Amend House Bill 452 by replacing 3 the title with the following: 4 "AN ACT concerning real property"; and 5 by replacing everything after the enacting clause with the 6 following: 7 "Article 5. 8 Section 5-5. Upon the payment of the sum of $1 and other 9 good and valuable consideration, pursuant to and conditioned 10 upon the execution of an intergovernmental agreement entered 11 into by the Department of Human Services and the Village of 12 Tinley Park, to the State of Illinois and the tender by the 13 Village of Tinley Park of a certified survey of the land 14 described in this Section, current within 6 months, the 15 Secretary of Human Services is authorized to convey by 16 quitclaim deed, subject to the condition that should the 17 property conveyed under this Section ever not be used by the 18 grantee for public purposes, then title shall revert to the 19 State of Illinois without further action on the part of the 20 State, to the Village of Tinley Park all right, title, and 21 interest in and to the land in Cook County, Illinois commonly 22 known as: -2- LRB9102001DJmbam02 1 THAT PART OF THE WEST 1900 FEET OF THE SOUTHWEST QUARTER 2 OF SECTION 36, TOWNSHIP 36 NORTH, RANGE 12 EAST OF THE 3 THIRD PRINCIPAL MERIDIAN LYING SOUTHERLY OF THE SOUTHERLY 4 RIGHT OF WAY OF THE CHICAGO, ROCK ISLAND AND PACIFIC 5 RAILROAD (COMMONLY KNOWN AS THE METRALINE) AND LYING 6 NORTHERLY OF THE NORTHERN TRIBUTARY TO THE UNION DRAINAGE 7 DITCH (EXCEPTING THEREFROM THAT PART, IF ANY, TAKEN FOR 8 80TH AVENUE), IN COOK COUNTY, ILLINOIS AND CONTAINING 56 9 ACRES. 10 The legal description of the land that appears in the 11 quitclaim deed shall conform to the survey required under 12 this Section. 13 Section 5-10. Short title. This Article may be cited as 12 the Ft. Dearborn United States Army Reserve Center 13 Retrocession Law. 14 Section 10-5. Any 12 additional land over which the State accepts retrocession of 13 jurisdiction shall be identified in a notice filed by the 14 Governor as provided in subsection (d). 15 (b) By retaining in the subject lands a federal 16 proprietary interest only, there exists a right of the United 17 States to perform the functions delegated to it by the United 18 States Constitution and directed by statutory enactment of 19 the United States Congress without interference from any 20 source. The State of Illinois may not impose its regulatory 21 power directly upon the United States and may not tax the 22 land under the federal proprietary interest; however, the 23 State of Illinois may tax a lessee's interest in the land to 24 the extent State law permits. 25 (c) Subject to subsection (b), the State of Illinois 26 accepts cession of exclusive federal legislative jurisdiction 27 from the United States, and the State of Illinois retains all 28 the legislative jurisdiction over the area it would have if a 29 private individual rather than the United States owned the 30 land. 31 (d) The Governor of the State of Illinois is authorized 32 to accept the retrocession of exclusive legislative 33 jurisdiction over the subject lands by filing a notice of 34 acceptance with the Illinois Secretary of State. -7- LRB9102001DJmbam02 1 (e) Upon transfer by deed of subject lands, or any 2 portion thereof, by the United States of America, the 3 proprietary interest retained by the United States shall 4 expire as to the particular property transferred. 5 ARTICLE 15. 6 Section 15-5. Upon the payment to the State of Illinois 7 of an amount to be negotiated by the parties in interest and 8 according to the terms of an agreement between the Lockport 9 Township Park District and the Director of Corrections, the 10 Director of Corrections is authorized to convey by quitclaim 11 deed to the Lockport Township Park District all right, title, 12 and interest in and to the following described land in Will 13 County, Illinois: 14 The NE 1/4 of the NW 1/4 of Section 21-36-10 and the SE 15 1/4 of the NW 1/4 of Section 21-36-10, (approximately 80 16 acres), all in Township 36 North, Range 10 East of the Third 17 Principal Meridian in Will County, Illinois. 