91_SB0556 LRB9102361NTsbA 1 AN ACT concerning education, amending named Acts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The State Finance Act is amended by adding 5 Section 5.490 as follows: 6 (30 ILCS 105/5.490 new) 7 Sec. 5.490. The State Teacher Professional Development 8 Fund. 9 Section 10. The School Code is amended by adding Section 10 2-3.11c and by changing Sections 3-12, 21-1b, 21-1c, 21-2, 11 21-7.1, 21-9, 21-11.3, 21-11.4, 21-12, 21-14, 21-16, 21-17, 12 21-21, 21-25, and 34-83 as follows: 13 (105 ILCS 5/2-3.11c new) 14 Sec. 2-3.11c. Teacher supply and demand report. To 15 report annually, on or before January 1, on the relative 16 supply and demand for education staff of the public schools 17 to the Governor, to the General Assembly, and to institutions 18 of higher education that prepare teachers, administrators, 19 school service personnel, other certificated individuals, and 20 other professionals employed by school districts or joint 21 agreements. The report shall contain the following 22 information: 23 (1) the relative supply and demand for teachers, 24 administrators, and other certificated and 25 non-certificated personnel by field, content area, and 26 levels; 27 (2) State and regional analyses of fields, content 28 areas, and levels with an over-supply or under-supply of 29 educators; and -2- LRB9102361NTsbA 1 (3) projections of likely high demand and low 2 demand for educators, in a manner sufficient to advise 3 the public, individuals, and institutions regarding 4 career opportunities in education. 5 (105 ILCS 5/3-12) (from Ch. 122, par. 3-12) 6 Sec. 3-12. Institute fund. All certificateexamination,7 registration,andrenewal, and duplicate fees shall be kept 8 by the regional superintendent as described in Sections 21-14 9 and 21-16 of this Code, together with a record of the names 10 of the persons paying them. Such feesfundshall be deposited 11 into the institute fund and shall be used by the regional 12 superintendent (i) to defray expenses incidental to teachers' 13 institutes, workshops, or meetings of a professional nature 14 that are designed to promote the professional growth of 15 teachers or (ii) for the purpose of defraying the expense of 16 any general or special meeting of teachers or school 17 personnel of the region, which has been approved by the 18 regional superintendent. 19 The regional superintendent shall on or before January 1 20 of each year publish in a newspaper of general circulation 21 published in the region or shall post in each school building 22 under his jurisdiction an accounting of (1) the balance on 23 hand in the Institute fund at the beginning of the previous 24 year; (2) all receipts within the previous year deposited in 25 the fund, with the sources from which they were derived; (3) 26 the amount distributed from the fund and the purposes for 27 which such distributions were made; and (4) the balance on 28 hand in the fund. 29 (Source: P.A. 88-89; 89-335, eff. 1-1-96.) 30 (105 ILCS 5/21-1b) (from Ch. 122, par. 21-1b) 31 Sec. 21-1b. Subject endorsement on certificates. All 32 certificates initially issued under this Article after June -3- LRB9102361NTsbA 1 30, 1986, shall be specifically endorsed by the State Board 2 of Education for each subject the holder of the certificate 3 is legally qualified to teach, such endorsements to be made 4 in accordance with standards promulgated by the State Board 5 of Education in consultation with the State Teacher 6 Certification Board. All certificates which are issued under 7 this Article prior to July 1, 1986 may, by application to the 8 State Board of Education, be specifically endorsed for each 9 subject the holder is legally qualified to teach. 10 Endorsements issued under this Section shall not apply to 11 substitute teacher's certificates issued under Section 21-9 12 of this Code.Each application for endorsement of an13existing teaching certificate shall be accompanied by a $2014nonrefundable fee.15 Commencing July 1, 1999, each application for endorsement 16 of an existing teaching certificate shall be accompanied by a 17 $30 nonrefundable feeJanuary 1, 1994, an additional $1018shall be charged for each application for endorsement. There 19 is hereby created a Teacher Certificate Fee Revolving Fund as 20 a special fund within the State Treasury. The proceeds of 21 each $30the additional $10fee shall be paid into the 22 Teacher Certificate Fee Revolving Fund; and the moneys in 23 that Fund shall be appropriated and used to provide the 24 technology and other resources necessary for the timely and 25 efficient processing of certification requests. 26 (Source: P.A. 88-224.) 27 (105 ILCS 5/21-1c) (from Ch. 122, par. 21-1c) 28 Sec. 21-1c. Exclusive certificate authority. Only the 29 State Board of Education and State Teacher Certification 30 Board, acting in accordance with the applicable provisions of 31 this Act and the rules, regulations and standards promulgated 32 thereunder, shall have the authority to issue or endorse any 33 certificate required for teaching, supervising or holding -4- LRB9102361NTsbA 1 certificated employment in the public schools; and no other 2 State agency shall have any power or authority (i) to 3 establish or prescribe any qualifications or other 4 requirements applicable to the issuance or endorsement of any 5 such certificate, or (ii) to establish or prescribe any 6 licensure or equivalent requirement which must be satisfied 7 in order to teach, supervise or hold certificated employment 8 in the public schools. This Section does not prohibit the 9 State Board of Education from delegating to regional 10 superintendents of schools the authority to grant temporary 11 employment authorizations to teacher applicants whose 12 qualifications have been confirmed by the State Board of 13 Education. 14 (Source: P.A. 86-1441.) 15 (105 ILCS 5/21-2) (from Ch. 122, par. 21-2) 16 Sec. 21-2. Grades of certificates. 