91_HB0452eng HB0452 Engrossed LRB9102001DJcd 1 AN ACT concerning real property. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Article 5. 5 Section 5-5. Upon the payment of the sum of $1 and other 6 good and valuable consideration, pursuant to and conditioned 7 upon the execution of an intergovernmental agreement entered 8 into by the Department of Human Services and the Village of 9 Tinley Park, to the State of Illinois and the tender by the 10 Village of Tinley Park of a certified survey of the land 11 described in this Section, current within 6 months, the 12 Secretary of Human Services is authorized to convey by 13 quitclaim deed, subject to the condition that should the 14 property conveyed under this Section ever not be used by the 15 grantee for public purposes, then title shall revert to the 16 State of Illinois without further action on the part of the 17 State, to the Village of Tinley Park all right, title, and 18 interest in and to the land in Cook County, Illinois commonly 19 known as: 20 THAT PART OF THE WEST 1900 FEET OF THE SOUTHWEST QUARTER 21 OF SECTION 36, TOWNSHIP 36 NORTH, RANGE 12 EAST OF THE 22 THIRD PRINCIPAL MERIDIAN LYING SOUTHERLY OF THE SOUTHERLY 23 RIGHT OF WAY OF THE CHICAGO, ROCK ISLAND AND PACIFIC 24 RAILROAD (COMMONLY KNOWN AS THE METRALINE) AND LYING 25 NORTHERLY OF THE NORTHERN TRIBUTARY TO THE UNION DRAINAGE 26 DITCH (EXCEPTING THEREFROM THAT PART, IF ANY, TAKEN FOR 27 80TH AVENUE), IN COOK COUNTY, ILLINOIS AND CONTAINING 56 28 ACRES. 29 The legal description of the land that appears in the 30 quitclaim deed shall conform to the survey required under 31 this Section. The Secretary of Human Services shall 23 obtain a certified copy of the portions of this Act 24 containing the title, the enacting clause, the effective 25 date, the appropriate Sections containing the land 26 descriptions of property to be transferred, and this Section 27 within 60 days after this Act's effective date and, upon 28 receipt of payment required by the appropriate Sections, 29 shall record the certified document in the Recorder's office 30 in the county in which the land is located. 31 Section 5-20. Any 34 additional land over which the State accepts retrocession of HB0452 Engrossed -6- LRB9102001DJcd 1 jurisdiction shall be identified in a notice filed by the 2 Governor as provided in subsection (d). 3 (b) By retaining in the subject lands a federal 4 proprietary interest only, there exists a right of the United 5 States to perform the functions delegated to it by the United 6 States Constitution and directed by statutory enactment of 7 the United States Congress without interference from any 8 source. The State of Illinois may not impose its regulatory 9 power directly upon the United States and may not tax the 10 land under the federal proprietary interest; however, the 11 State of Illinois may tax a lessee's interest in the land to 12 the extent State law permits. 13 (c) Subject to subsection (b), the State of Illinois 14 accepts cession of exclusive federal legislative jurisdiction 15 from the United States, and the State of Illinois retains all 16 the legislative jurisdiction over the area it would have if a 17 private individual rather than the United States owned the 18 land. 19 (d) The Governor of the State of Illinois is authorized 20 to accept the retrocession of exclusive legislative 21 jurisdiction over the subject lands by filing a notice of 22 acceptance with the Illinois Secretary of State. 23 (e) Upon transfer by deed of subject lands, or any 24 portion thereof, by the United States of America, the 25 proprietary interest retained by the United States shall 26 expire as to the particular property transferred. 27 ARTICLE 15. 28 Section 15-5. Upon the payment to the State of Illinois 29 of an amount to be negotiated by the parties in interest and 30 according to the terms of an agreement between the Lockport 31 Township Park District and the Director of Corrections, the 32 Director of Corrections is authorized to convey by quitclaim HB0452 Engrossed -7- LRB9102001DJcd 1 deed to the Lockport Township Park District all right, title, 2 and interest in and to the following described land in Will 3 County, Illinois: 4 The NE 1/4 of the NW 1/4 of Section 21-36-10 and the SE 5 1/4 of the NW 1/4 of Section 21-36-10, (approximately 80 6 acres), all in Township 36 North, Range 10 East of the Third 7 Principal Meridian in Will County, Illinois. 