91_SB0989eng SB989 Engrossed LRB9106043KSgc 1 AN ACT concerning motor carrier safety. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The State Finance Act is amended by adding 5 Section 5.490 as follows: 6 (30 ILCS 105/5.490 new) 7 Sec. 5.490. Motor Carrier Safety Inspection Fund. 8 Section 10. The Illinois Vehicle Code is amended by 9 changing Sections 2-119 and 6-118 as follows: 10 (625 ILCS 5/2-119) (from Ch. 95 1/2, par. 2-119) 11 Sec. 2-119. Disposition of fees and taxes. 12 (a) All moneys received from Salvage Certificates shall 13 be deposited in the Common School Fund in the State Treasury. 14 (b) Beginning January 1, 1990 and concluding December 15 31, 1994, of the money collected for each certificate of 16 title, duplicate certificate of title and corrected 17 certificate of title, $0.50 shall be deposited into the Used 18 Tire Management Fund. Beginning January 1, 1990 and 19 concluding December 31, 1994, of the money collected for each 20 certificate of title, duplicate certificate of title and 21 corrected certificate of title, $1.50 shall be deposited in 22 the Park and Conservation Fund. Beginning January 1, 1995, 23 of the money collected for each certificate of title, 24 duplicate certificate of title and corrected certificate of 25 title, $2 shall be deposited in the Park and Conservation 26 Fund. The moneys deposited in the Park and Conservation Fund 27 pursuant to this Section shall be used for the acquisition 28 and development of bike paths as provided for in Section 29 63a36 of the Civil Administrative Code of Illinois. Except as SB989 Engrossed -2- LRB9106043KSgc 1 otherwise provided in this Code, all remaining moneys 2 collected for certificates of title, and all moneys collected 3 for filing of security interests, shall be placed in the 4 General Revenue Fund in the State Treasury. 5 (c) All moneys collected for that portion of a driver's 6 license fee designated for driver education under Section 7 6-118 shall be placed in the Driver Education Fund in the 8 State Treasury. 9 (d) Beginning January 1, 1999, of the monies collected 10 as a registration fee for each motorcycle, motor driven cycle 11 and motorized pedalcycle, 27% of each annual registration fee 12 for such vehicle and 27% of each semiannual registration fee 13 for such vehicle is deposited in the Cycle Rider Safety 14 Training Fund. 15 (e) Of the monies received by the Secretary of State as 16 registration fees or taxes or as payment of any other fee, as 17 provided in this Act, except fees received by the Secretary 18 under paragraph (7) of subsection (b) of Section 5-101 and 19 Section 5-109 of this Code, 37% shall be deposited into the 20 State Construction Fund. 21 (f) Of the total money collected for a CDL instruction 22 permit or original or renewal issuance of a commercial 23 driver's license (CDL) pursuant to the Uniform Commercial 24 Driver's License Act (UCDLA):,(i) $6 of the total fee for an 25 original or renewal CDL, and $6 of the total CDL instruction 26 permit fee when such permit is issued to any person holding a 27 valid Illinois driver's license, shall be paid into the 28 CDLIS/AAMVAnet Trust Fund (Commercial Driver's License 29 Information System/American Association of Motor Vehicle 30 Administrators network Trust Fund) and shall be used for the 31 purposes provided in Section 6z-23 of the State Finance Act 32 and (ii) $20 of the total fee for an original or renewal CDL 33 or commercial driver instruction permit shall be paid into 34 the Motor Carrier Safety Inspection Fund, which is hereby SB989 Engrossed -3- LRB9106043KSgc 1 created as a special fund in the State Treasury, to be used 2 by the Department of State Police, subject to appropriation, 3 to hire additional officers to conduct motor carrier safety 4 inspections pursuant to Chapter 18b of this Code. 5 (g) All remaining moneys received by the Secretary of 6 State as registration fees or taxes or as payment of any 7 other fee, as provided in this Act, except fees received by 8 the Secretary under paragraph (7) of subsection (b) of 9 Section 5-101 and Section 5-109 of this Code, shall be 10 deposited in the Road Fund in the State Treasury. Moneys in 11 the Road Fund shall be used for the purposes provided in 12 Section 8.3 of the State Finance Act. 13 (h) (Blank). 14 (i) (Blank). 15 (j) (Blank). 16 (k) There is created in the State Treasury a special 17 fund to be known as the Secretary of State Special License 18 Plate Fund. Money deposited into the Fund shall, subject to 19 appropriation, be used by the Office of the Secretary of 20 State (i) to help defray plate manufacturing and plate 21 processing costs for the issuance and, when applicable, 22 renewal of any new or existing special registration plates 23 authorized under this Code and (ii) for grants made by the 24 Secretary of State to benefit Illinois Veterans Home 25 libraries. 