 1                     AMENDMENT TO SENATE BILL 13

 2        AMENDMENT NO.     .  Amend Senate Bill 13 as follows:
 3    on page 1, lines 2 and 8, after "312," each time it  appears,
 4    by inserting "313,"; and

 5    on  page  2, line 1, by replacing "a written" with "an oral";
 6    and

 7    on page 2, line 2, by replacing "72 hours" with  "7  days  72
 8    hours"; and

 9    on line 12, by replacing "72-hour" with "7-day 72-hour"; and

10    on page 9, after line 7, by inserting the following:

11        "(720 ILCS 570/313) (from Ch. 56 1/2, par. 1313)
12        Sec.  313.   (a) Controlled substances which are lawfully
13    administered in hospitals or institutions licensed under  the
14    "Hospital   Licensing   Act"   shall   be   exempt  from  the
15    requirements of Sections 308 and 312 and 316 except that  the
16    prescription for the controlled substance shall be in writing
17    on the patient's record, signed by the prescriber, dated, and
18    shall  state  the name, and quantity of controlled substances
19    ordered and the quantity actually administered.  The  records
20    of  such  prescriptions shall be maintained for two years and
21    shall be available for inspection by officers  and  employees

 1    of  the  Department  of  State  Police, and the Department of
 2    Professional Regulation.
 3        (b)  Controlled   substances   that   can   lawfully   be
 4    administered  or  dispensed  directly  to  a  patient  in   a
 5    long-term  care facility licensed by the Department of Public
 6    Health as  a  skilled  nursing  facility,  intermediate  care
 7    facility,  or  long-term care facility for residents under 22
 8    years of age, are exempt from the  requirements  of  Sections
 9    308  and  312  and  316.  ,  except that a prescription for a
10    Schedule II controlled substance must  be  either  a  written
11    prescription   signed   by   the   prescriber  or  a  written
12    prescription transmitted by the  prescriber  or  prescriber's
13    agent to the dispensing pharmacy by facsimile.  The facsimile
14    serves  as  the  original  written  prescription  and must be
15    maintained for 2 years from the date of  issue  in  the  same
16    manner as a written prescription signed by the prescriber.
17        (c)  (Blank).  A  prescription  that  is  written  for  a
18    Schedule  II controlled substance to be compounded for direct
19    administration  by  parenteral,  intravenous,  intramuscular,
20    subcutaneous, or intraspinal  infusion  to  a  patient  in  a
21    private   residence,  long-term  care  facility,  or  hospice
22    setting may be transmitted by facsimile by the prescriber  or
23    the  prescriber's  agent  to  the pharmacy providing the home
24    infusion services.
25        (d)  Controlled    substances    which    are    lawfully
26    administered  and/or  dispensed  in  drug   abuse   treatment
27    programs  licensed by the Department shall be exempt from the
28    requirements of Sections 308 and 312 and 316, except that the
29    prescription for such controlled substances shall  be  issued
30    and  authenticated on official prescription logs prepared and
31    supplied by the Department. The  official  prescription  logs
32    issued  by  the  Department shall be printed in triplicate on
33    distinctively marked  paper  and  furnished  to  programs  at
34    reasonable cost.  The official prescription logs furnished to

 1    the   programs   shall  contain,  in  preprinted  form,  such
 2    information as the  Department  may  require.   The  official
 3    prescription  logs  shall be properly endorsed by a physician
 4    licensed to practice medicine in all its branches issuing the
 5    order, with his own signature and the date of  ordering,  and
 6    further  endorsed  by the practitioner actually administering
 7    or dispensing the dosage at the time of such administering or
 8    dispensing in accordance  with  requirements  issued  by  the
 9    Department.   The  duplicate  copy  shall  be retained by the
10    program for a period of not less than three  years  nor  more
11    than  seven  years; the original and triplicate copy shall be
12    returned  to  the  Department  at  its  principal  office  in
13    accordance with requirements set forth by the Department.

15    on lines 19 and 23 before "controlled" each time it  appears,
16    by inserting  "Schedule II"; and

17    on page 10, after line 8, by inserting the following:
18        "Schedule  II  controlled  substances are exempt from the
19    requirements of  this  Section  to  the  extent  provided  in
20    Section 313."; and

21    on page 17, after line 11, by inserting the following:

22        "Section  99.   Effective  date.   This  Act takes effect
23    April 1, 2000.".
