92_SB0950eng SB0950 Engrossed LRB9208091WHcs 1 AN ACT concerning child support. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Public Aid Code is amended by 5 adding Section 12-12.1 as follows: 6 (305 ILCS 5/12-12.1 new) 7 Sec. 12-12.1. Deadbeats most wanted list. 8 (a) The Director may disclose a "deadbeats most wanted 9 list" of individuals who are in arrears in their child 10 support obligations under an Illinois court order or 11 administrative order. The list shall include only those 12 persons who are in arrears in an amount greater than $5,000 13 (or such greater amount as established by the Department by 14 rule). The list shall not exceed 200 individuals at any 15 point. The list shall include the individual's name and 16 address, the amount of any child support arrearage, and any 17 other information deemed appropriate by the Department. 18 (b) At least 90 days before the disclosure under 19 subsection (a) of the name of an individual who is in arrears 20 in his or her child support obligations, the Director shall 21 mail a written notice to the individual by certified mail 22 addressed to the individual's last known address. The notice 23 shall detail the amount of the arrearage and the Department's 24 intent to disclose the arrearage. If the arrearage is not 25 paid 60 days after the notice was delivered to the individual 26 or the Department has been notified that delivery was 27 refused, and the individual has not, since the mailing of the 28 notice, entered into a written agreement with the Department 29 for payment of the arrearage, the Director may disclose the 30 individual's arrearage under subsection (a). 31 (c) An individual in arrears in his or her child support SB0950 Engrossed -2- LRB9208091WHcs 1 obligations under an Illinois court order or administrative 2 order is not subject to disclosure under subsection (a) if 3 (1) a written agreement for payment exists between the 4 individual and the Department or (2) the arrearage is the 5 subject of an administrative hearing, administrative review, 6 or judicial review. 7 (d) The list shall be available for public inspection at 8 the Department or by other means of publication, including 9 the Internet. 10 (e) A disclosure made by the Director in a good faith 11 effort to comply with this Section may not be considered a 12 violation of any confidentiality laws. 13 Section 99. Effective date. This Act takes effect upon 14 becoming law.
