92_HB4344ham001 LRB9213778DHmbam01 1 AMENDMENT TO HOUSE BILL 4344 2 AMENDMENT NO. . Amend House Bill 4344 as follows: 3 on page 1, by replacing lines 4 through 12 with the 4 following: 5 "Section 5. The Illinois Vehicle Code is amended by 6 adding Sections 1-113.1, 1-202.1, 3-804.1, and 3-804.2 and by 7 changing Sections 3-104, 3-413, 4-209, 12-205, 12-208, 8 12-301, 12-501, 12-607, 12-608, 13-101, 13A-104, and 13B-15 9 as follows:"; and 10 on page 5, below line 15, by inserting the following: 11 "(625 ILCS 5/3-413) (from Ch. 95 1/2, par. 3-413) 12 Sec. 3-413. Display of registration plates, registration 13 stickers and driveway decal permits. 14 (a) Registration plates issued for a motor vehicle other 15 than a motorcycle, trailer, semitrailer, truck-tractor, 16 apportioned bus, or apportioned truck shall be attached 17 thereto, one in the front and one in the rear. The 18 registration plate issued for a motorcycle, trailer or 19 semitrailer required to be registered hereunder and any 20 apportionment plate issued to a bus under the provisions of 21 this Code shall be attached to the rear thereof. The -2- LRB9213778DHmbam01 1 registration plate issued for a truck-tractor or an 2 apportioned truck required to be registered hereunder shall 3 be attached to the front thereof. 4 (b) Every registration plate shall at all times be 5 securely fastened in a horizontal position to the vehicle for 6 which it is issued so as to prevent the plate from swinging 7 and at a height of not less than 12 inches from the ground, 8 measuring from the bottom of such plate, except that street 9 rod and custom vehicle registration plates must be mounted no 10 less than 5 inches from the ground, measuring from the bottom 11 of the plate. A registration plate must also be in a place 12 and position to be clearly visible and shall be maintained in 13 a condition to be clearly legible, free from any materials 14 that would obstruct the visibility of the plate, including, 15 but not limited to, glass covers and tinted plastic covers. 16 Clear plastic covers are permissible as long as they remain 17 clear and do not obstruct the visibility of the plates. 18 Registration stickers issued as evidence of renewed annual 19 registration shall be attached to registration plates as 20 required by the Secretary of State, and be clearly visible at 21 all times. 22 (c) Every driveway decal permit issued pursuant to this 23 Code shall be firmly attached to the inside windshield of the 24 motor vehicle in such a manner that it cannot be removed 25 without being destroyed. If such decal permits are affixed 26 to a motor vehicle in any other manner the permit shall be 27 void and of no effect. 28 (d) The Illinois prorate decal issued to a foreign 29 registered vehicle part of a fleet prorated or apportioned 30 with Illinois, shall be displayed on a registration plate and 31 displayed on the front of such vehicle in the same manner as 32 an Illinois registration plate. 33 (e) The registration plate issued for a camper body 34 mounted on a truck displaying registration plates shall be -3- LRB9213778DHmbam01 1 attached to the rear of the camper body. 2 (f) No person shall operate a vehicle, nor permit the 3 operation of a vehicle, upon which is displayed an Illinois 4 registration plate, plates or registration stickers after the 5 termination of the registration period for which issued or 6 after the expiration date set pursuant to Sections 3-414 and 7 3-414.1 of this Code. 8 (Source: P.A. 89-245, eff. 1-1-96; 89-375, eff. 8-18-95.)"; 9 and 10 on page 5, by replacing lines 17 and 18 with the following: 11 "Sec. 3-804.1. Custom vehicles. The owner of a custom 12 vehicle may register that"; and 13 on page 5, by replacing lines 24 through 27 with the 14 following: 15 "uses and will not be used for general daily transportation. 16 The"; and 17 on page 6, by deleting lines 4 through 12; and 18 on page 6, by replacing lines 14 and 15 with the following: 19 "Sec. 3-804.2. Street rods. The owner of street rod may 20 register the vehicle for"; and 21 on page 6, by replacing lines 21 through 24 with the 22 following: 23 "general daily transportation. The Secretary may, in his or 24 her"; and 25 on page 6, by deleting line 33; and 26 on page 7, by deleting lines 1 through 8; and 27 on page 8, by deleting lines 14 through 33; and 28 on page 9, by deleting lines 1 through 28; and 29 on page 10, by replacing line 23 with the following: -4- LRB9213778DHmbam01 1 "shall be equipped with"; and 2 on page 11, by replacing lines 12 and 13 with the following: 3 "12-208 of this Act."; and 4 on page 11, by replacing lines 28 through 33 with the 5 following: 6 "emit a red or amber light. An antique vehicle shall be 7 equipped with a turn signal device of the same type 8 originally installed by the manufacturer as original 9 equipment and in working order."; and 10 on page 13, by replacing lines 2 and 3 with the following: 11 "3. Every antique vehicle shall be equipped with the 12 brakes of"; and 13 on page 15, below line 30, by inserting the following: 14 "(625 ILCS 5/12-607) (from Ch. 95 1/2, par. 12-607) 15 Sec. 12-607. Suspension System. 16 (a) It shall be unlawful to operate a motor vehicle, 17 other than a street rod or a custom vehicle, on any highway 18 of this State when the suspension system has been modified 19 from the original manufactured design by lifting the body 20 from the chassis in excess of 3 inches or to cause the 21 horizontal line from the front to the rear bumper to vary 22 over 3 inches in height when measured from a level surface of 23 the highway to the lower edge of the bumper. 24 (b) Nothing in this Section shall prevent the 25 installation of manufactured heavy duty equipment to include 26 shock absorbers and overload springs, nor shall anything 27 contained in this Section prevent a person to operate a motor 28 vehicle on any highway of this State with normal wear of the 29 suspension system if normal wear does not affect the control 30 or safe operation of the vehicle. This Section shall not 31 apply to motor vehicles designed or modified primarily for -5- LRB9213778DHmbam01 1 off-highway racing purposes while such vehicles are in tow or 2 to motorcycles or motor driven cycles. 3 (Source: P.A. 78-436.)"; and 4 on page 17, by replacing lines 2 through 7 with the 5 following: 6 "(b) This Section shall not apply to street rods, custom 7 vehicles, motor vehicles designed or modified primarily for 8 off-highway purposes while such vehicles are in tow or to 9 motorcycles or motor driven cycles, nor to motor vehicles 10 registered as antique vehicles when the original design of 11 such antique vehicles did not include bumpers. The provisions 12 of this"; and 13 on page 19, by replacing line 19 with the following: 14 "(h) vehicles owned or operated by a manufacturer, 15 dealer".
