 30 sunrise to a half hour after sunset: 31 (1) Loads of hay, straw or other similar farm 32 products provided that the load is not more than 12 feet 33 wide. HB2259 Enrolled -3- LRB9203338DHmb 1 (2) Implements of husbandry being transported on 2 another vehicle and the transporting vehicle while 3 loaded. 4 The following requirements apply to the 5 transportation on another vehicle of an implement of 6 husbandry wider than 8 feet 6 inches on the National 7 System of Interstate and Defense Highways or other 8 highways in the system of State highways: 9 (A) The driver of a vehicle transporting an 10 implement of husbandry that exceeds 8 feet 6 inches 11 in width shall obey all traffic laws and shall check 12 the roadways prior to making a movement in order to 13 ensure that adequate clearance is available for the 14 movement. It is prima facie evidence that the 15 driver of a vehicle transporting an implement of 16 husbandry has failed to check the roadway prior to 17 making a movement if the vehicle is involved in a 18 collision with a bridge, overpass, fixed structure, 19 or properly placed traffic control device or if the 20 vehicle blocks traffic due to its inability to 21 proceed because of a bridge, overpass, fixed 22 structure, or properly placed traffic control 23 device. 24 (B) Flags shall be displayed so as to wave 25 freely at the extremities of overwidth objects and 26 at the extreme ends of all protrusions, projections, 27 and overhangs. All flags shall be clean, bright red 28 flags with no advertising, wording, emblem, or 29 insignia inscribed upon them and at least 18 inches 30 square. 31 (C) "OVERSIZE LOAD" signs are mandatory on the 32 front and rear of all vehicles with loads over 10 33 feet wide. These signs must have 12-inch high black 34 letters with a 2-inch stroke on a yellow sign that HB2259 Enrolled -4- LRB9203338DHmb 1 is 7 feet wide by 18 inches high. 2 (D) One civilian escort vehicle is required 3 for a load that exceeds 14 feet 6 inches in width 4 and 2 civilian escort vehicles are required for a 5 load that exceeds 16 feet in width on the National 6 System of Interstate and Defense Highways or other 7 highways in the system of State highways. 8 (E) The requirements for a civilian escort 9 vehicle and driver are as follows: 10 (1) The civilian escort vehicle shall be 11 a passenger car or a second division vehicle 12 not exceeding a gross vehicle weight of 8,000 13 pounds that is designed to afford clear and 14 unobstructed vision to both front and rear. 15 (2) The escort vehicle driver must be 16 properly licensed to operate the vehicle. 17 (3) While in use, the escort vehicle must 18 be equipped with illuminated rotating, 19 oscillating, or flashing amber lights or 20 flashing amber strobe lights mounted on top 21 that are of sufficient intensity to be visible 22 at 500 feet in normal sunlight. 23 (4) "OVERSIZE LOAD" signs are mandatory 24 on all escort vehicles. The sign on an escort 25 vehicle shall have 8-inch high black letters on 26 a yellow sign that is 5 feet wide by 12 inches 27 high. 28 (5) When only one escort vehicle is 29 required and it is operating on a two-lane 30 highway, the escort vehicle shall travel 31 approximately 300 feet ahead of the load. The 32 rotating, oscillating, or flashing lights or 33 flashing amber strobe lights and an "OVERSIZE 34 LOAD" sign shall be displayed on the escort HB2259 Enrolled -5- LRB9203338DHmb 1 vehicle and shall be visible from the front. 2 When only one escort vehicle is required and it 3 is operating on a multilane divided highway, 4 the escort vehicle shall travel approximately 5 300 feet behind the load and the sign and 6 lights shall be visible from the rear. 7 (6) When 2 escort vehicles are required, 8 one escort shall travel approximately 300 feet 9 ahead of the load and the second escort shall 10 travel approximately 300 feet behind the load. 11 The rotating, oscillating, or flashing lights 12 or flashing amber strobe lights and an 13 "OVERSIZE LOAD" sign shall be displayed on the 14 escort vehicles and shall be visible from the 15 front on the lead escort and from the rear on 16 the trailing escort. 17 (7) When traveling within the corporate 18 limits of a municipality, the escort vehicle 19 shall maintain a reasonable and proper distance 20 from the oversize load, consistent with 21 existing traffic conditions. 22 (8) A separate escort shall be provided 23 for each load hauled. 24 (9) The driver of an escort vehicle shall 25 obey all traffic laws. 26 (10) The escort vehicle must be in safe 27 operational condition. 28 (11) The driver of the escort vehicle 29 must be in radio contact with the driver of the 30 vehicle carrying the oversize load. 31 (F) A transport vehicle while under load of 32 more than 8 feet 6 inches in width must be equipped 33 with an illuminated rotating, oscillating, or 34 flashing amber light or lights or a flashing amber HB2259 Enrolled -6- LRB9203338DHmb 1 strobe light or lights mounted on the top of the cab 2 that are of sufficient intensity to be visible at 3 500 feet in normal sunlight. If the load on the 4 transport vehicle blocks the visibility of the amber 5 lighting from the rear of the vehicle, the vehicle 6 must also be equipped with an illuminated rotating, 7 oscillating, or flashing amber light or lights or a 8 flashing amber strobe light or lights mounted on the 9 rear of the load that are of sufficient intensity to 10 be visible at 500 feet in normal sunlight. 11 (G) When a flashing amber light is required on 12 the transport vehicle under load and it is operating 13 on a two-lane highway, the transport vehicle shall 14 display to the rear at least one rotating, 15 oscillating, or flashing light or a flashing amber 16 strobe light and an "OVERSIZE LOAD" sign. When a 17 flashing amber light is required on the transport 18 vehicle under load and it is operating on a 19 multilane divided highway, the sign and light shall 20 be visible from the rear. 21 (H) Maximum speed shall be 45 miles per hour 22 on all such moves or 5 miles per hour above the 23 posted minimum speed limit, whichever is greater, 24 but the vehicle shall not at any time exceed the 25 posted maximum speed limit. 26 (3) Portable buildings designed and used for 27 agricultural and livestock raising operations that are 28 not more than 14 feet wide and with not more than a 1 29 foot overhang along the left side of the hauling vehicle. 30 However, the buildings shall not be transported more than 31 10 miles and not on any route that is part of the 32 National System of Interstate and Defense Highways. 33 All buildings when being transported shall display at 34 least 2 red cloth flags, not less than 12 inches square, HB2259 Enrolled -7- LRB9203338DHmb 1 mounted as high as practicable on the left and right side of 2 the building. 3 A State Police escort shall be required if it is 4 necessary for this load to use part of the left lane when 5 crossing any 2 laned State highway bridge. 6 (c) Vehicles propelled by electric power obtained from 7 overhead trolley wires operated wholly within the corporate 8 limits of a municipality are also exempt from the width 9 limitation. 10 (d) Exemptions are also granted to vehicles designed for 11 the carrying of more than 10 persons under the following 12 conditions: 13 (1) (Blank); 14 (2) When operated within any public transportation 15 service with the approval of local authorities or an 16 appropriate public body authorized by law to provide 17 public transportation. Any vehicle so operated may be 8 18 feet 6 inches in width; or 19 (3) When a county engineer or superintendent of 20 highways, after giving due consideration to the mass 21 transportation needs of the area and to the width and 22 condition of the road, has determined that the operation 23 of buses wider than 8 feet will not pose an undue safety 24 hazard on a particular county or township road segment, 25 he or she may authorize buses not to exceed 8 feet 6 26 inches in width on any highway under that engineer's or 27 superintendent's jurisdiction. 28 (e) A vehicle and load traveling upon the National 29 System of Interstate and Defense Highways or any other 30 highway in the system of State highways that has been 31 designated as a Class I or Class II highway by the 32 Department, or any street or highway designated by local 33 authorities or road district commissioners, may have a total 34 outside width of 8 feet 6 inches, provided that certain HB2259 Enrolled -8- LRB9203338DHmb 1 safety devices that the Department determines as necessary 2 for the safe and efficient operation of motor vehicles shall 3 not be included in the calculation of width. 4 (e-1) A vehicle and load more than 8 feet wide but not 5 exceeding 8 feet 6 inches in width is allowed access 6 according to the following: 7 (1) A vehicle and load not exceeding 73,280 pounds 8 in weight is allowed access from any State designated 9 highway onto any county, township, or municipal highway 10 for a distance of 5 highway miles for the purpose of 11 loading and unloading, provided: 12 (A) The vehicle and load does not exceed 65 13 feet overall length. 14 (B) There is no sign prohibiting that access. 15 (C) The route is not being used as a 16 thoroughfare between State designated highways. 17 (2) A vehicle and load not exceeding 73,280 pounds 18 in weight is allowed access from any State designated 19 highway onto any county or township highway for a 20 distance of 5 highway miles or onto any municipal highway 21 for a distance of one highway mile for the purpose of 22 food, fuel, repairs, and rest, provided: 23 (A) The vehicle and load does not exceed 65 24 feet overall length. 25 (B) There is no sign prohibiting that access. 26 (C) The route is not being used as a 27 thoroughfare between State designated highways. 