92_SB0950 LRB9208091WHcs 1 AN ACT concerning child support. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Public Aid Code is amended by 5 adding Section 12-12.1 as follows: 6 (305 ILCS 5/12-12.1 new) 7 Sec. 12-12.1. World Wide Web page. The Illinois 8 Department of Public Aid shall create and maintain or cause 9 to be created and maintained one or more World Wide Web pages 10 containing information on selected individuals who are in 11 arrears in their child support obligations under an Illinois 12 court order or administrative order. The information 13 regarding each of the individuals shall include the 14 individual's name, a photograph if available, the amount of 15 the child support arrearage, and any other information deemed 16 appropriate by the Illinois Department in its discretion. The 17 individuals may be chosen by the Illinois Department using 18 criteria including, but not limited to, the amount of the 19 arrearage, the effect of inclusion of an individual upon the 20 likelihood of the individual's payment of an arrearage, the 21 motivational effect that inclusion of an individual may have 22 on the willingness of other individuals to pay their 23 arrearages, or the need to locate a particular individual. 24 The Illinois Department shall make the page or pages 25 accessible to Internet users through the World Wide Web. The 26 Illinois Department, in its discretion, may change the 27 contents of the page or pages from time to time. 28 Before including information on the World Wide Web page 29 concerning an individual who owes past due support, the 30 Illinois Department shall, pursuant to rule, provide the 31 individual with notice and an opportunity to be heard. Any -2- LRB9208091WHcs 1 final administrative decision rendered by the Illinois 2 Department shall be reviewed only under and in accordance 3 with the Administrative Review Law. 4 Section 10. The Clerks of Courts Act is amended by 5 adding Section 15.1 as follows: 6 (705 ILCS 105/15.1 new) 7 Sec. 15.1. Child support information. The clerks of the 8 circuit courts may, upon request, cooperate with and supply 9 information to counties and municipalities wishing to create 10 and maintain World Wide Web pages containing information on 11 individuals who are in arrears in their child support 12 obligations and have been found to be in contempt of court as 13 a result of the existence of that arrearage. 14 Section 99. Effective date. This Act takes effect upon 15 becoming law.