18 Section 15-10. The Director of Corrections shall obtain a 19 certified copy of the portions of this Act containing the 20 title, the enacting clause, the effective date, the 21 appropriate Sections containing the land descriptions of 22 property to be transferred, and this Section within 60 days 23 after this Act's effective date and, upon receipt of payment 24 required by the appropriate Sections, shall record the 25 certified document in the Recorder's office in the county in 26 which the land is located. 27 ARTICLE 20. 28 Section 20-5. Upon the payment of the sum of $50 to the 29 Department of Natural Resources, the Director of Natural -8- LRB9102001DJmbam02 1 Resources is authorized to convey by quitclaim deed all 2 right, title, and interest in and to the following described 3 real property in Johnson County, Illinois to the Cedar Grove 4 Church, of the Village of Buncombe, County of Johnson, State 5 of Illinois: 6 The South 70.00 feet of the West 50.00 feet of the 7 Southwest Quarter of the Northeast Quarter of Section 31, 8 Township 11 South, Range 2 East of the Third Principal 9 Meridian, Johnson County, Illinois, as said Southwest 10 Quarter of the Northeast Quarter was surveyed by Edward 11 J. Reeder, I.P.L.S. No. 2546, during the months of 12 February through May of 1997. 13 Section 20-10. The Director of Natural Resources shall 14 obtain a certified copy of this Act within 60 days after its 15 effective date and, upon receipt of payment required by this 16 Act, shall record the certified document in the Recorder's 17 Office in the county in which the land is located. 18 ARTICLE 25. 19 Section 25-5. Upon payment of the sum of $1, the 20 Secretary of Transportation is authorized to convey by 21 quitclaim deed to the Bureau County Soil and Water 22 Conservation District all right, title, and interest in and 23 to the property commonly known as "Center Prairie" and 24 described as follows: 25 IDOT Location: US 6&34 (approximately 1 1/2 miles West 26 of Princeton, Bureau County). FA 8 (SBI 27 7), Section 11Y, Bureau County. 28 Beginning left Station 565 + 00 and 29 extending in an easterly direction to 30 and ending at left Station 708 + 37. 31 Legal Description: The property lies North of US 6&34 ROW -9- LRB9102001DJmbam02 1 in Section 13 and 14, and the East 1/2 2 of the Southeast 1/4 of Section 15, 3 Township 16 North, Range 8, East of the 4 4th Principal Meridian in Bureau County, 5 Illinois. 6 The North boundary being the South 7 boundary of old US 6&34 in Sections 13 8 and 14, and the North boundary of 9 Section 15. 10 Section 25-10. Upon payment of the sum of $1, the 11 Secretary of Transportation is authorized to convey by 12 quitclaim deed to the Bureau County Soil and Water 13 Conservation District all right, title, and interest in and 14 to the property commonly known as "Old Indian Boundary 15 Prairie" and described as follows: 16 IDOT Location: Illinois 26 (approximately 2 miles South 17 of Ohio, Bureau County). FA 38, Section 18 115R. Beginning right Station 1160 + 00 19 and extending in a southerly direction 20 to and ending at right Station 1175 + 21 00. 22 Legal Description: The property is that portion of the 23 Northeast 1/4 of the Northwest 1/4 which 24 lies West of the ROW of Illinois 26 in 25 Section 28, Township 18 North, Range 9, 26 East of the 4th Principal Meridian. 27 Section 25-15. The Secretary of Transportation shall 28 obtain a certified copy of the portions of this Act 29 containing the title, the enacting clause, the effective 30 date, the appropriate Sections containing the land 31 descriptions of property to be transferred, and this Section 32 within 60 days after this Act's effective date and, upon -10- LRB9102001DJmbam02 1 receipt of payment required by the appropriate Sections, 2 shall record the certified document in the Recorder's office 3 in the county in which the land is located. 4 ARTICLE 30. 5 Section 30-2. For and in consideration of the sum of $1, 6 the Board of Trustees of Southern Illinois University is 7 authorized to convey, by quitclaim deed executed by the 8 chairperson and attested by the secretary of the Board of 9 Trustees of Southern Illinois University, to the Board of 10 Trustees of Lewis and Clark Community College District No. 11 536 all rights, title, and interest of the Board of Trustees 12 of Southern Illinois University in and to the following 13 described real estate: 14 Parcel 1: 15 A parcel of land, known as Lot 8 of the Subdivision 16 of Block 1, Leclaire, as the same appears in Plat Book 6 17 Page 19; (Except coal and other minerals underlying, with 18 right to mine and remove same from thereunder), in 19 Madison County, Illinois. 