28 (3) A vehicle and load not exceeding 80,000 pounds 29 in weight is allowed access from a Class I highway onto 30 any street or highway for a distance of one highway mile 31 for the purpose of loading, unloading, food, fuel, 32 repairs, and rest, provided there is no sign prohibiting 33 that access. 34 (4) A vehicle and load not exceeding 80,000 pounds HB2259 Enrolled -9- LRB9203338DHmb 1 in weight is allowed access from a Class I or Class II 2 highway onto any State highway or any locally designated 3 highway for a distance of 5 highway miles for the purpose 4 of loading, unloading, food, fuel, repairs, and rest. 5 (5) A trailer or semi-trailer not exceeding 28 feet 6 6 inches in length, that was originally in combination 7 with a truck tractor, shall have unlimited access to 8 points of loading and unloading. 9 (6) All household goods carriers shall have 10 unlimited access to points of loading and unloading. 11Vehicles operating under this paragraph (e) shall have12access for a distance of one highway mile to or from a Class13I highway on any street or highway, unless there is a sign14prohibiting the access, or 5 highway miles to or from a Class15I or II highway on a street or highway included in the system16of State highways and upon any street or highway designated17by local authorities or road district commissioners, without18additional fees, to points of loading and unloading and to19facilities for food, fuel, repairs and rest. In addition, any20trailer or semitrailer not exceeding 28 feet 6 inches in21length, that was originally in combination with a truck22tractor, and all household goods carriers, when operating23under paragraph (e), shall have access to points of loading24and unloading.25 Section 5-35 of the Illinois Administrative Procedure Act 26 relating to procedures for rulemaking shall not apply to the 27 designation of highways under this paragraph (e). 28 (f) Mirrors required by Section 12-502 of this Code and 29 other safety devices identified by the Department may project 30 up to 14 inches beyond each side of a bus and up to 6 inches 31 beyond each side of any other vehicle, and that projection 32 shall not be deemed a violation of the width restrictions of 33 this Section. 34 (g) Any person who is convicted of violating this HB2259 Enrolled -10- LRB9203338DHmb 1 Section is subject to the penalty as provided in paragraph 2 (b) of Section 15-113. 3 (Source: P.A. 90-14, eff. 7-1-97; 91-780, eff. 6-9-00.) 4 (625 ILCS 5/15-103) (from Ch. 95 1/2, par. 15-103) 5 Sec. 15-103. Height of vehicles. The height of a vehicle 6 from the under side of the tire to the top of the vehicle, 7 inclusive of load, shall not exceed 13 feet, 6 inches on any 8 highway in the State. 9 A person convicted of violating this Section is subject 10 to the penalty provided in paragraph (b) of Section 15-113. 11 (Source: P.A. 83-831.) 12 (625 ILCS 5/15-106) (from Ch. 95 1/2, par. 15-106) 13 Sec. 15-106. Protruding members of vehicles. 14 No vehicle with boom, arm, drill rig or other protruding 15 component shall be operated upon anythehighway in this 16 State unless such protruding component is fastened so as to 17 prevent shifting, bouncing or moving in any manner. 18 (Source: P.A. 76-1586.) 19 (625 ILCS 5/15-107) (from Ch. 95 1/2, par. 15-107) 20 Sec. 15-107. Length of vehicles. 21 (a) The maximum length of a single vehicle on any 22 highway of this State may not exceed 42 feet except the 23 following: 24 (1) Semitrailers. 25 (2) Charter or regulated route buses may be up to 26 45 feet in length, not including energy absorbing 27 bumpers.Unless otherwise provided for in this Code, no28single vehicle, with or without load, other than a29semitrailer that is not a housetrailer, shall exceed an30overall length of 42 feet.31 (b) On all non-State highways, the maximum length of HB2259 Enrolled -11- LRB9203338DHmb 1 vehicles in combinations is as follows: 2 (1) A truck tractor in combination with a 3 semitrailer may not exceed 55 feet overall dimension. 4 (2) A truck tractor-semitrailer-trailer may not 5 exceed 60 feet overall dimension. 6 (3) Combinations specially designed to transport 7 motor vehicles or boats may not exceed 60 feet overall 8 dimension. 9 Vehicles operating during daylight hours when 10 transporting poles, pipes, machinery, or other objects of a 11 structural nature that cannot readily be dismembered are 12 exempt from length limitations, provided that no object may 13 exceed 80 feet in length and the overall dimension of the 14 vehicle including the load may not exceed 100 feet. This 15 exemption does not apply to operation on a Saturday, Sunday, 16 or legal holiday. Legal holidays referred to in this Section 17 are the days on which the following traditional holidays are 18 celebrated: New Year's Day; Memorial Day; Independence Day; 19 Labor Day; Thanksgiving Day; and Christmas Day. 20 Vehicles and loads operated by a public utility while en 21 route to make emergency repairs to public service facilities 22 or properties are exempt from length limitations, provided 23 that during night operations every vehicle and its load must 24 be equipped with a sufficient number of clearance lamps on 25 both sides and marker lamps on the extreme ends of any 26 projecting load to clearly mark the dimensions of the load. 27 A tow truck in combination with a disabled vehicle or 28 combination of disabled vehicles, as provided in paragraph 29 (6) of subsection (c) of this Section, is exempt from length 30 limitations. 31 All other combinations not listed in this subsection (b) 32 may not exceed 60 feet overall dimension.Subject to the33provisions of paragraph (f) and unless otherwise provided in34this Code, no truck tractor and semitrailer, unladen or withHB2259 Enrolled -12- LRB9203338DHmb 1load, except a semitrailer other than a house trailer, shall2exceed a length of 55 feet extreme overall dimension, except3that the combination when specially designed to transport4motor vehicles may have a length of 60 feet extreme overall5dimension, subject to those exceptions and special rules6otherwise stated in this Code. No other combination of7vehicles, unladen or with load, shall exceed a length of 608feet extreme overall dimension.9 (c) Combinations of vehicles may not exceed a total of 2 10 vehicles except the following: 11 (1) A truck tractor semitrailer may draw one 12 trailer. 13 (2) A truck tractor semitrailer may draw one 14 converter dolly. 15 (3) A truck tractor semitrailer may draw one 16 vehicle that is defined in Chapter 1 as special mobile 17 equipment, provided the overall dimension does not exceed 18 60 feet. 19 (4) A truck in transit may draw 3 trucks in transit 20 coupled together by the triple saddlemount method. 21 (5) Recreational vehicles consisting of 3 vehicles, 22 provided the following: 23 (A) The total overall dimension does not 24 exceed 60 feet. 25 (B) The towing vehicle is a properly 26 registered vehicle capable of towing another vehicle 27 using a fifth-wheel type assembly. 28 (C) The second vehicle in the combination of 29 vehicles is a recreational vehicle that is towed by 30 a fifth-wheel assembly. This vehicle must be 31 properly registered and must be equipped with 32 brakes, regardless of weight. 33 (D) The third vehicle must be the lightest of 34 the 3 vehicles and be a trailer or semitrailer HB2259 Enrolled -13- LRB9203338DHmb 1 designed or used for transporting a boat, 2 all-terrain vehicle, personal watercraft, or 3 motorcycle. 4 (E) The towed vehicles may be only for the use 5 of the operator of the towing vehicle. 6 (F) All vehicles must be properly equipped 7 with operating brakes and safety equipment required 8 by this Code, except the additional brake 9 requirement in subdivision (C) of this subparagraph 10 (5). 11 (6) A tow truck in combination with a disabled 12 vehicle or combination of disabled vehicles, provided the 13 towing vehicle: 14 (A) Is specifically designed as a tow truck 15 having a gross vehicle weight rating of at least 16 18,000 pounds and equipped with air brakes, provided 17 that air brakes are required only if the towing 18 vehicle is towing a vehicle, semitrailer, or 19 tractor-trailer combination that is equipped with 20 air brakes. For the purpose of this subsection, 21 gross vehicle weight rating, or GVWR, means the 22 value specified by the manufacturer as the loaded 23 weight of the tow truck. 24 (B) Is equipped with flashing, rotating, or 25 oscillating amber lights, visible for at least 500 26 feet in all directions. 27 (C) Is capable of utilizing the lighting and 28 braking systems of the disabled vehicle or 29 combination of vehicles. 30 (D) Does not engage a tow exceeding 50 highway 31 miles from the initial point of wreck or disablement 32 to a place of repair. Any additional movement of the 33 vehicles may occur only upon issuance of 34 authorization for that movement under the provisions HB2259 Enrolled -14- LRB9203338DHmb 1 of Sections 15-301 through 15-319 of this Code. 2 The Department may by rule or regulation prescribe 3 additional requirements regarding length limitations for a 4 tow truck towing another vehicle. 