91_SB0989sam001 LRB9106043KSgcam01 1 AMENDMENT TO SENATE BILL 989 2 AMENDMENT NO. . Amend Senate Bill 989 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The State Finance Act is amended by adding 5 Section 5.490 as follows: 6 (30 ILCS 105/5.490 new) 7 Sec. 5.490. Motor Carrier Safety Inspection Fund. 8 Section 10. The Illinois Vehicle Code is amended by 9 changing Sections 2-119 and 6-118 as follows: 10 (625 ILCS 5/2-119) (from Ch. 95 1/2, par. 2-119) 11 Sec. 2-119. Disposition of fees and taxes. 12 (a) All moneys received from Salvage Certificates shall 13 be deposited in the Common School Fund in the State Treasury. 14 (b) Beginning January 1, 1990 and concluding December 15 31, 1994, of the money collected for each certificate of 16 title, duplicate certificate of title and corrected 17 certificate of title, $0.50 shall be deposited into the Used 18 Tire Management Fund. Beginning January 1, 1990 and 19 concluding December 31, 1994, of the money collected for each 20 certificate of title, duplicate certificate of title and -2- LRB9106043KSgcam01 1 corrected certificate of title, $1.50 shall be deposited in 2 the Park and Conservation Fund. Beginning January 1, 1995, 3 of the money collected for each certificate of title, 4 duplicate certificate of title and corrected certificate of 5 title, $2 shall be deposited in the Park and Conservation 6 Fund. The moneys deposited in the Park and Conservation Fund 7 pursuant to this Section shall be used for the acquisition 8 and development of bike paths as provided for in Section 9 63a36 of the Civil Administrative Code of Illinois. Except as 10 otherwise provided in this Code, all remaining moneys 11 collected for certificates of title, and all moneys collected 12 for filing of security interests, shall be placed in the 13 General Revenue Fund in the State Treasury. 14 (c) All moneys collected for that portion of a driver's 15 license fee designated for driver education under Section 16 6-118 shall be placed in the Driver Education Fund in the 17 State Treasury. 18 (d) Beginning January 1, 1999, of the monies collected 19 as a registration fee for each motorcycle, motor driven cycle 20 and motorized pedalcycle, 27% of each annual registration fee 21 for such vehicle and 27% of each semiannual registration fee 22 for such vehicle is deposited in the Cycle Rider Safety 23 Training Fund. 24 (e) Of the monies received by the Secretary of State as 25 registration fees or taxes or as payment of any other fee, as 26 provided in this Act, except fees received by the Secretary 27 under paragraph (7) of subsection (b) of Section 5-101 and 28 Section 5-109 of this Code, 37% shall be deposited into the 29 State Construction Fund. 30 (f) Of the total money collected for a CDL instruction 31 permit or original or renewal issuance of a commercial 32 driver's license (CDL) pursuant to the Uniform Commercial 33 Driver's License Act (UCDLA):,(i) $6 of the total fee for an 34 original or renewal CDL, and $6 of the total CDL instruction -3- LRB9106043KSgcam01 1 permit fee when such permit is issued to any person holding a 2 valid Illinois driver's license, shall be paid into the 3 CDLIS/AAMVAnet Trust Fund (Commercial Driver's License 4 Information System/American Association of Motor Vehicle 5 Administrators network Trust Fund) and shall be used for the 6 purposes provided in Section 6z-23 of the State Finance Act 7 and (ii) $20 of the total fee for an original or renewal CDL 8 or commercial driver instruction permit shall be paid into 9 the Motor Carrier Safety Inspection Fund, which is hereby 10 created as a special fund in the State Treasury, to be used 11 by the Department of State Police, subject to appropriation, 12 to hire additional officers to conduct motor carrier safety 13 inspections pursuant to Chapter 18b of this Code. 14 (g) All remaining moneys received by the Secretary of 15 State as registration fees or taxes or as payment of any 16 other fee, as provided in this Act, except fees received by 17 the Secretary under paragraph (7) of subsection (b) of 18 Section 5-101 and Section 5-109 of this Code, shall be 19 deposited in the Road Fund in the State Treasury. Moneys in 20 the Road Fund shall be used for the purposes provided in 21 Section 8.3 of the State Finance Act. 22 (h) (Blank). 23 (i) (Blank). 24 (j) (Blank). 