17 (a) Until July 1, 1999, all certificates issued under 18 this Article shall be State certificates valid, except as 19 limited in Section 21-1, in every school district coming 20 under the provisions of this Act and shall be limited in time 21 and designated as follows: Provisional vocational 22 certificate, temporary provisional vocational certificate, 23 early childhood certificate, elementary school certificate, 24 special certificate, high school certificate, school service 25 personnel certificate, administrative certificate, 26 provisional certificate, and substitute certificate. The 27 requirement of student teaching under close and competent 28 supervision for obtaining a teaching certificate may be 29 waived by the State Teacher Certification Board upon 30 presentation to the Board by the teacher of evidence of 5 31 years successful teaching experience on a valid certificate 32 and graduation from a recognized institution of higher 33 learning with a bachelor's degree with not less than 120 -5- LRB9102361NTsbA 1 semester hours and a minimum of 16 semester hours in 2 professional education. 3 (b) Initial Teaching Certificate. Beginning July 1, 4 1999, persons who (1) have completed an approved teacher 5 preparation program, (2) are recommended by an approved 6 teacher preparation program, (3) have successfully completed 7 the Initial Teaching Certification examinations required by 8 the State Board of Education, and (4) have met all other 9 criteria established by the State Board of Education in 10 consultation with the State Teacher Certification Board, 11 shall be issued an Initial Teaching Certificate valid for 4 12 years of teaching. Initial Teaching Certificates shall be 13 issued for categories corresponding to Early Childhood, 14 Elementary, Secondary, and Special K-12, with special 15 certification designations for Special Education, Bilingual 16 Education, fundamental learning areas (including Language 17 Arts, Reading, Mathematics, Science, Social Science, Physical 18 Development and Health, Fine Arts, and Foreign Language), and 19 other areas designated by the State Board of Education, in 20 consultation with the State Teacher Certification Board. 21 (c) Standard Certificate. Beginning July 1, 1999, 22 persons who (1) have completed 4 years of teaching with an 23 Initial Certificate, have successfully completed the Standard 24 Teaching Certificate examinations, and have met all other 25 criteria established by the State Board of Education in 26 consultation with the State Teacher Certification Board, or 27 (2) were issued teaching certificates prior to July 1, 1999 28 and are renewing those certificates after July 1, 1999, shall 29 be issued a Standard Certificate valid for 5 years, which may 30 be renewed thereafter every 5 years by the State Teacher 31 Certification Board based on proof of continuing education or 32 professional development. Standard Certificates shall be 33 issued for categories corresponding to Early Childhood, 34 Elementary, Secondary, and Special K-12, with special -6- LRB9102361NTsbA 1 certification designations for Special Education, Bilingual 2 Education, fundamental learning areas (including Language 3 Arts, Reading, Mathematics, Science, Social Science, Physical 4 Development and Health, Fine Arts, and Foreign Language), and 5 other areas designated by the State Board of Education, in 6 consultation with the State Teacher Certification Board. 7 (d) Master Certificate. Beginning July 1, 1999, persons 8 who have successfully achieved National Board certification 9 through the National Board for Professional Teaching 10 Standards shall be issued a Master Certificate, valid for 10 117years and renewable thereafter every 107years through 12 compliance with requirements set forth by the State Board of 13 Education. 14 (Source: P.A. 90-548, eff. 1-1-98; 90-653, eff. 7-29-98; 15 90-811, eff. 1-26-99.) 16 (105 ILCS 5/21-7.1) (from Ch. 122, par. 21-7.1) 17 Sec. 21-7.1. Administrative certificate. 18 (a) After July 1, 1999January 1, 1986, an 19 administrative certificate valid for 5 years of supervising 20 and administering in the public common schools may be issued 21 to persons who have graduated from a regionally accredited 22recognizedinstitution of higher learning with a master's 23 degree and who have been recommendedcertifiedby a 24 recognized institutionthese institutionsof higher learning 25 as having completed a program of preparation for one or more 26 of these endorsements. Such programs of academic and 27 professional preparation required for endorsement shall be 28 administered by the institution in accordance with standards 29 set forth by the State Superintendent of Education in 30 consultation with the State Teacher Certification Board. 31 (b) No administrative certificate shall be issued for 32 the first time after June 30, 1987 and no endorsement 33 provided for by this Section shall be made or affixed to an -7- LRB9102361NTsbA 1 administrative certificate for the first time after June 30, 2 1987 unless the person to whom such administrative 3 certificate is to be issued or to whose administrative 4 certificate such endorsement is to be affixed has been 5 required to demonstrate as a part of a program of academic or 6 professional preparation for such certification or 7 endorsement: (i) an understanding of the knowledge called for 8 in establishing productive parent-school relationships and of 9 the procedures fostering the involvement which such 10 relationships demand; and (ii) an understanding of the 11 knowledge required for establishing a high quality school 12 climate and promoting good classroom organization and 13 management, including rules of conduct and instructional 14 procedures appropriate to accomplishing the tasks of 15 schooling; and (iii) a demonstration of the knowledge and 16 skills called for in providing instructional leadership. The 17 standards for demonstrating an understanding of such 18 knowledge shall be set forth by the State Board of Education 19 in consultation with the State Teacher Certification Board, 20 and shall be administered