5 For purposes of this Section, a tow-dolly that merely 6 serves as substitute wheels for another legally licensed 7 vehicle is considered part of the licensed vehicle and not a 8 separate vehicle.A truck tractor semitrailer may draw one9trailer, or a converter dolly, or a vehicle that is special10mobile equipment if the extreme length of the combination11does not exceed 60 feet, and a truck in transit may draw 312trucks in transit coupled together by the triple saddlemount13method. Except as otherwise provided, no other combinations14of vehicles coupled together shall consist of more than 215vehicles. For the purposes of this paragraph, a tow-dolly16that merely serves as substitute wheels for another legally17licensed vehicle will be considered part of the vehicle and18not as a separate vehicle.19Vehicles in combination, whether being operated20intrastate or interstate, shall be operated and towed in21compliance with all requirements of Federal Highway22Administration, Title 49, C. F. R., Motor Carrier Safety23Regulations, pertaining to coupling devices and towing24methods and all other equipment safety requirements set forth25in the regulations.26 (d) On Class I highways there are no overall length 27 limitations on motor vehicles operating in combinations 28 provided: 29 (1) The length of a semitrailer, unladen or with 30 load, in combination with a truck tractor may not exceed 31 53 feet. 32 (2) The distance between the kingpin and the center 33 of the rear axle of a semitrailer longer than 48 feet, in 34 combination with a truck tractor, may not exceed 45 feet HB2259 Enrolled -15- LRB9203338DHmb 1 6 inches. 2 (3) The length of a semitrailer or trailer, unladen 3 or with load, operated in a truck 4 tractor-semitrailer-trailer combination, may not exceed 5 28 feet 6 inches. 6 (4) Maxi-cube combinations, as defined in Chapter 7 1, may not exceed 65 feet overall dimension. 8 (5) Combinations of vehicles specifically designed 9 to transport motor vehicles or boats may not exceed 65 10 feet overall dimension. The length limitation is 11 inclusive of front and rear bumpers but exclusive of the 12 overhang of the transported vehicles, as provided in 13 paragraph (i) of this Section. 14 (6) Stinger steered semitrailer vehicles as defined 15 in Chapter 1, specifically designed to transport motor 16 vehicles or boats, may not exceed 75 feet overall 17 dimension. The length limitation is inclusive of front 18 and rear bumpers but exclusive of the overhang of the 19 transported vehicles, as provided in paragraph (i) of 20 this Section. 21 (7) A truck in transit transporting 3 trucks 22 coupled together by the triple saddlemount method may not 23 exceed 75 feet overall dimension. 24 Vehicles operating during daylight hours when 25 transporting poles, pipes, machinery, or other objects of a 26 structural nature that cannot readily be dismembered are 27 exempt from length limitations, provided that no object may 28 exceed 80 feet in length and the overall dimension of the 29 vehicle including the load may not exceed 100 feet. HB2259 Enrolled -16- LRB9203338DHmb 1 Vehicles and loads operated by a public utility while en 2 route to make emergency repairs to public service facilities 3 or properties are exempt from length limitations, provided 4 that during night operations every vehicle and its load must 5 be equipped with a sufficient number of clearance lamps on 6 both sides and marker lamps on the extreme ends of any 7 projecting load to clearly mark the dimensions of the load. 8 A tow truck in combination with a disabled vehicle or 9 combination of disabled vehicles, as provided in paragraph 10 (6) of subsection (c) of this Section, is exempt from length 11 limitations.Notwithstanding any other provisions of this12Code, there is no overall length limitation on motor vehicles13operating in truck tractor-semitrailer or truck14tractor-semitrailer-trailer combinations, except that15maxi-cube combinations as defined in this Section, and a16combination of vehicles specifically designed to transport17motor vehicles or boats, shall not exceed 65 feet overall18length, and provided that a stinger steered combination of19vehicles specifically designed to transport motor vehicles or20boats and a truck in transit transporting 3 trucks coupled21together by the triple saddlemount method shall not exceed 7522feet overall length, with the length limitations inclusive of23front and rear bumpers but exclusive of the overhang of the24transported vehicles as provided for in paragraph (i) of this25Section, upon the National System of Interstate and Defense26Highways or any other highways in the system of State27highways that have been designated Class I highways by the28Department or any street or highway designated by local29authorities or road district commissioners; provided that the30length of the semitrailer unit, unladen or with load,31operated in a truck tractor-semitrailer combination shall not32exceed 53 feet and the distance between the kingpin and the33center of the rear axle of a semitrailer longer than 48 feet34shall not exceed 45 feet, 6 inches; and provided that theHB2259 Enrolled -17- LRB9203338DHmb 1length of any semitrailer or trailer, unladen or with load,2operated in a truck tractor-semitrailer-trailer combination3shall not exceed 28 feet 6 inches.4 The length limitations described in this paragraph (d) 5 shall be exclusive of safety and energy conservation devices, 6 such asrear view mirrors, turn signals, marker lamps, steps7and handholds for entry and egress, flexible fender8extensions,bumpers,mudflaps and splash and spray9suppressant devices, load-induced tire bulge,refrigeration 10 units or air compressors and other devices, that the 11 Department may interpret as necessary for safe and efficient 12 operation; except that no device excluded under this 13 paragraph shall have by its design or use the capability to 14 carry cargo. 15Vehicles operating under this paragraph (d) shall have16access for a distance of one highway mile to or from a Class17I highway on any street or highway, unless there is a sign18prohibiting the access, or 5 highway miles on a street or19highway in the system of State highways, and upon any street20or highway designated, without additional fees, by local21authorities or road district commissioners, to points of22loading and unloading and facilities for food, fuel, repairs23and rest. Household goods carriers shall have access to24points of loading and unloading.25 Section 5-35 of the Illinois Administrative Procedure Act 26 relating to procedures for rulemaking shall not apply to the 27 designation of highways under this paragraph (d). 28 (e) On Class II highways there are no overall length 29 limitations on motor vehicles operating in combinations, 30 provided: 31 (1) The length of a semitrailer, unladen or with 32 load, in combination with a truck tractor, may not exceed 33 53 feet overall dimension. 34 (2) The distance between the kingpin and the center HB2259 Enrolled -18- LRB9203338DHmb 1 of the rear axle of a semitrailer longer than 48 feet, in 2 combination with a truck tractor, may not exceed 45 feet 3 6 inches. 4 (3) A truck tractor-semitrailer-trailer combination 5 may not exceed 65 feet overall dimension. 6 (4) The length of a semitrailer or trailer, unladen 7 or with load, operated in a truck 8 tractor-semitrailer-trailer combination, may not exceed 9 28 feet 6 inches. 10 (5) Maxi-cube combinations, as defined in Chapter 11 1, may not exceed 65 feet overall dimension. 12 (6) A combination of vehicles, specifically 13 designed to transport motor vehicles or boats, may not 14 exceed 65 feet overall dimension. The length limitation 15 is inclusive of front and rear bumpers but exclusive of 16 the overhang of the transported vehicles, as provided in 17 paragraph (i) of this Section. 18 (7) Stinger steered semitrailer vehicles, as 19 defined in Chapter 1, specifically designed to transport 20 motor vehicles or boats, may not exceed 75 feet overall 21 dimension. The length limitation is inclusive of front 22 and rear bumpers but exclusive of the overhang of the 23 transported vehicles, as provided in paragraph (i) of 24 this Section. 25 (8) A truck in transit transporting 3 trucks 26 coupled together by the triple saddlemount method may not 27 exceed 75 feet overall dimension. 28 Vehicles operating during daylight hours when 29 transporting poles, pipes, machinery, or other objects of a 30 structural nature that cannot readily be dismembered are 31 exempt from length limitations, provided that no object may 32 exceed 80 feet in length and the overall dimension of the 33 vehicle including the load may not exceed 100 feet. This 34 exemption does not apply to operation on a Saturday, Sunday, HB2259 Enrolled -19- LRB9203338DHmb 1 or legal holiday. Legal holidays referred to in this Section 2 are the days on which the following traditional holidays are 3 celebrated: New Year's Day; Memorial Day; Independence Day; 4 Labor Day; Thanksgiving Day; and Christmas Day. 5 Vehicles and loads operated by a public utility while en 6 route to make emergency repairs to public service facilities 7 or properties are exempt from length limitations, provided 8 that during night operations every vehicle and its load must 9 be equipped with a sufficient number of clearance lamps on 10 both sides and marker lamps on the extreme ends of any 11 projecting load to clearly mark the dimensions of the load. 12 A tow truck in combination with a disabled vehicle or 13 combination of disabled vehicles, as provided in paragraph 14 (6) of subsection (c) of this Section, is exempt from length 15 limitations. 