8 Section 15-10. The Director of Corrections shall obtain a 9 certified copy of the portions of this Act containing the 10 title, the enacting clause, the effective date, the 11 appropriate Sections containing the land descriptions of 12 property to be transferred, and this Section within 60 days 13 after this Act's effective date and, upon receipt of payment 14 required by the appropriate Sections, shall record the 15 certified document in the Recorder's office in the county in 16 which the land is located. 17 ARTICLE 20. 18 Section 20-5. Upon the payment of the sum of $50 to the 19 Department of Natural Resources, the Director of Natural 20 Resources is authorized to convey by quitclaim deed all 21 right, title, and interest in and to the following described 22 real property in Johnson County, Illinois to the Cedar Grove 23 Church, of the Village of Buncombe, County of Johnson, State 24 of Illinois: 25 The South 70.00 feet of the West 50.00 feet of the 26 Southwest Quarter of the Northeast Quarter of Section 31, 27 Township 11 South, Range 2 East of the Third Principal 28 Meridian, Johnson County, Illinois, as said Southwest 29 Quarter of the Northeast Quarter was surveyed by Edward 30 J. Upon payment of the sum of $1, the 8 Secretary of Transportation is authorized to convey by 9 quitclaim deed to the Bureau County Soil and Water 10 Conservation District all right, title, and interest in and 11 to the property commonly known as "Center Prairie" and 12 described as follows: 13 IDOT Location: US 6&34 (approximately 1 1/2 miles West 14 of Princeton, Bureau County). FA 8 (SBI 15 7), Section 11Y, Bureau County. 16 Beginning left Station 565 + 00 and 17 extending in an easterly direction to 18 and ending at left Station 708 + 37. 19 Legal Description: The property lies North of US 6&34 ROW 20 in Section 13 and 14, and the East 1/2 21 of the Southeast 1/4 of Section 15, 22 Township 16 North, Range 8, East of the 23 4th Principal Meridian in Bureau County, 24 Illinois. 25 The North boundary being the South 26 boundary of old US 6&34 in Sections 13 27 and 14, and the North boundary of 28 Section 15. 29 Section 25-10. Beginning right Station 1160 + 00 7 and extending in a southerly direction 8 to and ending at right Station 1175 + 9 00. 10 Legal Description: The property is that portion of the 11 Northeast 1/4 of the Northwest 1/4 which 12 lies West of the ROW of Illinois 26 in 13 Section 28, Township 18 North, Range 9, 14 East of the 4th Principal Meridian. 15 Section 25-15. The Secretary of Transportation shall 16 obtain a certified copy of the portions of this Act 17 containing the title, the enacting clause, the effective 18 date, the appropriate Sections containing the land 19 descriptions of property to be transferred, and this Section 20 within 60 days after this Act's effective date and, upon 21 receipt of payment required by the appropriate Sections, 22 shall record the certified document in the Recorder's office 23 in the county in which the land is located. 24 ARTICLE 30. 25 Section 30-2. For and in consideration of the sum of $1, 26 the Board of Trustees of Southern Illinois University is 27 authorized to convey, by quitclaim deed executed by the 28 chairperson and attested by the secretary of the Board of 29 Trustees of Southern Illinois University, to the Board of 30 Trustees of Lewis and Clark Community College District No. 31 536 all rights, title, and interest of the Board of Trustees HB0452 Engrossed -10- LRB9102001DJcd 1 of Southern Illinois University in and to the following 2 described real estate: 3 Parcel 1: 4 A parcel of land, known as Lot 8 of the Subdivision 5 of Block 1, Leclaire, as the same appears in Plat Book 6 6 Page 19; Upon the payment to the State of Illinois 22 of an amount to be negotiated by the parties in interest and 23 according to the terms of an agreement between the