by the recognized institutions of 21 higher learning as part of the programs of academic and 22 professional preparation required for certification and 23 endorsement under this Section. As used in this subsection: 24 "establishing productive parent-school relationships" means 25 the ability to maintain effective communication between 26 parents and school personnel, to encourage parental 27 involvement in schooling, and to motivate school personnel to 28 engage parents in encouraging student achievement, including 29 the development of programs and policies which serve to 30 accomplish this purpose; and "establishing a high quality 31 school climate" means the ability to promote academic 32 achievement, to maintain discipline, to recognize substance 33 abuse problems among students and utilize appropriate law 34 enforcement and other community resources to address these -8- LRB9102361NTsbA 1 problems, to support teachers and students in their education 2 endeavors, to establish learning objectives and to provide 3 instructional leadership, including the development of 4 policies and programs which serve to accomplish this purpose; 5 and "providing instructional leadership" means the ability to 6 effectively evaluate school personnel, to possess general 7 communication and interpersonal skills, and to establish and 8 maintain appropriate classroom learning environments. The 9 provisions of this subsection shall not apply to or affect 10 the initial issuance or making on or before June 30, 1987 of 11 any administrative certificate or endorsement provided for 12 under this Section, nor shall such provisions apply to or 13 affect the renewal after June 30, 1987 of any such 14 certificate or endorsement initially issued or made on or 15 before June 30, 1987. 16 (c) Administrative certificates shall be renewed every 17 five years with the first renewal being five years following 18 the initial receipt of an administrative certificate. Renewal 19 requirements for administrators whose positions require 20 certification shall be based upon evidence of continuing 21 professional education which promotes the following goals: 22 (1) Improving administrators' knowledge of instructional 23 practices and administrative procedures; (2) Maintaining the 24 basic level of competence required for initial certification; 25 and (3) Improving the mastery of skills and knowledge 26 regarding the improvement of teaching performance in clinical 27 settings and assessment of the levels of student performance 28 in their schools. Evidence of continuing professional 29 education must include verification of biennial attendance in 30 a program developed by the Illinois Administrators' Academy 31 and verification of annual participation in a school district 32 approved activity which contributes to continuing 33 professional education. The State Board of Education, in 34 consultation with the State Teacher Certification Board, -9- LRB9102361NTsbA 1 shall develop procedures for implementing this Section and 2 shall administer the renewal of administrative certificates. 3 Failure to submit satisfactory evidence of continuing 4 professional education which contributes to promoting the 5 goals of this Section shall result in a loss of 6 administrative certification. 7 (d) Any limited or life supervisory certificate issued 8 prior to July 1, 1968 shall continue to be valid for all 9 administrative and supervisory positions in the public 10 schools for which it is valid as of that date as long as its 11 holder meets the requirements for registration or renewal as 12 set forth in the statutes or until revoked according to law. 13 (e) The administrative or supervisory positions for 14 which the certificate shall be valid shall be determined by 15 one or more of 3 endorsements: general supervisory, general 16 administrative and superintendent. 17 Subject to the provisions of Section 21-1a, endorsements 18 shall be made under conditions set forth in this Section. 19 The State Board of Education shall, in consultation with the 20 State Teacher Certification Board, adopt rules pursuant to 21 the Illinois Administrative Procedure Act, establishing 22 requirements for obtaining administrative certificates where 23 the minimum administrative or supervisory requirements 24 surpass those set forth in this Section. 25 The State Teacher Certification Board shall file with the 26 State Board of Education a written recommendation when 27 considering additional administrative or supervisory 28 requirements. All additional requirements shall be based 29 upon the requisite knowledge necessary to perform those tasks 30 required by the certificate. The State Board of Education 31 shall in consultation with the State Teacher Certification 32 Board, establish standards within its rules which shall 33 include the academic and professional requirements necessary 34 for certification. These standards shall at a minimum -10- LRB9102361NTsbA 1 contain, but not be limited to, those used by the State Board 2 of Education in determining whether additional knowledge will 3 be required. Additionally, the State Board of Education 4 shall in consultation with the State Teacher Certification 5 Board, establish provisions within its rules whereby any 6 member of the educational community or the public may file a 7 formal written recommendation or inquiry regarding 8 requirements. 9 (1) Until July 1, 2003, the general supervisory 10 endorsement shall be affixed to the administrative 11 certificate of any holder who has at least 16 semester 12 hours of graduate credit in professional education 13 including 8 semester hours of graduate credit in 14 curriculum and research and who has at least 2 years of 15 full-time teaching experience or school service personnel 16 experience in public schools, schools under the 17 supervision of the Department of Corrections, schools 18 under the administration of the Department of 19 Rehabilitation Services, or nonpublic schools meeting the 20 standards established by the State Superintendent of 21 Education or comparable out-of-state recognition 22 standards approved by the State Superintendent of 23 Education. 