91_SB0989enr SB989 Enrolled LRB9106043KSgc 1 AN ACT concerning motor carrier safety. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The State Finance Act is amended by adding 5 Section 5.490 and changing Section 6z-23 as follows: 6 (30 ILCS 105/5.490 new) 7 Sec. 5.490. Motor Carrier Safety Inspection Fund. 8 (30 ILCS 105/6z-23) (from Ch. 127, par. 142z-23) 9 Sec. 6z-23. All monies received by the Secretary of 10 State pursuant to paragraph (f),of Section 2-119,of the 11 Illinois Vehicle Code,shall be deposited in the 12 CDLIS/AAMVAnet Trust Fund. The money in this Fund shall only 13 be used by the Secretary of State to pay for (1) the 14 enrollment of commercial drivers into the Commercial Driver 15 License Information System (CDLIS), (2)and fornetwork 16 charges assessed Illinois by AAMVAnet, Inc., for motor 17 vehicle and driver records data and information, and (3) 18 equipment to be used for the testing of applicants for 19 commercial driver's licenses and the maintenance of that 20 equipment. 21 (Source: P.A. 86-845; 86-1028.) 22 Section 10. The Illinois Vehicle Code is amended by 23 changing Sections 2-119 and 6-118 as follows: 24 (625 ILCS 5/2-119) (from Ch. 95 1/2, par. 2-119) 25 Sec. 2-119. Disposition of fees and taxes. 26 (a) All moneys received from Salvage Certificates shall 27 be deposited in the Common School Fund in the State Treasury. 28 (b) Beginning January 1, 1990 and concluding December SB989 Enrolled -2- LRB9106043KSgc 1 31, 1994, of the money collected for each certificate of 2 title, duplicate certificate of title and corrected 3 certificate of title, $0.50 shall be deposited into the Used 4 Tire Management Fund. Beginning January 1, 1990 and 5 concluding December 31, 1994, of the money collected for each 6 certificate of title, duplicate certificate of title and 7 corrected certificate of title, $1.50 shall be deposited in 8 the Park and Conservation Fund. Beginning January 1, 1995, 9 of the money collected for each certificate of title, 10 duplicate certificate of title and corrected certificate of 11 title, $2 shall be deposited in the Park and Conservation 12 Fund. The moneys deposited in the Park and Conservation Fund 13 pursuant to this Section shall be used for the acquisition 14 and development of bike paths as provided for in Section 15 63a36 of the Civil Administrative Code of Illinois. Except as 16 otherwise provided in this Code, all remaining moneys 17 collected for certificates of title, and all moneys collected 18 for filing of security interests, shall be placed in the 19 General Revenue Fund in the State Treasury. 20 (c) All moneys collected for that portion of a driver's 21 license fee designated for driver education under Section 22 6-118 shall be placed in the Driver Education Fund in the 23 State Treasury. 24 (d) Beginning January 1, 1999, of the monies collected 25 as a registration fee for each motorcycle, motor driven cycle 26 and motorized pedalcycle, 27% of each annual registration fee 27 for such vehicle and 27% of each semiannual registration fee 28 for such vehicle is deposited in the Cycle Rider Safety 29 Training Fund. 30 (e) Of the monies received by the Secretary of State as 31 registration fees or taxes or as payment of any other fee, as 32 provided in this Act, except fees received by the Secretary 33 under paragraph (7) of subsection (b) of Section 5-101 and 34 Section 5-109 of this Code, 37% shall be deposited into the SB989 Enrolled -3- LRB9106043KSgc 1 State Construction Fund. 2 (f) Of the total money collected for a CDL instruction 3 permit or original or renewal issuance of a commercial 4 driver's license (CDL) pursuant to the Uniform Commercial 5 Driver's License Act (UCDLA):,(i) $6 of the total fee for an 6 original or renewal CDL, and $6 of the total CDL instruction 7 permit fee when such permit is issued to any person holding a 8 valid Illinois driver's license, shall be paid into the 9 CDLIS/AAMVAnet Trust Fund (Commercial Driver's License 10 Information System/American Association of Motor Vehicle 11 Administrators network Trust Fund) and shall be used for the 12 purposes provided in Section 6z-23 of the State Finance Act 13 and (ii) $20 of the total fee for an original or renewal CDL 14 or commercial driver instruction permit shall be paid into 15 the Motor Carrier Safety Inspection Fund, which is hereby 16 created as a special fund in the State Treasury, to be used 17 by the Department of State Police, subject to appropriation, 18 to hire additional officers to conduct motor carrier safety 19 inspections pursuant to Chapter 18b of this Code. 20 (g) All remaining moneys received by the Secretary of 21 State as registration fees or taxes or as payment of any 22 other fee, as provided in this Act, except fees received by 23 the Secretary under paragraph (7) of subsection (b) of 24 Section 5-101 and Section 5-109 of this Code, shall be 25 deposited in the Road Fund in the State Treasury. Moneys in 26 the Road Fund shall be used for the purposes provided in 27 Section 8.3 of the State Finance Act. 28 (h) (Blank). 