Will 24 County Department of Highways and the Director of 25 Corrections, the Director of Corrections is authorized to 26 convey by quitclaim deed to the Will County Department of 27 Highways all right, title, and interest in and to the 28 following described land in Will County, Illinois: 29 That Part of the South Half of Section 29, Township 36 30 North, Range 10 East of the Third Principal Meridian, 31 Lockport Township, Will County, Illinois, described as HB0452 Engrossed -14- LRB9102001DJcd 1 follows: Beginning at the Southeast corner of the Southwest 2 Quarter of the above said Section 29; thence westerly along 3 the south boundary of the above said Southwest Quarter 660.22 4 feet to the west boundary of the Stateville Penitentiary; 5 thence northerly 450.00 feet along that boundary; thence 6 easterly to a point which is 430.01 feet east and 450.00 feet 7 north of the point of beginning; thence South 450.00 feet to 8 the south line of the Southeast Quarter of Section 29; thence 9 West and at a 90 degree angle from the last described course, 10 430.01 feet to the point of beginning. Containing 10 acres, 11 more or less. Acreage based on that portion outside the 12 limits of a 50 foot right of way. 13 Section 35-10. The Director of Corrections shall obtain a 14 certified copy of the portions of this Act containing the 15 title, the enacting clause, the effective date, the 16 appropriate Sections containing the land descriptions of 17 property to be transferred, and this Section within 60 days 18 after this Act's effective date and, upon receipt of payment 19 required by the appropriate Sections, shall record the 20 certified document in the Recorder's office in the county in 21 which the land is located. 22 Article 90. 23 Section 90-5. The Property Tax Code is amended by 24 changing Section 9-195 and adding Section 15-103 as follows: 25 (35 ILCS 200/9-195) 26 Sec. 9-195. Leasing of exempt property. 27 (a) Except as provided in SectionsSection15-55,and28 15-100, and 15-103, when property which is exempt from 29 taxation is leased to another whose property is not exempt, 30 and the leasing of which does not make the property taxable, HB0452 Engrossed -15- LRB9102001DJcd 1 the leasehold estate and the appurtenances shall be listed as 2 the property of the lessee thereof, or his or her assignee. 3 Taxes on that property shall be collected in the same manner 4 as on property that is not exempt, and the lessee shall be 5 liable for those taxes. However, no tax lien shall attach to 6 the exempt real estate. The changes made by this amendatory 7 Act of 1997 are declaratory of existing law and shall not be 8 construed as a new enactment. The changes made by Public 9 Acts 88-221 and 88-420 that are incorporated into this 10 Section by this amendatory Act of 1993 are declarative of 11 existing law and are not a new enactment. 12 (b) The provisions of this Section regarding taxation of 13 leasehold interests in exempt property do not apply to any 14 leasehold interest created pursuant to any transaction 15 described in subsection (b) of Section 15-100 or in Section 16 15-103. 17 (Source: P.A. 90-562, eff. 12-16-97.) 18 (35 ILCS 200/15-103 new) 19 Sec. 15-103. Bi-State Development Agency. 20 (a) Property owned by the Bi-State Development Agency of 21 the Missouri-Illinois Metropolitan District is exempt. 22 (b) The exemption under this Section is not affected by 23 any transaction in which, for the purpose of obtaining 24 financing, the Agency, directly or indirectly, leases or 25 otherwise transfers the property to another for which or whom 26 property is not exempt and immediately after the lease or 27 transfer enters into a leaseback or other agreement that 28 directly or indirectly gives the Agency a right to use, 29 control, and possess the property. In the case of a 30 conveyance of the property, the Agency must retain an option 31 to purchase the property at a future date or, within the 32 limitations period for reverters, the property must revert 33 back to the Agency. HB0452 Engrossed -16- LRB9102001DJcd 1 (c) If the property has been conveyed as described in 2 subsection (b), the property is no longer exempt under this 3 Section as of the date when: 4 (1) the right of the Agency to use, control, and 5 possess the property is terminated; 6 (2) the Agency no longer has an option to purchase 7 or otherwise acquire the property; and 8 (3) there is no provision for a reverter of the 9 property to the Agency within the limitations period for 10 reverters. 