24 Such endorsement shall be required for supervisors, 25 curriculum directors and for such similar and related 26 positions as determined by the State Superintendent of 27 Education in consultation with the State Teacher 28 Certification Board. 29 (2) The general administrative endorsement shall be 30 affixed to the administrative certificate of any holder 31 who has at least 20 semester hours of graduate credit in 32 educational administration and supervision and who has at 33 least 2 years of full-time teaching experience or school 34 service personnel experience in public schools, schools -11- LRB9102361NTsbA 1 under the supervision of the Department of Corrections, 2 schools under the administration of the Department of 3 Rehabilitation Services, or nonpublic schools meeting the 4 standards established by the State Superintendent of 5 Education or comparable out-of-state recognition 6 standards approved by the State Superintendent of 7 Education. 8 Such endorsement shall be required for principal, 9 assistant principal, assistant or associate 10 superintendent, junior college dean and for related or 11 similar positions as determined by the State 12 Superintendent of Education in consultation with the 13 State Teacher Certification Board. 14 Notwithstanding any other provisions of this Act, 15 after January 1, 1990 and until January 1, 1991, any 16 teacher employed by a district subject to Article 34 17 shall be entitled to receive an administrative 18 certificate with a general administrative endorsement 19 affixed thereto if he or she: (i) had at least 3 years of 20 experience as a certified teacher for such district prior 21 to August 1, 1985; (ii) obtained a Master's degree prior 22 to August 1, 1985; (iii) completed at least 20 hours of 23 graduate credit in education courses (including at least 24 12 hours in educational administration and supervision) 25 prior to September 1, 1987; and (iv) has received a 26 rating of superior for at least each of the last 5 years. 27 Any person who obtains an administrative certificate with 28 a general administrative endorsement affixed thereto 29 under this paragraph shall not be qualified to serve in 30 any administrative position except assistant principal. 31 (3) The chief school business official endorsement 32 shall be affixed to the administrative certificate of any 33 holder who qualifies by having a Master's degree, two 34 years of administrative experience in school business -12- LRB9102361NTsbA 1 management, and a minimum of 20 semester hours of 2 graduate credit in a program established by the State 3 Superintendent of Education in consultation with the 4 State Teacher Certification Board for the preparation of 5 school business administrators. Such endorsement shall 6 also be affixed to the administrative certificate of any 7 holder who qualifies by having a Master's Degree in 8 Business Administration, Finance or Accounting from a 9 regionally accredited institution of higher education. 10 After June 30, 1977, such endorsement shall be 11 required for any individual first employed as a chief 12 school business official. 13 (4) The superintendent endorsement shall be affixed to 14 the administrative certificate of any holder who has 15 completed 30 semester hours of graduate credit beyond the 16 master's degree in a program for the preparation of 17 superintendents of schools including 16 semester hours of 18 graduate credit in professional education and who has at 19 least 2 years experience as an administrator or supervisor in 20 the public schools or the State Board of Education or 21 education service regions or in nonpublic schools meeting the 22 standards established by the State Superintendent of 23 Education or comparable out-of-state recognition standards 24 approved by the State Superintendent of Education and holds 25 general supervisory or general administrative endorsement, or 26 who has had 2 years of experience as a supervisor or 27 administrator while holding an all-grade supervisory 28 certificate or a certificate comparable in validity and 29 educational and experience requirements. 30 After June 30, 1968, such endorsement shall be required 31 for a superintendent of schools, except as provided in the 32 second paragraph of this Section and in Section 34-6. 33 Any person appointed to the position of superintendent 34 between the effective date of this Act and June 30, 1993 in a -13- LRB9102361NTsbA 1 school district organized pursuant to Article 32 with an 2 enrollment of at least 20,000 pupils shall be exempt from the 3 provisions of this Subsection (4) until June 30, 1996. 4 (f) All official interpretations or acts of issuing or 5 denying administrative certificates or endorsements by the 6 State Teacher's Certification Board, State Board of Education 7 or the State Superintendent of Education, from the passage of 8 P.A. 81-1208 on November 8, 1979 through September 24, 1981 9 are hereby declared valid and legal acts in all respects and 10 further that the purported repeal of the provisions of this 11 Section by P.A. 81-1208 and P.A. 81-1509 is declared null and 12 void. 13 (Source: P.A. 89-626, eff. 8-9-96.) 14 (105 ILCS 5/21-9) (from Ch. 122, par. 21-9) 15 Sec. 21-9. Substitute certificates. (a) A substitute 16 teacher's certificate may be issued for teaching in all 17 grades of and substitute teaching in the common schools. 