92_HB4453sam003 LRB9204410LDcsam 1 AMENDMENT TO HOUSE BILL 4453 2 AMENDMENT NO.___. Amend House Bill 4453, AS AMENDED, by 3 inserting the following after the end of Section 1-40: 4 "Section 1-45. Upon the payment of the sum of $1,140.00 5 to the State of Illinois, and subject to the conditions set 6 forth in Section 1-900 of this Act, the easement for highway 7 purposes acquired by the People of the State of Illinois is 8 released over and through the following described land in 9 Ogle County, Illinois: 10 Parcel No. 2DOG037 11 A parcel of land in the Southwest Quarter of Section 4, 12 Township 22 North, Range 8 East of the Fourth Principal 13 Meridian, Ogle County, Illinois, described as follows: 14 Commencing at the South Quarter Corner of said Section 4; 15 thence northerly on the east line of the Southwest 16 Quarter of said Section 4, said line having a bearing of 17 North 0 degrees 48 minutes 27 seconds East, a distance of 18 332.94 feet to a point; thence westerly on a line having 19 a bearing of North 89 degrees 13 minutes 29 seconds West, 20 a distance of 67.24 feet to a point in the northwesterly 21 right-of-way line of a public highway designated S.B.I. 22 Route 87 (Sterling Road), said point being the Point of 23 Beginning of the hereinafter described parcel of land; -2- LRB9204410LDcsam 1 thence southerly on a line having a bearing of South 0 2 degrees 46 minutes 31 seconds West, a distance of 234.02 3 feet to a point; thence southwesterly on a line having a 4 bearing of South 33 degrees 09 minutes 47 seconds West, a 5 distance of 32.95 feet to a point; thence westerly on a 6 line having a bearing of South 88 degrees 54 minutes 10 7 seconds West, a distance of 235.92 feet to a point in 8 said northwesterly right-of-way line; thence 9 northeasterly on said northwesterly right-of-way line, a 10 distance of 379.95 feet on a curve to the left, having a 11 radius of 477.18 feet, a central angle of 45 degrees 37 12 minutes 17 seconds and the long chord of said curve bears 13 North 44 degrees 00 minutes 40 seconds East, a chord 14 distance of 369.99 feet to the Point of Beginning, 15 containing 0.542 acre, more or less. 16 For the purpose of this description, said east line of 17 the Southwest Quarter of Section 4 has been assigned the 18 bearing of North 0 degrees 48 minutes 27 seconds East."; 19 and 20 immediately below the end of Article 5, by inserting the 21 following: 22 "ARTICLE 6 23 Section 6-5. Upon payment of the sum of $1, the Director 24 of the Historic Preservation Agency, on behalf of the State 25 of Illinois, is authorized to convey by quitclaim deed to 26 Lewis University all right, title, and interest in and to the 27 following described real property located in Will County, 28 Illinois: 29 That part of Lot 8 in Fitzpatrick Subdivision, being a 30 subdivision of part of Section 15, Township 36 North, 31 Range 10 East of the Third Principal Meridian, according 32 to the plat thereof recorded May 12, 1933, in Plat Book -3- LRB9204410LDcsam 1 23, pages 30 and 31 as document no. 464335, described as 2 follows: commencing at the southwest corner of the 3 southeast 1/4 of said Section 15; thence north along the 4 north-south center line of said Section 15, for a 5 distance of 1,089 feet; thence west and perpendicular to 6 the last described line for a distance of 155.13 feet to 7 the east right-of-way line of Illinois State Route 53; 8 thence north along said right-of-way line for a distance 9 of 110 feet for a point of beginning; thence east and 10 perpendicular to the last described line for a distance 11 of 300 feet; thence north and perpendicular to the last 12 described line for a distance of 350 feet; thence west 13 and perpendicular to the last described line a distance 14 of 300 feet to the east right-of-way line of Illinois 15 State Route 53; thence south along said right-of-way line 16 for a distance of 350 feet to the point of beginning, all 17 in Will County, Illinois. 18 Section 6-10. The conveyance of real property authorized 19 by Section 6-5 shall be made subject to the express condition 20 that the property must be maintained as a historic property 21 in accordance with the Secretary of the Interior's Standards 22 for the Rehabilitation of Historic Buildings, and the 23 property must be used for public or educational purposes and 24 that if the property ceases to be used for public or 25 educational purposes, or is not maintained as a historic 26 building it shall revert to the State of Illinois without 27 further action on the part of the State. 28 ARTICLE 7 29 Section 7-5. The conveyance of real property authorized 25 by Section 7-5 shall be made subject to the condition that 26 said real property shall be used for the promotion, 27 protection and preservation of wildlife and the setting aside 28 of the real property for open space and outdoor recreational 29 activities specifically that the part of the 74.771 acres 30 lying in the flood plain and adjacent to the DuPage River 31 shall be set aside and left as best it can in its natural 32 state, though permitting its limited development with walking 33 and hiking paths and that that part of the 74.771 acres lying -7- LRB9204410LDcsam 1 west of the west flood plain line adjacent to the DuPage 2 River may be used for open space and outdoor recreational 3 activities, including the construction of parking lots, 4 washrooms, picnic grounds and outdoor recreational facilities 5 and buildings ancillary thereto, reference being had to that 6 Order of Distribution and Settlement entered May 14, 1997, in 7 the Circuit Court of the 12th Judicial Circuit, Will County, 8 Illinois, in Case Number 95-PE-3202.".