20 Parcel 2: 21 A tract of land situated in the Southeast Quarter of 22 Section 11, Township 4 North, Range 8 West of the Third 23 Principal Meridian, within the corporate limits of the 24 City of Edwardsville, Madison County, Illinois; Upon the payment to the State of Illinois 3 of an amount to be negotiated by the parties in interest and 4 according to the terms of an agreement between the Will 5 County Department of Highways and the Director of 6 Corrections, the Director of Corrections is authorized to 7 convey by quitclaim deed to the Will County Department of 8 Highways all right, title, and interest in and to the 9 following described land in Will County, Illinois: 10 That Part of the South Half of Section 29, Township 36 11 North, Range 10 East of the Third Principal Meridian, 12 Lockport Township, Will County, Illinois, described as 13 follows: Beginning at the Southeast comer of the Southwest 14 Quarter of the above said Section 29; thence westerly along 15 the south boundary of the above said Southwest Quarter 660.22 16 feet to the west boundary of the Stateville Penitentiary; 17 thence northerly 450.00 feet along that boundary; thence 18 easterly to a point which is 430.01 feet east and 450.00 feet 19 north of the point of beginning; thence South 450.00 feet to 20 the south line of the Southeast Quarter of Section 29; thence 21 West and at a 90 degree angle from the last described course, 22 430.01 feet to the point of beginning. Containing 10 acres, 23 more or less. Acreage based on that portion outside the 24 limits of a 50 foot right of way. 25 Section 35-10. The Director of Corrections shall obtain a 26 certified copy of the portions of this Act containing the 27 title, the enacting clause, the effective date, the 28 appropriate Sections containing the land descriptions of 29 property to be transferred, and this Section within 60 days 30 after this Act's effective date and, upon receipt of payment 31 required by the appropriate Sections, shall record the 32 certified document in the Recorder's office in the county in -15- LRB9102001DJmbam02 1 which the land is located. 2 Article 90. 3 Section 90-5. The Property Tax Code is amended by 4 changing Sections 9-195 and adding Section 15-103 as follows: 5 (35 ILCS 200/9-195) 6 Sec. 9-195. Leasing of exempt property. 7 (a) Except as provided in SectionsSection15-55,and8 15-100, and 15-103, when property which is exempt from 9 taxation is leased to another whose property is not exempt, 10 and the leasing of which does not make the property taxable, 11 the leasehold estate and the appurtenances shall be listed as 12 the property of the lessee thereof, or his or her assignee. 13 Taxes on that property shall be collected in the same manner 14 as on property that is not exempt, and the lessee shall be 15 liable for those taxes. However, no tax lien shall attach to 16 the exempt real estate. The changes made by this amendatory 17 Act of 1997 are declaratory of existing law and shall not be 18 construed as a new enactment. The changes made by Public 19 Acts 88-221 and 88-420 that are incorporated into this 20 Section by this amendatory Act of 1993 are declarative of 21 existing law and are not a new enactment. 22 (b) The provisions of this Section regarding taxation of 23 leasehold interests in exempt property do not apply to any 24 leasehold interest created pursuant to any transaction 25 described in subsection (b) of Section 15-100 or in Section 26 15-103. 27 (Source: P.A. 90-562, eff. 12-16-97.) 28 (35 ILCS 200/15-103 new) 29 Sec. 15-103. Bi-State Development Agency. 30 (a) Property owned by the Bi-State Development Agency of -16- LRB9102001DJmbam02 1 the Missouri-Illinois Metropolitan District is exempt. 2 (b) The exemption under this Section is not affected by 3 any transaction in which, for the purpose of obtaining 4 financing, the Agency, directly or indirectly, leases or 5 otherwise transfers the property to another for which or whom 6 property is not exempt and immediately after the lease or 7 transfer enters into a leaseback or other agreement that 8 directly or indirectly gives the Agency a right to use, 9 control, and possess the property. In the case of a 10 conveyance of the property, the Agency must retain an option 11 to purchase the property at a future date or, within the 12 limitations period for reverters, the property must revert 13 back to the Agency. 