92_HB2259eng HB2259 Engrossed LRB9203338DHmb 1 AN ACT in relation to motor carriers. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 adding Section 1-126.1 and changing Sections 15-101, 15-102, 6 15-103, 15-106, 15-107, 15-111, 15-112, and 15-316 as 7 follows: 8 (625 ILCS 5/1-126.1 new) 9 Sec. 1-126.1. Highway Designations. The Department of 10 Transportation may designate streets or highways in the 11 system of State highways as follows: 12 (a) Class I highways include interstate highways, 13 expressways, tollways, and other highways deemed 14 appropriate by the department. 15 (b) Class II highways include major arterials not 16 built to interstate highway standards that have at least 17 11 feet lane widths. 18 (c) Class III highways include those State highways 19 that have lane widths of less than 11 feet. 20 (d) Non-designated highways are highways in the 21 system of State highways not designated as Class I, II, 22 or III, or local highways which are part of any county, 23 township, municipal, or district road system. Local 24 authorities also may designate Class II or Class III 25 highways within their systems of highways. 26 (625 ILCS 5/15-101) (from Ch. 95 1/2, par. 15-101) 27 Sec. 15-101. Scope and effect of Chapter 15. (a) It is 28 unlawful for any person to drive or move on, upon or across 29 or for the owner to cause or knowingly permit to be driven or 30 moved on, upon or across any highway any vehicle or vehicles HB2259 Engrossed -2- LRB9203338DHmb 1 of a size and weight exceeding the limitations stated in this 2 Chapter or otherwise in violation of this Chapter, and the 3 maximum size and weight of vehicles herein specified shall be 4 lawful throughout this State, and local authorities shall 5 have no power or authority to alter such limitations except 6 as express authority may be granted in this Chapter. 7 (b) The provisions of this Chapter governing size, 8 weight and load do not apply to fire apparatus or equipment 9 for snow and ice removal operations owned or operated by any 10 governmental body, or to implements of husbandry, as defined 11 in Chapter 1 of this Code, temporarily operated or towed in a 12 combination upon a highway provided such combination does not 13 consist of more than 3 vehicles or, in the case of hauling 14 fresh, perishable fruits or vegetables from farm to the point 15 of first processing, not more than 3 wagons being towed by an 16 implement of husbandry, or to a vehicle operated under the 17 terms of a special permit issued hereunder. 18 (Source: P.A. 83-831.) 19 (625 ILCS 5/15-102) (from Ch. 95 1/2, par. 15-102) 20 Sec. 15-102. Width of Vehicles. 21 (a) On Class III and non-designated State and local 22 highways,Except as otherwise provided in this Section or23this Code,the total outside width of any vehicle or load 24 thereon shall not exceed 8 feet. 25 (b) Except during those times when, due to insufficient 26 light or unfavorable atmospheric conditions, persons and 27 vehicles on the highway are not clearly discernible at a 28 distance of 1000 feet, the following vehicles may exceed the 29 8 feet limitation during the period from a half hour before 30 sunrise to a half hour after sunset: 31 (1) Loads of hay, straw or other similar farm 32 products provided that the load is not more than 12 feet 33 wide. HB2259 Engrossed -3- LRB9203338DHmb 1 (2) Implements of husbandry being transported on 2 another vehicle and the transporting vehicle while 3 loaded. 4 The following requirements apply to the 5 transportation on another vehicle of an implement of 6 husbandry wider than 8 feet 6 inches on the National 7 System of Interstate and Defense Highways or other 8 highways in the system of State highways: 9 (A) The driver of a vehicle transporting an 10 implement of husbandry that exceeds 8 feet 6 inches 11 in width shall obey all traffic laws and shall check 12 the roadways prior to making a movement in order to 13 ensure that adequate clearance is available for the 14 movement. It is prima facie evidence that the 15 driver of a vehicle transporting an implement of 16 husbandry has failed to check the roadway prior to 17 making a movement if the vehicle is involved in a 18 collision with a bridge, overpass, fixed structure, 19 or properly placed traffic control device or if the 20 vehicle blocks traffic due to its inability to 21 proceed because of a bridge, overpass, fixed 22 structure, or properly placed traffic control 23 device. 24 (B) Flags shall be displayed so as to wave 25 freely at the extremities of overwidth objects and 26 at the extreme ends of all protrusions, projections, 27 and overhangs. All flags shall be clean, bright red 28 flags with no advertising, wording, emblem, or 29 insignia inscribed upon them and at least 18 inches 30 square. 31 (C) "OVERSIZE LOAD" signs are mandatory on the 32 front and rear of all vehicles with loads over 10 33 feet wide. These signs must have 12-inch high black 34 letters with a 2-inch stroke on a yellow sign that HB2259 Engrossed -4- LRB9203338DHmb 1 is 7 feet wide by 18 inches high. 2 (D) One civilian escort vehicle is required 3 for a load that exceeds 14 feet 6 inches in width 4 and 2 civilian escort vehicles are required for a 5 load that exceeds 16 feet in width on the National 6 System of Interstate and Defense Highways or other 7 highways in the system of State highways. 8 (E) The requirements for a civilian escort 9 vehicle and driver are as follows: 10 (1) The civilian escort vehicle shall be 11 a passenger car or a second division vehicle 12 not exceeding a gross vehicle weight of 8,000 13 pounds that is designed to afford clear and 14 unobstructed vision to both front and rear. 15 (2) The escort vehicle driver must be 16 properly licensed to operate the vehicle. 17 (3) While in use, the escort vehicle must 18 be equipped with illuminated rotating, 19 oscillating, or flashing amber lights or 20 flashing amber strobe lights mounted on top 21 that are of sufficient intensity to be visible 22 at 500 feet in normal sunlight. 23 (4) "OVERSIZE LOAD" signs are mandatory 24 on all escort vehicles. The sign on an escort 25 vehicle shall have 8-inch high black letters on 26 a yellow sign that is 5 feet wide by 12 inches 27 high. 28 (5) When only one escort vehicle is 29 required and it is operating on a two-lane 30 highway, the escort vehicle shall travel 31 approximately 300 feet ahead of the load. The 32 rotating, oscillating, or flashing lights or 33 flashing amber strobe lights and an "OVERSIZE 34 LOAD" sign shall be displayed on the escort HB2259 Engrossed -5- LRB9203338DHmb 1 vehicle and shall be visible from the front. 2 When only one escort vehicle is required and it 3 is operating on a multilane divided highway, 4 the escort vehicle shall travel approximately 5 300 feet behind the load and the sign and 6 lights shall be visible from the rear. 7 (6) When 2 escort vehicles are required, 8 one escort shall travel approximately 300 feet 9 ahead of the load and the second escort shall 10 travel approximately 300 feet behind the load. 11 The rotating, oscillating, or flashing lights 12 or flashing amber strobe lights and an 13 "OVERSIZE LOAD" sign shall be displayed on the 14 escort vehicles and shall be visible from the 15 front on the lead escort and from the rear on 16 the trailing escort. 17 (7) When traveling within the corporate 18 limits of a municipality, the escort vehicle 19 shall maintain a reasonable and proper distance 20 from the oversize load, consistent with 21 existing traffic conditions. 22 (8) A separate escort shall be provided 23 for each load hauled. 24 (9) The driver of an escort vehicle shall 25 obey all traffic laws. 26 (10) The escort vehicle must be in safe 27 operational condition. 28 (11) The driver of the escort vehicle 29 must be in radio contact with the driver of the 30 vehicle carrying the oversize load. 31 (F) A transport vehicle while under load of 32 more than 8 feet 6 inches in width must be equipped 33 with an illuminated rotating, oscillating, or 34 flashing amber light or lights or a flashing amber HB2259 Engrossed -6- LRB9203338DHmb 1 strobe light or lights mounted on the top of the cab 2 that are of sufficient intensity to be visible at 3 500 feet in normal sunlight. If the load on the 4 transport vehicle blocks the visibility of the amber 5 lighting from the rear of the vehicle, the vehicle 6 must also be equipped with an illuminated rotating, 7 oscillating, or flashing amber light or lights or a 8 flashing amber strobe light or lights mounted on the 9 rear of the load that are of sufficient intensity to 10 be visible at 500 feet in normal sunlight. 11 (G) When a flashing amber light is required on 12 the transport vehicle under load and it is operating 13 on a two-lane highway, the transport vehicle shall 14 display to the rear at least one rotating, 15 oscillating, or flashing light or a flashing amber 16 strobe light and an "OVERSIZE LOAD" sign. When a 17 flashing amber light is required on the transport 18 vehicle under load and it is operating on a 19 multilane divided highway, the sign and light shall 20 be visible from the rear. 21 (H) Maximum speed shall be 45 miles per hour 22 on all such moves or 5 miles per hour above the 23 posted minimum speed limit, whichever is greater, 24 but the vehicle shall not at any time exceed the 25 posted maximum speed limit. 26 (3) Portable buildings designed and used for 27 agricultural and livestock raising operations that are 28 not more than 14 feet wide and with not more than a 1 29 foot overhang along the left side of the hauling vehicle. 30 However, the buildings shall not be transported more than 31 10 miles and not on any route that is part of the 32 National System of Interstate and Defense Highways. 33 All buildings when being transported shall display at 34 least 2 red cloth flags, not less than 12 inches square, HB2259 Engrossed -7- LRB9203338DHmb 1 mounted as high as practicable on the left and right side of 2 the building. 3 A State Police escort shall be required if it is 4 necessary for this load to use part of the left lane when 5 crossing any 2 laned State highway bridge. 