26 On or before October 1, 1995, the Secretary of State 27 shall direct the State Comptroller and State Treasurer to 28 transfer any unexpended balance in the Special Environmental 29 License Plate Fund, the Special Korean War Veteran License 30 Plate Fund, and the Retired Congressional License Plate Fund 31 to the Secretary of State Special License Plate Fund. 32 (l) The Motor Vehicle Review Board Fund is created as a 33 special fund in the State Treasury. Moneys deposited into 34 the Fund under paragraph (7) of subsection (b) of Section SB989 Engrossed -4- LRB9106043KSgc 1 5-101 and Section 5-109 shall, subject to appropriation, be 2 used by the Office of the Secretary of State to administer 3 the Motor Vehicle Review Board, including without limitation 4 payment of compensation and all necessary expenses incurred 5 in administering the Motor Vehicle Review Board under the 6 Motor Vehicle Franchise Act. 7 (m) Effective July 1, 1996, there is created in the 8 State Treasury a special fund to be known as the Family 9 Responsibility Fund. Moneys deposited into the Fund shall, 10 subject to appropriation, be used by the Office of the 11 Secretary of State for the purpose of enforcing the Family 12 Financial Responsibility Law. 13 (n) The Illinois Fire Fighters' Memorial Fund is created 14 as a special fund in the State Treasury. Moneys deposited 15 into the Fund shall, subject to appropriation, be used by the 16 Office of the State Fire Marshal for construction of the 17 Illinois Fire Fighters' Memorial to be located at the State 18 Capitol grounds in Springfield, Illinois. 9 $20 for the Motor Carrier Safety Inspection Fund; 10 $10 for the driver's license; 11 and $24 for the CDL:.........................$60$4012 Renewal commercial driver's license: 13 $6 for the CDLIS/AAMVAnet Trust Fund; 14 $20 for the Motor Carrier Safety Inspection Fund; 15 $10 for the driver's license; and 16 $24 for the CDL:.............................$60$4017 Commercial driver instruction permit 18 issued to any person holding a valid 19 Illinois driver's license for the 20 purpose of changing to a 21 CDL classification: $6 for the 22 CDLIS/AAMVAnet Trust Fund; 23 $20 for the Motor Carrier 24 Safety Inspection Fund; and 25 $24 for the CDL classification...............$50$3026 Commercial driver instruction permit 27 issued to any person holding a valid 28 Illinois CDL for the purpose of 29 making a change in a classification, 30 endorsement or restriction........................$5 31 CDL duplicate or corrected license.....................$5 32 In order to ensure the proper implementation of the 33 Uniform Commercial Driver License Act, Article V of this 34 Chapter, the Secretary of State is empowered to pro-rate the SB989 Engrossed -7- LRB9106043KSgc 1 $24 fee for the commercial driver's license proportionate to 2 the expiration date of the applicant's Illinois driver's 3 license. 4 The fee for any duplicate license or permit shall be 5 waived for any person age 60 or older who presents the 6 Secretary of State's office with a police report showing that 7 his license or permit was stolen. 8 No additional fee shall be charged for a driver's 9 license, or for a commercial driver's license, when issued to 10 the holder of an instruction permit for the same 11 classification or type of license who becomes eligible for 12 such license. 13 (b) Any person whose license or privilege to operate a 14 motor vehicle in this State has been suspended or revoked 15 under any provision of Chapter 6, Chapter 11, or Section 16 7-702 of the Family Financial Responsibility Law of this 17 Code, shall in addition to any other fees required by this 18 Code, pay a reinstatement fee as follows: 19 Summary suspension under Section 11-501.1.............$60 20 Other suspension......................................$30 21 Revocation............................................$60 22 However, any person whose license or privilege to operate 23 a motor vehicle in this State has been suspended or revoked 24 for a second or subsequent time for a violation of Section 25 11-501 or 11-501.1 of this Code or a similar provision of a 26 local ordinance or Section 9-3 of the Criminal Code of 1961 27 and each suspension or revocation was for a violation of 28 Section 11-501 or 11-501.1 of this Code or a similar 29 provision of a local ordinance or Section 9-3 of the Criminal 30 Code of 1961 shall pay, in addition to any other fees 31 required by this Code, a reinstatement fee as follows: 32 Summary suspension under Section 11-501.1............