 1                    AMENDMENT TO SENATE BILL 2016

 2        AMENDMENT NO.     .  Amend Senate Bill 2016 by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  10.   The  Counties Code is amended by changing
 5    Sections 3-6037 and 4-6003 as follows:

 6        (55 ILCS 5/3-6037) (from Ch. 34, par. 3-6037)
 7        Sec. 3-6037.  Salary of Supervisor of Safety.  The county
 8    board may, but need not, allow the Supervisor  of  Safety  an
 9    annual  salary.   Beginning  December  1, 2002, if the county
10    board allows the Supervisor of Safety an annual salary,  that
11    annual  salary  shall  not  be  less  than  not to exceed the
12    following:
13        In counties of less than 20,000 population,  the  sum  of
14    $1,500;
15        In  counties  of  20,000  or  more  and  less than 30,000
16    population, the sum of $2,000;
17        In counties of  30,000  or  more  and  less  than  50,000
18    population, the sum of $2,500;
19        In  counties  of  50,000  or  more  and  less than 75,000
20    population, the sum of $3,000;
21        In counties of 75,000  or  more  and  less  than  100,000
22    population, the sum of $3,500;

 1        In  counties  of  100,000  or  more and less than 500,000
 2    population, the sum of $4,000;
 3        In counties of 500,000 or more  population,  the  sum  of
 4    $4,500.
 5        The  word  "population"  when  used in this section shall
 6    mean the population  as  determined  by  the  last  preceding
 7    Federal Census.
 8        These  salaries  shall  be without regard to and separate
 9    from the salaries that may be fixed by the county  board  for
10    the Sheriff, and shall be payable out of the County Treasury.

13        Sec.   4-6003.  Compensation   of  sheriffs  for  certain
14    expenses in counties of less than 2,000,000.
15        (a)  The County Board,  in  all  counties  of  less  than
16    2,000,000   inhabitants,   shall   fix  the  compensation  of
17    sheriffs, with the amount  of  their  necessary  clerk  hire,
18    stationery, fuel and other expenses.  The county shall supply
19    the sheriff with all necessary uniforms, guns and ammunition.
20    The   compensation  of  each  such  officer  shall  be  fixed
21    separately from his necessary clerk  hire,  stationery,  fuel
22    and  other expenses.  Beginning immediately, no county with a
23    population  under  2,000,000   may   reduce   the   rate   of
24    compensation  of  its  sheriff below the rate of compensation
25    that it was actually paying to its sheriff on January 1, 2002
26    or the effective date of this  amendatory  Act  of  the  92nd
27    General Assembly, whichever is greater.
28        (b)  In  addition  to  the requirement of subsection (a),
29    the rate of compensation payable to the sheriff by the county
30    shall not be less than the following  and  such  compensation
31    shall be fixed within the following limits:
32        To  each  such  sheriff  in counties containing less than
33    10,000 inhabitants, not less than $27,000 per annum.

 1        To each such sheriff in  counties  containing  10,000  or
 2    more  inhabitants  but less than 20,000 inhabitants, not less
 3    than $31,000 per annum.
 4        To each such sheriff in  counties  containing  20,000  or
 5    more  inhabitants  but less than 30,000 inhabitants, not less
 6    than $34,000 per annum.
 7        To each such sheriff in  counties  containing  30,000  or
 8    more  inhabitants  but less than 60,000 inhabitants, not less
 9    than $37,000 per annum.
10        To each such sheriff in  counties  containing  60,000  or
11    more  inhabitants but less than 100,000 inhabitants, not less
12    than $40,000 per annum.
13        To each such sheriff in counties  containing  100,000  or
14    more  inhabitants  but  less  than 2,000,000 inhabitants, not
15    less than $43,000 per annum.
16        The population of each county for the purpose  of  fixing
17    compensation as herein provided, shall be based upon the last
18    federal  census  immediately  previous to the election of the
19    sheriff in question in such county.
20        (b)  Those sheriffs beginning a  term  of  office  before
21    December  1,  1990  shall be compensated at the rate of their
22    base salary.  "Base salary" is the compensation paid for each
23    of those offices, respectively, before July 1, 1989.
24        (c)  (Blank). Those sheriffs beginning a term  of  office
25    on or after December 1, 1990 shall be compensated as follows:
26             (1)  Beginning December 1, 1990, base salary plus at
27        least 3% of base salary.
28             (2)  Beginning December 1, 1991, base salary plus at
29        least 6% of base salary.
30             (3)  Beginning December 1, 1992, base salary plus at
31        least 9% of base salary.
32             (4)  Beginning December 1, 1993, base salary plus at
33        least 12% of base salary.
34        (d)  In   addition   to   the   salary  provided  for  in

 1    subsections (a), (b), and (c), beginning  December  1,  1998,
 2    each  sheriff, for his or her their additional duties imposed
 3    by other statutes or laws, shall receive an annual stipend to
 4    be paid by the State in the amount of $6,500.
 5        (e)  No county board may reduce or otherwise  impair  the
 6    compensation  payable  from  county funds to a sheriff if the
 7    reduction  or  impairment  is  the  result  of  the   sheriff
 8    receiving an award or stipend payable from State funds.

10        Section  90.  The State Mandates Act is amended by adding
11    Section 8.26 as follows:

12        (30 ILCS 805/8.26 new)
13        Sec. 8.26. Exempt mandate.   Notwithstanding  Sections  6
14    and  8 of this Act, no reimbursement by the State is required
15    for  the  implementation  of  any  mandate  created  by  this
16    amendatory Act of the 92nd General Assembly.

17        Section 99. Effective date.  This Act takes  effect  upon
18    becoming law.".