6 (c) Vehicles propelled by electric power obtained from 7 overhead trolley wires operated wholly within the corporate 8 limits of a municipality are also exempt from the width 9 limitation. 10 (d) Exemptions are also granted to vehicles designed for 11 the carrying of more than 10 persons under the following 12 conditions: 13 (1) (Blank); 14 (2) When operated within any public transportation 15 service with the approval of local authorities or an 16 appropriate public body authorized by law to provide 17 public transportation. Any vehicle so operated may be 8 18 feet 6 inches in width; or 19 (3) When a county engineer or superintendent of 20 highways, after giving due consideration to the mass 21 transportation needs of the area and to the width and 22 condition of the road, has determined that the operation 23 of buses wider than 8 feet will not pose an undue safety 24 hazard on a particular county or township road segment, 25 he or she may authorize buses not to exceed 8 feet 6 26 inches in width on any highway under that engineer's or 27 superintendent's jurisdiction. 28 (e) A vehicle and load traveling upon the National 29 System of Interstate and Defense Highways or any other 30 highway in the system of State highways that has been 31 designated as a Class I or Class II highway by the 32 Department, or any street or highway designated by local 33 authorities or road district commissioners, may have a total 34 outside width of 8 feet 6 inches, provided that certain HB2259 Engrossed -8- LRB9203338DHmb 1 safety devices that the Department determines as necessary 2 for the safe and efficient operation of motor vehicles shall 3 not be included in the calculation of width. 4 (e-1) A vehicle and load not exceeding 8 feet 6 inches 5 in width is allowed access according to the following: 6 (1) A vehicle and load not exceeding 73,280 pounds 7 in weight is allowed access from any State designated 8 highway onto any county, township, or municipal highway 9 for a distance of 5 highway miles for the purpose of 10 loading and unloading, provided: 11 (A) The vehicle and load does not exceed 65 12 feet overall length. 13 (B) There is no sign prohibiting that access. 14 (C) The route is not being used as a 15 thoroughfare between State designated highways. 16 (2) A vehicle and load not exceeding 73,280 pounds 17 in weight is allowed access from any State designated 18 highway onto any county or township highway for a 19 distance of 5 highway miles or onto any municipal highway 20 for a distance of one highway mile for the purpose of 21 food, fuel, repairs, and rest, provided: 22 (A) The vehicle and load does not exceed 65 23 feet overall length. 24 (B) There is no sign prohibiting that access. 25 (C) The route is not being used as a 26 thoroughfare between State designated highways. 27 (3) A vehicle and load not exceeding 80,000 pounds 28 in weight is allowed access from a Class I highway onto 29 any street or highway for a distance of one highway mile 30 for the purpose of loading, unloading, food, fuel, 31 repairs, and rest, provided there is no sign prohibiting 32 that access. 33 (4) A vehicle and load not exceeding 80,000 pounds 34 in weight is allowed access from a Class I or Class II HB2259 Engrossed -9- LRB9203338DHmb 1 highway onto any State highway or any locally designated 2 highway for a distance of 5 highway miles for the purpose 3 of loading, unloading, food, fuel, repairs, and rest. 4 (5) A trailer or semi-trailer not exceeding 28 feet 5 6 inches in length, that was originally in combination 6 with a truck tractor, shall have unlimited access to 7 points of loading and unloading. 8 (6) All household goods carriers shall have 9 unlimited access to points of loading and unloading. 10Vehicles operating under this paragraph (e) shall have11access for a distance of one highway mile to or from a Class12I highway on any street or highway, unless there is a sign13prohibiting the access, or 5 highway miles to or from a Class14I or II highway on a street or highway included in the system15of State highways and upon any street or highway designated16by local authorities or road district commissioners, without17additional fees, to points of loading and unloading and to18facilities for food, fuel, repairs and rest. In addition, any19trailer or semitrailer not exceeding 28 feet 6 inches in20length, that was originally in combination with a truck21tractor, and all household goods carriers, when operating22under paragraph (e), shall have access to points of loading23and unloading.24 Section 5-35 of the Illinois Administrative Procedure Act 25 relating to procedures for rulemaking shall not apply to the 26 designation of highways under this paragraph (e). 27 (f) Mirrors required by Section 12-502 of this Code and 28 other safety devices identified by the Department may project 29 up to 14 inches beyond each side of a bus and up to 6 inches 30 beyond each side of any other vehicle, and that projection 31 shall not be deemed a violation of the width restrictions of 32 this Section. 33 (g) Any person who is convicted of violating this 34 Section is subject to the penalty as provided in paragraph HB2259 Engrossed -10- LRB9203338DHmb 1 (b) of Section 15-113. 2 (Source: P.A. 90-14, eff. 7-1-97; 91-780, eff. 6-9-00.) 3 (625 ILCS 5/15-103) (from Ch. 95 1/2, par. 15-103) 4 Sec. 15-103. Height of vehicles. The height of a vehicle 5 from the under side of the tire to the top of the vehicle, 6 inclusive of load, shall not exceed 13 feet, 6 inches on any 7 highway in the State. 8 A person convicted of violating this Section is subject 9 to the penalty provided in paragraph (b) of Section 15-113. 10 (Source: P.A. 83-831.) 11 (625 ILCS 5/15-106) (from Ch. 95 1/2, par. 15-106) 12 Sec. 15-106. Protruding members of vehicles. 13 No vehicle with boom, arm, drill rig or other protruding 14 component shall be operated upon anythehighway in this 15 State unless such protruding component is fastened so as to 16 prevent shifting, bouncing or moving in any manner. 17 (Source: P.A. 76-1586.) 18 (625 ILCS 5/15-107) (from Ch. 95 1/2, par. 15-107) 19 Sec. 15-107. Length of vehicles. 20 (a) The maximum length of a single vehicle on any 21 highway of this State may not exceed 42 feet except the 22 following: 23 (1) Semitrailers. 24 (2) Charter or regulated route buses may be up to 25 45 feet in length, not including energy absorbing 26 bumpers.Unless otherwise provided for in this Code, no27single vehicle, with or without load, other than a28semitrailer that is not a housetrailer, shall exceed an29overall length of 42 feet.30 (b) On all non-State highways, the maximum length of 31 vehicles in combinations is as follows: HB2259 Engrossed -11- LRB9203338DHmb 1 (1) A truck tractor in combination with a 2 semitrailer may not exceed 55 feet overall dimension. 3 (2) A truck tractor-semitrailer-trailer may not 4 exceed 60 feet overall dimension. 5 (3) Combinations specially designed to transport 6 motor vehicles or boats may not exceed 60 feet overall 7 dimension. 8 Vehicles operating during daylight hours when 9 transporting poles, pipes, machinery, or other objects of a 10 structural nature that cannot readily be dismembered are 11 exempt from length limitations, provided that no object may 12 exceed 80 feet in length and the overall dimension of the 13 vehicle including the load may not exceed 100 feet. This 14 exemption does not apply to operation on a Saturday, Sunday, 15 or legal holiday. Legal holidays referred to in this Section 16 are the days on which the following traditional holidays are 17 celebrated: New Year's Day; Memorial Day; Independence Day; 18 Labor Day; Thanksgiving Day; and Christmas Day. 19 Vehicles and loads operated by a public utility while en 20 route to make emergency repairs to public service facilities 21 or properties are exempt from length limitations, provided 22 that during night operations every vehicle and its load must 23 be equipped with a sufficient number of clearance lamps on 24 both sides and marker lamps on the extreme ends of any 25 projecting load to clearly mark the dimensions of the load. 26 A tow truck in combination with a disabled vehicle or 27 combination of disabled vehicles, as provided in paragraph 28 (6) of subsection (c) of this Section, is exempt from length 29 limitations. 30 All other combinations not listed in this subsection (b) 31 may not exceed 60 feet overall dimension.Subject to the32provisions of paragraph (f) and unless otherwise provided in33this Code, no truck tractor and semitrailer, unladen or with34load, except a semitrailer other than a house trailer, shallHB2259 Engrossed -12- LRB9203338DHmb 1exceed a length of 55 feet extreme overall dimension, except2that the combination when specially designed to transport3motor vehicles may have a length of 60 feet extreme overall4dimension, subject to those exceptions and special rules5otherwise stated in this Code. No other combination of6vehicles, unladen or with load, shall exceed a length of 607feet extreme overall dimension.8 (c) Combinations of vehicles may not exceed a total of 2 9 vehicles except the following: 10 (1) A truck tractor semitrailer may draw one 11 trailer. 12 (2) A truck tractor semitrailer may draw one 13 converter dolly. 14 (3) A truck tractor semitrailer may draw one 15 vehicle that is defined in Chapter 1 as special mobile 16 equipment, provided the overall dimension does not exceed 17 60 feet. 18 (4) A truck in transit may draw 3 trucks in transit 19 coupled together by the triple saddlemount method. 20 (5) Recreational vehicles consisting of 3 vehicles, 21 provided the following: 22 (A) The total overall dimension does not 23 exceed 60 feet. 24 (B) The towing vehicle is a properly 25 registered vehicle capable of towing another vehicle 26 using a fifth-wheel type assembly. 27 (C) The second vehicle in the combination of 28 vehicles is a recreational vehicle that is towed by 29 a fifth-wheel assembly. This vehicle must be 30 properly registered and must be equipped with 31 brakes, regardless of weight. 32 (D) The third vehicle must be the lightest of 33 the 3 vehicles and be a trailer or semitrailer 34 designed or used for transporting a boat, HB2259 Engrossed -13- LRB9203338DHmb 1 all-terrain vehicle, personal watercraft, or 2 motorcycle. 