92_HB3192eng HB3192 Engrossed LRB9207087NTsbA 1 AN ACT concerning education. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Disabled Persons Rehabilitation Act is 5 amended by changing Section 13a as follows: 6 (20 ILCS 2405/13a) (from Ch. 23, par. 3444a) 7 Sec. 13a. (a) The Department shall be responsible for 8 coordinating the establishment of local Transition Planning 9 Committees. Members of the committees shall consist of 10 representatives from special education; vocational and 11 regular education; post-secondary education; parents of youth 12 with disabilities; persons with disabilities; local business 13 or industry; the Department of Human Services; public and 14 private adult service providers; case coordination; and other 15 consumer, school, and adult services as appropriate. The 16 Committee shall elect a chair and shall meet at least 17 quarterly. Each Transition Planning Committee shall: 18 (1) identify current transition services, programs, 19 and funding sources provided within the community for 20 secondary and post-secondary aged youth with disabilities 21 and their families as well as the development of 22 strategies to address unmet needs; 23 (2) facilitate the development of transition 24 interagency teams to address present and future 25 transition needs of individual students on their 26 individual education plans; 27 (3) develop a mission statement that emphasizes the 28 goals of integration and participation in all aspects of 29 community life for persons with disabilities; 30 (4) provide for the exchange of information such as 31 appropriate data, effectiveness studies, special HB3192 Engrossed -2- LRB9207087NTsbA 1 projects, exemplary programs, and creative funding of 2 programs; 3 (5) develop consumer in-service and awareness 4 training programs in the local community; and 5 (6) assist in staff training for individual 6 transition planning and student transition needs 7 assessment. 8 (b) Each Transition Planning Committee shall select a 9 chair from among its members who shall serve for a term of 10 one year. Each committee shall meet at least quarterly, or 11 at such other times at the call of the chair. 12 (c) Each Transition Planning Committee shall annually 13 prepare and submit to the Interagency Coordinating Council a 14 reportsummarywhich assesses the level of currently 15 available services in the community as well as the level of 16 unmet needs of secondary students with disabilities, makes 17 recommendations to address unmet needs, and summarizes the 18 steps taken to address unmet needs based on the 19 recommendations made in previous reports. 20 (d) The name and affiliation of each local Transition 21 Planning Committee member and the annual report required 22 under subsection (c) of this Section shall be filed with the 23 administrative office of each school district served by the 24 local Transition Planning Committee, be made available to the 25 public upon request, and be sent to each member of the 26 General Assembly whose district encompasses the area served 27 by the Transition Planning Committee. 28 (Source: P.A. 89-507, eff. 7-1-97.) 29 Section 10. The School Code is amended by adding 30 Section 14-3.05 and changing Section 14-8.03 as follows: 31 (105 ILCS 5/14-3.05 new) 32 Sec. 14-3.05. Study on post-school experiences. The HB3192 Engrossed -3- LRB9207087NTsbA 1 State Board of Education must contract with an entity 2 experienced in applied research to conduct a longitudinal 3 study over 5 years, to be completed on or before May 31, 4 2006, of the post-school experiences of children with 5 disabilities who exit high schools in this State in 2001, 6 including employment, post-secondary education, vocational 7 education, continuing and adult education, independent 8 living, community participation, and adult services. The 9 State Board of Education must provide an interim report of 10 this study to the Governor and the General Assembly on or 11 before May 31, 2002 and on or before May 31, 2004. The State 12 Board of Education must provide a final report of this study 13 to the Governor and the General Assembly on or before May 31, 14 2006. 15 (105 ILCS 5/14-8.03) (from Ch. 122, par. 14-8.03) 16 Sec. 14-8.03. Transition goals, supports, and services. 17 (a) A school district shall consider, and develop when 18 needed, the transition goals and supports for eligible 19 students with disabilities not later thanbythe school year 20 in which the student reaches age 14 1/2 at the individualized 21 education planprogrammeeting and provide services as 22 identified on the student's individualized education plan 23program. Transition goals shall be based on appropriate 24 evaluation procedures and information, take into 25 consideration the preferences of the student and his or her 26 parents or guardian, be outcome-oriented, and include 27 employment, post-secondary education, and community living 28 alternatives. Consideration of these goals shall result in 29 the clarification of a school district's responsibility to 30 deliver specific educational services such as vocational 31 training and community living skills instruction. 32 (b) To appropriately assess and plan for the student's 33 transition needs, additional individualized education plan HB3192 Engrossed -4- LRB9207087NTsbA 1 teamprogrammembers may be necessary and may be asked by 2 the school district to assist in the planning process. 3 Additional individualized education plan teamprogram4planningmembers may include a representative from the 5 Department of Human Services, a case coordinator, or persons 6 representing other community agencies or services. The 7 individualized education planprogramshall specify each 8 personwho isresponsible for coordinating and delivering 9 transition services. The public school's responsibility for 10 delivering educational services does not extend beyond the 11 time the student leaves school or when the student reaches 12 age 21. 13 (c) A school district shall submit annually a summary of 14 each eligible student's transition goals and needed supports 15 resulting from themultidisciplinary staff conference and16 individualized education plan teamprogrammeeting to the 17 appropriate local Transition Planning Committee. If students 18 with disabilities who are ineligible for special education 19 services request transition services, local public school 20 districts shall assist those students by identifying 21 post-secondary school goals, delivering appropriate education 22 services, and coordinating with other agencies and services 23 for assistance. 24 (Source: P.A. 89-397, eff. 8-20-95; 89-507, eff. 7-1-97.) 25 Section 99. Effective date. This Act takes effect upon 26 becoming law.
