92_SB1537sam001 LRB9210763DHgcam05 1 AMENDMENT TO SENATE BILL 1537 2 AMENDMENT NO. . Amend Senate Bill 1537 by replacing 3 everything after the enacting clause with the following: 4 "Section 1. Short title. This Act may be cited as the 5 Emergency Evacuation Plan for People with Disabilities Act. 6 Section 5. Emergency evacuation plan for persons with 7 disabilities required. By January 1, 2004, every high rise 8 building owner must establish and maintain an emergency 9 evacuation plan for disabled occupants of the building. As 10 used in this Act, "high rise building" means any building 80 11 feet or more in height. The owner is responsible for 12 maintaining and updating the plan as necessary to ensure that 13 the plan continues to comply with the provisions of this Act. 14 Section 10. Plan requirements. 15 (a) Each plan must establish procedures for locating and 16 evacuating persons with disabilities from the building in the 17 event of an emergency. 18 (b) Each plan must provide for a list to be maintained 19 of persons who have notified the owner that they are disabled 20 and would require special assistance in the event of an 21 emergency. The list must include the unit, office, or room -2- LRB9210763DHgcam05 1 number location that the disabled person occupies in the 2 building. The intent of this Act is to provide that these 3 lists must be maintained for the sole purpose of emergency 4 evacuation. The lists may not be used or disseminated for 5 any other purpose. 6 (c) The plan must provide for a means to notify 7 occupants of the building that a list identifying persons 8 with a disability in need of emergency evacuation assistance 9 is maintained by the owner, and the method by which occupants 10 can place their name on the list. 11 (d) In hotels and motels, each plan must provide an 12 opportunity for a guest to identify himself or herself as a 13 person with a disability in need of emergency evacuation 14 assistance. 15 (e) The plan must identify the location and type of any 16 evacuation assistance devices or assistive technologies that 17 are available in the building. 18 If the plan provides for areas of rescue assistance, the 19 plan must provide that these areas are to be identified by 20 signs that state "Area of Rescue Assistance" and display the 21 international symbol of accessibility. Lettering must be 22 permanent and must comply with Americans with Disabilities 23 Act Accessibility Guidelines. 24 (f) Each plan must include recommended procedures to be 25 followed by building employees, tenants, or guests to assist 26 persons with disabilities in need of emergency evacuation 27 assistance. 28 (g) A copy of the plan must be maintained at all times 29 in a place that is easily accessible by law enforcement or 30 fire safety personnel, such as in the management office of 31 the high rise building, at the security desk, or in the 32 vicinity of the fireman's elevator recall key, the life 33 safety panel, or the fire pump room. -3- LRB9210763DHgcam05 1 Section 15. Implementation 2 (a) The plan must be made available to local law 3 enforcement and fire safety personnel upon request. 4 (b) The plan must provide the names of and contact 5 information regarding any building personnel to be contacted 6 by law enforcement or fire safety personnel in the event of 7 an emergency requiring implementation of the plan. 8 (c) The plan must provide for dissemination or 9 availability of the plan to building employees, tenants, or 10 guests. 11 (d) The plan must identify the roles and 12 responsibilities of building personnel in carrying out the 13 evacuation plan. The plan must provide for appropriate 14 training for building personnel regarding their roles and 15 responsibilities. 16 (e) The plan must provide for drills regarding 17 evacuation procedures not less than once per year. A written 18 record of the date of the drill must be kept with the 19 evacuation plan. 20 Section 905. The State Mandates Act is amended by adding 21 Section 8.26 as follows: 22 (30 ILCS 805/8.26 new) 23 Sec. 8.26. Exempt mandate. Notwithstanding Sections 6 24 and 8 of this Act, no reimbursement by the State is required 25 for the implementation of any mandate created by this 26 amendatory Act of the 92nd General Assembly. 27 Section 999. Effective date. This Act takes effect upon 28 becoming law.".