3 (E) The towed vehicles may be only for the use 4 of the operator of the towing vehicle. 5 (F) All vehicles must be properly equipped 6 with operating brakes and safety equipment required 7 by this Code, except the additional brake 8 requirement in subdivision (C) of this subparagraph 9 (5). 10 (6) A tow truck in combination with a disabled 11 vehicle or combination of disabled vehicles, provided the 12 towing vehicle: 13 (A) Is specifically designed as a tow truck 14 having a gross vehicle weight rating of at least 15 18,000 pounds and equipped with air brakes, provided 16 that air brakes are required only if the towing 17 vehicle is towing a vehicle, semitrailer, or 18 tractor-trailer combination that is equipped with 19 air brakes. For the purpose of this subsection, 20 gross vehicle weight rating, or GVWR, means the 21 value specified by the manufacturer as the loaded 22 weight of the tow truck. 23 (B) Is equipped with flashing, rotating, or 24 oscillating amber lights, visible for at least 500 25 feet in all directions. 26 (C) Is capable of utilizing the lighting and 27 braking systems of the disabled vehicle or 28 combination of vehicles. 29 (D) Does not engage a tow exceeding 50 highway 30 miles from the initial point of wreck or disablement 31 to a place of repair. Any additional movement of the 32 vehicles may occur only upon issuance of 33 authorization for that movement under the provisions 34 of Sections 15-301 through 15-319 of this Code. HB2259 Engrossed -14- LRB9203338DHmb 1 The Department may by rule or regulation prescribe 2 additional requirements regarding length limitations for a 3 tow truck towing another vehicle. 4 For purposes of this Section, a tow-dolly that merely 5 serves as substitute wheels for another legally licensed 6 vehicle is considered part of the licensed vehicle and not a 7 separate vehicle.A truck tractor semitrailer may draw one8trailer, or a converter dolly, or a vehicle that is special9mobile equipment if the extreme length of the combination10does not exceed 60 feet, and a truck in transit may draw 311trucks in transit coupled together by the triple saddlemount12method. Except as otherwise provided, no other combinations13of vehicles coupled together shall consist of more than 214vehicles. For the purposes of this paragraph, a tow-dolly15that merely serves as substitute wheels for another legally16licensed vehicle will be considered part of the vehicle and17not as a separate vehicle.18Vehicles in combination, whether being operated19intrastate or interstate, shall be operated and towed in20compliance with all requirements of Federal Highway21Administration, Title 49, C. F. R., Motor Carrier Safety22Regulations, pertaining to coupling devices and towing23methods and all other equipment safety requirements set forth24in the regulations.25 (d) On Class I highways there are no overall length 26 limitations on motor vehicles operating in combinations 27 provided: 28 (1) The length of a semitrailer, unladen or with 29 load, in combination with a truck tractor may not exceed 30 53 feet. 31 (2) The distance between the kingpin and the center 32 of the rear axle of a semitrailer longer than 48 feet, in 33 combination with a truck tractor, may not exceed 45 feet 34 6 inches. HB2259 Engrossed -15- LRB9203338DHmb 1 (3) The length of a semitrailer or trailer, unladen 2 or with load, operated in a truck 3 tractor-semitrailer-trailer combination, may not exceed 4 28 feet 6 inches. 5 (4) Maxi-cube combinations, as defined in Chapter 6 1, may not exceed 65 feet overall dimension. 7 (5) Combinations of vehicles specifically designed 8 to transport motor vehicles or boats may not exceed 65 9 feet overall dimension. The length limitation is 10 inclusive of front and rear bumpers but exclusive of the 11 overhang of the transported vehicles, as provided in 12 paragraph (i) of this Section. 13 (6) Stinger steered semitrailer vehicles as defined 14 in Chapter 1, specifically designed to transport motor 15 vehicles or boats, may not exceed 75 feet overall 16 dimension. The length limitation is inclusive of front 17 and rear bumpers but exclusive of the overhang of the 18 transported vehicles, as provided in paragraph (i) of 19 this Section. 20 (7) A truck in transit transporting 3 trucks 21 coupled together by the triple saddlemount method may not 22 exceed 75 feet overall dimension. 23 Vehicles operating during daylight hours when 24 transporting poles, pipes, machinery, or other objects of a 25 structural nature that cannot readily be dismembered are 26 exempt from length limitations, provided that no object may 27 exceed 80 feet in length and the overall dimension of the 28 vehicle including the load may not exceed 100 feet. This 29 exemption does not apply to operation on a Saturday, Sunday, 30 or legal holiday. Legal holidays referred to in this Section 31 are the days on which the following traditional holidays are 32 celebrated: New Year's Day; Memorial Day; Independence Day; 33 Labor Day; Thanksgiving Day; and Christmas Day. 34 Vehicles and loads operated by a public utility while en HB2259 Engrossed -16- LRB9203338DHmb 1 route to make emergency repairs to public service facilities 2 or properties are exempt from length limitations, provided 3 that during night operations every vehicle and its load must 4 be equipped with a sufficient number of clearance lamps on 5 both sides and marker lamps on the extreme ends of any 6 projecting load to clearly mark the dimensions of the load. 7 A tow truck in combination with a disabled vehicle or 8 combination of disabled vehicles, as provided in paragraph 9 (6) of subsection (c) of this Section, is exempt from length 10 limitations.Notwithstanding any other provisions of this11Code, there is no overall length limitation on motor vehicles12operating in truck tractor-semitrailer or truck13tractor-semitrailer-trailer combinations, except that14maxi-cube combinations as defined in this Section, and a15combination of vehicles specifically designed to transport16motor vehicles or boats, shall not exceed 65 feet overall17length, and provided that a stinger steered combination of18vehicles specifically designed to transport motor vehicles or19boats and a truck in transit transporting 3 trucks coupled20together by the triple saddlemount method shall not exceed 7521feet overall length, with the length limitations inclusive of22front and rear bumpers but exclusive of the overhang of the23transported vehicles as provided for in paragraph (i) of this24Section, upon the National System of Interstate and Defense25Highways or any other highways in the system of State26highways that have been designated Class I highways by the27Department or any street or highway designated by local28authorities or road district commissioners; provided that the29length of the semitrailer unit, unladen or with load,30operated in a truck tractor-semitrailer combination shall not31exceed 53 feet and the distance between the kingpin and the32center of the rear axle of a semitrailer longer than 48 feet33shall not exceed 45 feet, 6 inches; and provided that the34length of any semitrailer or trailer, unladen or with load,HB2259 Engrossed -17- LRB9203338DHmb 1operated in a truck tractor-semitrailer-trailer combination2shall not exceed 28 feet 6 inches.3 The length limitations described in this paragraph (d) 4 shall be exclusive of safety and energy conservation devices, 5 such asrear view mirrors, turn signals, marker lamps, steps6and handholds for entry and egress, flexible fender7extensions,bumpers,mudflaps and splash and spray8suppressant devices, load-induced tire bulge,refrigeration 9 units or air compressors and other devices, that the 10 Department may interpret as necessary for safe and efficient 11 operation; except that no device excluded under this 12 paragraph shall have by its design or use the capability to 13 carry cargo. 14 Vehicles operating under this paragraph (d) shall have 15 access for a distance of one highway mile to or from a Class 16 I highway on any street or highway, unless there is a sign 17 prohibiting the access, or 5 highway miles on a street or 18 highway in the system of State highways, and upon any street 19 or highway designated, without additional fees, by local 20 authorities or road district commissioners, to points of 21 loading and unloading and facilities for food, fuel, repairs 22 and rest. Household goods carriers shall have access to 23 points of loading and unloading. 24 Local access on highways under the control of county, 25 township, or municipal authorities is restricted for motor 26 vehicles and motor vehicles in combination with a gross 27 weight not exceeding 73,280 pounds, an overall length not 28 exceeding 65 feet, or a width not exceeding 102 inches, to a 29 distance of 5 highway miles from a State designated highway 30 for the purpose of loading and unloading and one highway mile 31 for food, fuel, or repairs, unless there is a sign 32 prohibiting that access. No exemption may be granted 33 authorizing travel on local roads as a thoroughfare between 34 State designated highways. HB2259 Engrossed -18- LRB9203338DHmb 1 Section 5-35 of the Illinois Administrative Procedure Act 2 relating to procedures for rulemaking shall not apply to the 3 designation of highways under this paragraph (d). 4 (e) On Class II highways there are no overall length 5 limitations on motor vehicles operating in combinations, 6 provided: 7 (1) The length of a semitrailer, unladen or with 8 load, in combination with a truck tractor, may not exceed 9 53 feet overall dimension. 10 (2) The distance between the kingpin and the center 11 of the rear axle of a semitrailer longer than 48 feet, in 12 combination with a truck tractor, may not exceed 45 feet 13 6 inches. 14 (3) A truck tractor-semitrailer-trailer combination 15 may not exceed 65 feet overall dimension. 16 (4) The length of a semitrailer or trailer, unladen 17 or with load, operated in a truck 18 tractor-semitrailer-trailer combination, may not exceed 19 28 feet 6 inches. 20 (5) Maxi-cube combinations, as defined in Chapter 21 1, may not exceed 65 feet overall dimension. 