Amend Senate Bill 950 by replacing 3 lines 7 through 31 on page 1 and lines 1 through 13 on page 2 4 with the following: 5 "Sec. 12-12.1. Deadbeats most wanted list. 6 (a) The Director may disclose a "deadbeats most wanted 7 list" of individuals who are in arrears in their child 8 support obligations under an Illinois court order or 9 administrative order. The list shall include only those 10 persons who are in arrears in an amount greater than $5,000 11 (or such greater amount as established by the Department by 12 rule). The list shall not exceed 200 individuals at any 13 point. The list shall include the individual's name and 14 address, the amount of any child support arrearage, and any 15 other information deemed appropriate by the Department. 16 (b) At least 90 days before the disclosure under 17 subsection (a) of the name of an individual who is in arrears 18 in his or her child support obligations, the Director shall 19 mail a written notice to the individual by certified mail 20 addressed to the individual's last known address. The notice 21 shall detail the amount of the arrearage and the Department's 22 intent to disclose the arrearage. If the arrearage is not 23 paid 60 days after the notice was delivered to the individual 24 or the Department has been notified that delivery was -2- LRB9208091WHcsam 1 refused, and the individual has not, since the mailing of the 2 notice, entered into a written agreement with the Department 3 for payment of the arrearage, the Director may disclose the 4 individual's arrearage under subsection (a). 5 (c) An individual in arrears in his or her child support 6 obligations under an Illinois court order or administrative 7 order is not subject to disclosure under subsection (a) if 8 (1) a written agreement for payment exists between the 9 individual and the Department or (2) the arrearage is the 10 subject of an administrative hearing, administrative review, 11 or judicial review. 12 (d) The list shall be available for public inspection at 13 the Department or by other means of publication, including 14 the Internet. 15 (e) The Department shall adopt reasonable rules for the 16 administration and implementation of this Section. 17 (f) A disclosure made by the Director in a good faith 18 effort to comply with this Section may not be considered a 19 violation of any confidentiality laws.".
