1 AN ACT relating to facility planning areas.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended
5 by adding Section 12.5 as follows:
6 (415 ILCS 5/12.5 new)
7 Sec. 12.5. Facility planning area enlargements. The
8 Agency shall propose and the Board shall adopt rules to
9 require consideration of the water quality impact of proposed
10 changes in a facility planning area. A proposed facility
11 planning area enlargement may be approved only if the
12 proposal (1) includes mitigation for all negative water
13 quality impacts, including non-point source pollution, (2) is
14 fully consistent with clean water laws and regulations, (3)
15 is consistent with the Illinois Quality Management Plan, and
16 (4) is consistent with any applicable resource protection
17 plan.