22 (6) A combination of vehicles, specifically 23 designed to transport motor vehicles or boats, may not 24 exceed 65 feet overall dimension. The length limitation 25 is inclusive of front and rear bumpers but exclusive of 26 the overhang of the transported vehicles, as provided in 27 paragraph (i) of this Section. 28 (7) Stinger steered semitrailer vehicles, as 29 defined in Chapter 1, specifically designed to transport 30 motor vehicles or boats, may not exceed 75 feet overall 31 dimension. The length limitation is inclusive of front 32 and rear bumpers but exclusive of the overhang of the 33 transported vehicles, as provided in paragraph (i) of 34 this Section. HB2259 Engrossed -19- LRB9203338DHmb 1 (8) A truck in transit transporting 3 trucks 2 coupled together by the triple saddlemount method may not 3 exceed 75 feet overall dimension. 4 Vehicles operating during daylight hours when 5 transporting poles, pipes, machinery, or other objects of a 6 structural nature that cannot readily be dismembered are 7 exempt from length limitations, provided that no object may 8 exceed 80 feet in length and the overall dimension of the 9 vehicle including the load may not exceed 100 feet. This 10 exemption does not apply to operation on a Saturday, Sunday, 11 or legal holiday. Notwithstanding any other provisions of33this Code, effective June 1, 1996 there is no overall length34limitation on motor vehicles operating in truckHB2259 Engrossed -20- LRB9203338DHmb 1tractor-semitrailer combinations operating upon designated2Class II highways, provided the length of the semitrailer3unit, unladen or with load, operated in a truck4tractor-semitrailer combination shall not exceed 53 feet and5the distance between the kingpin and the center of the rear6axle of a semitrailer longer than 48 feet shall not exceed 457feet, 6 inches. A truck tractor-semitrailer-trailer8combination may be operated provided that the wheelbase9between the front axle and rear axle shall not exceed 6510feet and the length of any semitrailer or trailer, unladen or11with load, in a combination shall not exceed 28 feet 612inches. Local authorities and road district commissioners13with respect to streets and highways under their14jurisdiction, may also by ordinance or resolution allow the15length limitations of this paragraph (e).16A maxi-cube combination, a truck in transit transporting173 trucks coupled together by the triple saddlemount method,18and a combination of vehicles specifically designed to19transport motor vehicles or boats may operate on the20designated streets or highways provided the overall length21shall not exceed 65 feet, and provided that a stinger steered22combination of vehicles specifically designed to transport23motor vehicles or boats shall not exceed 75 feet overall24length, with the length limitations inclusive of front and25rear bumpers but exclusive of the overhang of the transported26vehicles as provided for in paragraph (i) of this Section.27 The length limitations described in this paragraph (e) 28 shall be exclusive of safety and energy conservation devices, 29 such asrear view mirrors, turn signals, marker lamps, steps30and handholds for entry and egress, flexible fender31extensions,bumpers,mudflaps and splash and spray32suppressant devices, load-induced tire bulge,refrigeration 33 units or air compressors and other devices, that the 34 Department may interpret as necessary for safe and efficient HB2259 Engrossed -21- LRB9203338DHmb 1 operation; except that no device excluded under this 2 paragraph shall have by its design or use the capability to 3 carry cargo. 4 Vehicles operating under this paragraph (e) shall have 5 access for a distance of 5 highway miles on a street or 6 highway in the system of State highways, and upon any street 7 or highway designated by local authorities or road district 8 commissioners, to points of loading and unloading and to 9 facilities for food, fuel, repairs and rest. Household goods 10 carriers shall have access to points of loading and 11 unloading. 12 (1) A vehicle and load not exceeding 73,280 pounds 13 in weight is allowed access from any State designated 14 highway onto any county, township, or municipal highway 15 for a distance of 5 highway miles for the purpose of 16 loading and unloading, provided: 17 (A) The vehicle and load does not exceed 65 18 feet overall length. 19 (B) There is no sign prohibiting that access. 20 (C) The route is not being used as a 21 thoroughfare between State designated highways. 22 (2) A vehicle and load not exceeding 73,280 pounds 23 in weight is allowed access from any State designated 24 highway onto any county or township highway for a 25 distance of 5 highway miles, or any municipal highway for 26 a distance of one highway mile for the purpose of food, 27 fuel, repairs, and rest, provided: 28 (A) The vehicle and load does not exceed 65 29 feet overall length. 30 (B) There is no sign prohibiting that access. 31 (C) The route is not being used as a 32 thoroughfare between State designated highways. 33 (3) A vehicle and load not exceeding 80,000 pounds 34 in weight is allowed access from a Class I highway onto HB2259 Engrossed -22- LRB9203338DHmb 1 any street or highway for a distance of one highway mile 2 for the purpose of loading, unloading, food, fuel, 3 repairs, and rest, provided there is no sign prohibiting 4 that access. 5 (4) A vehicle and load not exceeding 80,000 pounds 6 in weight is allowed access from a Class I or Class II 7 highway onto any State highway or any locally designated 8 highway for a distance of 5 highway miles for the purpose 9 of loading, unloading, food, fuel, repairs, and rest. 10 (5) All household goods carriers shall have 11 unlimited access to points of loading and unloading. 12 Section 5-35 of the Illinois Administrative Procedure Act 13 relating to procedures for rulemaking shall not apply to the 14 designation of highways under this paragraph (e). 15 (f) On Class III and other non-designated State 16 highways, the length limitations for vehicles in combination 17 are as follows: 18 (1) Truck tractor-semitrailer combinations, must 19 comply with either a maximum 55 feet overall wheel base 20 or a maximum 65 feet extreme overall dimension. 21 (2) Semitrailers, unladen or with load, may not 22 exceed 53 feet overall dimension. 23 (3) No truck tractor-semitrailer-trailer 24 combination may exceed 60 feet extreme overall dimension. 25 (4) The distance between the kingpin and the center 26 axle of a semitrailer longer than 48 feet, in combination 27 with a truck tractor, may not exceed 42 feet 6 inches.On28any street or highway in the system of State highways29that has not been designated by the Department under30paragraph (d) or (e), the wheelbase between the front31axle and the rear axle in a truck tractor-semitrailer32combination shall not exceed 55 feet or, effective June331, 1996, no truck tractor and semitrailer, unladen or34with load, except a semitrailer other than a houseHB2259 Engrossed -23- LRB9203338DHmb 1trailer, shall exceed a length of 65 feet between extreme2overall dimensions, the length of the semitrailer,3unladen or with load, shall not exceed 53 feet and the4distance between the kingpin and the center of the rear5axle of a semitrailer longer than 48 feet 894ll not6exceed 42 feet, 6 inches. On any street or highway in the7State system of highways that has not been designated by8the Department under paragraph (d) or (e), no truck9tractor-semitrailer-trailer combination shall exceed a10length of 60 feet extreme overall dimension.11 (g) Length limitations in the preceding subsections of 12 this Section 15-107 do not apply to the following: 13 (1) Vehicles operated in the daytime, except on 14 Saturdays, Sundays, or legal holidays, when transporting 15 poles, pipe, machinery, or other objects of a structural 16 nature that cannot readily be dismembered, provided the 17 overall length of vehicle and load may not exceed 100 18 feet and no object exceeding 80 feet in length may be 19 transported unless a permit has been obtained as 20 authorized in Section 15-301. 21 (2) Vehicles and loads operated by a public utility 22 while en route to make emergency repairs to public 23 service facilities or properties, but during night 24 operation every vehicle and its load must be equipped 25 with a sufficient number of clearance lamps on both sides 26 and marker lamps upon the extreme ends of any projecting 27 load to clearly mark the dimensions of the load. 28 (3) A tow truck in combination with a disabled 29 vehicle or combination of disabled vehicles, provided the 30 towing vehicle meets the following conditions: 31 (A) It is specifically designed as a tow truck 32 having a gross vehicle weight rating of at least 33 18,000 pounds and equipped with air brakes, provided 34 that air brakes are required only if the towing HB2259 Engrossed -24- LRB9203338DHmb 1 vehicle is towing a vehicle, semitrailer, or 2 tractor-trailer combination that is equipped with 3 air brakes. 4 (B) It is equipped with flashing, rotating, or 5 oscillating amber lights, visible for at least 500 6 feet in all directions. 7 (C) It is capable of utilizing the lighting 8 and braking systems of the disabled vehicle or 9 combination of vehicles. 10 (D) It does not engage in a tow exceeding 50 11 miles from the initial point of wreck or 12 disablement. 