16 Local authorities and road district commissioners, with 17 respect to streets and highways under their jurisdiction, may 18 also by ordinance or resolution allow length limitations of 19 this subsection (e).In addition to the designation of20highways under paragraph (d) the Department may designate21other streets or highways in the system of State highways as22Class II highways. Notwithstanding any other provisions of23this Code, effective June 1, 1996 there is no overall length24limitation on motor vehicles operating in truck25tractor-semitrailer combinations operating upon designated26Class II highways, provided the length of the semitrailer27unit, unladen or with load, operated in a truck28tractor-semitrailer combination shall not exceed 53 feet and29the distance between the kingpin and the center of the rear30axle of a semitrailer longer than 48 feet shall not exceed 4531feet, 6 inches. A truck tractor-semitrailer-trailer32combination may be operated provided that the wheelbase33between the front axle and rear axle shall not exceed 6534feet and the length of any semitrailer or trailer, unladen orHB2259 Enrolled -20- LRB9203338DHmb 1with load, in a combination shall not exceed 28 feet 62inches. Local authorities and road district commissioners3with respect to streets and highways under their4jurisdiction, may also by ordinance or resolution allow the5length limitations of this paragraph (e).6A maxi-cube combination, a truck in transit transporting73 trucks coupled together by the triple saddlemount method,8and a combination of vehicles specifically designed to9transport motor vehicles or boats may operate on the10designated streets or highways provided the overall length11shall not exceed 65 feet, and provided that a stinger steered12combination of vehicles specifically designed to transport13motor vehicles or boats shall not exceed 75 feet overall14length, with the length limitations inclusive of front and15rear bumpers but exclusive of the overhang of the transported16vehicles as provided for in paragraph (i) of this Section.17 The length limitations described in this paragraph (e) 18 shall be exclusive of safety and energy conservation devices, 19 such asrear view mirrors, turn signals, marker lamps, steps20and handholds for entry and egress, flexible fender21extensions,bumpers,mudflaps and splash and spray22suppressant devices, load-induced tire bulge,refrigeration 23 units or air compressors and other devices, that the 24 Department may interpret as necessary for safe and efficient 25 operation; except that no device excluded under this 26 paragraph shall have by its design or use the capability to 27 carry cargo. 28Vehicles operating under this paragraph (e) shall have29access for a distance of 5 highway miles on a street or30highway in the system of State highways, and upon any street31or highway designated by local authorities or road district32commissioners, to points of loading and unloading and to33facilities for food, fuel, repairs and rest. Household goods34carriers shall have access to points of loading andHB2259 Enrolled -21- LRB9203338DHmb 1unloading.2 (e-1) Combinations of vehicles not exceeding 65 feet 3 overall length are allowed access as follows: 4 (1) From any State designated highway onto any 5 county, township, or municipal highway for a distance of 6 5 highway miles for the purpose of loading and unloading, 7 provided: 8 (A) The vehicle does not exceed 73,280 pounds 9 in gross weight and 8 feet 6 inches in width. 10 (B) There is no sign prohibiting that access. 11 (C) The route is not being used as a 12 thoroughfare between State designated highways. 13 (2) From any State designated highway onto any 14 county or township highway for a distance of 5 highway 15 miles or onto any municipal highway for a distance of one 16 highway mile for the purpose of food, fuel, repairs, and 17 rest, provided: 18 (A) The vehicle does not exceed 73,280 pounds 19 in gross weight and 8 feet 6 inches in width. 20 (B) There is no sign prohibiting that access. 21 (C) The route is not being used as a 22 thoroughfare between State designated highways. 23 (e-2) Except as provided in subsection (e-3), 24 combinations of vehicles over 65 feet in length, with no 25 overall length limitation except as provided in subsections 26 (d) and (e) of this Section, are allowed access as follows: 27 (1) From a Class I highway onto any street or 28 highway for a distance of one highway mile for the 29 purpose of loading, unloading, food, fuel, repairs, and 30 rest, provided there is no sign prohibiting that access. 31 (2) From a Class I or Class II highway onto any 32 State highway or any locally designated highway for a 33 distance of 5 highway miles for the purpose of loading, 34 unloading, food, fuel, repairs, and rest. HB2259 Enrolled -22- LRB9203338DHmb 1 (e-3) Combinations of vehicles over 65 feet in length 2 operated by household goods carriers, with no overall length 3 limitations except as provided in subsections (d) and (e) of 4 this Section, have unlimited access to points of loading and 5 unloading. 6 Section 5-35 of the Illinois Administrative Procedure Act 7 relating to procedures for rulemaking shall not apply to the 8 designation of highways under this paragraph (e). 9 (f) On Class III and other non-designated State 10 highways, the length limitations for vehicles in combination 11 are as follows: 12 (1) Truck tractor-semitrailer combinations, must 13 comply with either a maximum 55 feet overall wheel base 14 or a maximum 65 feet extreme overall dimension. 15 (2) Semitrailers, unladen or with load, may not 16 exceed 53 feet overall dimension. 17 (3) No truck tractor-semitrailer-trailer 18 combination may exceed 60 feet extreme overall dimension. 19 (4) The distance between the kingpin and the center 20 axle of a semitrailer longer than 48 feet, in combination 21 with a truck tractor, may not exceed 42 feet 6 inches.On22any street or highway in the system of State highways23that has not been designated by the Department under24paragraph (d) or (e), the wheelbase between the front25axle and the rear axle in a truck tractor-semitrailer26combination shall not exceed 55 feet or, effective June271, 1996, no truck tractor and semitrailer, unladen or28with load, except a semitrailer other than a house29trailer, shall exceed a length of 65 feet between extreme30overall dimensions, the length of the semitrailer,31unladen or with load, shall not exceed 53 feet and the32distance between the kingpin and the center of the rear33axle of a semitrailer longer than 48 feet 894ll not34exceed 42 feet, 6 inches. On any street or highway in theHB2259 Enrolled -23- LRB9203338DHmb 1State system of highways that has not been designated by2the Department under paragraph (d) or (e), no truck3tractor-semitrailer-trailer combination shall exceed a4length of 60 feet extreme overall dimension.5 (g) Length limitations in the preceding subsections of 6 this Section 15-107 do not apply to the following: 7 (1) Vehicles operated in the daytime, except on 8 Saturdays, Sundays, or legal holidays, when transporting 9 poles, pipe, machinery, or other objects of a structural 10 nature that cannot readily be dismembered, provided the 11 overall length of vehicle and load may not exceed 100 12 feet and no object exceeding 80 feet in length may be 13 transported unless a permit has been obtained as 14 authorized in Section 15-301. 15 (2) Vehicles and loads operated by a public utility 16 while en route to make emergency repairs to public 17 service facilities or properties, but during night 18 operation every vehicle and its load must be equipped 19 with a sufficient number of clearance lamps on both sides 20 and marker lamps upon the extreme ends of any projecting 21 load to clearly mark the dimensions of the load. 22 (3) A tow truck in combination with a disabled 23 vehicle or combination of disabled vehicles, provided the 24 towing vehicle meets the following conditions: 25 (A) It is specifically designed as a tow truck 26 having a gross vehicle weight rating of at least 27 18,000 pounds and equipped with air brakes, provided 28 that air brakes are required only if the towing 29 vehicle is towing a vehicle, semitrailer, or 30 tractor-trailer combination that is equipped with 31 air brakes. 32 (B) It is equipped with flashing, rotating, or 33 oscillating amber lights, visible for at least 500 34 feet in all directions. HB2259 Enrolled -24- LRB9203338DHmb 1 (C) It is capable of utilizing the lighting 2 and braking systems of the disabled vehicle or 3 combination of vehicles. 4 (D) It does not engage in a tow exceeding 50 5 miles from the initial point of wreck or 6 disablement. 7Length limitations in the preceding subsections of this8Section 15-107 shall not apply to vehicles operated in the9daytime, except on Saturdays, Sundays or legal holidays, when10transporting poles, pipe, machinery or other objects of a11structural nature that cannot readily be dismembered, nor to12vehicles transporting those objects operated on Saturdays,13Sundays or legal holidays or at nighttime by a public utility14when required for emergency repair of public service15facilities or properties, but in respect to the night16operation every vehicle and the load thereon shall be17equipped with a sufficient number of clearance lamps on both18sides and marker lamps upon the extreme ends of any19projecting load to clearly mark the dimensions of the load,20provided that the overall length of vehicle and load shall21not exceed 100 feet and no object exceeding 80 feet in length22shall be transported, except by a public utility when23required for emergency repairs, unless a permit has first24been obtained as authorized in Section 15-301. A combination25of vehicles, including a tow truck and a disabled vehicle or26disabled combination of vehicles, that exceeds the length27restriction imposed by this Code, may be operated on a public28highway in this State upon the following conditions:29(1) The towing vehicle must be:30a. specifically designed as a tow truck having31a gross vehicle weight rating of at least 18,00032lbs. and equipped with air brakes;33b. equipped with flashing, rotating or34oscillating amber lights, visible for a least 500HB2259 Enrolled -25- LRB9203338DHmb 1feet in all directions; and2c. capable of utilizing the lighting and3braking systems of the disabled vehicle or4combination of vehicles.5(2) The towing of vehicles on the highways of this6State shall not exceed 50 miles from the initial point of7wreck or disablement. Any additional movement of the8vehicles shall only occur upon issuance of authorization9for that movement under the provisions of Section 15-30110through 15-319 of this Chapter.11 The Department may by rule or regulation prescribe 12 additional requirements regarding length limitations for a 13 tow truck towing another vehicle. 