11 (d) Pursuant to Sections 15-15 and 15-20 of this Code, 12 the Agency shall notify the chief county assessment officer 13 of any transaction under subsection (b). The chief county 14 assessment officer shall determine initial and continuing 15 compliance with the requirements of this Section for tax 16 exemption. Failure to notify the chief county assessment 17 officer of a transaction under this Section or to otherwise 18 comply with the requirements of Sections 15-15 and 15-20 of 19 this Code shall, in the discretion of the chief county 20 assessment officer, constitute cause to terminate the 21 exemption, notwithstanding any other provision of this Code. 22 (e) No provision of this Section shall be construed to 23 affect the obligation of the Agency under Section 15-10 of 24 this Code to file an annual certificate of status or to 25 notify the chief county assessment officer of transfers of 26 interest or other changes in the status of the property as 27 required by this Code. 28 Section 90-15. The Public Water District Act is amended 29 by changing Section 26 as follows: 30 (70 ILCS 3705/26) (from Ch. 111 2/3, par. 212.1) 31 Sec. 26. Annexation. Any territory which is contiguous to 32 a public water district organized under this Act and which is HB0452 Engrossed -17- LRB9102001DJcd 1 not included in any public water district may be annexed to 2 such contiguous public water district in the manner provided 3 by this Section. 4 A petition, signed by two-thirds of the legal voters 5 residing in the territory sought to be annexed, or if there 6 are no legal voters in the territory, a majority of the 7 owners of record of the land in the territory, and addressed 8 to the circuit court of the county in which the public water 9 district to which annexation is sought was organized, 10 requesting that the territory described in the petition be 11 annexed to such public water district, may be filed with the 12 clerk of such court. The clerk of such court shall thereupon 13 present such petition to the court which shall set a time, 14 place and date for a hearing thereon, which date shall be not 15 less than 20 nor more than 45 days after the date the 16 petition was filed. The court shall give notice of the time, 17 place and date of the hearing by publication in one or more 18 newspapers published in the district, and if there is no such 19 newspaper, in one or more newspapers published in the county 20 and having a general circulation within the public water 21 district and within the territory sought to be annexed 22 thereto, which publication shall be made at least 15 days 23 prior to the date set for the hearing. 24 (Source: P.A. 83-532.) 25 Section 90-50. The Code of Civil Procedure is amended by 26 changing Section 7-103 as follows: 27 (735 ILCS 5/7-103) (from Ch. 110, par. 7-103) 28 Sec. 7-103. "Quick-take". 2 (2) (blank); 3 (3) by the Department of Commerce and Community 4 Affairs for the purpose specified in the Illinois Coal 5 Development Bond Act; 6 (4) (blank); 7 (5) for the purpose specified in the St. Louis 8 Metropolitan Area Airport Authority Act; 9 (6) for a period of 24 months after May 24, 1996, 10 by the Southwestern Illinois Development Authority 11 pursuant to the Southwestern Illinois Development 12 Authority Act; 13 (7) for a period of 3 years after December 30, 14 1987, by the Quad Cities Regional Economic Development 15 Authority (except for the acquisition of land or 16 interests therein that is farmland, or upon which is 17 situated a farm dwelling and appurtenant structures, or 18 upon which is situated a residence, or which is wholly 19 within an area that is zoned for residential use) 20 pursuant to the Quad Cities Regional Economic Development 21 Authority Act; 22 (8) by a sanitary district