13Length limitations in the preceding subsections of this14Section 15-107 shall not apply to vehicles operated in the15daytime, except on Saturdays, Sundays or legal holidays, when16transporting poles, pipe, machinery or other objects of a17structural nature that cannot readily be dismembered, nor to18vehicles transporting those objects operated on Saturdays,19Sundays or legal holidays or at nighttime by a public utility20when required for emergency repair of public service21facilities or properties, but in respect to the night22operation every vehicle and the load thereon shall be23equipped with a sufficient number of clearance lamps on both24sides and marker lamps upon the extreme ends of any25projecting load to clearly mark the dimensions of the load,26provided that the overall length of vehicle and load shall27not exceed 100 feet and no object exceeding 80 feet in length28shall be transported, except by a public utility when29required for emergency repairs, unless a permit has first30been obtained as authorized in Section 15-301. A combination31of vehicles, including a tow truck and a disabled vehicle or32disabled combination of vehicles, that exceeds the length33restriction imposed by this Code, may be operated on a public34highway in this State upon the following conditions:HB2259 Engrossed -25- LRB9203338DHmb 1(1) The towing vehicle must be:2a. specifically designed as a tow truck having3a gross vehicle weight rating of at least 18,0004lbs. and equipped with air brakes;5b. equipped with flashing, rotating or6oscillating amber lights, visible for a least 5007feet in all directions; and8c. capable of utilizing the lighting and9braking systems of the disabled vehicle or10combination of vehicles.11(2) The towing of vehicles on the highways of this12State shall not exceed 50 miles from the initial point of13wreck or disablement. Any additional movement of the14vehicles shall only occur upon issuance of authorization15for that movement under the provisions of Section 15-30116through 15-319 of this Chapter.17 The Department may by rule or regulation prescribe 18 additional requirements regarding length limitations for a 19 tow truck towing another vehicle. 20 For the purpose of this subsection, gross vehicle weight 21 rating, or GVWR, shall mean the value specified by the 22 manufacturer as the loaded weight of the tow truck. Legal 23 holidays referred to in this Section shall be specified as 24 the day on which the following traditional holidays are 25 celebrated: 26 New Year's Day; 27 Memorial Day; 28 Independence Day; 29 Labor Day; 30 Thanksgiving Day; and 31 Christmas Day. 32 (h) The load upon any vehicle operated alone, or the 33 load upon the front vehicle of a combination of vehicles, 34 shall not extend more than 3 feet beyond the front wheels of HB2259 Engrossed -26- LRB9203338DHmb 1 the vehicle or the front bumper of the vehicle if it is 2 equipped with a front bumper. The provisions of this 3 subsection (h) shall not apply to any vehicle or combination 4 of vehicles specifically designed for the collection and 5 transportation of waste, garbage, or recyclable materials 6 during the vehicle's operation in the course of collecting 7 garbage, waste, or recyclable materials if the vehicle is 8 traveling at a speed not in excess of 15 miles per hour 9 during the vehicle's operation and in the course of 10 collecting garbage, waste, or recyclable materials. However, 11 in no instance shall the load extend more than 7 feet beyond 12 the front wheels of the vehicle or the front bumper of the 13 vehicle if it is equipped with a front bumper. 14 (i) The load upon the front vehicle of a combination of 15 vehicles specifically designed to transport motor vehicles 16 shall not extend more than 3 feet beyond the foremost part of 17 the transporting vehicle and the load upon the rear 18 transporting vehicle shall not extend more than 4 feet beyond 19 the rear of the bed or body of the vehicle. This paragraph 20 shall only be applicable upon highways designated in 21 paragraphs (d) and (e) of this Section. 22 (j) Articulated vehicles comprised of 2 sections, 23 neither of which exceeds a length of 42 feet, designed for 24 the carrying of more than 10 persons, may be up to 60 feet in 25 length, not including energy absorbing bumpers, provided that 26 the vehicles are: 27 1. operated by or for any public body or motor 28 carrier authorized by law to provide public 29 transportation services; or 30 2. operated in local public transportation service 31 by any other person and the municipality in which the 32 service is to be provided approved the operation of the 33 vehicle. 34 (j-1) (Blank).Charter or regulated route buses may beHB2259 Engrossed -27- LRB9203338DHmb 1up to 45 feet in length, not including energy absorbing2bumpers.3 (k) Any person who is convicted of violating this 4 Section is subject to the penalty as provided in paragraph 5 (b) of Section 15-113. 6 (l) (Blank).A combination of 3 vehicles not to exceed760 feet overall length may be operated on the highways of the8State, provided that the vehicles meet the following9requirements:10(1) The towing vehicle is a properly registered11vehicle capable of towing another vehicle using a12fifth-wheel type assembly.13(2) The second vehicle in the combination of14vehicles shall be a recreational vehicle that is towed by15a fifth-wheel assembly. This vehicle shall be properly16registered and be equipped with brakes regardless of17weight.18(3) The third vehicle shall be the lightest of the193 vehicles and be a trailer or semi-trailer designed or20used for transporting a boat, all-terrain vehicle,21personal watercraft, or motorcycle.22(4) The towed vehicles may only be for the use of23the operator of the towing vehicle.24(5) All vehicles shall be properly equipped with25operating brakes and safety equipment required by this26Code, except the additional brake requirement in27paragraph (2) above.28 (Source: P.A. 89-219, eff. 1-1-96; 89-434, eff. 6-1-96; 29 89-626, eff. 8-9-96; 90-89, eff. 1-1-98; 90-147, eff. 30 7-23-97; 90-407, eff. 8-15-97; 90-655, eff. 7-30-98.) 31 (625 ILCS 5/15-111) (from Ch. 95 1/2, par. 15-111) 32 Sec. 15-111. Wheel and axle loads and gross weights. 33 (a) On non-designated highways, no vehicle or HB2259 Engrossed -28- LRB9203338DHmb 1 combination of vehicles equipped with pneumatic tires may be 2 operated, unladen or with load, when the total weight 3 transmitted to the road surface exceeds 18,000 pounds on a 4 single axle or 32,000 pounds on a tandem axle with no axle 5 within the tandem exceeding 18,000 pounds except: 6 (1) when a different limit is established and 7 posted in accordance with Section 15-316 of this Code; 8 (2) vehicles for which the Department of 9 Transportation and local authorities issue overweight 10 permits under authority of Section 15-301 of this Code; 11 (3) tow trucks subject to the conditions provided 12 in subsection (d) may not exceed 24,000 pounds on a 13 single rear axle or 44,000 pounds on a tandem rear axle; 14 (4) any single axle of a 2-axle truck weighing 15 36,000 pounds or less and not a part of a combination of 16 vehicles, shall not exceed 20,000 pounds; 17 (5) any single axle of a 2-axle truck equipped with 18 a personnel lift or digger derrick, weighing 36,000 19 pounds or less, owned and operated by a public utility, 20 shall not exceed 20,000 pounds; 21 (6) any single axle of a 2-axle truck specially 22 equipped with a front loading compactor used exclusively 23 for garbage, refuse, or recycling may not exceed 20,000 24 pounds per axle, provided that the gross weight of the 25 vehicle does not exceed 40,000 pounds; 26 (7) a truck, not in combination and specially 27 equipped with a selfcompactor or an industrial roll-off 28 hoist and roll-off container, used exclusively for 29 garbage or refuse operations may, when laden, transmit 30 upon the road surface the following maximum weights: 31 22,000 pounds on a single axle; 40,000 pounds on a tandem 32 axle; 33 (8) a truck, not in combination and used 34 exclusively for the collection of rendering materials, HB2259 Engrossed -29- LRB9203338DHmb 1 may, when laden, transmit upon the road surface the 2 following maximum weights: 22,000 pounds on a single 3 axle; 40,000 pounds on a tandem axle; 4 (9) tandem axles on a 3-axle truck registered as a 5 Special Hauling Vehicle, manufactured prior to or in the 6 model year of 2004 and first registered in Illinois prior 7 to January 1, 2005, with a distance greater than 72 8 inches but not more than 96 inches between any series of 9 2 axles, is allowed a combined weight on the series not 10 to exceed 36,000 pounds and neither axle of the series 11 may exceed 18,000 pounds. Any vehicle of this type 12 manufactured after the model year of 2004 or first 13 registered in Illinois after December 31, 2004 may not 14 exceed a combined weight of 32,000 pounds through the 15 series of 2 axles and neither axle of the series may 16 exceed 18,000 pounds; 17 (10) tandem axles on a 4-axle truck mixer, whose 18 fourth axle is a road surface engaging mixer trailing 19 axle, registered as a Special Hauling Vehicle, used 20 exclusively for the mixing and transportation of concrete 21 and manufactured prior to or in the model year of 2004 22 and first registered in Illinois prior to January 1, 23 2005, with a distance greater than 72 inches but not more 24 than 96 inches between any series of 2 axles, is allowed 25 a combined weight on the series not to exceed 36,000 26 pounds and neither axle of the series may exceed 18,000 27 pounds. Any vehicle of this type manufactured after the 28 model year of 2004 or first registered in Illinois after 29 December 31, 2004 may not exceed a combined weight of 30 32,000 pounds through the series of 2 axles and neither 31 axle of the series may exceed 18,000 pounds; 32 (11) 4-axle vehicles or a 5 or more axle 33 combination of vehicles: The weight transmitted upon the 34 road surface through any series of 3 axles whose centers HB2259 Engrossed -30- LRB9203338DHmb 1 are more than 96 inches apart, measured between extreme 2 axles in the series, may not exceed those allowed in the 3 table contained in subsection (f) of this Section. No 4 axle or tandem axle of the series may exceed the maximum 5 weight permitted under this Section for a single or 6 tandem axle. 7 No vehicle or combination of vehicles equipped with other 8 than pneumatic tires may be operated, unladen or with load, 9 upon the highways of this State when the gross weight on the 10 road surface through any wheel exceeds 800 pounds per inch 11 width of tire tread or when the gross weight on the road 12 surface through any axle exceeds 16,000 pounds.No vehicle or13combination of vehicles equipped with pneumatic tires shall14be operated, unladen or with load, upon the highways of this15State when the gross weight on the road surface through any16single axle thereof exceeds 18,000 pounds, except when a17different limit is established and posted in accordance