14 For the purpose of this subsection, gross vehicle weight 15 rating, or GVWR, shall mean the value specified by the 16 manufacturer as the loaded weight of the tow truck. Legal 17 holidays referred to in this Section shall be specified as 18 the day on which the following traditional holidays are 19 celebrated: 20 New Year's Day; 21 Memorial Day; 22 Independence Day; 23 Labor Day; 24 Thanksgiving Day; and 25 Christmas Day. 26 (h) The load upon any vehicle operated alone, or the 27 load upon the front vehicle of a combination of vehicles, 28 shall not extend more than 3 feet beyond the front wheels of 29 the vehicle or the front bumper of the vehicle if it is 30 equipped with a front bumper. The provisions of this 31 subsection (h) shall not apply to any vehicle or combination 32 of vehicles specifically designed for the collection and 33 transportation of waste, garbage, or recyclable materials 34 during the vehicle's operation in the course of collecting HB2259 Enrolled -26- LRB9203338DHmb 1 garbage, waste, or recyclable materials if the vehicle is 2 traveling at a speed not in excess of 15 miles per hour 3 during the vehicle's operation and in the course of 4 collecting garbage, waste, or recyclable materials. However, 5 in no instance shall the load extend more than 7 feet beyond 6 the front wheels of the vehicle or the front bumper of the 7 vehicle if it is equipped with a front bumper. 8 (i) The load upon the front vehicle of a combination of 9 vehicles specifically designed to transport motor vehicles 10 shall not extend more than 3 feet beyond the foremost part of 11 the transporting vehicle and the load upon the rear 12 transporting vehicle shall not extend more than 4 feet beyond 13 the rear of the bed or body of the vehicle. This paragraph 14 shall only be applicable upon highways designated in 15 paragraphs (d) and (e) of this Section. 16 (j) Articulated vehicles comprised of 2 sections, 17 neither of which exceeds a length of 42 feet, designed for 18 the carrying of more than 10 persons, may be up to 60 feet in 19 length, not including energy absorbing bumpers, provided that 20 the vehicles are: 21 1. operated by or for any public body or motor 22 carrier authorized by law to provide public 23 transportation services; or 24 2. operated in local public transportation service 25 by any other person and the municipality in which the 26 service is to be provided approved the operation of the 27 vehicle. 28 (j-1) (Blank).Charter or regulated route buses may be29up to 45 feet in length, not including energy absorbing30bumpers.31 (k) Any person who is convicted of violating this 32 Section is subject to the penalty as provided in paragraph 33 (b) of Section 15-113. 34 (l) (Blank).A combination of 3 vehicles not to exceedHB2259 Enrolled -27- LRB9203338DHmb 160 feet overall length may be operated on the highways of the2State, provided that the vehicles meet the following3requirements:4(1) The towing vehicle is a properly registered5vehicle capable of towing another vehicle using a6fifth-wheel type assembly.7(2) The second vehicle in the combination of8vehicles shall be a recreational vehicle that is towed by9a fifth-wheel assembly. This vehicle shall be properly10registered and be equipped with brakes regardless of11weight.12(3) The third vehicle shall be the lightest of the133 vehicles and be a trailer or semi-trailer designed or14used for transporting a boat, all-terrain vehicle,15personal watercraft, or motorcycle.16(4) The towed vehicles may only be for the use of17the operator of the towing vehicle.18(5) All vehicles shall be properly equipped with19operating brakes and safety equipment required by this20Code, except the additional brake requirement in21paragraph (2) above.22 (Source: P.A. 89-219, eff. 1-1-96; 89-434, eff. 6-1-96; 23 89-626, eff. 8-9-96; 90-89, eff. 1-1-98; 90-147, eff. 24 7-23-97; 90-407, eff. 8-15-97; 90-655, eff. 7-30-98.) 25 (625 ILCS 5/15-111) (from Ch. 95 1/2, par. 15-111) 26 Sec. 15-111. Wheel and axle loads and gross weights. 27 (a) On non-designated highways, no vehicle or 28 combination of vehicles equipped with pneumatic tires may be 29 operated, unladen or with load, when the total weight 30 transmitted to the road surface exceeds 18,000 pounds on a 31 single axle or 32,000 pounds on a tandem axle with no axle 32 within the tandem exceeding 18,000 pounds except: 33 (1) when a different limit is established and HB2259 Enrolled -28- LRB9203338DHmb 1 posted in accordance with Section 15-316 of this Code; 2 (2) vehicles for which the Department of 3 Transportation and local authorities issue overweight 4 permits under authority of Section 15-301 of this Code; 5 (3) tow trucks subject to the conditions provided 6 in subsection (d) may not exceed 24,000 pounds on a 7 single rear axle or 44,000 pounds on a tandem rear axle; 8 (4) any single axle of a 2-axle truck weighing 9 36,000 pounds or less and not a part of a combination of 10 vehicles, shall not exceed 20,000 pounds; 11 (5) any single axle of a 2-axle truck equipped with 12 a personnel lift or digger derrick, weighing 36,000 13 pounds or less, owned and operated by a public utility, 14 shall not exceed 20,000 pounds; 15 (6) any single axle of a 2-axle truck specially 16 equipped with a front loading compactor used exclusively 17 for garbage, refuse, or recycling may not exceed 20,000 18 pounds per axle, provided that the gross weight of the 19 vehicle does not exceed 40,000 pounds; 20 (7) a truck, not in combination and specially 21 equipped with a selfcompactor or an industrial roll-off 22 hoist and roll-off container, used exclusively for 23 garbage or refuse operations may, when laden, transmit 24 upon the road surface the following maximum weights: 25 22,000 pounds on a single axle; 40,000 pounds on a tandem 26 axle; 27 (8) a truck, not in combination and used 28 exclusively for the collection of rendering materials, 29 may, when laden, transmit upon the road surface the 30 following maximum weights: 22,000 pounds on a single 31 axle; 40,000 pounds on a tandem axle; 32 (9) tandem axles on a 3-axle truck registered as a 33 Special Hauling Vehicle, manufactured prior to or in the 34 model year of 2004 and first registered in Illinois prior HB2259 Enrolled -29- LRB9203338DHmb 1 to January 1, 2005, with a distance greater than 72 2 inches but not more than 96 inches between any series of 3 2 axles, is allowed a combined weight on the series not 4 to exceed 36,000 pounds and neither axle of the series 5 may exceed 18,000 pounds. Any vehicle of this type 6 manufactured after the model year of 2004 or first 7 registered in Illinois after December 31, 2004 may not 8 exceed a combined weight of 32,000 pounds through the 9 series of 2 axles and neither axle of the series may 10 exceed 18,000 pounds; 11 (10) tandem axles on a 4-axle truck mixer, whose 12 fourth axle is a road surface engaging mixer trailing 13 axle, registered as a Special Hauling Vehicle, used 14 exclusively for the mixing and transportation of concrete 15 and manufactured prior to or in the model year of 2004 16 and first registered in Illinois prior to January 1, 17 2005, with a distance greater than 72 inches but not more 18 than 96 inches between any series of 2 axles, is allowed 19 a combined weight on the series not to exceed 36,000 20 pounds and neither axle of the series may exceed 18,000 21 pounds. Any vehicle of this type manufactured after the 22 model year of 2004 or first registered in Illinois after 23 December 31, 2004 may not exceed a combined weight of 24 32,000 pounds through the series of 2 axles and neither 25 axle of the series may exceed 18,000 pounds; 26 (11) 4-axle vehicles or a 5 or more axle 27 combination of vehicles: The weight transmitted upon the 28 road surface through any series of 3 axles whose centers 29 are more than 96 inches apart, measured between extreme 30 axles in the series, may not exceed those allowed in the 31 table contained in subsection (f) of this Section. No 32 axle or tandem axle of the series may exceed the maximum 33 weight permitted under this Section for a single or 34 tandem axle. HB2259 Enrolled -30- LRB9203338DHmb 1 No vehicle or combination of vehicles equipped with other 2 than pneumatic tires may be operated, unladen or with load, 3 upon the highways of this State when the gross weight on the 4 road surface through any wheel exceeds 800 pounds per inch 5 width of tire tread or when the gross weight on the road 6 surface through any axle exceeds 16,000 pounds.No vehicle or7combination of vehicles equipped with pneumatic tires shall8be operated, unladen or with load, upon the highways of this9State when the gross weight on the road surface through any10single axle thereof exceeds 18,000 pounds, except when a11different limit is established and posted in accordance with12Section 15-316 and except any single axle of a 2 axle motor13vehicle weighing 36,000 pounds or less and not a part of a14combination of vehicles, shall not exceed 20,000 pounds.15Provided, however, that any single axle of a 2 axle motor16vehicle equipped with a personnel lift or digger derrick,17weighing 36,000 pounds or less, owned and operated by a18public utility, shall not exceed 20,000 pounds. No vehicle19or combination of vehicles equipped with other than pneumatic20tires shall be operated, unladen or with load, upon the21highways of this State when the gross weight on the road22surface through any wheel thereof exceeds 800 pounds per inch23width of tire tread or when the gross weight on the road24surface through any axle thereof exceeds 16,000 pounds. The25gross weight transmitted to the road surface through tandem26axles shall not exceed 32,000 pounds and no axle of the27series shall exceed the maximum weight permitted under this28Section for a single axle. Provided that on a 4 axle vehicle29or on a 5 or more axle combination of vehicles the weight on30a series of 3 axles whose centers are more than 96 