created under the 23 Metropolitan Water Reclamation District Act for the 24 acquisition of land or interests therein for purposes 25 specified in that Act; 26 (9) by a rail carrier within the time limitations 27 and subject to the terms and conditions set forth in 28 Section 18c-7501 of the Illinois Vehicle Code; 29 (10) for a period of 18 months after January 26, 30 1987, for the purpose specified in Division 135 of 31 Article 11 of the Illinois Municipal Code, by a 32 commission created under Section 2 of the Water 33 Commission Act of 1985; 34 (11) by a village containing a population of less HB0452 Engrossed -19- LRB9102001DJcd 1 than 15,000 for the purpose of acquiring property to be 2 used for a refuse derived fuel system designed to 3 generate steam and electricity, and for industrial 4 development that will utilize such steam and electricity, 5 pursuant to Section 11-19-10 of the Illinois Municipal 6 Code; 7 (12) after receiving the prior approval of the City 8 Council, by a municipality having a population of more 9 than 500,000 for the purposes set forth in Section 10 11-61-1a and Divisions 74.2 and 74.3 of Article 11 of the 11 Illinois Municipal Code, and for the same purposes when 12 established pursuant to home rule powers; 13 (13) by a home rule municipality, after a public 14 hearing held by the corporate authorities or by a 15 committee of the corporate authorities and after approval 16 by a majority of the corporate authorities, within an 17 area designated as an enterprise zone by the municipality 18 under the Illinois Enterprise Zone Act; 19 (14) by the Illinois Sports Facilities Authority 20 for the purpose specified in Section 12 of the Illinois 21 Sports Facilities Authority Act; 22 (15) by a municipality having a population of more 23 than 2,000,000 for the purpose of acquiring the property 24 described in Section 3 of the Sports Stadium Act; 25 (16) for a period of 18 months after July 29, 1986, 26 in any proceeding by the Board of Trustees of the 27 University of Illinois for the acquisition of land in 28 Champaign County or interests therein as a site for a 29 building or for any educational purpose; 30 (17) for a period of 2 years after July 1, 1990, by 31 a home rule municipality and a county board, upon 32 approval of a majority of the corporate authorities of 33 both the county board and the municipality, within an 34 area designated as an enterprise zone by the municipality HB0452 Engrossed -20- LRB9102001DJcd 1 and the county board through an intergovernmental 2 agreement under the Illinois Enterprise Zone Act, when 3 the purpose of the condemnation proceeding is to acquire 4 land for the construction of an industrial harbor port, 5 and when the total amount of land to be acquired for that 6 purpose is less than 75 acres and is adjacent to the 7 Illinois River; 8 (18) by an airport authority located solely within 9 the boundaries of Madison County, Illinois, and which is 10 organized pursuant to the provisions of the Airport 11 Authorities Act, (i) for the acquisition of 160 acres, or 12 less, of land or interests therein for the purposes 13 specified in that Act which may be necessary to extend, 14 mark, and light runway 11/29 for a distance of 1600 feet 15 in length by 100 feet in width with parallel taxiway, to 16 relocate and mark County Highway 19, Madison County, 17 known as Moreland Road, to relocate the instrument 18 landing system including the approach lighting system and 19 to construct associated drainage, fencing and seeding 20 required for the foregoing project and (ii) for a period 21 of 6 months after December 28, 1989, for the acquisition 22 of 75 acres, or less, of land or interests therein for 23 the purposes specified in that Act which may be necessary 24 to extend, mark and light the south end of runway 17/35 25 at such airport; 26 (19) by any unit of local government for a 27 permanent easement for the purpose of maintaining, 28 dredging or cleaning the Little Calumet River; 29 (20) by any unit of local government for a 30 permanent easement for the purpose of maintaining, 31 dredging or cleaning the Salt Creek in DuPage County;