18 Such certificate may be issued upon request of the regional 19 superintendent of schools of any region in which the teacher 20 is to teach. A substitute teacher's certificate is valid for 21 teaching in the public schools of any county. Such 22 certificate may be issued to persons who either (a) hold a 23 certificate valid for teaching in the common schools as 24 shown on the face of the certificate, (b) hold a bachelor of 25 arts degree from an institution of higher learning accredited 26 by the North Central Association or other comparable regional 27 accrediting association or have been graduated from a 28 recognized institution of higher learning with a bachelor's 29 degree, or (c) have had 2 years of teaching experience and 30 meet such other rules and regulations as may be adopted by 31 the State Board of Education in consultation with the State 32 Teacher Certification Board. Such certificate shall expire 33 on June 30 in the fourth year from date of issue. Substitute -14- LRB9102361NTsbA 1 teacher's certificates are not subject to endorsement as 2 described in Section 21-1b of this Code. 3 (b) A teacher holding a substitute teacher's certificate 4 may teach only in the place of a certified teacher who is 5 under contract with the employing board and may teach only 6 when no appropriate fully certified teacher is available to 7 teach in a substitute capacity. A teacher holding an early 8 childhood certificate, an elementary certificate, a high 9 school certificate, or a special certificate may also 10 substitute teach in grades K-12 but only in the place of a 11 certified teacher who is under contract with the employing 12 board. A substitute teacher may teach only for a period not 13 to exceed 90 paid school days or 450 paid school hours in any 14 one school district in any one school term. Where such 15 teaching is partly on a daily and partly on an hourly basis, 16 a school day shall be considered as 5 hours. The teaching 17 limitations imposed by this subsection upon teachers holding 18 substitute certificates shall not apply in any school 19 district operating under Article 34. 20 (Source: P.A. 89-212, eff. 8-4-95.) 21 (105 ILCS 5/21-11.3) (from Ch. 122, par. 21-11.3) 22 Sec. 21-11.3. Resident teacher certificate. A resident 23 teacher certificate shall be valid for 2 years for employment 24 as a resident teacher in a public school. It shall be issued 25 only to persons who have graduated from a regionally 26 accreditedrecognizedinstitution of higher education with a 27 bachelor's degree, who are enrolled in a program of 28 preparation approved by the State Superintendent of Education 29 in consultation with the State Teacher Certification Board, 30 and who have passed the appropriate tests as required in 31 Section 21-1a and as determined by the State Board of 32 Education. A resident teacher certificate may be issued for 33 teaching children through grade 3 or for grades K-9, 6-12, or -15- LRB9102361NTsbA 1 K-12 in a special subject area and may not be renewed. A 2 resident teacher may teach only in conjunction with and under 3 the direction of a certified teacher and shall not teach in 4 place of a certified teacher. 5 (Source: P.A. 90-548, eff. 1-1-98.) 6 (105 ILCS 5/21-11.4) 7 Sec. 21-11.4. Illinois Teacher Corps. 8 (a) The General Assembly finds and determines that (i) 9 it is important to encourage the entry of qualified 10 professionals into elementary and secondary teaching as a 11 second career; and (ii) there are a number of individuals who 12 have bachelors' degrees, experience in the work force, and an 13 interest in serving youth that creates a special talent pool 14 with great potential for enriching the lives of Illinois 15 children as teachers. To provide this talent pool with the 16 opportunity to serve children as teachers, school districts, 17 colleges, and universities are encouraged, as part of the 18 public policy of this State, to enter into collaborative 19 programs to educate and induct these non-traditional 20 candidates into the teaching profession. To facilitate the 21 certification of such candidates, the State Board of 22 Education, in consultation with the State Teacher 23 Certification Board, shall assist institutions of higher 24 education and school districts with the implementation of the 25 Illinois Teacher Corps. 26 (b) Individuals who wish to become candidates for the 27 Illinois Teacher Corps program must earn a resident teacher 28 certificate as defined in Section 21-11.3, including: 29 (1) graduation from a regionally accredited 30recognizedinstitution of higher education with a 31 bachelor's degree and at least a 3.00 out of a 4.00 grade 32 point average; 33 (2) a minimum of 5 years of professional experience -16- LRB9102361NTsbA 1 in the area the candidate wishes to teach; 2 (3) passing the examinations required by the State 3 Board of Education; 4 (4) enrollment in a Masters of Education Degree 5 program approved by the State Superintendent of Education 6 in consultation with the State Teacher Certification 7 Board; and 8 (5) completion of a 6 week summer intensive teacher 9 preparation course which is the first component of the 10 Masters Degree program. 11 (c) School districts may hire an Illinois Teacher Corps 12 candidate after the candidate has received his or her 13 resident teacher certificate. The school district has the 14 responsibility of ensuring that the candidates receive the 15 supports necessary to become qualified, competent and 16 productive teachers. To be eligible to participate in the 17 Illinois Teacher Corps program, school districts must provide 18 a minimum of the following supports to the candidates: 19 (1) a salary and benefits package as negotiated 20 through the teacher contracts; 21 (2) a mentor certified teacher who will provide 22 guidance to one or more candidates under a program 23 developed collaboratively by the school district and 24 university; 25 (3) at least quarterly evaluations performed of 26 each candidate jointly by the mentor teacher and the 27 principal of the school or the principal's designee; and 28 (4) a written and signed document from the school 29 district outlining the support the district intends to 30 provide to the candidates, for approval by the State 31 Teacher Certification Board. 