92_HB3192enr HB3192 Enrolled LRB9207087NTsbA 1 AN ACT concerning education. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Disabled Persons Rehabilitation Act is 5 amended by changing Section 13a as follows: 6 (20 ILCS 2405/13a) (from Ch. 23, par. 3444a) 7 Sec. 13a. (a) The Department shall be responsible for 8 coordinating the establishment of local Transition Planning 9 Committees. Members of the committees shall consist of 10 representatives from special education; vocational and 11 regular education; post-secondary education; parents of youth 12 with disabilities; persons with disabilities; local business 13 or industry; the Department of Human Services; public and 14 private adult service providers; case coordination; and other 15 consumer, school, and adult services as appropriate. The 16 Committee shall elect a chair and shall meet at least 17 quarterly. Each Transition Planning Committee shall: 18 (1) identify current transition services, programs, 19 and funding sources provided within the community for 20 secondary and post-secondary aged youth with disabilities 21 and their families as well as the development of 22 strategies to address unmet needs; 23 (2) facilitate the development of transition 24 interagency teams to address present and future 25 transition needs of individual students on their 26 individual education plans; 27 (3) develop a mission statement that emphasizes the 28 goals of integration and participation in all aspects of 29 community life for persons with disabilities; 30 (4) provide for the exchange of information such as 31 appropriate data, effectiveness studies, special HB3192 Enrolled -2- LRB9207087NTsbA 1 projects, exemplary programs, and creative funding of 2 programs; 3 (5) develop consumer in-service and awareness 4 training programs in the local community; and 5 (6) assist in staff training for individual 6 transition planning and student transition needs 7 assessment. 8 (b) Each Transition Planning Committee shall select a 9 chair from among its members who shall serve for a term of 10 one year. Each committee shall meet at least quarterly, or 11 at such other times at the call of the chair. 12 (c) Each Transition Planning Committee shall annually 13 prepare and submit to the Interagency Coordinating Council a 14 reportsummarywhich assesses the level of currently 15 available services in the community as well as the level of 16 unmet needs of secondary students with disabilities, makes 17 recommendations to address unmet needs, and summarizes the 18 steps taken to address unmet needs based on the 19 recommendations made in previous reports. 20 (d) The name and affiliation of each local Transition 21 Planning Committee member and the annual report required 22 under subsection (c) of this Section shall be filed with the 23 administrative office of each school district served by the 24 local Transition Planning Committee, be made available to the 25 public upon request, and be sent to each member of the 26 General Assembly whose district encompasses the area served 27 by the Transition Planning Committee. 28 (Source: P.A. 89-507, eff. 7-1-97.) 29 Section 7. The Interagency Coordinating Council Act is 30 amended by changing Sections 2 and 3 as follows: 31 (20 ILCS 3970/2) (from Ch. 127, par. 3832) 32 Sec. 2. Interagency Coordinating Council. There is HB3192 Enrolled -3- LRB9207087NTsbA 1 hereby created an Interagency Coordinating Council which 2 shall be composed of the Directors, or their designees, of 3 the Illinois Department of Children and Family Services, 4 Illinois Department of Commerce and Community Affairs, 5 Illinois Department of Corrections, Illinois Department of 6 Employment Security, and Illinois Department of Public Aid; 7 the Secretary of Human Services or his or her designee; the 8 Executive Director, or a designee, of the Illinois Community 9 College Board, the Board of Higher Education, and the 10 Illinois Planning Council on Developmental Disabilities; the 11 State Superintendent of Education, or a designee; and a 12 designee representing the University of Illinois - Division 13 of Specialized Care for Children. The Secretary of Human 14 Services (or the member who is the designee for the Secretary 15 of Human Services) and the State Superintendent of Education 16 (or the member who is the designee for the State 17 Superintendent of Education) shall be co-chairs of the 18 Council. The co-chairs shall be responsible for ensuring 19 that the functions described in Section 3 of this Act are 20 carried outAt its first meeting the Council shall select a21chair from among its members who shall serve for a term of 222years. 