LRB9002462LDdv LRB9002462LDdv 1 AN ACT to amend the Code of Civil Procedure by changing 2 Section 8-1401. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Code of Civil Procedure is amended by 6 changing Section 8-1401 as follows: 7 (735 ILCS 5/8-1401) (from Ch. 110, par. 8-1401) 8 Sec. 8-1401. Language interpreter. 9 (a) Interpreters may be sworn truly to interpret, when 10 necessary. 11 (b) (1) The Administrative Office of Illinois Courts 12 shall establish and administer a comprehensive testing 13 and certification program for language interpreters. 14 (2) The Administrative Office of Illinois Courts 15 shall work cooperatively with community colleges and 16 other private or public educational institutions and with 17 other public or private organizations to establish a 18 certification preparation curriculum and suitable 19 training programs to ensure the availability of certified 20 interpreters. Training programs shall be made readily 21 available throughout the State. 22 (3) The Administrative Office of Illinois Courts 23 shall establish and adopt standards of proficiency, 24 written and oral, in English and the language to be 25 interpreted. 26 (4) The Administrative Office of Illinois Courts 27 shall conduct periodic examinations to ensure the 28 availability of certified interpreters. Periodic 29 examinations shall be made readily available throughout 30 the State. 31 (5) The Administrative Office of Illinois Courts -2- LRB9002462LDdv 1 shall compile, maintain, and disseminate a current list 2 of interpreters certified by the Administrative Office of 3 Illinois Courts. 4 (6) The Administrative Office of Illinois Courts 5 may charge reasonable fees for testing, training, and 6 certification. 7 (Source: P.A. 82-280.) 8 Section 99. Effective date. This Act takes effect 9 January 1, 1998.