32 (d) Illinois institutions of higher education shall work 33 collaboratively with school districts and the State Teacher 34 Certification Board to academically prepare the candidates -17- LRB9102361NTsbA 1 for the teaching profession. To be eligible to participate, 2 the College or School of Education of a participating 3 Illinois institution of higher education must develop a 4 curriculum that provides, upon completion, a Masters Degree 5 in Education for the candidates. The Masters Degree program 6 must: 7 (1) receive approval from the State Teacher 8 Certification Board; and 9 (2) take no longer than 3 summers and 2 academic 10 years to complete, and balance the needs and time 11 constraints of the candidates. 12 (e) Upon successful completion of the Masters Degree 13 program, the candidate receives an Initial Teaching 14 Certificate in the State of Illinois. 15 (f) If an individual wishes to become a candidate in the 16 Illinois Teacher Corps program, but does not possess 5 years 17 of professional experience, the individual may qualify for 18 the program by participating in a one year internship 19 teacher preparation program with a school district. The one 20 year internship shall be developed collaboratively by the 21 school district and the Illinois institution of higher 22 education, and shall be approved by the State Teacher 23 Certification Board. 24 (g) The State Board of Education is authorized to award 25 grants to school districts that seek to prepare candidates 26 for the teaching profession who have bachelors' degrees and 27 professional work experience in subjects relevant to teaching 28 fields, but who do not have formal preparation for teaching. 29 Grants may be made to school districts for up to $3,000 per 30 candidate when the school district, in cooperation with a 31 public or private university and the school district's 32 teacher bargaining unit, develop a program designed to 33 prepare teachers pursuant to the Illinois Teacher Corps 34 program under this Section. -18- LRB9102361NTsbA 1 (Source: P.A. 90-548, eff. 1-1-98.) 2 (105 ILCS 5/21-12) (from Ch. 122, par. 21-12) 3 Sec. 21-12. Printing;ofSeal; Signature; Credentials. 4 All certificates shall be printed by and bear theseal of the5State Teacher Certification Board and thesignatures of the 6 chairman and of the secretary of the State Teacher 7 Certification Boardboard. Each certificate shall show the 8 integrally printed seal of the State Teacher Certification 9 Board. All college credentials offered as the basis of a 10 certificate shall be presented to the secretary of the State 11 Teacher Certification Board for inspection and approval. 12After January 1, 1964, each application for a certificate or13evaluation of credentials shall be accompanied by an14evaluation fee of $20 which is not refundable.15 Commencing July 1, 1999, each application for a 16 certificate or evaluation of credentials shall be accompanied 17 by an evaluation fee of $30 payable to the State 18 Superintendent of Education,January 1, 1994, an additional19$10 shall be charged for each application for a certificate20or evaluation of credentialswhich is not refundable.There21is hereby created a Teacher Certificate Fee Revolving Fund as22a special fund within the State Treasury.The proceeds of 23 each $30the additional $10fee shall be paid into the 24 Teacher Certificate Fee Revolving Fund, created under Section 25 21-1b of this Code; and the moneys in that Fund shall be 26 appropriated and used to provide the technology and other 27 resources necessary for the timely and efficient processing 28 of certification requests. 29 When evaluation verifies the requirements for a valid 30 certificate, the applicant shall be issued an entitlement 31 card that may be presented to a regional superintendent of 32 schools together with a fee of one dollar for issuance of a 33 certificate. -19- LRB9102361NTsbA 1 The applicant shall be notified of any deficiencies. 2 (Source: P.A. 88-224; revised 10-31-98.) 3 (105 ILCS 5/21-14) (from Ch. 122, par. 21-14) 4 Sec. 21-14.Registration andRenewal of certificates. 5 (a) A limited four-year certificate or a certificate 6 issued after July 1, 1955, shall be renewable at its 7 expiration or within 60 days thereafter by the county 8 superintendent of schools having supervision and control over 9 the school where the teacher is teaching upon certified 10 evidence of meeting the requirements for renewal as required 11 by this Act and prescribed by the State Board of Education in 12 consultation with the State Teacher Certification Board. An 13 elementary supervisory certificate shall not be renewed at 14 the end of the first four-year period covered by the 15 certificate unless the holder thereof has filed certified 16 evidence with the State Teacher Certification Board that he 17 has a master's degree or that he has earned 8 semester hours 18 of credit in the field of educational administration and 19 supervision in a recognized institution of higher learning. 20 The holder shall continue to earn 8 semester hours of credit 21 each four-year period until such time as he has earned a 22 master's degree. 23 All certificates not renewedor registeredas herein 24 provided shall lapse after a period of 54years from the 25 expiration of the last year of registration. Such 26 certificates may be reinstated for a one year period upon 27 payment of all accumulated registration fees. Such 28 reinstated certificates shall only be renewed: (1) by earning 29 5 semester hours of credit in a recognized institution of 30 higher learning in the field of professional education or in 31 courses related to the holder's contractual teaching duties; 32 or (2) by presenting evidence of holding a valid regular 33 certificate of some other type. Any certificate may be -20- LRB9102361NTsbA 1 voluntarily surrendered by the certificate holder. A 2 voluntarily surrendered certificate shall be treated as a 3 revoked certificate. 4 (b) When those teaching certificates issued before July 5 1, 1999 are renewed for the first time after July 1, 1999, 6 all such teaching certificates shall be exchanged for 7 Standard Teaching Certificates as provided in subsection (c) 8 of Section 21-2. All Initial and Standard Teaching 9 Certificates, including those issued to persons who 10 previously held teaching certificates issued before July 1, 11 1999, shall be renewable under the conditions set forth in 12 this subsection (b). 