29 (i) (Blank). 30 (j) (Blank). 31 (k) There is created in the State Treasury a special 32 fund to be known as the Secretary of State Special License 33 Plate Fund. Money deposited into the Fund shall, subject to 34 appropriation, be used by the Office of the Secretary of SB989 Enrolled -4- LRB9106043KSgc 1 State (i) to help defray plate manufacturing and plate 2 processing costs for the issuance and, when applicable, 3 renewal of any new or existing special registration plates 4 authorized under this Code and (ii) for grants made by the 5 Secretary of State to benefit Illinois Veterans Home 6 libraries. 7 On or before October 1, 1995, the Secretary of State 8 shall direct the State Comptroller and State Treasurer to 9 transfer any unexpended balance in the Special Environmental 10 License Plate Fund, the Special Korean War Veteran License 11 Plate Fund, and the Retired Congressional License Plate Fund 12 to the Secretary of State Special License Plate Fund. 13 (l) The Motor Vehicle Review Board Fund is created as a 14 special fund in the State Treasury. Moneys deposited into 15 the Fund under paragraph (7) of subsection (b) of Section 16 5-101 and Section 5-109 shall, subject to appropriation, be 17 used by the Office of the Secretary of State to administer 18 the Motor Vehicle Review Board, including without limitation 19 payment of compensation and all necessary expenses incurred 20 in administering the Motor Vehicle Review Board under the 21 Motor Vehicle Franchise Act. 22 (m) Effective July 1, 1996, there is created in the 23 State Treasury a special fund to be known as the Family 24 Responsibility Fund. Moneys deposited into the Fund shall, 25 subject to appropriation, be used by the Office of the 26 Secretary of State for the purpose of enforcing the Family 27 Financial Responsibility Law. 28 (n) The Illinois Fire Fighters' Memorial Fund is created 29 as a special fund in the State Treasury. Moneys deposited 30 into the Fund shall, subject to appropriation, be used by the 31 Office of the State Fire Marshal for construction of the 32 Illinois Fire Fighters' Memorial to be located at the State 33 Capitol grounds in Springfield, Illinois. 4 $20 for the Motor Carrier 5 Safety Inspection Fund; and 6 $24 for the CDL classification...............$50$307 Commercial driver instruction permit 8 issued to any person holding a valid 9 Illinois CDL for the purpose of 10 making a change in a classification, 11 endorsement or restriction........................$5 12 CDL duplicate or corrected license.....................$5 13 In order to ensure the proper implementation of the 14 Uniform Commercial Driver License Act, Article V of this 15 Chapter, the Secretary of State is empowered to pro-rate the 16 $24 fee for the commercial driver's license proportionate to 17 the expiration date of the applicant's Illinois driver's 18 license. 19 The fee for any duplicate license or permit shall be 20 waived for any person age 60 or older who presents the 21 Secretary of State's office with a police report showing that 22 his license or permit was stolen. 23 No additional fee shall be charged for a driver's 24 license, or for a commercial driver's license, when issued to 25 the holder of an instruction permit for the same 26 classification or type of license who becomes eligible for 27 such license. 28 (b) Any person whose license or privilege to operate a 29 motor vehicle in this State has been suspended or revoked 30 under any provision of Chapter 6, Chapter 11, or Section 31 7-702 of the Family Financial Responsibility Law of this 32 Code, shall in addition to any other fees required by this 33 Code, pay a reinstatement fee as follows: 34 Summary suspension under Section 11-501.1.............$60 SB989 Enrolled -8- LRB9106043KSgc 1 Other suspension......................................$30 2 Revocation............................................$60 3 However, any person whose license or privilege to operate 4 a motor vehicle in this State has been suspended or revoked 5 for a second or subsequent time for a violation of Section 6 11-501 or 11-501.1 of this Code or a similar provision of a 7 local ordinance or Section 9-3 of the Criminal Code of 1961 8 and each suspension or revocation was for a violation of 9 Section 11-501 or 11-501.1 of this Code or a similar 10 provision of a local ordinance or Section 9-3 of the Criminal 11 Code of 1961 shall pay, in addition to any other fees 12 required by this Code, a reinstatement fee as follows: 13 Summary suspension under Section 11-501.1............