23 (Source: P.A. 89-507, eff. 7-1-97.) 24 (20 ILCS 3970/3) (from Ch. 127, par. 3833) 25 Sec. 3. Scope and Functions. The Interagency 26 Coordinating Council shall: 27 (a) gather and coordinate data on services for secondary 28 age youth with disabilities in transition from school to 29 employment, post-secondary education and training, and 30 community living; 31 (b) provide information, consultation, and technical 32 assistance to State and local agencies and local school 33 districts involved in the delivery of services to youth with HB3192 Enrolled -4- LRB9207087NTsbA 1 disabilities in transition from secondary school programs to 2 employment and other post-secondary programs; 3 (c) assist State and local agencies and school 4 districts, through local transition planning committees, in 5 establishing interagency agreements to assure the necessary 6 services for efficient and appropriate transition from school 7 to employment, post-secondary education and training, and 8 community living; 9 (d) conduct an annual statewide evaluation of student 10 transition outcomes and needs from information collected from 11 local transition planning committees, school districts, and 12 other appropriate sources; indicators used to evaluate 13 outcomes shall include (i) high school graduation or passage 14 of the Test of General Educational Development, (ii) 15 participation in post-secondary education, including 16 continuing and adult education, (iii) involvement in 17 integrated employment, supported employment, and work-based 18 learning activities, including vocational training, and (iv) 19 independent living, community participation, adult services, 20 and other post-secondary activitiesassessment of transition21needs and post-secondary school outcomes from information22supplied by local transition planning committees; and 23 (e) provide periodic in-service training to consumers in 24 developing and improving awareness of transition services. 25 (Source: P.A. 86-1218.) 26 Section 10. The School Code is amended by changing 27 Section 14-8.03 as follows: 28 (105 ILCS 5/14-8.03) (from Ch. 122, par. 14-8.03) 29 Sec. 14-8.03. Transition goals, supports, and services. 30 (a) A school district shall consider, and develop when 31 needed, the transition goals and supports for eligible 32 students with disabilities not later thanbythe school year HB3192 Enrolled -5- LRB9207087NTsbA 1 in which the student reaches age 14 1/2 at the individualized 2 education planprogrammeeting and provide services as 3 identified on the student's individualized education plan 4program. Transition goals shall be based on appropriate 5 evaluation procedures and information, take into 6 consideration the preferences of the student and his or her 7 parents or guardian, be outcome-oriented, and include 8 employment, post-secondary education, and community living 9 alternatives. Consideration of these goals shall result in 10 the clarification of a school district's responsibility to 11 deliver specific educational services such as vocational 12 training and community living skills instruction. 13 (b) To appropriately assess and plan for the student's 14 transition needs, additional individualized education plan 15 teamprogrammembers may be necessary and may be asked by 16 the school district to assist in the planning process. 17 Additional individualized education plan teamprogram18planningmembers may include a representative from the 19 Department of Human Services, a case coordinator, or persons 20 representing other community agencies or services. The 21 individualized education planprogramshall specify each 22 personwho isresponsible for coordinating and delivering 23 transition services. The public school's responsibility for 24 delivering educational services does not extend beyond the 25 time the student leaves school or when the student reaches 26 age 21. 27 (c) A school district shall submit annually a summary of 28 each eligible student's transition goals and needed supports 29 resulting from themultidisciplinary staff conference and30 individualized education plan teamprogrammeeting to the 31 appropriate local Transition Planning Committee. If students 32 with disabilities who are ineligible for special education 33 services request transition services, local public school 34 districts shall assist those students by identifying HB3192 Enrolled -6- LRB9207087NTsbA 1 post-secondary school goals, delivering appropriate education 2 services, and coordinating with other agencies and services 3 for assistance. 4 (Source: P.A. 89-397, eff. 8-20-95; 89-507, eff. 7-1-97.) 5 Section 99. Effective date. This Act takes effect upon 6 becoming law.
