91_SB1042eng SB1042 Engrossed LRB9106082KScd 1 AN ACT to amend the Illinois Vehicle Code by adding 2 Section 12-612. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Vehicle code is amended by 6 adding Section 12-612 as follows: 7 (625 ILCS 5/12-612 new) 8 Sec. 12-612. False or secret compartment in a motor 9 vehicle. 10 (a) Offenses. It is unlawful for any person to own or 11 operate any motor vehicle he or she knows to contain a false 12 or secret compartment. It is unlawful for any person to 13 knowingly install, create, build, or fabricate in any motor 14 vehicle a false or secret compartment. 15 (b) Definitions. For purposes of this Section, a "false 16 or secret compartment" means any enclosure that is intended 17 and designed to be used to conceal, hide, and prevent 18 discovery by law enforcement officers of the false or secret 19 compartment, or its contents, and which is integrated into a 20 vehicle. For purpose of this Section, a person's intention 21 to use a false or secret compartment to conceal the contents 22 of the compartment from a law enforcement officer may be 23 inferred from factors including, but not limited to, the 24 discovery of a person, firearm, controlled substance, or 25 other contraband within the false or secret compartment, or 26 from the discovery of evidence of the previous placement of a 27 person, firearm, controlled substance, or other contraband 28 within the false or secret compartment. 29 (c) Forfeiture. Any motor vehicle containing a false or 30 secret compartment, as well as any items within that 31 compartment, shall be subject to seizure by the Department of SB1042 Engrossed -2- LRB9106082KScd 1 State Police or by any municipal or other local law 2 enforcement agency within whose jurisdiction that property is 3 found as provided in Sections 36-1 and 36-2 of the Criminal 4 Code of 1961 (720 ILCS 5/36-1 and 5/36-2). 5 (d) Sentence. A violation of this Section is a Class C 6 misdemeanor.