inches31apart, measured between extreme axles in the series, shall32not exceed those allowed on 3 axles in the table contained in33subsection (f) of this Section and no axle or tandem axle of34the series shall exceed the maximum weight permitted underHB2259 Enrolled -31- LRB9203338DHmb 1this Section for a single or tandem axle. Provided also that2a 3 axle vehicle or 3 axle truck mixer registered as a3Special Hauling Vehicle, used exclusively for the mixing and4transportation of concrete, specially equipped with a road5surface engaging mixer trailing 4th axle, manufactured6prior to or in the model year of 2004 and first registered in7Illinois prior to January 1, 2005, with a distance greater8than 72 inches but not more than 96 inches between any series9of 2 axles may transmit to the road surface a maximum weight10of 18,000 pounds on each of these axles with a gross weight11on these 2 axles not to exceed 36,000 pounds. Any such12vehicle manufactured in the model year of 2004 or thereafter13or first registered in Illinois after December 31, 2004 may14transmit to the road surface a maximum of 32,000 pounds15through these 2 axles and none of the axles shall exceed1618,000 pounds.17A truck, not in combination and specially equipped with a18selfcompactor, or an industrial roll-off hoist and roll-off19container, used exclusively for garbage or refuse operations,20and a truck used exclusively for the collection of rendering21materials may, however, when laden, transmit upon the road22surface of any highway except when part of the National23System of Interstate and Defense Highways, a gross weight24upon a single axle not more than 22,000 pounds, and upon a25tandem axle not more than 40,000 pounds. During the towing operation, 20 neither the tow truck nor the vehicle combination shall 21 exceed 24,000 pounds on a single rear axle and 44,000 pounds 22 on a tandem rear axle, provided the towing vehiclethe23following axle weight limitations: 24 (1) is specifically designed as a tow truck having 25 a gross vehicle weight rating of at least 18,000 pounds 26 and is equipped with air brakes, provided that air brakes 27 are required only if the towing vehicle is towing a 28 vehicle, semitrailer, or tractor-trailer combination that 29 is equipped with air brakes; 30 (2) is equipped with flashing, rotating, or 31 oscillating amber lights, visible for at least 500 feet 32 in all directions; 33 (3) is capable of utilizing the lighting and 34 braking systems of the disabled vehicle or combination of HB2259 Enrolled -35- LRB9203338DHmb 1 vehicles; and 2 (4) does not engage in a tow exceeding 20 miles 3 from the initial point of wreck or disablement. Any 4 additional movement of the vehicles may occur only upon 5 issuance of authorization for that movement under the 6 provisions of Sections 15-301 through 15-319 of this 7 Code. 8A. 24,000 pounds - Single rear axle;9B. 44,000 pounds - Tandem rear axle;10 Gross weight limits shall not apply to the combination of 11 the tow truck and vehicles being towed. The tow truck 12 license plate must cover the operating empty weight of the 13 tow truck only. The weight of each vehicle being towed shall 14 be covered by a valid license plate issued to the owner or 15 operator of the vehicle being towed and displayed on that 16 vehicle. If no valid plate issued to the owner or operator of 17 that vehicle is displayed on that vehicle, or the plate 18 displayed on that vehicle does not cover the weight of the 19 vehicle, the weight of the vehicle shall be covered by the 20 third tow truck plate issued to the owner or operator of the 21 tow truck and temporarily affixed to the vehicle being towed. 22In addition, the following conditions must be met:23(1) the towing vehicle must be:24a. specifically designed as a tow truck having25a gross vehicle weight rating of at least 18,00026lbs. and equipped with air brakes provided that air27brakes shall be required only if the towing vehicle28is towing a vehicle, semitrailer, or tractor-trailer29combination that is equipped with airbrakes;30b. equipped with flashing, rotating or31oscillating amber lights, visible for at least 50032feet in all directions; and33c. capable of utilizing the lighting and34braking systems of the disabled vehicle orHB2259 Enrolled -36- LRB9203338DHmb 1combination of vehicles.2(2) The towing of the vehicles on the highways of3this State shall not exceed 20 miles from the initial4point of wreck or disablement. Any additional movement of5the vehicles shall only occur upon issuance of6authorization for that movement under the provisions of7Sections 15-301 through 15-319 of this Chapter.8 The Department may by rule or regulation prescribe 9 additional requirements. However, nothing in this Code shall 10 prohibit a tow truck under instructions of a police officer 11 from legally clearing a disabled vehicle, that may be in 12 violation of weight limitations of this Chapter, from the 13 roadway to the berm or shoulder of the highway. If in the 14 opinion of the police officer that location is unsafe, the 15 officer is authorized to have the disabled vehicle towed to 16 the nearest place of safety. 17 For the purpose of this subsection, gross vehicle weight 18 rating, or GVWR, shall mean the value specified by the 19 manufacturer as the loaded weight of the tow truck. 20 (e) No vehicle or combination of vehicles equipped with 21 pneumatic tires shall be operated, unladen or with load, upon 22 the highways of this State in violation of the provisions of 23 any permit issued under the provisions of Sections 15-301 24 through 15-319 of this Chapter. 25 (f) On designated Class I, II, or III highways and the 26 National System of Interstate and Defense Highways, no 27 vehicle or combination of vehicles with pneumatic tires may 28 be operated, unladen or with load, when the total weight on 29 the road surface exceeds the following: 20,000 pounds on a 30 single axle; 34,000 pounds on a tandem axle with no axle 31 within the tandem exceeding 20,000 pounds; 80,000 pounds 32 gross weight for vehicle combinations of 5 or more axles; or 33 a total weight on a group of 2 or more consecutive axles in 34 excess of that weight produced by the application of the HB2259 Enrolled -37- LRB9203338DHmb 1 following formula: W = 500 times the sum of (LN divided by 2 N-1) + 12N + 36, where "W" equals overall total weight on any 3 group of 2 or more consecutive axles to the nearest 500 4 pounds, "L" equals the distance measured to the nearest foot 5 between extremes of any group of 2 or more consecutive axles, 6 and "N" equals the number of axles in the group under 7 consideration.Notwithstanding any other provision in this8Code, except for those provisions of subsection (d) of this9Section relating to emergency operations of public utilities10and tow trucks while actually engaged in the towing of a11disabled vehicle, and those vehicles for which the Department12issues overweight permits under authority of Section 15-30113of this Code, the weight limitations contained in this14subsection shall apply to the National System of Interstate15and Defense Highways and other highways in the system of16State highways that have been designated by the Department as17Class I, II, or III. No vehicle shall be operated on the18highways with a weight in excess of 20,000 pounds carried on19any one axle or with a tandem axle weight in excess of 34,00020pounds, or a gross weight in excess of 80,000 pounds for21vehicle combinations of 5 axles or more, or a gross weight on22a group of 2 or more consecutive axles in excess of that23weight produced by the application of the following formula:24W = 500 times the sum of (LN divided by N-1) + 12N + 3625Where "W" equals overall gross weight on any group of 2 or26more consecutive axles to the nearest 500 pounds; "L" equals27the distance measured to the nearest foot between extremes of28any group of 2 or more consecutive axles; and "N" equals the29number of axles in the group under consideration, except that302 consecutive sets of tandem axles may carry a gross load of3134,000 pounds each, provided the overall distance between the32first and last axles of the consecutive sets of tandem axles33is 36 feet or more. Provided also that a 3-axle vehicle34registered as a Special Hauling Vehicle manufactured prior toHB2259 Enrolled -38- LRB9203338DHmb 1or in the model year of 2004, and first registered in2Illinois prior to January 1, 2005, with a distance greater3than 72 inches but not more than 96 inches between the 2 rear4axles may transmit to the road surface a maximum weight of518,000 pounds on each of the 2 rear axles with a gross weight6on these 2 axles not to exceed 36,000 pounds. Any vehicle7registered as a Special Hauling Vehicle manufactured prior to8or in the model year of 2004 or thereafter or first9registered in Illinois after December 31, 2004, may transmit10to the road notwithstanding the 12 higher limit resulting from the application of the formula. 13 Vehicles not in a combination having more than 4 axles 14 may not exceed the weight in the table in this subsection (f) 15 for 4 axles measured between the extreme axles of the 16 vehicle. 17 Vehicles in a combination having more than 6 axles may 18 not exceed the weight in the table in this subsection (f) for 19 6 axles measured between the extreme axles of the 20 combination. 