with18Section 15-316 and except any single axle of a 2 axle motor19vehicle weighing 36,000 pounds or less and not a part of a20combination of vehicles, shall not exceed 20,000 pounds.21Provided, however, that any single axle of a 2 axle motor22vehicle equipped with a personnel lift or digger derrick,23weighing 36,000 pounds or less, owned and operated by a24public utility, shall not exceed 20,000 pounds. No vehicle25or combination of vehicles equipped with other than pneumatic26tires shall be operated, unladen or with load, upon the27highways of this State when the gross weight on the road28surface through any wheel thereof exceeds 800 pounds per inch29width of tire tread or when the gross weight on the road30surface through any axle thereof exceeds 16,000 pounds. The31gross weight transmitted to the road surface through tandem32axles shall not exceed 32,000 pounds and no axle of the33series shall exceed the maximum weight permitted under this34Section for a single axle. Provided that on a 4 axle vehicleHB2259 Engrossed -31- LRB9203338DHmb 1or on a 5 or more axle combination of vehicles the weight on2a series of 3 axles whose centers are more than 96 inches3apart, measured between extreme axles in the series, shall4not exceed those allowed on 3 axles in the table contained in5subsection (f) of this Section and no axle or tandem axle of6the series shall exceed the maximum weight permitted under7this Section for a single or tandem axle. Provided also that8a 3 axle vehicle or 3 axle truck mixer registered as a9Special Hauling Vehicle, used exclusively for the mixing and10transportation of concrete, specially equipped with a road11surface engaging mixer trailing 4th axle, manufactured12prior to or in the model year of 2004 and first registered in13Illinois prior to January 1, 2005, with a distance greater14than 72 inches but not more than 96 inches between any series15of 2 axles may transmit to the road surface a maximum weight16of 18,000 pounds on each of these axles with a gross weight17on these 2 axles not to exceed 36,000 pounds. Any such18vehicle manufactured in the model year of 2004 or thereafter19or first registered in Illinois after December 31, 2004 may20transmit to the road surface a maximum of 32,000 pounds21through these 2 axles and none of the axles shall exceed2218,000 pounds.23A truck, not in combination and specially equipped with a24selfcompactor, or an industrial roll-off hoist and roll-off25container, used exclusively for garbage or refuse operations,26and a truck used exclusively for the collection of rendering27materials may, however, when laden, transmit upon the road28surface of any highway except when part of the National29System of Interstate and Defense Highways, a gross weight30upon a single axle not more than 22,000 pounds, and upon a31tandem axle not more than 40,000 pounds. During the towing operation, 26 neither the tow truck nor the vehicle combination shall 27 exceed 24,000 pounds on a single rear axle and 44,000 pounds 28 on a tandem rear axle, provided the towing vehiclethe29following axle weight limitations: 30 (1) is specifically designed as a tow truck having 31 a gross vehicle weight rating of at least 18,000 pounds 32 and is equipped with air brakes, provided that air brakes 33 are required only if the towing vehicle is towing a HB2259 Engrossed -35- LRB9203338DHmb 1 vehicle, semitrailer, or tractor-trailer combination that 2 is equipped with air brakes; 3 (2) is equipped with flashing, rotating, or 4 oscillating amber lights, visible for at least 500 feet 5 in all directions; 6 (3) is capable of utilizing the lighting and 7 braking systems of the disabled vehicle or combination of 8 vehicles; and 9 (4) does not engage in a tow exceeding 20 miles 10 from the initial point of wreck or disablement. Any 11 additional movement of the vehicles may occur only upon 12 issuance of authorization for that movement under the 13 provisions of Sections 15-301 through 15-319 of this 14 Code. 15A. 24,000 pounds - Single rear axle;16B. 44,000 pounds - Tandem rear axle;17 Gross weight limits shall not apply to the combination of 18 the tow truck and vehicles being towed. The tow truck 19 license plate must cover the operating empty weight of the 20 tow truck only. The weight of each vehicle being towed shall 21 be covered by a valid license plate issued to the owner or 22 operator of the vehicle being towed and displayed on that 23 vehicle. If no valid plate issued to the owner or operator of 24 that vehicle is displayed on that vehicle, or the plate 25 displayed on that vehicle does not cover the weight of the 26 vehicle, the weight of the vehicle shall be covered by the 27 third tow truck plate issued to the owner or operator of the 28 tow truck and temporarily affixed to the vehicle being towed. 29In addition, the following conditions must be met:30(1) the towing vehicle must be:31a. specifically designed as a tow truck having32a gross vehicle weight rating of at least 18,00033lbs. and equipped with air brakes provided that air34brakes shall be required only if the towing vehicleHB2259 Engrossed -36- LRB9203338DHmb 1is towing a vehicle, semitrailer, or tractor-trailer2combination that is equipped with airbrakes;3b. equipped with flashing, rotating or4oscillating amber lights, visible for at least 5005feet in all directions; and6c. capable of utilizing the lighting and7braking systems of the disabled vehicle or8combination of vehicles.9(2) The towing of the vehicles on the highways of10this State shall not exceed 20 miles from the initial11point of wreck or disablement. Any additional movement of12the vehicles shall only occur upon issuance of13authorization for that movement under the provisions of14Sections 15-301 through 15-319 of this Chapter.15 The Department may by rule or regulation prescribe 16 additional requirements. However, nothing in this Code shall 17 prohibit a tow truck under instructions of a police officer 18 from legally clearing a disabled vehicle, that may be in 19 violation of weight limitations of this Chapter, from the 20 roadway to the berm or shoulder of the highway. If in the 21 opinion of the police officer that location is unsafe, the 22 officer is authorized to have the disabled vehicle towed to 23 the nearest place of safety. 24 For the purpose of this subsection, gross vehicle weight 25 rating, or GVWR, shall mean the value specified by the 26 manufacturer as the loaded weight of the tow truck. 27 (e) No vehicle or combination of vehicles equipped with 28 pneumatic tires shall be operated, unladen or with load, upon 29 the highways of this State in violation of the provisions of 30 any permit issued under the provisions of Sections 15-301 31 through 15-319 of this Chapter. 32 (f) On designated Class I, II, or III highways and the 33 National System of Interstate and Defense Highways, no 34 vehicle or combination of vehicles with pneumatic tires may HB2259 Engrossed -37- LRB9203338DHmb 1 be operated, unladen or with load, when the total weight on 2 the road surface exceeds the following: 20,000 pounds on a 3 single axle; 34,000 pounds on a tandem axle with no axle 4 within the tandem exceeding 20,000 pounds; 80,000 pounds 5 gross weight for vehicle combinations of 5 or more axles; or 6 a total weight on a group of 2 or more consecutive axles in 7 excess of that weight produced by the application of the 8 following formula: W = 500 times the sum of (LN divided by 9 N-1) + 12N + 36, where "W" equals overall total weight on any 10 group of 2 or more consecutive axles to the nearest 500 11 pounds, "L" equals the distance measured to the nearest foot 12 between extremes of any group of 2 or more consecutive axles, 13 and "N" equals the number of axles in the group under 14 consideration.Notwithstanding any other provision in this15Code, except for those provisions of subsection (d) of this16Section relating to emergency operations of public utilities17and tow trucks while actually engaged in the towing of a18disabled vehicle, and those vehicles for which the Department19issues overweight permits under authority of Section 15-30120of this Code, the weight limitations contained in this21subsection shall apply to the National System of Interstate22and Defense Highways and other highways in the system of23State highways that have been designated by the Department as24Class I, II, or III. No vehicle shall be operated on the25highways with a weight in excess of 20,000 pounds carried on26any one axle or with a tandem axle weight in excess of 34,00027pounds, or a gross weight in excess of 80,000 pounds for28vehicle combinations of 5 axles or more, or a gross weight on29a group of 2 or more consecutive axles in excess of that30weight produced by the application of the following formula:31W = 500 times the sum of (LN divided by N-1) + 12N + 3632Where "W" equals overall gross weight on any group of 2 or33more consecutive axles to the nearest 500 pounds; "L" equals34the distance measured to the nearest foot between extremes ofHB2259 Engrossed -38- LRB9203338DHmb 1any group of 2 or more consecutive axles; and "N" equals the2number of axles in the group under consideration, except that32 consecutive sets of tandem axles may carry a gross load of434,000 pounds each, provided the overall distance between the5first and last axles of the consecutive sets of tandem axles6is 36 feet or more. Provided also that a 3-axle vehicle7registered as a Special Hauling Vehicle manufactured prior to8or in the model year of 2004, and first registered in9Illinois prior to January 1, 2005, with a distance greater10than 72 inches but not more than 96 inches between the 2 rear11axles may transmit to the road surface a maximum weight of1218,000 pounds on each of the 2 rear axles with a gross weight13on these 2 axles not to exceed 36,000 pounds. Any vehicle14registered as a Special Hauling Vehicle manufactured prior to15or in the model year of 2004 or thereafter or first16registered in Illinois after December 31, 2004, may transmit17to the subsection (f) 22 for 4 axles measured between the extreme axles of the 23 vehicle. 24 Vehicles in a combination having more than 6 axles may 25 not exceed the weight in the table in this subsection (f) for 26 6 axles measured between the extreme axles of the 27 combination. 