92_SB2214eng SB2214 Engrossed LRB9213234LDcsA 1 AN ACT in relation to certain land. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 ARTICLE 1 5 Section 1-5. Upon the payment of the sum of $12,000.00 to 6 the State of Illinois, the rights or easements of access, 7 crossing, light, air and view from, to and over the following 8 described line and FAP Route 12 (US 40) are restored subject 9 to permit requirements of the State of Illinois, Department 10 of Transportation. 11 Parcel No. 800XA86 12 A line in the Southeast Quarter of the Southwest Quarter 13 of Section 14, Township 5 North, Range 3 West of the 14 Third Principal Meridian, Bond County, Illinois, more 15 particularly described as follows: 16 Commencing at a stone at the south quarter corner of said 17 Section 14; thence on an assumed bearing of South 88 18 degrees 45 minutes 55 seconds West on the south line of 19 said Section 14, a distance of 700.38 feet to an iron 20 rod; thence North 01 degree 45 minutes 03 seconds West, 21 576.33 feet to an iron rod on the south right of way line 22 of old U.S. Route 40, also being the Point of Beginning. 23 From said Point of Beginning; thence North 63 degrees 47 24 minutes 57 seconds East on said right of way line, 564.92 25 feet to an iron rod, being the point of terminus. 26 Section 1-10. Upon the payment of the sum of $200.00 to 27 the State of Illinois, and subject to the conditions set 28 forth in Section 900 in this Act, the easement for highway 29 purposes acquired by the People of the State of Illinois is 30 released over and through the following described land in SB2214 Engrossed -2- LRB9213234LDcsA 1 Kendall County, Illinois: 2 Parcel No. 3LR0073 3 That part of Section 8, Township 36 North, Range 7 East 4 of the Third Principal Meridian described as follows: 5 Commencing at the northwest corner of Woodland Acres 6 Subdivision as recorded September 23, 1971, in Book 14 of 7 Plats at pages 1 and 2 in the Recorder's Office of 8 Kendall County, Illinois; thence North 00 degrees 21 9 minutes 00 seconds East along the westerly line of said 10 Woodland Acres Subdivision extended a distance of 314.70 11 feet; thence South 73 degrees 19 minutes 39 seconds West, 12 520.13 feet; thence North 11 degrees 46 minutes 45 13 seconds West, 208.80 feet; thence South 73 degrees 19 14 minutes 39 seconds West, 208.80 feet to the westerly line 15 of High Point Road; thence North 11 degrees 51 minutes 47 16 seconds West, 512.10 feet along said westerly line of 17 High Point Road; thence North 78 degrees 08 minutes 12 18 seconds East, 43.80 feet to the existing southerly right 19 of way line of Illinois Route 71 and the Point Of 20 Beginning; thence North 29 degrees 18 minutes 34 seconds 21 East, 136.44 feet; thence North 73 degrees 00 minutes 53 22 seconds East, 50.09 feet to the existing southerly right 23 of way line of said Illinois Route 71; thence 24 southwesterly 24.64 feet along a 4,441.27 foot radius 25 curve to the left having a chord of South 70 degrees 20 26 minutes 54 seconds West, 24.64 feet on said right of way 27 line; thence South 36 degrees 07 minutes 57 seconds West, 28 155.17 feet on said right of way line to the Point Of 29 Beginning, containing 0.030 acre, more or less, and all 30 being situated in Kendall Township, Kendall County, 31 Illinois. 32 Section 1-15. Upon the payment of the sum of $1,300.00 33 to the State of Illinois, and subject to the conditions set SB2214 Engrossed -3- LRB9213234LDcsA 1 forth in Section 900 in this Act, the easement for highway 2 purposes acquired by the People of the State of Illinois is 3 released over and through the following described land in 4 Woodford County, Illinois: 5 Parcel No. 3LR0015 6 A part of the Southwest Quarter of Section 16, Township 7 27 North, Range 2 West of the Third Principal Meridian, 8 and also being a part of a tract of land described in the 9 Dedication Of Right Of Way For Public Road Purposes 10 recorded as Document Number 118539 in Book 113 of Deeds 11 on page 103 in the Recorder's Office of Woodford County, 12 Illinois, described as follows: 13 Commencing at the intersection of the west line of the 14 East Half of the Northeast Quarter of the Northeast 15 Quarter of Section 20, Township 27 North, Range 2 West of 16 the Third Principal Meridian and the southerly right of 17 way line of Partridge Street in the Village of Metamora, 18 Illinois, as shown on a Plat of Honeysuckle Point 19 Subdivision recorded as Document Number 287476 in Book 20 26, Page 89, in the Recorder's Office of Woodford County, 21 Illinois; thence, on a basis of bearings from an assumed 22 north used on the aforesaid plat, North 00 degrees 07 23 minutes 52 seconds East, 60.00 feet to the northerly 24 right of way line of said Partridge Street; thence South 25 89 degrees 56 minutes 13 seconds, East 714.00 feet along 26 said northerly right of way line of Partridge Street to 27 the northerly existing right of