13 Initial Teaching Certificates are nonrenewable and are 14 valid for 4 years of teaching. Standard Teaching 15 Certificates are renewable every 5 years as provided in 16 subsection (c) of Section 21-2. Application for the renewal 17 of one or more certificates shall be accompanied by a fee of 18 $20, payable to the State Superintendent of Education for 19 deposit into the State Teacher Professional Development Fund. 20 The State Teacher Professional Development Fund is created as 21 a special fund in the State treasury. The moneys in the 22 State Teacher Professional Development Fund shall be 23 appropriated and used to establish and support continuing 24 education or professional development required for renewing 25 Standard Teaching Certificates. 26 (Source: P.A. 90-548, eff. 1-1-98; 90-653, eff. 7-29-98; 27 90-811, eff. 1-26-99.) 28 (105 ILCS 5/21-16) (from Ch. 122, par. 21-16) 29 Sec. 21-16. Fees - Requirement for registration. Every 30 applicant when issued a certificate shall pay to the regional 31 superintendent of schools a fee of $1, which shall be paid 32 into the institute fund. Every certificate issued under the 33 provisions of this Act shall be registered annually or, at -21- LRB9102361NTsbA 1 the option of the holder of the certificate, once every 532 years. The regional superintendent of schools having 3 supervision and control over the school where the teaching is 4 done shall register the certificate before the holder begins 5 to teach, otherwise it shall be registered in any county in 6 the State of Illinois. Each holder shall pay to the regional 7 superintendentand onean annual fee of $4 per year for 8 registrationor renewalof one or more certificates which 9 have been issued to the same holder.shall be paidThe 10 regional superintendent of schools shall deposit the annual 11 registration fees into the institute fund. Any certificate 12 holder who teaches in more than one educational service 13 region shall register the certificate in all the regions 14 where the teaching is done, but shall be required to pay only 15 one annual registration fee. 16 Requirements for registration of any certificate limited 17 in time shall include evidence of professional growth defined 18 as successful teaching experience since last registration of 19 certificate, attendance at professional meetings, membership 20 in professional organizations, additional credits earned in 21 recognized teacher-training institutions, travel specifically 22 for educational experience, reading of professional books and 23 periodicals, filing all reports as required by the regional 24 superintendent of schools and the State Superintendent of 25 Education or such other professional experience or 26 combination of experiences as are presented by the teacher 27 and are approved by the State Superintendent of Education in 28 consultation with the State Teacher Certification Board. A 29 duplicate certificate may be issued to the holder of a valid 30 life certificate or valid certificate limited in time by the 31 State Superintendent of Education; however, it shall only be 32 issued upon request of a regional superintendent of schools 33 and upon payment to the regional superintendent of schools 34 who requests such duplicate a fee of $4, which shall be -22- LRB9102361NTsbA 1 deposited into the institute fund. 2 (Source: P.A. 87-745.) 3 (105 ILCS 5/21-17) (from Ch. 122, par. 21-17) 4 Sec. 21-17. Fee for original and duplicate certificate. 5 A duplicate certificate shall be issued by the State 6 Superintendent of Education when requested by the regional 7 superintendent of schools as provided in Section 21-16. The 8 request for a duplicate certificate shall be accompanied by a 9 fee of $4, which shall be deposited into the Teacher 10 Certificate Fee Revolving Fund. 11 (Source: P.A. 81-940.) 12 (105 ILCS 5/21-21) (from Ch. 122, par. 21-21) 13 Sec. 21-21. Definitions; granting of recognition; 14 regional accreditation). 15 (a) "Recognized", as used in this Article in connection 16 with the word "school" or "institution", means such school, 17 college, university, private junior college, public community 18 college or special or technical school as maintains aan19equipment,course of study, a standard of scholarship and 20 other requirements set by the State Board of Education in 21 consultation with the State Teacher Certification Board. 22 Application for recognition of such school or institution as 23 a teacher educationtraininginstitution shall be made to the 24 State Board of Education. The State Board of Education in 25 consultation with the State Teacher Certification Board shall 26 set the criteria by which the school or institution shall be 27 judged and through the Secretary of the Board shall arrange 28 for an official inspection and shall grant recognition of 29 such school or institution as may meet the required 30 standards. If such standards include requirements with 31 regard to education in acquiring skills in working with 32 culturally distinctive students, as defined by the State -23- LRB9102361NTsbA 1 Board of Education, then the rules of the State Board of 2 Education shall include the criteria used to evaluate 3 compliance with this requirement. No school or institution 4 shall make assignments of student teachers or teachers for 5 practice teaching so as to promote segregation on the basis 6 of race, creed, color, religion, sex or national origin. 7 All recommendations for initial or standard certification 8 shall be madeAll courses listed or credentials required as9the basis of any certificate or for its renewal shall be the10equivalent of courses offeredby a recognized teacher 11 training institution operating a program of preparation for 12 the certificate approved by the State Superintendent of 13 Education in consultation with the State Teacher 14 Certification Board. The State Board of Education in 15 consultation with the State Teacher Certification Board shall 16 have the power to define a major or minor when used as a 17 basis for recognition and certification purposes. 