Amend House Bill 4453 by replacing 3 everything after the enacting clause with the following: 4 "ARTICLE 1 5 Section 1-5. Upon the payment of the sum of $12,000.00 to 6 the State of Illinois, the rights or easements of access, 7 crossing, light, air and view from, to and over the following 8 described line and FAP Route 12 (US 40) are restored subject 9 to permit requirements of the State of Illinois, Department 10 of Transportation. 11 Parcel No. 800XA86 12 A line in the Southeast Quarter of the Southwest Quarter 13 of Section 14, Township 5 North, Range 3 West of the 14 Third Principal Meridian, Bond County, Illinois, more 15 particularly described as follows: 16 Commencing at a stone at the south quarter corner of said 17 Section 14; thence on an assumed bearing of South 88 18 degrees 45 minutes 55 seconds West on the south line of 19 said Section 14, a distance of 700.38 feet to an iron 20 rod; thence North 01 degree 45 minutes 03 seconds West, 21 576.33 feet to an iron rod on the south right of way line -2- LRB9204410LDtmam 1 of old U.S. Route 40, also being the Point of Beginning. 2 From said Point of Beginning; thence North 63 degrees 47 3 minutes 57 seconds East on said right of way line, 564.92 4 feet to an iron rod, being the point of terminus. 5 Section 1-10. The Secretary of Transportation shall 33 obtain a certified copy of the portions of this Act -8- LRB9204410LDtmam 1 containing the title, enacting clause, the effective date, 2 the appropriate Section or Sections containing the land 3 descriptions of the property to be transferred or otherwise 4 affected under this Article, and this Section within 60 days 5 after its effective date and, upon receipt of payment 6 required by the Section or Sections, if any payment is 7 required, shall record the certified document in the 8 Recorder's Office in the county which the land is located. 9 ARTICLE 2 10 Section 2-5. The Department of Natural Resources is 11 authorized to convey an easement to the owner of record of 12 the real estate described in this Section. The easement may 13 be permanent and is to provide access to the real estate and 14 shall not be for other purposes. The easement shall be 15 conveyed in such form and with such conditions as may be 16 determined by the Department to be necessary. The real 17 estate that is the subject of this Section is described as 18 follows: 19 Part of the West Half(W 1/2) of the Northeast Quarter (NE 20 1/4) of Section Numbered Two (2), Township Numbered Eight (8) 21 North, Range Numbered Six (6) West of the Third Principal 22 Meridian, described in detail as follows; 23 Commencing at an iron pin at the Northwest corner of the 24 Northeast Quarter (NE 1/4) of said Section Numbered Two (2); 25 Thence South 0 degree 29 minutes 30 seconds West along 26 the Quarter Section line one hundred twenty-six and sixty-one 27 hundredths (126.61) feet to the point of beginning. The Director of Natural Resources shall 10 obtain a certified copy of the portions of this Act 11 containing the title, enacting clause, the effective date, 12 the appropriate Section or Sections containing the land 13 descriptions of the property to be transferred or otherwise 14 affected under this Article, and this Section within 60 days 15 after its effective date and, upon receipt of payment 16 required by the Section or Sections, if any payment is 17 required, shall record the certified document in the 18 Recorder's Office in the county in which the land is located. 19 ARTICLE 3 20 Section 3-5. The Secretary of Human Services and the 7 Kankakee River Valley Forest Preserve District are authorized 8 to enter into an intergovernmental agreement that sets forth 9 the conditions for the use and occupancy of the land subject 10 to Section 3-5. The Secretary of Human Services and the 11 Kankakee River Valley Forest Preserve District must enter 12 into the intergovernmental agreement prior to the transfer of 13 said land. If the Kankakee River Valley Forest Preserve 14 District breaches a condition of the intergovernmental 15 agreement, then the State of Illinois shall have the right of 16 entry upon said land upon written demand submitted by the 17 Secretary of Human Services or his or her successor on behalf 18 of the State of Illinois and upon return of the purchase 19 price. 20 Section 3-900. The Secretary of Human Services shall 21 obtain a certified copy of the portions of this Act 22 containing the title, the enacting clause, the effective 23 date, the appropriate Section or Sections containing the land 24 descriptions of the property to be transferred or otherwise 25 affected under this Article, Section 3-10, and this Section 26 within 60 days after its effective date and, upon receipt of 27 payment required by the Section or Sections, if any payment 28 is required, shall record the certified document in the 29 Recorder's Office in the county in which the land is located. 