25 (k) There is created in the State Treasury a special 26 fund to be known as the Secretary of State Special License 27 Plate Fund. Money deposited into the Fund shall, subject to 28 appropriation, be used by the Office of the Secretary of 29 State (i) to help defray plate manufacturing and plate 30 processing costs for the issuance and, when applicable, 31 renewal of any new or existing special registration plates 32 authorized under this Code and (ii) for grants made by the 33 Secretary of State to benefit Illinois Veterans Home 34 libraries. -4- LRB9106043KSgcam01 1 On or before October 1, 1995, the Secretary of State 2 shall direct the State Comptroller and State Treasurer to 3 transfer any unexpended balance in the Special Environmental 4 License Plate Fund, the Special Korean War Veteran License 5 Plate Fund, and the Retired Congressional License Plate Fund 6 to the Secretary of State Special License Plate Fund. 7 (l) The Motor Vehicle Review Board Fund is created as a 8 special fund in the State Treasury. Moneys deposited into 9 the Fund under paragraph (7) of subsection (b) of Section 10 5-101 and Section 5-109 shall, subject to appropriation, be 11 used by the Office of the Secretary of State to administer 12 the Motor Vehicle Review Board, including without limitation 13 payment of compensation and all necessary expenses incurred 14 in administering the Motor Vehicle Review Board under the 15 Motor Vehicle Franchise Act. 16 (m) Effective July 1, 1996, there is created in the 17 State Treasury a special fund to be known as the Family 18 Responsibility Fund. Moneys deposited into the Fund shall, 19 subject to appropriation, be used by the Office of the 20 Secretary of State for the purpose of enforcing the Family 21 Financial Responsibility Law. 22 (n) The Illinois Fire Fighters' Memorial Fund is created 23 as a special fund in the State Treasury. Moneys deposited 24 into the Fund shall, subject to appropriation, be used by the 25 Office of the State Fire Marshal for construction of the 26 Illinois Fire Fighters' Memorial to be located at the State 27 Capitol grounds in Springfield, Illinois. 18 $20 for the Motor Carrier Safety Inspection Fund; 19 $10 for the driver's license; 20 and $24 for the CDL:.........................$60$4021 Renewal commercial driver's license: 22 $6 for the CDLIS/AAMVAnet Trust Fund; 23 $20 for the Motor Carrier Safety Inspection Fund; 24 $10 for the driver's license; and 25 $24 for the CDL:.............................$60$4026 Commercial driver instruction permit 27 issued to any person holding a valid 28 Illinois driver's license for the 29 purpose of changing to a 30 CDL classification: $6 for the 31 CDLIS/AAMVAnet Trust Fund; 32 $20 for the Motor Carrier 33 Safety Inspection Fund; and 34 $24 for the CDL classification...............$50$30-7- LRB9106043KSgcam01 1 Commercial driver instruction permit 2 issued to any person holding a valid 3 Illinois CDL for the purpose of 4 making a change in a classification, 5 endorsement or restriction........................$5 6 CDL duplicate or corrected license.....................$5 7 In order to ensure the proper implementation of the 8 Uniform Commercial Driver License Act, Article V of this 9 Chapter, the Secretary of State is empowered to pro-rate the 10 $24 fee for the commercial driver's license proportionate to 11 the expiration date of the applicant's Illinois driver's 12 license. 13 The fee for any duplicate license or permit shall be 14 waived for any person age 60 or older who presents the 15 Secretary of State's office with a police report showing that 16 his license or permit was stolen. 17 No additional fee shall be charged for a driver's 18 license, or for a commercial driver's license, when issued to 19 the holder of an instruction permit for the same 20 classification or type of license who becomes eligible for 21 such license. 22 (b) Any person whose license or privilege to operate a 23 motor vehicle in this State has been suspended or revoked 24 under any provision of Chapter 6, Chapter 11, or Section 25 7-702 of the Family Financial Responsibility Law of this 26 Code, shall in addition to any other fees required by this 27 Code, pay a reinstatement fee as follows: 28 Summary suspension under Section 11-501.1.............$60 29 Other suspension......................................$30 30 Revocation............................................