14 (c) If the property has been conveyed as described in 15 subsection (b), the property is no longer exempt under this 16 Section as of the date when: 17 (1) the right of the Agency to use, control, and 18 possess the property is terminated; 19 (2) the Agency no longer has an option to purchase 20 or otherwise acquire the property; and 21 (3) there is no provision for a reverter of the 22 property to the Agency within the limitations period for 23 reverters. 24 (d) Pursuant to Sections 15-15 and 15-20 of this Code, 25 the Agency shall notify the chief county assessment officer 26 of any transaction under subsection (b). The chief county 27 assessment officer shall determine initial and continuing 28 compliance with the requirements of this Section for tax 29 exemption. Failure to notify the chief county assessment 30 officer of a transaction under this Section or to otherwise 31 comply with the requirements of Sections 15-15 and 15-20 of 32 this Code shall, in the discretion of the chief county 33 assessment officer, constitute cause to terminate the 34 exemption, notwithstanding any other provision of this Code. -17- LRB9102001DJmbam02 1 (e) No provision of this Section shall be construed to 2 affect the obligation of the Agency under Section 15-10 of 3 this Code to file an annual certificate of status or to 4 notify the chief county assessment officer of transfers of 5 interest or other changes in the status of the property as 6 required by this Code. 7 Section 90-15. The Public Water District Act is amended 8 by changing Section 26 as follows: 9 (70 ILCS 3705/26) (from Ch. 111 2/3, par. 212.1) 10 Sec. 26. Annexation. Any territory which is contiguous to 11 a public water district organized under this Act and which is 12 not included in any public water district may be annexed to 13 such contiguous public water district in the manner provided 14 by this Section. 15 A petition, signed by two-thirds of the legal voters 16 residing in the territory sought to be annexed, or if there 17 are no legal voters in the territory, a majority of the 18 owners of record of the land in the territory, and addressed 19 to the circuit court of the county in which the public water 20 district to which annexation is sought was organized, 21 requesting that the territory described in the petition be 22 annexed to such public water district, may be filed with the 23 clerk of such court. The clerk of such court shall thereupon 24 present such petition to the court which shall set a time, 25 place and date for a hearing thereon, which date shall be not 26 less than 20 nor more than 45 days after the date the 27 petition was filed. The court shall give notice of the time, 28 place and date of the hearing by publication in one or more 29 newspapers published in the district, and if there is no such 30 newspaper, in one or more newspapers published in the county 31 and having a general circulation within the public water 32 district and within the territory sought to be annexed -18- LRB9102001DJmbam02 1 thereto, which publication shall be made at least 15 days 2 prior to the date set for the hearing. 3 (Source: P.A. 83-532.) 4 Section 90-50. The Code of Civil Procedure is amended by 5 changing Section 7-103 as follows: 6 (735 ILCS 5/7-103) (from Ch. 110, par. 7-103) 7 Sec. 7-103. "Quick-take". This Section applies only to 8 proceedings under this Article: 9 (1) by the State of Illinois, the Illinois Toll 10 Highway Authority or the St. Louis Metropolitan Area 11 Airport Authority for the acquisition of land or 12 interests therein for highway purposes; 13 (2) (blank); 14 (3) by the Department of Commerce and Community 15 Affairs for the purpose specified in the Illinois Coal 16 Development Bond Act; 17 (4) (blank); 18 (5) for the purpose specified in the St. Louis 19 Metropolitan Area Airport Authority Act; -19- LRB9102001DJmbam02 1 (8) by a sanitary district created under the 2 Metropolitan Water Reclamation District Act for the 3 acquisition of land or interests therein for purposes 4 specified in that Act; 5 (9) by a rail carrier within the time limitations 6 and subject to the terms and conditions set forth in 7 Section 18c-7501 of the Illinois Vehicle Code; 8 (10) for a period of 18 months