92_SB1019 LRB9208158WHcs 1 AN ACT concerning employment. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Employee Benefit Contribution Act is 5 amended by changing Section 2 as follows: 6 (820 ILCS 160/2) (from Ch. 48, par. 39x) 7 Sec. 2. Any employer who has agreed to make payments to 8 an employee health insurance plan shall notify its employees 9 of any failure to make such payments where such failure may 10 result in the loss of insurance coverage so as to provide its 11 employees a reasonable opportunity to replace such coverage 12 at the time the employee health insurance plan terminates. 13 The employer must mail the notification directly to each of 14 its employees who are covered under the plan.Notification15may be made by posting in a conspicuous place in the place of16employment.Any employer who fails to provide timely notice 17 of a prospective termination of a health insurance plan, 18 which failure results in the deprivation of the opportunity 19 to replace such coverage and which further results in damages 20 to one or more employees arising from the loss of coverage, 21 shall be guilty of a Class B misdemeanor.The Department of22Insurance has authority to inspect places of employment for23the purpose of assuring the employer's compliance with the24notification requirements of this Section.25 (Source: P.A. 83-1006.)
