92_HB0604eng HB0604 Engrossed LRB9201924LBgc 1 AN ACT relating to facility planning areas. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Facility Planning Area Rules Act. 6 Section 5. Definitions. For the purposes of this Act: 7 "Facility planning area" means an area as defined in 8 paragraph 2.33 of the Illinois Water Quality Management Plan. 9 "Resource protection plan" is any plan adopted by a 10 public agency that includes goals, policies, strategies, and 11 procedures for preserving key farmland, natural areas, 12 cultural resources, or aquatic resources. 13 Section 10. Rules. Within one year of the enactment of 14 this Act, the Illinois Environmental Protection Agency shall 15 propose rules that set forth procedures for Agency approval 16 of facility planning area amendments that provide that the 17 Agency shall do the following: 18 (a) approve amendments only when they: 19 (1) are consistent with (i) the provisions of 20 the Illinois Water Quality Management Plan and its 21 recommended ordinances for nonpoint source control 22 including, but not limited to, provisions and 23 ordinances related to construction site runoff, 24 urban runoff, and hydrographic modification; (ii) 25 the Illinois Nonpoint Source Management Program; and 26 (iii) antidegradation criteria; and 27 (2) do not cause or contribute to violations 28 of water quality standards; and 29 (b) consider local, county, and regional land use 30 plans and resource protection plans. The Agency may deny HB0604 Engrossed -2- LRB9201924LBgc 1 facility planning area amendments that are inconsistent 2 with a local or regional comprehensive plan or a resource 3 protection plan. 4 Section 90. Repealer. This Act is repealed on January 5 1, 2007. 6 Section 99. Effective date. This Act takes effect upon 7 becoming law.