$60 31 However, any person whose license or privilege to operate 32 a motor vehicle in this State has been suspended or revoked 33 for a second or subsequent time for a violation of Section 34 11-501 or 11-501.1 of this Code or a similar provision of a -8- LRB9106043KSgcam01 1 local ordinance or Section 9-3 of the Criminal Code of 1961 2 and each suspension or revocation was for a violation of 3 Section 11-501 or 11-501.1 of this Code or a similar 4 provision of a local ordinance or Section 9-3 of the Criminal 5 Code of 1961 shall pay, in addition to any other fees 6 required by this Code, a reinstatement fee as follows: 7 Summary suspension under Section 11-501.1............$250 8 Revocation...........................................$250 9 (c) All fees collected under the provisions of this 10 Chapter 6 shall be paid into the Road Fund in the State 11 Treasury except as follows: 12 1. The following amounts shall be paid into the 13 Driver Education Fund: 14 (A) $16 of the $20 fee for an original 15 driver's instruction permit; 16 (B) $5 of the $10 fee for an original driver's 17 license; 18 (C) $5 of the $10 fee for a 4 year renewal 19 driver's license; and 20 (D) $4 of the $8 fee for a restricted driving 21 permit. 22 2. $30 of the $60 fee for reinstatement of a license 23 summarily suspended under Section 11-501.1 shall be 24 deposited into the Drunk and Drugged Driving Prevention 25 Fund. However, for a person whose license or privilege 26 to operate a motor vehicle in this State has been 27 suspended or revoked for a second or subsequent time for 28 a violation of Section 11-501 or 11-501.1 of this Code or 29 Section 9-3 of the Criminal Code of 1961, $190 of the 30 $250 fee for reinstatement of a license summarily 31 suspended under Section 11-501.1, and $190 of the $250 32 fee for reinstatement of a revoked license shall be 33 deposited into the Drunk and Drugged Driving Prevention 34 Fund. -9- LRB9106043KSgcam01 1 3. $6 of such original or renewal fee for a 2 commercial driver's license and $6 of the commercial 3 driver instruction permit fee when such permit is issued 4 to any person holding a valid Illinois driver's license, 5 shall be paid into the CDLIS/AAMVAnet Trust Fund. 6 4. The fee for reinstatement of a license suspended 7 under the Family Financial Responsibility Law shall be 8 paid into the Family Responsibility Fund. 9 5. $20 of any original or renewal fee for a 10 commercial driver's license or commercial driver 11 instruction permit shall be paid into the Motor Carrier 12 Safety Inspection Fund. 13 (Source: P.A. 89-92, eff. 7-1-96; 90-738, eff. 1-1-99; 14 revised 9-21-98.) 15 (Text of Section after amendment by P.A. 90-622) 16 Sec. 6-118. However, for a person whose license or privilege 2 to operate a motor vehicle in this State has been 3 suspended or revoked for a second or subsequent time for 4 a violation of Section 11-501 or 11-501.1 of this Code or 5 Section 9-3 of the Criminal Code of 1961, $190 of the 6 $250 fee for reinstatement of a license summarily 7 suspended under Section 11-501.1, and $190 of the $250 8 fee for reinstatement of a revoked license shall be 9 deposited into the Drunk and Drugged Driving Prevention 10 Fund. 11 3. $6 of such original or renewal fee for a 12 commercial driver's license and $6 of the commercial 13 driver instruction permit fee when such permit is issued 14 to any person holding a valid Illinois driver's license, 15 shall be paid into the CDLIS/AAMVAnet Trust Fund. 16 4. The fee for reinstatement of a license suspended 17 under the Family Financial Responsibility Law shall be 18 paid into the Family Responsibility Fund. 19 5. The $5 fee for each original or renewal M or L 20 endorsement shall be deposited into the Cycle Rider 21 Safety Training Fund. 22 6. $20 of any original or renewal fee for a 23 commercial driver's license or commercial driver 24 instruction permit shall be paid into the Motor Carrier 25 Safety Inspection Fund. 26 (Source: P.A. 89-92, eff. 7-1-96; 90-622, eff. 3-1-99; 27 90-738, eff. 1-1-99; revised 9-21-98.) 28 Section 95. No acceleration or delay. Where this Act 29 makes changes to a stature that is represented in this Act by 30 text that is not yet or no longer in effect (for example, a 31 Section represented by multiple versions), the use of that 32 text does not accelerate or delay the taking effect of (i) 33 the changes made to this Act or (ii) provisions derived from -14- LRB9106043KSgcam01 1 any other Public Act. 2 Section 99. Effective date. This Act takes effect upon 3 becoming law.".