21In applying the above formula to a vehicle having more22than 4 axles that is not a combination, only 4 axles shall be23considered in determining the maximum gross weight, and for a24combination of vehicles having more than 6 axles, only 625axles shall be considered in determining the maximum gross26weight.27Notwithstanding the above table, 2 consecutive sets of28tandem axles may carry a gross weight of 34,000 pounds each29if the overall distance between the first and last axles of30the consecutive sets of tandem axles is 36 feet or more.31 Local authorities and road district highway 32 commissioners, with respect to streets and highways under 33 their jurisdiction, without additional fees, may also by 34 ordinance or resolution allow the weight limitations of this HB2259 Enrolled -41- LRB9203338DHmb 1 subsection, provided the maximum gross weight on any one axle 2 shall not exceed 20,000 pounds and the maximum totalgross3 weight on any tandem axle shall not exceed 34,000 pounds, on 4 designated highways when appropriate regulatory signs giving 5 notice are erected upon the street or highway or portion of 6 any street or highway affected by the ordinance or 7 resolution. 8 The following are exceptions to the above formula: 9 (1) Two consecutive sets of tandem axles may carry 10 a total weight of 34,000 pounds each if the overall 11 distance between the first and last axles of the 12 consecutive sets of tandem axles is 36 feet or more. 13 (2) Vehicles for which a different limit is 14 established and posted in accordance with Section 15-316 15 of this Code. 16 (3) Vehicles for which the Department of 17 Transportation and local authorities issue overweight 18 permits under authority of Section 15-301 of this Code. 19 These vehicles are not subject to the bridge formula. 20 (4) Tow trucks subject to the conditions provided 21 in subsection (d) may not exceed 24,000 pounds on a 22 single rear axle or 44,000 pounds on a tandem rear axle. 23 (5) A tandem axle on a 3-axle truck registered as a 24 Special Hauling Vehicle, manufactured prior to or in the 25 model year of 2004, and registered in Illinois prior to 26 January 1, 2005, with a distance between 2 axles in a 27 series greater than 72 inches but not more than 96 inches 28 may not exceed a total weight of 36,000 pounds and 29 neither axle of the series may exceed 18,000 pounds. 30 (6) A truck not in combination, equipped with a 31 self compactor or an industrial roll-off hoist and 32 roll-off container, used exclusively for garbage or 33 refuse operations, may, when laden, transmit upon the 34 road surface, except when on part of the National System HB2259 Enrolled -42- LRB9203338DHmb 1 of Interstate and Defense Highways, the following maximum 2 weights: 22,000 pounds on a single axle; 40,000 pounds on 3 a tandem axle; 36,000 pounds gross weight on a 2-axle 4 vehicle; 54,000 pounds gross weight on a 3-axle vehicle. 5 This vehicle is not subject to the bridge formula. 6 (7) Combinations of vehicles, registered as Special 7 Hauling Vehicles that include a semitrailer manufactured 8 prior to or in the model year of 2004, and registered in 9 Illinois prior to January 1, 2005, having 5 axles with a 10 distance of 42 feet or less between extreme axles, may 11 not exceed the following maximum weights: 18,000 pounds 12 on a single axle; 32,000 pounds on a tandem axle; and 13 72,000 pounds gross weight. This combination of vehicles 14 is not subject to the bridge formula. For all those 15 combinations of vehicles that include a semitrailer 16 manufactured after the effective date of this amendatory 17 Act of the 92nd General Assembly, the overall distance 18 between the first and last axles of the 2 sets of tandems 19 must be 18 feet 6 inches or more. Any combination of 20 vehicles that has had its cargo container replaced in its 21 entirety after December 31, 2004 may not exceed the 22 weights allowed by the bridge formula. 23 No vehicle or combination of vehicles equipped with other 24 than pneumatic tires may be operated, unladen or with load, 25 upon the highways of this State when the gross weight on the 26 road surface through any wheel exceeds 800 pounds per inch 27 width of tire tread or when the gross weight on the road 28 surface through any axle exceeds 16,000 pounds. 29Combinations of vehicles, registered as Special Hauling30Vehicles that include a semitrailer manufactured prior to or31in the model year of 2004, and first registered in Illinois32prior to January 1, 2005, having 5 axles with a distance of3342 feet or less between extreme axles shall be limited to the34weights prescribed in subsections (a) and (b) of this SectionHB2259 Enrolled -43- LRB9203338DHmb 1and not subject to the bridge formula on the National System2of Interstate and Defense Highways and other highways in the3system of State highways designated by the Department. For4all those combinations of vehicles, that include a5semitrailer manufactured after the effective date of this6amendatory Act of 1986, the overall distance between the7first and last axles of the 2 sets of tandems must be 18 feet86 inches or more. All combinations of vehicles registered as9Special Hauling Vehicles that include a semitrailer10manufactured prior to or in the model year of 2004 or11thereafter or first registered in Illinois after December 31,122004, or that has had its cargo container replaced in its13entirety after December 31, 2004, are limited to the gross14weight allowed by the above formula.15A truck not in combination, equipped with a self16compactor or an industrial roll-off hoist and roll-off17container, used exclusively for garbage or refuse operations,18shall be allowed the weights as prescribed in subsections (a)19and (b) of this Section and not subject to the bridge20formula, provided they are not operated on a highway that is21part of the Interstate and Defense Highway System.22Vehicles operating under this subsection shall have23access for a distance of one highway mile to or from a Class24I highway on any street or highway, unless there is a sign25prohibiting the access, or 5 highway miles to or from either26a Class I, II, or III highway on a street or highway included27in the system of State highways and upon any street or28highway designated by local authorities or road district29commissioners to points of loading and unloading and to30facilities for food, fuel, repairs and rest.31 (f-1) A vehicle and load not exceeding 73,280 pounds is 32 allowed access as follows: 33 (1) From any State designated highway onto any 34 county, township, or municipal highway for a distance of HB2259 Enrolled -44- LRB9203338DHmb 1 5 highway miles for the purpose of loading and unloading, 2 provided: 3 (A) The vehicle and load does not exceed 8 4 feet 6 inches in width and 65 feet overall length. 5 (B) There is no sign prohibiting that access. 6 (C) The route is not being used as a 7 thoroughfare between State designated highways. 8 (2) From any State designated highway onto any 9 county or township highway for a distance of 5 highway 10 miles, or any municipal highway for a distance of one 11 highway mile for the purpose of food, fuel, repairs, and 12 rest, provided: 13 (A) The vehicle and load does not exceed 8 14 feet 6 inches in width and 65 feet overall length. 15 (B) There is no sign prohibiting that access. 16 (C) The route is not being used as a 17 thoroughfare between State designated highways. 18 (f-2) A vehicle and load greater than 73,280 pounds in 19 weight but not exceeding 80,000 pounds is allowed access as 20 follows: 21 (1) From a Class I highway onto any street or 22 highway for a distance of one highway mile for the 23 purpose of loading, unloading, food, fuel, repairs, and 24 rest, provided there is no sign prohibiting that access. 25 (2) From a Class I, II, or III highway onto any 26 State highway or any local designated highway for a 27 distance of 5 highway miles for the purpose of loading, 28 unloading, food, fuel, repairs, and rest. 29 Section 5-35 of the Illinois Administrative Procedure Act 30 relating to procedures for rulemaking shall not apply to the 31 designation of highways under this subsection. 32 (g) No person shall operate a vehicle or combination of 33 vehicles over a bridge or other elevated structure 34 constituting part of a highway with a gross weight that is HB2259 Enrolled -45- LRB9203338DHmb 1 greater than the maximum weight permitted by the Department, 2 when the structure is sign posted as provided in this 3 Section. 4 (h) The Department upon request from any local authority 5 shall, or upon its own initiative may, conduct an 6 investigation of any bridge or other elevated structure 7 constituting a part of a highway, and if it finds that the 8 structure cannot with safety to itself withstand the weight 9 of vehicles otherwise permissible under this Code the 10 Department shall determine and declare the maximum weight of 11 vehicles that the structures can withstand, and shall cause 12 or permit suitable signs stating maximum weight to be erected 13 and maintained before each end of the structure. No person 14 shall operate a vehicle or combination of vehicles over any 15 structure with a gross weight that is greater than the posted 16 maximum weight. 17 (i) Upon the trial of any person charged with a 18 violation of subsections (g) or (h) of this Section, proof of 19 the determination of the maximum allowable weight by the 20 Department and the existence of the signs, constitutes 21 conclusive evidence of the maximum weight that can be 22 maintained with safety to the bridge or structure. 23 (Source: P.A. 89-117, eff. 7-7-95; 89-433, eff. 12-15-95; 24 90-89, eff. 1-1-98; 90-330, eff. 8-8-97; 90-655, eff. 25 7-30-98.) 26 (625 ILCS 5/15-112) (from Ch. 95 1/2, par. 15-112) 27 Sec. 15-112. Officers to weigh vehicles and require 28 removal of excess loads. 