$250 14 Revocation...........................................$250 15 (c) All fees collected under the provisions of this 16 Chapter 6 shall be paid into the Road Fund in the State 17 Treasury except as follows: 18 1. The following amounts shall be paid into the 19 Driver Education Fund: 20 (A) $16 of the $20 fee for an original 21 driver's instruction permit; 22 (B) $5 of the $10 fee for an original driver's 23 license; 24 (C) $5 of the $10 fee for a 4 year renewal 25 driver's license; and 26 (D) $4 of the $8 fee for a restricted driving 27 permit. 28 2. $30 of the $60 fee for reinstatement of a license 29 summarily suspended under Section 11-501.1 shall be 30 deposited into the Drunk and Drugged Driving Prevention 31 Fund. However, for a person whose license or privilege 32 to operate a motor vehicle in this State has been 33 suspended or revoked for a second or subsequent time for 34 a violation of Section 11-501 or 11-501.1 of this Code or SB989 Enrolled -9- LRB9106043KSgc 1 Section 9-3 of the Criminal Code of 1961, $190 of the 2 $250 fee for reinstatement of a license summarily 3 suspended under Section 11-501.1, and $190 of the $250 4 fee for reinstatement of a revoked license shall be 5 deposited into the Drunk and Drugged Driving Prevention 6 Fund. 7 3. $6 of such original or renewal fee for a 8 commercial driver's license and $6 of the commercial 9 driver instruction permit fee when such permit is issued 10 to any person holding a valid Illinois driver's license, 11 shall be paid into the CDLIS/AAMVAnet Trust Fund. 12 4. The fee for reinstatement of a license suspended 13 under the Family Financial Responsibility Law shall be 14 paid into the Family Responsibility Fund. 15 5. $20 of any original or renewal fee for a 16 commercial driver's license or commercial driver 17 instruction permit shall be paid into the Motor Carrier 18 Safety Inspection Fund. 19 (Source: P.A. 89-92, eff. 7-1-96; 90-738, eff. 1-1-99; 20 revised 9-21-98.) 21 (Text of Section after amendment by P.A. 90-622) 22 Sec. 6-118. The following amounts shall be paid into the 29 Driver Education Fund: 30 (A) $16 of the $20 fee for an original 31 driver's instruction permit; 32 (B) $5 of the $10 fee for an original driver's 33 license; 34 (C) $5 of the $10 fee for a 4 year renewal SB989 Enrolled -13- LRB9106043KSgc 1 driver's license; and 2 (D) $4 of the $8 fee for a restricted driving 3 permit. 4 2. $30 of the $60 fee for reinstatement of a license 5 summarily suspended under Section 11-501.1 shall be 6 deposited into the Drunk and Drugged Driving Prevention 7 Fund. However, for a person whose license or privilege 8 to operate a motor vehicle in this State has been 9 suspended or revoked for a second or subsequent time for 10 a violation of Section 11-501 or 11-501.1 of this Code or 11 Section 9-3 of the Criminal Code of 1961, $190 of the 12 $250 fee for reinstatement of a license summarily 13 suspended under Section 11-501.1, and $190 of the $250 14 fee for reinstatement of a revoked license shall be 15 deposited into the Drunk and Drugged Driving Prevention 16 Fund. 17 3. $6 of such original or renewal fee for a 18 commercial driver's license and $6 of the commercial 19 driver instruction permit fee when such permit is issued 20 to any person holding a valid Illinois driver's license, 21 shall be paid into the CDLIS/AAMVAnet Trust Fund. 22 4. The fee for reinstatement of a license suspended 23 under the Family Financial Responsibility Law shall be 24 paid into the Family Responsibility Fund. 25 5. The $5 fee for each original or renewal M or L 26 endorsement shall be deposited into the Cycle Rider 27 Safety Training Fund. 28 6. $20 of any original or renewal fee for a 29 commercial driver's license or commercial driver 30 instruction permit shall be paid into the Motor Carrier 31 Safety Inspection Fund. 32 (Source: P.A. 89-92, eff. 7-1-96; 90-622, eff. 3-1-99; 33 90-738, eff. 1-1-99; revised 9-21-98.) Where this Act 2 makes changes to a statute that is represented in this Act by 3 text that is not yet or no longer in effect (for example, a 4 Section represented by multiple versions), the use of that 5 text does not accelerate or delay the taking effect of (i) 6 the changes made to this Act or (ii) provisions derived from 7 any other Public Act. 8 Section 99. Effective date. This Act takes effect upon 9 becoming law.