30 ARTICLE 4 -12- LRB9204410LDtmam 1 Section 4-5. Upon payment of the sum of $1, the Director 2 of Veterans' Affairs, on behalf of the State of Illinois, is 3 authorized to convey by quitclaim deed to the Manteno Fire 4 Protection District all right, title, and interest in and to 5 the following described real property located in Kankakee 6 County, Illinois: 7 A part of the East Half of the Southwest Quarter of 8 Section 23, Township 32 North, Range 12 East of Third 9 Principal Meridian in Kankakee County, Illinois, 10 described as follows: Commencing at the Southwest corner 11 of the East Half of the Southwest Quarter of said Section 12 23; thence South 89 degrees 53 minutes 18 seconds East 13 along the South line of the Southwest Quarter of said 14 Section 23 a distance of 502.30 feet (as previously 15 described) to an iron rod, said point to be known as the 16 point of beginning. From said point of beginning; thence 17 North 00 degrees 04 minutes 05 seconds East a distance of 18 519.07 feet (previously described as North 00 degrees 11 19 minutes 50 seconds East a distance of 518.98 feet) to an 20 iron rod; thence North 89 degrees 58 minutes 11 seconds 21 East (previously described as South 89 degrees 53 minutes 22 18 seconds East) a distance of 643.04 feet to an iron 23 rod; thence South 00 degrees 32 minutes 27 seconds East a 24 distance of 520.70 feet to an iron rod on the South line 25 of the Southwest Quarter of said Section 23; thence North 26 89 degrees 53 minutes 18 seconds West a distance of 27 648.57 feet to the point of beginning, EXCEPT the South 28 65.00 feet thereof, containing 6.74 acres more or less, 29 SUBJECT TO rights-of-way for roads, drainage and 30 easements apparent or of record. 31 Section 4-10. The conveyance of real property authorized 32 by Section 4-5 shall be made subject to the express condition 33 that the property must be used for public or educational -13- LRB9204410LDtmam 1 purposes and that if the property ceases to be used for 2 public or educational purposes, it shall revert to the State 3 of Illinois without further action on the part of the State. 4 Section 4-15. The Director of Veterans' Affairs shall 5 obtain a certified copy of the portions of this Act 6 containing the title, the enacting clause, the effective 7 date, the appropriate Sections containing the land 8 descriptions of property to be transferred under this 9 Article, Section 4-10, and this Section within 60 days after 10 this Act's effective date and, upon receipt of payment 11 required by the appropriate Sections, shall record the 12 certified document in the Recorder's office in the county in 13 which the land is located. 14 ARTICLE 5 15 Section 5-1. The Director of the Department of Natural 16 Resources, on behalf of the State of Illinois, is authorized 17 to Convey and Quit Claim unto the City of Granite City, an 18 Illinois unit of local government, its successors and 19 assigns, for and in consideration of $1.00 paid to said 20 Department, a non-exclusive, unobstructed, perpetual easement 21 for the purpose of constructing, installing, or laying, and 22 thereafter using, operating, inspecting, repairing, 23 maintaining, and replacing a storm water ditch or sewer on, 24 over, under, and across all or part of the following 25 described real property, subject to such conditions as may be 26 deemed necessary by said Department to protect the public 27 interest, to wit: 28 An 80-foot wide tract of land being 40 feet wide on 29 either side of a centerline located in the West Half of 30 Section 15, Township 3 North, Range 9 West of the Third 31 Principal Meridian, Madison County, Illinois, said -14- LRB9204410LDtmam 1 centerline being more fully described as follows: 2 Commencing at the Southeast corner of the Northwest 3 Quarter of the Northwest Quarter of said Section 15; 4 thence North along the East line of said Northwest 5 Quarter of the Northwest Quarter of Section 15, a 6 distance of 574.2 feet to a point on the southeasterly 7 right-of-way line of the former Nickel Plate Railroad; 8 thence Southwesterly along said right-of-way line, a 9 distance of 69.04 feet to a point on the centerline of a 10 tract of land conveyed to the Alton and Southern 11 Railroad Company by deed recorded in Book 550, Page 167 12 in the records of Madison County, Illinois, and being 13 the Point of Beginning of the centerline being described; 14 thence South along the centerline of said tract conveyed 15 to the Alton and Southern Railroad Company, a distance of 16 2700 feet, more or less, to a point on the Northerly 17 shoreline of Horseshoe Lake, being the Termination Point 18 of the centerline being described; 19 Said 80-foot wide tract being bounded on the North 20 by the Southeasterly right-of-way line of the former 21 Nickel Plate Railroad, and on the South by the Northerly 22 shoreline of Horseshoe Lake. 23 Section 5-900. The Director of Natural Resources shall 24 obtain a certified copy of the portions of this Act 25 containing the title, enacting clause, the effective date, 26 the appropriate Section or Sections containing the land 27 descriptions of the property to be transferred or otherwise 28 affected under this Article, and this Section within 60 days 29 after its effective date and, upon receipt of the payment 30 required by the Section or Sections, if any payment is 31 required, shall record the certified document in the 32 Recorder's Office in the county in which the land is located. -15- LRB9204410LDtmam 1 ARTICLE 999 2 Section 999-5. Effective date. This Act takes effect 3 upon becoming law.".