29 (a) Any police officer having reason to believe that the 30 weight of a vehicle and load is unlawful shall require the 31 driver to stop and submit to a weighing of the same either by 32 means of a portable or stationary scales that have been 33 tested and approved at a frequency prescribed by the Illinois HB2259 Enrolled -46- LRB9203338DHmb 1 Department of Agriculture, or for those scales operated by 2 the State, when such tests are requested by the Department of 3 State Police, whichever is more frequent. If such scales are 4 not available at the place where such vehicle is stopped, the 5 police officer shall require that such vehicle be driven to 6 the nearest available scale that has been tested and approved 7 pursuant to this Section by the Illinois Department of 8 Agriculture. Notwithstanding any provisions of the Weights 9 and Measures Act or the United States Department of Commerce 10 NIST handbook 44, multi or single draft weighing is an 11 acceptable method of weighing by law enforcement for 12 determining a violation of Chapter 3 or 15 of this Code. Law 13 enforcement is exempt from the requirements of commercial 14 weighing established in NIST handbook 44. 15 Within 18 months after the effective date of this 16 amendatory Act of the 91st General Assembly, all municipal 17 and county officers, technicians, and employees who set up 18 and operate portable scales for wheel load or axle load or 19 both and issue citations based on the use of portable scales 20 for wheel load or axle load or both and who have not 21 successfully completed initial classroom and field training 22 regarding the set up and operation of portable scales, shall 23 attend and successfully complete initial classroom and field 24 training administered by the Illinois Law Enforcement 25 Training Standards Board. 26 (b) Whenever an officer, upon weighing a vehicle and the 27 load, determines that the weight is unlawful, such officer 28 shall require the driver to stop the vehicle in a suitable 29 place and remain standing until such portion of the load is 30 removed as may be necessary to reduce the weight of the 31 vehicle to the limit permitted under this Chapter, or to the 32 limit permitted under the terms of a permit issued pursuant 33 to Sections 15-301 through 15-318 and shall forthwith arrest 34 the driver or owner. All material so unloaded shall be cared HB2259 Enrolled -47- LRB9203338DHmb 1 for by the owner or operator of the vehicle at the risk of 2 such owner or operator; however, whenever a 3 or 4 axle 3 vehicle with a tandem axle dimension greater than 72 inches, 4 but less than 96 inches and registered as a Special Hauling 5 Vehicle is transporting asphalt or concrete in the plastic 6 state that exceeds axle weight or gross weight limits by less 7 than 4,000 pounds, the owner or operator of the vehicle shall 8 accept the arrest ticket or tickets for the alleged 9 violations under this Section and proceed without shifting or 10 reducing the load being transported or may shift or reduce 11 the load under the provisions of subsection (d) or (e) of 12 this Section, when applicable. Any fine imposed following an 13 overweight violation by a vehicle registered as a Special 14 Hauling Vehicle transporting asphalt or concrete in the 15 plastic state shall be paid as provided in subsection 4 of 16 paragraph (a) of Section 16-105 of this Code. 17 (c) The Department of Transportation may, at the request 18 of the Department of State Police, erect appropriate 19 regulatory signs on any State highway directing second 20 division vehicles to a scale. The Department of 21 Transportation may also, at the direction of any State Police 22 officer, erect portable regulating signs on any highway 23 directing second division vehicles to a portable scale. 24 Every such vehicle, pursuant to such sign, shall stop and be 25 weighed. 26 (d) Whenever any axle load of a vehicle exceeds the axle 27 or tandem axle weight limits permitted by paragraph (a) or 28 (f) of Section 15-111 by 2000 pounds or less, the owner or 29 operator of the vehicle must shift or remove the excess so as 30 to comply with paragraph (a) or (f) of Section 15-111. No 31 overweight arrest ticket shall be issued to the owner or 32 operator of the vehicle by any officer if the excessgross33 weight is shifted or removed as required by this paragraph. 34 (e) Whenever the gross weight of a vehicle with a HB2259 Enrolled -48- LRB9203338DHmb 1 registered gross weight of 73,280 pounds or less exceeds the 2 weight limits of paragraph (b) or (f) of Section 15-111 of 3 this Chapter by 2000 pounds or less, the owner or operator of 4 the vehicle must remove the excess. Whenever the gross weight 5 of a vehicle with a registered gross weight of 73,281 pounds 6 or more exceeds the weight limits of paragraph (b) or (f) of 7 Section 15-111 by 1,000 pounds or less or 2,000 pounds or 8 less if weighed on wheel load weighers, the owner or operator 9 of the vehicle must remove the excess. In either case no 10 arrest ticket for any overweight violation of this Code shall 11 be issued to the owner or operator of the vehicle by any 12 officer if the excess weight is removed as required by this 13 paragraph. A person who has been granted a special permit 14 under Section 15-301 of this Code shall not be granted a 15 tolerance on wheel load weighers. 16 (f) Whenever an axle load of a vehicle exceeds axle 17 weight limits allowed by the provisions of a permit an arrest 18 ticket shall be issued, but the owner or operator of the 19 vehicle may shift the load so as to comply with the 20 provisions of the permit. Where such shifting of a load to 21 comply with the permit is accomplished, the owner or operator 22 of the vehicle may then proceed. 23 (g) Any driver of a vehicle who refuses to stop and 24 submit his vehicle and load to weighing after being directed 25 to do so by an officer or removes or causes the removal of 26 the load or part of it prior to weighing is guilty of a 27 business offense and shall be fined not less than $500 nor 28 more than $2,000. 29 (Source: P.A. 91-129, eff. 7-16-99.) 30 (625 ILCS 5/15-316) (from Ch. 95 1/2, par. 15-316) 31 Sec. 15-316. When the Department, local authority or road 32 district highway commissioner may restrict right to use 33 highways. HB2259 Enrolled -49- LRB9203338DHmb 1 (a) Local authorities and road district highway 2 commissioners with respect to highways under their 3 jurisdiction may by ordinance or resolution prohibit the 4 operation of vehicles upon any such highway or impose 5 restrictions as to the weight of vehicles to be operated upon 6 any such highway, for a total period of not to exceed 90 days 7 in any one calendar year, whenever any said highway by reason 8 of deterioration, rain, snow, or other climate conditions 9 will be seriously damaged or destroyed unless the use of 10 vehicles thereon is prohibited or the permissible weights 11 thereof reduced. 12 (b) The local authority or road district highway 13 commissioner enacting any such ordinance or resolution shall 14 erect or cause to be erected and maintained signs designating 15 the provision of the ordinance or resolution at each end of 16 that portion of any highway affected thereby, and the 17 ordinance or resolution shall not be effective unless and 18 until such signs are erected and maintained. 19 (c) Local authorities and road district highway 20 commissioners with respect to highways under their 21 jurisdiction may also, by ordinance or resolution, prohibit 22 the operation of trucks or other commercial vehicles, or may 23 impose limitations as the weight thereof, on designated 24 highways, which prohibitions and limitations shall be 25 designated by appropriate signs placed on such highways. 26 (c-1) (Blank)The weight provisions of subsections (a),27(b), and (c) take precedence over the provisions of28subsections (d-1) and (d-2). 29 (d) The Department shall likewise have authority as 30 hereinbefore granted to local authorities and road district 31 highway commissioners to determine by resolution and to 32 impose restrictions as to the weight of vehicles operated 33 upon any highway under the jurisdiction of said department, 34 and such restrictions shall be effective when signs giving HB2259 Enrolled -50- LRB9203338DHmb 1 notice thereof are erected upon the highway or portion of any 2 highway affected by such resolution. 3 (d-1) (Blank)Motor vehicles and motor vehicles in4combination with gross weights not exceeding 73,280 pounds5and up to 65 feet in overall length and 102 inches in width6operating on highways under the control of a county or7township road district highway commissioner may have access8for a distance of 5 miles from a State designated highway for9the purpose of loading, unloading, services, and home base.10No exemption shall be granted authorizing travel on local11roads as a thoroughfare between State designated highways. 12 (d-2) (Blank)Motor vehicles and motor vehicles in13combination with gross weights not exceeding 73,280 pounds14and up to 65 feet in overall length and 102 inches in width15operating on highways under the control of municipal16authorities may have access for 5 miles from a State17designated highway for the purpose of loading and unloading18and one mile for food, fuel, repairs, and rest on those19municipally controlled highways. No exemption shall be20granted authorizing travel on municipal roads as a21thoroughfare between State designated highways. 22 (e) When any vehicle is operated in violation of this 23 Section, the owner or driver of the vehicle shall be deemed 24 guilty of a violation and either the owner or the driver of 25 the vehicle may be prosecuted for the violation. Any person, 26 firm, or corporation convicted of violating this Section 27 shall be fined $50 for any weight exceeding the posted limit 28 up to the axle or gross weight limit allowed a vehicle as 29 provided for in subsections (a) or (b) of Section 15-111 and 30 $75 per every 500 pounds or fraction thereof for any weight 31 exceeding that which is provided for in subsections (a) or 32 (b) of Section 15-111. 33 (f) A municipality is authorized to enforce a county 34 weight limit ordinance applying to county highways within its HB2259 Enrolled -51- LRB9203338DHmb 1 corporate limits and is entitled to the proceeds of any fines 2 collected from the enforcement. 3 (Source: P.A. 89-117, eff. 7-7-95; 89-687, eff. 6-1-97; 4 90-211, eff. 1-1-98.)