$250 33 Revocation...........................................$250 34 (c) All fees collected under the provisions of this SB989 Engrossed -8- LRB9106043KSgc 1 Chapter 6 shall be paid into the Road Fund in the State 2 Treasury except as follows: 3 1. The following amounts shall be paid into the 4 Driver Education Fund: 5 (A) $16 of the $20 fee for an original 6 driver's instruction permit; 7 (B) $5 of the $10 fee for an original driver's 8 license; 9 (C) $5 of the $10 fee for a 4 year renewal 10 driver's license; and 11 (D) $4 of the $8 fee for a restricted driving 12 permit. 13 2. $30 of the $60 fee for reinstatement of a license 14 summarily suspended under Section 11-501.1 shall be 15 deposited into the Drunk and Drugged Driving Prevention 16 Fund. However, for a person whose license or privilege 17 to operate a motor vehicle in this State has been 18 suspended or revoked for a second or subsequent time for 19 a violation of Section 11-501 or 11-501.1 of this Code or 20 Section 9-3 of the Criminal Code of 1961, $190 of the 21 $250 fee for reinstatement of a license summarily 22 suspended under Section 11-501.1, and $190 of the $250 23 fee for reinstatement of a revoked license shall be 24 deposited into the Drunk and Drugged Driving Prevention 25 Fund. 26 3. $6 of such original or renewal fee for a 27 commercial driver's license and $6 of the commercial 28 driver instruction permit fee when such permit is issued 29 to any person holding a valid Illinois driver's license, 30 shall be paid into the CDLIS/AAMVAnet Trust Fund. 31 4. The fee for reinstatement of a license suspended 32 under the Family Financial Responsibility Law shall be 33 paid into the Family Responsibility Fund. 34 5. $20 of any original or renewal fee for a SB989 Engrossed -9- LRB9106043KSgc 1 commercial driver's license or commercial driver 2 instruction permit shall be paid into the Motor Carrier 3 Safety Inspection Fund. 4 (Source: P.A. 89-92, eff. 7-1-96; 90-738, eff. 1-1-99; 5 revised 9-21-98.) 6 (Text of Section after amendment by P.A. 90-622) 7 Sec. 6-118. The following amounts shall be paid into the 14 Driver Education Fund: 15 (A) $16 of the $20 fee for an original 16 driver's instruction permit; 17 (B) $5 of the $10 fee for an original driver's 18 license; 19 (C) $5 of the $10 fee for a 4 year renewal 20 driver's license; and 21 (D) $4 of the $8 fee for a restricted driving 22 permit. 23 2. $30 of the $60 fee for reinstatement of a license 24 summarily suspended under Section 11-501.1 shall be 25 deposited into the Drunk and Drugged Driving Prevention 26 Fund. However, for a person whose license or privilege 27 to operate a motor vehicle in this State has been 28 suspended or revoked for a second or subsequent time for 29 a violation of Section 11-501 or 11-501.1 of this Code or 30 Section 9-3 of the Criminal Code of 1961, $190 of the 31 $250 fee for reinstatement of a license summarily 32 suspended under Section 11-501.1, and $190 of the $250 33 fee for reinstatement of a revoked license shall be 34 deposited into the Drunk and Drugged Driving Prevention SB989 Engrossed -13- LRB9106043KSgc 1 Fund. 2 3. $6 of such original or renewal fee for a 3 commercial driver's license and $6 of the commercial 4 driver instruction permit fee when such permit is issued 5 to any person holding a valid Illinois driver's license, 6 shall be paid into the CDLIS/AAMVAnet Trust Fund. 7 4. The fee for reinstatement of a license suspended 8 under the Family Financial Responsibility Law shall be 9 paid into the Family Responsibility Fund. 10 5. The $5 fee for each original or renewal M or L 11 endorsement shall be deposited into the Cycle Rider 12 Safety Training Fund. 13 6. $20 of any original or renewal fee for a 14 commercial driver's license or commercial driver 15 instruction permit shall be paid into the Motor Carrier 16 Safety Inspection Fund. 17 (Source: P.A. 89-92, eff. 7-1-96; 90-622, eff. 3-1-99; 18 90-738, eff. 1-1-99; revised 9-21-98.) 19 Section 95. No acceleration or delay. Where this Act 20 makes changes to a statute that is represented in this Act by 21 text that is not yet or no longer in effect (for example, a 22 Section represented by multiple versions), the use of that 23 text does not accelerate or delay the taking effect of (i) 24 the changes made to this Act or (ii) provisions derived from 25 any other Public Act. 26 Section 99. Effective date. This Act takes effect upon 27 becoming law.