28In applying the above formula to a vehicle having more29than 4 axles that is not a combination, only 4 axles shall be30considered in determining the maximum gross weight, and for a31combination of vehicles having more than 6 axles, only 632axles shall be considered in determining the maximum gross33weight.34Notwithstanding the above table, 2 consecutive sets ofHB2259 Engrossed -41- LRB9203338DHmb 1tandem axles may carry a gross weight of 34,000 pounds each2if the overall distance between the first and last axles of3the consecutive sets of tandem axles is 36 feet or more.4 Local authorities and road district highway 5 commissioners, with respect to streets and highways under 6 their jurisdiction, without additional fees, may also by 7 ordinance or resolution allow the weight limitations of this 8 subsection, provided the maximum gross weight on any one axle 9 shall not exceed 20,000 pounds and the maximum totalgross10 weight on any tandem axle shall not exceed 34,000 pounds, on 11 designated highways when appropriate regulatory signs giving 12 notice are erected upon the street or highway or portion of 13 any street or highway affected by the ordinance or 14 resolution. 15 The following are exceptions to the above formula: 16 (1) Two consecutive sets of tandem axles may carry 17 a total weight of 34,000 pounds each if the overall 18 distance between the first and last axles of the 19 consecutive sets of tandem axles is 36 feet or more. 20 (2) Vehicles for which a different limit is 21 established and posted in accordance with Section 15-316 22 of this Code. 23 (3) Vehicles for which the Department of 24 Transportation and local authorities issue overweight 25 permits under authority of Section 15-301 of this Code. 26 These vehicles are not subject to the bridge formula. 27 (4) Tow trucks subject to the conditions provided 28 in subsection (d) may not exceed 24,000 pounds on a 29 single rear axle or 44,000 pounds on a tandem rear axle. 30 (5) A tandem axle on a 3-axle truck registered as a 31 Special Hauling Vehicle, manufactured prior to or in the 32 model year of 2004, and registered in Illinois prior to 33 January 1, 2005, with a distance between 2 axles in a 34 series greater than 72 inches but not more than 96 inches HB2259 Engrossed -42- LRB9203338DHmb 1 may not exceed a total weight of 36,000 pounds and 2 neither axle of the series may exceed 18,000 pounds. 3 (6) A truck not in combination, equipped with a 4 self compactor or an industrial roll-off hoist and 5 roll-off container, used exclusively for garbage or 6 refuse operations, may, when laden, transmit upon the 7 road surface, except when on part of the National System 8 of Interstate and Defense Highways, the following maximum 9 weights: 22,000 pounds on a single axle; 40,000 pounds on 10 a tandem axle; 36,000 pounds gross weight on a 2-axle 11 vehicle; 54,000 pounds gross weight on a 3-axle vehicle. 12 This vehicle is not subject to the bridge formula. 13 (7) Combinations of vehicles, registered as Special 14 Hauling Vehicles that include a semitrailer manufactured 15 prior to or in the model year of 2004, and registered in 16 Illinois prior to January 1, 2005, having 5 axles with a 17 distance of 42 feet or less between extreme axles, may 18 not exceed the following maximum weights: 18,000 pounds 19 on a single axle; 32,000 pounds on a tandem axle; and 20 72,000 pounds gross weight. This combination of vehicles 21 is not subject to the bridge formula. For all those 22 combinations of vehicles that include a semitrailer 23 manufactured after the effective date of this amendatory 24 Act of the 92nd General Assembly, the overall distance 25 between the first and last axles of the 2 sets of tandems 26 must be 18 feet 6 inches or more. Any combination of 27 vehicles that has had its cargo container replaced in its 28 entirety after December 31, 2004 may not exceed the 29 weights allowed by the bridge formula. 30 No vehicle or combination of vehicles equipped with other 31 than pneumatic tires may be operated, unladen or with load, 32 upon the highways of this State when the gross weight on the 33 road surface through any wheel exceeds 800 pounds per inch 34 width of tire tread or when the gross weight on the road HB2259 Engrossed -43- LRB9203338DHmb 1 surface through any axle exceeds 16,000 pounds. 2Combinations of vehicles, registered as Special Hauling3Vehicles that include a semitrailer manufactured prior to or4in the model year of 2004, and first registered in Illinois5prior to January 1, 2005, having 5 axles with a distance of642 feet or less between extreme axles shall be limited to the7weights prescribed in subsections (a) and (b) of this Section8and not subject to the bridge formula on the National System9of Interstate and Defense Highways and other highways in the10system of State highways designated by the Department. For11all those combinations of vehicles, that include a12semitrailer manufactured after the effective date of this13amendatory Act of 1986, the overall distance between the14first and last axles of the 2 sets of tandems must be 18 feet156 inches or more. All combinations of vehicles registered as16Special Hauling Vehicles that include a semitrailer17manufactured prior to or in the model year of 2004 or18thereafter or first registered in Illinois after December 31,192004, or that has had its cargo container replaced in its20entirety after December 31, 2004, are limited to the gross21weight allowed by the above formula.22A truck not in combination, equipped with a self23compactor or an industrial roll-off hoist and roll-off24container, used exclusively for garbage or refuse operations,25shall be allowed the weights as prescribed in subsections (a)26and (b) of this Section and not subject to the bridge27formula, provided they are not operated on a highway that is28part of the Interstate and Defense Highway System.29 Vehicles operating under this subsection shall have 30 access for a distance of one highway mile to or from a Class 31 I highway on any street or highway, unless there is a sign 32 prohibiting the access, or 5 highway miles to or from either 33 a Class I, II, or III highway on a street or highway included 34 in the system of State highways and upon any street or HB2259 Engrossed -44- LRB9203338DHmb 1 highway designated by local authorities or road district 2 commissioners to points of loading and unloading and to 3 facilities for food, fuel, repairs and rest. 4 (1) A vehicle and load not exceeding 73,280 pounds 5 in weight is allowed access from any State designated 6 highway onto any county, township, or municipal highway 7 for a distance of 5 highway miles for the purpose of 8 loading and unloading, provided: 9 (A) The vehicle and load does not exceed 65 10 feet overall length. 11 (B) There is no sign prohibiting that access. 12 (C) The route is not being used as a 13 thoroughfare between State designated highways. 14 (2) A vehicle and load not exceeding 73,280 pounds 15 in weight is allowed access from any State designated 16 highway onto any county or township highway for a 17 distance of 5 highway miles, or any municipal highway for 18 a distance of one highway mile for the purpose of food, 19 fuel, repairs, and rest, provided: 20 (A) The vehicle and load does not exceed 65 21 feet overall length. 22 (B) There is no sign prohibiting that access. 23 (C) The route is not being used as a 24 thoroughfare between State designated highways. 25 (3) A vehicle and load not exceeding 80,000 pounds 26 in weight is allowed access from a Class I highway onto 27 any street or highway for a distance of one highway mile 28 for the purpose of loading, unloading, food, fuel, 29 repairs, and rest, provided there is no sign prohibiting 30 that access. 31 (4) A vehicle and load not exceeding 80,000 pounds 32 in weight is allowed access from a Class I, Class II, or 33 Class III highway onto any State highway or any locally 34 designated highway for a distance of 5 highway miles for HB2259 Engrossed -45- LRB9203338DHmb 1 the purpose of loading, unloading, food, fuel, repairs, 2 and rest. 3 Section 5-35 of the Illinois Administrative Procedure Act 4 relating to procedures for rulemaking shall not apply to the 5 designation of highways under this subsection. 6 (g) No person shall operate a vehicle or combination of 7 vehicles over a bridge or other elevated structure 8 constituting part of a highway with a gross weight that is 9 greater than the maximum weight permitted by the Department, 10 when the structure is sign posted as provided in this 11 Section. 12 (h) The Department upon request from any local authority 13 shall, or upon its own initiative may, conduct an 14 investigation of any bridge or other elevated structure 15 constituting a part of a highway, and if it finds that the 16 structure cannot with safety to itself withstand the weight 17 of vehicles otherwise permissible under this Code the 18 Department shall determine and declare the maximum weight of 19 vehicles that the structures can withstand, and shall cause 20 or permit suitable signs stating maximum weight to be erected 21 and maintained before each end of the structure. No person 22 shall operate a vehicle or combination of vehicles over any 23 structure with a gross weight that is greater than the posted 24 maximum weight. 25 (i) Upon the trial of any person charged with a 26 violation of subsections (g) or (h) of this Section, proof of 27 the determination of the maximum allowable weight by the 28 Department and the existence of the signs, constitutes 29 conclusive evidence of the maximum weight that can be 30 maintained with safety to the bridge or structure. 31 (Source: P.A. 89-117, eff. 7-7-95; 89-433, eff. 12-15-95; 32 90-89, eff. 1-1-98; 90-330, eff. 8-8-97; 90-655, eff. 33 7-30-98.) Officers to weigh vehicles and require 3 removal of excess loads. 