way line of former S.B.I. 28 Route 116 and the Point Of Beginning; thence South 82 29 degrees 34 minutes 49 seconds West, 25.99 feet; thence 30 North 89 degrees 50 minutes 50 seconds East, 77.01 feet; 31 thence South 89 degrees 30 minutes 46 seconds East, 32 550.00 feet; thence South 89 degrees 58 minutes 54 33 seconds East, 100.00 feet; thence South 89 degrees 24 34 minutes 31 seconds East, 325.74 feet to a point being SB2214 Engrossed -4- LRB9213234LDcsA 1 60.00 feet radially distant from the existing centerline 2 of Illinois Route 116; thence North 84 degrees 25 minutes 3 38 seconds East, 98.56 feet to the northerly existing 4 right of way line of Illinois Route 116; thence North 88 5 degrees 43 minutes 38 seconds West, 875.79 feet along the 6 northerly existing right of way line of former S.B.I. 7 Route 116; thence South 88 degrees 32 minutes 46 seconds 8 West, 140.09 feet along said northerly existing right of 9 way line of former S.B.I. Upon the payment of the sum of $500.00 to 15 the State of Illinois, the rights or easements of access, 16 crossing, light, air and view from, to and over the following 17 described line and IL Route 116 are restored subject to 18 permit requirements of the State of Illinois, Department of 19 Transportation: 20 Parcel No. 3LR0071 21 A part of the Northeast Quarter of Section 21, Township 22 27 North, Range 1 West of the Third Principal Meridian, 23 Woodford County, Illinois, more particularly described as 24 follows: 25 Commencing at the intersection of the westerly right of 26 way line of Township Road 1700E and the southerly right 27 of way line of S.B.I. Route 116 as the Point Of Beginning 28 of the Release Of Access Control, said Point Of Beginning 29 being 112.00 feet South of Survey Line Station 414+72; 30 thence in a northwesterly direction to a point 60.00 feet 31 South of Survey Line Station 414+42; thence West, a 32 distance of 492.50 feet, more or less, to the termination 33 of said Release, said point being 60.00 feet south of SB2214 Engrossed -5- LRB9213234LDcsA 1 Station 409+49.5, containing 552.53 lineal feet, more or 2 less, situated in Roanoke Township, Woodford County, 3 Illinois. 4 Section 1-25. Upon the payment of $525.00 to the State of 5 Illinois and subject to the conditions set forth in Section 6 900 of this Act, the easement for highway purposes acquired 7 by the People of the State of Illinois is released over and 8 through the following described land in Lawrence County, 9 Illinois: 10 Parcel No. 7LA010X 11 Part of the South Half (S.1/2) of Section 36, T4N, R12W 12 of the Second Principal Meridian, Lawrence County, 13 Illinois, being all that part of City of Lawrenceville 14 Tract Number 11, as shown on Pages 3 and 4 in Road Deed 15 Book 7 in the Lawrence County Recorder's Office, lying 16 North of a line being 185 feet North of and parallel to 17 the centerline of Federal Aid Interstate Route 08 (U.S. 18 Route 50), as recorded in Road Deed Book 6, Pages 208-209 19 in said Recorder's Office, more particularly described as 20 follows: 21 Commencing at Station 543+64 on the centerline of Federal 22 Aid Interstate Route 08 (U.S. Route 50), as recorded in 23 Road Deed Book 6, Pages 208-209, Lawrence County 24 Recorder's Office; thence North 209.11 feet with the west 25 line of the former Cemetery of the City of Lawrenceville, 26 Illinois, now State of Illinois public road right of way, 27 to the Point of Beginning, being a point 185 feet 28 northwesterly of and normal to centerline Station 544+58 29 of said Route 08, thence N-00° -19'-24"-E 232.09 feet; 30 thence S-89° -06'-49"-E 432.41 feet to a point 185 feet 31 northwesterly of and normal to centerline Station 549+47 32 of said Route 08; thence southwesterly along a line 185 33 feet northwesterly of and parallel with said centerline SB2214 Engrossed -6- LRB9213234LDcsA 1 of Route 08 to the Point of Beginning, containing 1.15 2 acres, more or less. 3 The above described real estate is not located in the 4 Special Flood Hazard Area identified for Lawrence County, 5 Illinois by the Federal Emergency Management Agency on 6 the Flood Insurance Rate Map, Panel No. 80 of 150 dated 7 February 1, 1985. 8 The described real estate is within 1 1/2 miles of the 9 corporate limits of the City of Lawrenceville which has 10 adopted a City Plan and is exercising the special powers 11 authorized by Division 12 of Article 11 of the Illinois 12 Municipal Code, as now or hereafter amended. 