91_SB1042sam001 SDS/910025/AMdo 1 AMENDMENT TO SENATE BILL 1042 2 AMENDMENT NO. . Amend Senate Bill 1042, by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The Illinois Vehicle Code is amended by 5 adding Section 12-612 as follows: 6 (625 ILCS 5/12-612 new) 7 Sec. 12-612. Hidden or false compartment in a motor 8 vehicle. 9 (a) It is unlawful for any person to knowingly own or 10 operate any motor vehicle containing a hidden or false 11 compartment created for the purpose of concealment of a 12 controlled substance, firearm, person, currency, or other 13 contraband from a law enforcement officer. It is unlawful 14 for any person to knowingly install, create, build, or 15 fabricate in any motor vehicle a hidden or false compartment 16 for the purpose of concealment of a controlled substance, 17 firearm, person, currency, or other contraband from a law 18 enforcement officer. For the purposes of this Section, a 19 "hidden compartment" or "false compartment" means any box, 20 container, space, or enclosure that is intended for use or 21 designed for use to conceal, hide or otherwise prevent -2- SDS/910025/AMdo 1 discovery by law enforcement officers of any controlled 2 substance, firearm, person, currency, or other contraband 3 within or attached to a vehicle, including, but not limited 4 to, a compartment, space, or box that is added to, or 5 fabricated, made or created from, existing compartments, 6 spaces or boxes within a vehicle. Any motor vehicle 7 containing a false or hidden compartment, as well as any 8 items within that compartment, shall be subject to seizure by 9 the Department of State Police or by any municipal or other 10 local authority within whose jurisdiction that property is 11 found as provided in Section 36-1 (720 ILCS 5/36-1) and 12 Section 36-2 (720 ILCS 5/36-2) of the Criminal Code of 1961. 13 (b) A violation of this Section is a Class C 14 misdemeanor. ".