4 (a) Any police officer having reason to believe that the 5 weight of a vehicle and load is unlawful shall require the 6 driver to stop and submit to a weighing of the same either by 7 means of a portable or stationary scales that have been 8 tested and approved at a frequency prescribed by the Illinois 9 Department of Agriculture, or for those scales operated by 10 the State, when such tests are requested by the Department of 11 State Police, whichever is more frequent. If such scales are 12 not available at the place where such vehicle is stopped, the 13 police officer shall require that such vehicle be driven to 14 the nearest available scale that has been tested and approved 15 pursuant to this Section by the Illinois Department of 16 Agriculture. Notwithstanding any provisions of the Weights 17 and Measures Act or the United States Department of Commerce 18 NIST handbook 44, multi or single draft weighing is an 19 acceptable method of weighing by law enforcement for 20 determining a violation of Chapter 3 or 15 of this Code. Law 21 enforcement is exempt from the requirements of commercial 22 weighing established in NIST handbook 44. 23 Within 18 months after the effective date of this 24 amendatory Act of the 91st General Assembly, all municipal 25 and county officers, technicians, and employees who set up 26 and operate portable scales for wheel load or axle load or 27 both and issue citations based on the use of portable scales 28 for wheel load or axle load or both and who have not 29 successfully completed initial classroom and field training 30 regarding the set up and operation of portable scales, shall 31 attend and successfully complete initial classroom and field 32 training administered by the Illinois Law Enforcement 33 Training Standards Board. 34 (b) Whenever an officer, upon weighing a vehicle and the HB2259 Engrossed -47- LRB9203338DHmb 1 load, determines that the weight is unlawful, such officer 2 shall require the driver to stop the vehicle in a suitable 3 place and remain standing until such portion of the load is 4 removed as may be necessary to reduce the weight of the 5 vehicle to the limit permitted under this Chapter, or to the 6 limit permitted under the terms of a permit issued pursuant 7 to Sections 15-301 through 15-318 and shall forthwith arrest 8 the driver or owner. All material so unloaded shall be cared 9 for by the owner or operator of the vehicle at the risk of 10 such owner or operator; however, whenever a 3 or 4 axle 11 vehicle with a tandem axle dimension greater than 72 inches, 12 but less than 96 inches and registered as a Special Hauling 13 Vehicle is transporting asphalt or concrete in the plastic 14 state that exceeds axle weight or gross weight limits by less 15 than 4,000 pounds, the owner or operator of the vehicle shall 16 accept the arrest ticket or tickets for the alleged 17 violations under this Section and proceed without shifting or 18 reducing the load being transported or may shift or reduce 19 the load under the provisions of subsection (d) or (e) of 20 this Section, when applicable. Any fine imposed following an 21 overweight violation by a vehicle registered as a Special 22 Hauling Vehicle transporting asphalt or concrete in the 23 plastic state shall be paid as provided in subsection 4 of 24 paragraph (a) of Section 16-105 of this Code. 25 (c) The Department of Transportation may, at the request 26 of the Department of State Police, erect appropriate 27 regulatory signs on any State highway directing second 28 division vehicles to a scale. The Department of 29 Transportation may also, at the direction of any State Police 30 officer, erect portable regulating signs on any highway 31 directing second division vehicles to a portable scale. 32 Every such vehicle, pursuant to such sign, shall stop and be 33 weighed. 34 (d) Whenever any axle load of a vehicle exceeds the axle HB2259 Engrossed -48- LRB9203338DHmb 1 or tandem axle weight limits permitted by paragraph (a) or 2 (f) of Section 15-111 by 2000 pounds or less, the owner or 3 operator of the vehicle must shift or remove the excess so as 4 to comply with paragraph (a) or (f) of Section 15-111. No 5 overweight arrest ticket shall be issued to the owner or 6 operator of the vehicle by any officer if the excessgross7 weight is shifted or removed as required by this paragraph. 8 (e) Whenever the gross weight of a vehicle with a 9 registered gross weight of 73,280 pounds or less exceeds the 10 weight limits of paragraph (b) or (f) of Section 15-111 of 11 this Chapter by 2000 pounds or less, the owner or operator of 12 the vehicle must remove the excess. Whenever the gross weight 13 of a vehicle with a registered gross weight of 73,281 pounds 14 or more exceeds the weight limits of paragraph (b) or (f) of 15 Section 15-111 by 1,000 pounds or less or 2,000 pounds or 16 less if weighed on wheel load weighers, the owner or operator 17 of the vehicle must remove the excess. In either case no 18 arrest ticket for any overweight violation of this Code shall 19 be issued to the owner or operator of the vehicle by any 20 officer if the excess weight is removed as required by this 21 paragraph. A person who has been granted a special permit 22 under Section 15-301 of this Code shall not be granted a 23 tolerance on wheel load weighers. 24 (f) Whenever an axle load of a vehicle exceeds axle 25 weight limits allowed by the provisions of a permit an arrest 26 ticket shall be issued, but the owner or operator of the 27 vehicle may shift the load so as to comply with the 28 provisions of the permit. Where such shifting of a load to 29 comply with the permit is accomplished, the owner or operator 30 of the vehicle may then proceed. 31 (g) Any driver of a vehicle who refuses to stop and 32 submit his vehicle and load to weighing after being directed 33 to do so by an officer or removes or causes the removal of 34 the load or part of it prior to weighing is guilty of a HB2259 Engrossed -49- LRB9203338DHmb 1 business offense and shall be fined not less than $500 nor 2 more than $2,000. 3 (Source: P.A. 91-129, eff. 7-16-99.) 4 (625 ILCS 5/15-316) (from Ch. 95 1/2, par. 15-316) 5 Sec. 15-316. When the Department, local authority or road 6 district highway commissioner may restrict right to use 7 highways. 8 (a) Local authorities and road district highway 9 commissioners with respect to highways under their 10 jurisdiction may by ordinance or resolution prohibit the 11 operation of vehicles upon any such highway or impose 12 restrictions as to the weight of vehicles to be operated upon 13 any such highway, for a total period of not to exceed 90 days 14 in any one calendar year, whenever any said highway by reason 15 of deterioration, rain, snow, or other climate conditions 16 will be seriously damaged or destroyed unless the use of 17 vehicles thereon is prohibited or the permissible weights 18 thereof reduced. 19 (b) The local authority or road district highway 20 commissioner enacting any such ordinance or resolution shall 21 erect or cause to be erected and maintained signs designating 22 the provision of the ordinance or resolution at each end of 23 that portion of any highway affected thereby, and the 24 ordinance or resolution shall not be effective unless and 25 until such signs are erected and maintained. 26 (c) Local authorities and road district highway 27 commissioners with respect to highways under their 28 jurisdiction may also, by ordinance or resolution, prohibit 29 the operation of trucks or other commercial vehicles, or may 30 impose limitations as the weight thereof, on designated 31 highways, which prohibitions and limitations shall be 32 designated by appropriate signs placed on such highways. 33 (c-1) (Blank)The weight provisions of subsections (a),HB2259 Engrossed -50- LRB9203338DHmb 1(b), and (c) take precedence over the provisions of2subsections (d-1) and (d-2). 3 (d) The Department shall likewise have authority as 4 hereinbefore granted to local authorities and road district 5 highway commissioners to determine by resolution and to 6 impose restrictions as to the weight of vehicles operated 7 upon any highway under the jurisdiction of said department, 8 and such restrictions shall be effective when signs giving 9 notice thereof are erected upon the highway or portion of any 10 highway affected by such resolution. 11 (d-1) (Blank)Motor vehicles and motor vehicles in12combination with gross weights not exceeding 73,280 pounds13and up to 65 feet in overall length and 102 inches in width14operating on highways under the control of a county or15township road district highway commissioner may have access16for a distance of 5 miles from a State designated highway for17the purpose of loading, unloading, services, and home base.18No exemption shall be granted authorizing travel on local19roads as a thoroughfare between State designated highways. 20 (d-2) (Blank)Motor vehicles and motor vehicles in21combination with gross weights not exceeding 73,280 pounds22and up to 65 feet in overall length and 102 inches in width23operating on highways under the control of municipal24authorities may have access for 5 miles from a State25designated highway for the purpose of loading and unloading26and one mile for food, fuel, repairs, and rest on those27municipally controlled highways. No exemption shall be28granted authorizing travel on municipal roads as a29thoroughfare between State designated highways. 30 (e) When any vehicle is operated in violation of this 31 Section, the owner or driver of the vehicle shall be deemed 32 guilty of a violation and either the owner or the driver of 33 the vehicle may be prosecuted for the violation. Any person, 34 firm, or corporation convicted of violating this Section HB2259 Engrossed -51- LRB9203338DHmb 1 shall be fined $50 for any weight exceeding the posted limit 2 up to the axle or gross weight limit allowed a vehicle as 3 provided for in subsections (a) or (b) of Section 15-111 and 4 $75 per every 500 pounds or fraction thereof for any weight 5 exceeding that which is provided for in subsections (a) or 6 (b) of Section 15-111. 7 (f) A municipality is authorized to enforce a county 8 weight limit ordinance applying to county highways within its 9 corporate limits and is entitled to the proceeds of any fines 10 collected from the enforcement. 11 (Source: P.A. 89-117, eff. 7-7-95; 89-687, eff. 6-1-97; 12 90-211, eff. 1-1-98.)