after January 26, 9 1987, for the purpose specified in Division 135 of 10 Article 11 of the Illinois Municipal Code, by a 11 commission created under Section 2 of the Water 12 Commission Act of 1985; 13 (11) by a village containing a population of less 14 than 15,000 for the purpose of acquiring property to be 15 used for a refuse derived fuel system designed to 16 generate steam and electricity, and for industrial 17 development that will utilize such steam and electricity, 18 pursuant to Section 11-19-10 of the Illinois Municipal 19 Code; 20 (12) after receiving the prior approval of the City 21 Council, by a municipality having a population of more 22 than 500,000 for the purposes set forth in Section 23 11-61-1a and Divisions 74.2 and 74.3 of Article 11 of the 24 Illinois Municipal Code, and for the same purposes when 25 established pursuant to home rule powers; 26 (13) by a home rule municipality, after a public 27 hearing held by the corporate authorities or by a 28 committee of the corporate authorities and after approval 29 by a majority of the corporate authorities, within an 30 area designated as an enterprise zone by the municipality 31 under the Illinois Enterprise Zone Act; 32 (14) by the Illinois Sports Facilities Authority 33 for the purpose specified in Section 12 of the Illinois 34 Sports Facilities Authority Act; -20- LRB9102001DJmbam02 1 (15) by a municipality having a population of more 2 than 2,000,000 for the purpose of acquiring the property 3 described in Section 3 of the Sports Stadium Act; 4 (16) for a period of 18 months after July 29, 1986, 5 in any proceeding by the Board of Trustees of the 6 University of Illinois for the acquisition of land in 7 Champaign County or interests therein as a site for a 8 building or for any educational purpose; 9 (17) for a period of 2 years after July 1, 1990, by 10 a home rule municipality and a county board, upon 11 approval of a majority of the corporate authorities of 12 both the county board and the municipality, within an 13 area designated as an enterprise zone by the municipality 14 and the county board through an intergovernmental 15 agreement under the Illinois Enterprise Zone Act, when 16 the purpose of the condemnation proceeding is to acquire 17 land for the construction of an industrial harbor port, 18 and when the total amount of land to be acquired for that 19 purpose is less than 75 acres and is adjacent to the 20 Illinois River; 21 (18) by an airport authority located solely within 22 the boundaries of Madison County, Illinois, and which is 23 organized pursuant to the provisions of the Airport 24 Authorities Act, (i) for the acquisition of 160 acres, or 25 less, of land or interests therein for the purposes 26 specified in that Act which may be necessary to extend, 27 mark, and light runway 11/29 for a distance of 1600 feet 28 in length by 100 feet in width with parallel taxiway, to 29 relocate and mark County Highway 19, Madison County, 30 known as Moreland Road, to relocate the instrument 31 landing system including the approach lighting system and 32 to construct associated drainage, fencing and seeding 33 required for the foregoing project and (ii) for a period 34 of 6 months after December 28, 1989, for the acquisition -21- LRB9102001DJmbam02 1 of 75 acres, or less, of land or interests therein for 2 the purposes specified in that Act which may be necessary 3 to extend, mark and light the south end of runway 17/35 4 at such airport; 5 (19) by any unit of local government for a 6 permanent easement for the purpose of maintaining, 7 dredging or cleaning the Little Calumet River; 8 (20) by any unit of local government for a 9 permanent easement for the purpose of maintaining, 10 dredging or cleaning the Salt Creek in DuPage County; 30 (26) for a period of 24 months after June 30, 1991, 31 by the City of Aurora for completion of an instrument 32 landing system and construction of an east-west runway at 33 the Aurora Municipal Airport; 34 (27) for the acquisition by the Metropolitan Pier -22- LRB9102001DJmbam02 1 and Exposition Authority of property described in 2 subsection (f) of Section 5 of the Metropolitan Pier and 3 Exposition Authority Act for the purposes of providing 4 additional grounds, buildings, and facilities related to 5 the purposes of the Metropolitan Pier and Exposition 6 Authority;
