92_SB1019enr SB1019 Enrolled LRB9208158WHcs 1 AN ACT concerning employment. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Employee Benefit Contribution Act is 5 amended by changing Section 2 as follows: 6 (820 ILCS 160/2) (from Ch. 48, par. 39x) 7 Sec. 2. Any employer who has agreed to make payments to 8 an employee health insurance plan shall notify its employees 9 of any failure to make such payments where such failure 10 shallmayresult in the total loss of insurance coverage so 11 as to provide its employees a reasonable opportunity to 12 replace such coverage at the time the employee health 13 insurance plan terminates. The employer must provide written 14 notification directly to each of its employees who are 15 covered under the plan.Notification may be made by posting16in a conspicuous place in the place of employment.Any 17 employer who fails to provide timely notice of a prospective 18 termination of a health insurance plan, which failure results 19 in the deprivation of the opportunity to replace such 20 coverage and which further results in damages to one or more 21 employees arising from the loss of coverage, shall be guilty 22 of a Class B misdemeanor.The Department of Insurance has23authority to inspect places of employment for the purpose of24assuring the employer's compliance with the notification25requirements of this Section.26 (Source: P.A. 83-1006.)