18 (b) "Regionally accredited" or "accredited" as used in 19 this Article in connection with a university or institution 20 shall mean an institution of higher education accredited by 21 the North Central Association or other comparable regional 22 accrediting association. 23 (Source: P.A. 84-793.) 24 (105 ILCS 5/21-25) (from Ch. 122, par. 21-25) 25 Sec. 21-25. School service personnel certificate. 26 Subject to the provisions of Section 21-1a, a school service 27 personnel certificate shall be issued to those applicants of 28 good character, good health, a citizen of the United States 29 and at least 19 years of age who have a Bachelor's degree 30 with not fewer than 120 semester hours from a regionally 31 accreditedrecognizedinstitution of higher learning and who 32 meets the requirements established by the State 33 Superintendent of Education in consultation with the State -24- LRB9102361NTsbA 1 Teacher Certification Board. A school service personnel 2 certificate with a school nurse endorsement may be issued to 3 a person who holds a bachelor of science degree from an 4 institution of higher learning accredited by the North 5 Central Association or other comparable regional accrediting 6 association. Persons seeking any other endorsement on the 7 school service personnel certificate shall be recommended for 8 the endorsement by a recognized teacher education institution 9 as having completed a program of preparation approved by the 10 State Superintendent of Education in consultation with the 11 State Teacher Certification Board. 12 Such certificate shall be endorsed with the area of 13 Service as determined by the State Superintendent of 14 Education in consultation with the State Teacher 15 Certification Board. 16 The holder of such certificate shall be entitled to all 17 of the rights and privileges granted holders of a valid 18 teaching certificate, including teacher benefits, 19 compensation and working conditions. 20 When the holder of such certificate has earned a master's 21 degree, including 8 semester hours of graduate professional 22 education from a recognized institution of higher learning, 23 and has at least 2 years of successful school experience 24 while holding such certificate, the certificate may be 25 endorsed for supervision. 26 (Source: P.A. 88-386.) 27 (105 ILCS 5/34-83) (from Ch. 122, par. 34-83) 28 Sec. 34-83. Board of examiners - Certificates - 29 Examinations. A board of 3 examiners shall examine all 30 applicants required to hold certificates to teach and the 31 board of education shall issue gratuitously to those who pass 32 a required test of character, scholarship and general 33 fitness, such certificates to teach as they are found -25- LRB9102361NTsbA 1 entitled to receive. No person may be granted or continue to 2 hold a teaching certificate who has knowingly altered or 3 misrepresented his or her teaching qualifications in order to 4 acquire the certificate. Any other certificate held by such 5 person may be suspended or revoked by the board of examiners, 6 depending upon the severity of the alteration or 7 misrepresentation. The board of examiners shall consist of 8 the general superintendent of schools and 2 persons approved 9 and appointed by the board of education upon the nomination 10 of the general superintendent of schools. The board of 11 examiners shall hold such examinations as the board of 12 education may prescribe, upon the recommendation of the 13 general superintendent of schools and shall prepare all 14 necessary eligible lists, which shall be kept in the office 15 of the general superintendent of schools and be open to 16 public inspection. Members of the board of examiners shall 17 hold office for a term of 2 years. 18 The board of examiners created herein is abolished 19 effective July 1, 1988. Commencing July 1, 1988, all new 20 teachers employed by the board shall hold teaching 21 certificates issued by the State Teacher Certification Board 22 under Article 21. The State Board of Education in 23 consultation with the board of examiners and the State 24 Teacher Certification Board shall develop procedures whereby 25 teachers currently holding valid certificates issued by the 26 board of examiners, and all teachers employed by the board 27 after August 1, 1985 and prior to July 1, 1988, shall no 28 later than July 1, 1988 exchange certificates issued by the 29 board of examiners for comparable certificates issued by the 30 State Teacher Certification Board. On the exchange of a 31 certificate on or before July 1, 1988, the State Teacher 32 Certification Board shall not require any additional 33 qualifications for the issuance of the comparable 34 certificate. If prior to July 1, 1988 the board of examiners -26- LRB9102361NTsbA 1 has issued types of teaching certificates which are not 2 comparable to the types of certificates issued by the State 3 Teacher Certification Board, such certificates shall continue 4 to be valid for and shall be renewable by the holders 5 thereof, and no additional qualifications shall be required 6 by the State Teacher Certification Board for any such renewal 7 ; however, no individual who received a letter of continuing 8 eligibility shall be issued an Initial or Standard Teaching 9 Certificate, as provided in Section 21-2 of this Code, unless 10 that individual also holds such a valid and renewable 11 certificate. 12 The State Board of Education shall report by July 1, 13 1986, to the Illinois General Assembly on the procedures for 14 exchange it has developed in consultation with the board of 15 examiners and the State Teacher Certification Board as 16 required in this Section. 17 (Source: P.A. 89-15, eff. 5-30-95.) 18 (105 ILCS 5/21-11 rep.) 19 Section 15.