13 Section 1-30. Upon the payment of the sum of $2,000.00 14 to the State of Illinois, the rights or easements of access, 15 crossing, light, air and view from, to and over the following 16 described line and FA Route 5 (Old U.S. 66) are restored 17 subject to permit requirements of the State of Illinois, 18 Department of Transportation: 19 Parcel No. 3LR0074 20 A part of the South Half of Section 34, Township 31 21 North, Range 7 East of the Third Principal Meridian, 22 Grundy County, Illinois, more particularly described as 23 follows: 24 Commencing at the southeast corner of the First Addition 25 Northbrook Subdivision; thence South 88 degrees 13 26 minutes 26 seconds West, along the south line of said 27 First Addition Northbrook Subdivision, 119.57 feet; 28 thence South 01 degree 47 minutes 21 seconds East, 388.58 29 feet, to a point on the northerly right of way line of 30 F.A. 5 (U.S. Route 66) per plat recorded in Road Plat 31 Record No. 1, Pages 66 and 67, said point being 125.00 32 feet right of Transit Line Station 387+24.5, more or 33 less, for said F.A. 5 (U.S. Route 66); thence North 70 SB2214 Engrossed -7- LRB9213234LDcsA 1 degrees 03 minutes 50 seconds East, 373.75 feet along 2 said northerly line of F.A. 5 (U.S. Route 66), to the 3 point of curvature of a 8469.42 foot radius curve to the 4 left at Station 383+50.72, 125.00 feet northerly of the 5 Transit Line; thence northeasterly, along said northerly 6 line of F.A. 5 (U.S. Route 66), on a curve, tangent to 7 the last described course, concave northwesterly, having 8 a radius of 8469.42 feet, an arc distance of 96.32 feet 9 and a chord of North 69 degrees 44 minutes 17 seconds 10 East, 96.32 feet, to the Point Of Beginning of the 11 Release Of Access Control, said point being 125.00 feet 12 northerly of said Transit Line Station 382+53, more or 13 less; thence continuing along the aforedescribed curve, 14 along said northerly line of F.A. Route 5, having a 15 radius of 8469.42 feet, an arc distance of 200.00 feet 16 and a chord of North 68 degrees 44 minutes 09 seconds 17 East, 200.00 feet, to the termination of said Release, 18 said point being 125.00 feet northerly of said Transit 19 Line Station 380+50, more or less, containing 200.00 20 lineal feet, more or less, situated in Grundy County, 21 Illinois. 22 Section 1-900. The Secretary of Transportation shall 23 obtain a certified copy of the portions of this Act 24 containing the title, enacting clause, the effective date, 25 the appropriate Section or Sections containing the land 26 descriptions of the property to be transferred or otherwise 27 affected under this Article, and this Section within 60 days 28 after its effective date and, upon receipt of payment 29 required by the Section or Sections, if any payment is 30 required, shall record the certified document in the 31 Recorder's Office in the county which the land is located. 32 ARTICLE 2 SB2214 Engrossed -8- LRB9213234LDcsA 1 Section 2-5. The Department of Natural Resources is 2 authorized to convey an easement to the owner of record of 3 the real estate described in this Section. The easement may 4 be permanent and is to provide access to the real estate and 5 shall not be for other purposes. The easement shall be 6 conveyed in such form and with such conditions as may be 7 determined by the Department to be necessary. The real 8 estate that is the subject of this Section is described as 9 follows: 10 Part of the West Half(W 1/2) of the Northeast Quarter (NE 11 1/4) of Section Numbered Two (2), Township Numbered Eight (8) 12 North, Range Numbered Six (6) West of the Third Principal 13 Meridian, described in detail as follows; 14 Commencing at an iron pin at the Northwest corner of the 15 Northeast Quarter (NE 1/4) of said Section Numbered Two (2); 16 Thence South 0 degree 29 minutes 30 seconds West along 17 the Quarter Section line one hundred twenty-six and sixty-one 18 hundredths (126.61) feet to the point of beginning. Said 19 point of beginning being located in the South line of the old 20 railroad right of way. 21 From the point of beginning South 89 degrees 21 minutes 22 24 seconds East along said right of way line thirteen hundred 23 thirty-five and seventy-six hundredths (1335.76) feet; 24 Thence South 0 degrees 29 minutes 30 seconds West eleven 25 hundred ninety-five and fifty-four hundredths (1195.54) feet; 26 Thence West thirteen hundred thirty-five and sixty-seven 27 hundredths (1335.67) feet; 28 Thence North 0 degrees 29 minutes 30 seconds East twelve 29 hundred eleven and thirty-eight hundredths (1211.38) feet 30 along the Quarter Section line to the point of beginning. 31 All in the County of Macoupin, State of Illinois. 32 Section 2-900. The Director of Natural Resources shall 33 obtain a certified copy of the portions of this Act SB2214 Engrossed -9- LRB9213234LDcsA 1 containing the title, enacting clause, the effective date, 2 the appropriate Section or Sections containing the land 3 descriptions of the property to be transferred or otherwise 4 affected under this Article, and this Section within 60 days 5 after its effective date and, upon receipt of payment 6 required by the Section or Sections, if any payment is 7 required, shall record the certified document in the 8 Recorder's Office in the county in which the land is located. 9 ARTICLE 999 10 Section 999-5. Effective date. This Act takes effect 11 upon becoming law.
