92_SB1537eng SB1537 Engrossed LRB9210763DHmgA 1 AN ACT in relation to public safety. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Emergency Evacuation Plan for People with Disabilities Act. 6 Section 5. Scope of the Act. This Act does not apply 7 within a municipality with a population of over 1,000,000 8 that, before the effective date of this Act, has adopted an 9 ordinance establishing emergency procedures for high rise 10 buildings. 11 Section 10. Emergency evacuation plan for persons with 12 disabilities required. By January 1, 2004, every high rise 13 building owner must establish and maintain an emergency 14 evacuation plan for disabled occupants of the building who 15 have notified the owner of their need for assistance. As used 16 in this Act, "high rise building" means any building 80 feet 17 or more in height. The owner is responsible for maintaining 18 and updating the plan as necessary to ensure that the plan 19 continues to comply with the provisions of this Act. 20 Section 15. Plan requirements. 21 (a) Each plan must establish procedures for evacuating 22 persons with disabilities from the building in the event of 23 an emergency, when those persons have notified the owner of 24 their need for assistance. 25 (b) Each plan must provide for a list to be maintained 26 of persons who have notified the owner that they are disabled 27 and would require special assistance in the event of an 28 emergency. The list must include the unit, office, or room 29 number location that the disabled person occupies in the SB1537 Engrossed -2- LRB9210763DHmgA 1 building. It is the intent of this Act that these lists must 2 be maintained for the sole purpose of emergency evacuation. 3 The lists may not be used or disseminated for any other 4 purpose. 5 (c) The plan must provide for a means to notify 6 occupants of the building that a list identifying persons 7 with a disability in need of emergency evacuation assistance 8 is maintained by the owner, and the method by which occupants 9 can place their name on the list. 10 (d) In hotels and motels, each plan must provide an 11 opportunity for a guest to identify himself or herself as a 12 person with a disability in need of emergency evacuation 13 assistance. 14 (e) The plan must identify the location and type of any 15 evacuation assistance devices or assistive technologies that 16 are available in the building. 17 If the plan provides for areas of rescue assistance, the 18 plan must provide that these areas are to be identified by 19 signs that state "Area of Rescue Assistance" and display the 20 international symbol of accessibility. Lettering must be 21 permanent and must comply with Americans with Disabilities 22 Act Accessibility Guidelines. 23 (f) Each plan must include recommended procedures to be 24 followed by building employees, tenants, or guests to assist 25 persons with disabilities in need of emergency evacuation 26 assistance. 27 (g) A copy of the plan must be maintained at all times 28 in a place that is easily accessible by law enforcement or 29 fire safety personnel, such as in the management office of 30 the high rise building, at the security desk, or in the 31 vicinity of the fireman's elevator recall key, the life 32 safety panel, or the fire pump room. 33 Section 20. Implementation. SB1537 Engrossed -3- LRB9210763DHmgA 1 (a) The plan must be made available to local law 2 enforcement and fire safety personnel upon request. 3 (b) The plan must provide the names of and contact 4 information regarding any building personnel to be contacted 5 by law enforcement or fire safety personnel in the event of 6 an emergency requiring implementation of the plan. 7 (c) The plan must provide for dissemination or 8 availability of the appropriate evacuation procedures 9 portions of the plan to building employees, tenants, or 10 guests. 11 (d) The plan must identify the roles and 12 responsibilities of building personnel in carrying out the 13 evacuation plan. The plan must provide for appropriate 14 training for building personnel regarding their roles and 15 responsibilities. 16 (e) The plan must provide for drills regarding 17 evacuation procedures not less than once per year. A written 18 record of the date of the drill must be kept with the 19 evacuation plan. 20 Section 25. Penalty. Failure to comply with any Section 21 of this Act is a petty offense punishable by a fine of $500. 22 Section 905. The State Mandates Act is amended by adding 23 Section 8.26 as follows: 24 (30 ILCS 805/8.26 new) 25 Sec. 8.26. Exempt mandate. Notwithstanding Sections 6 26 and 8 of this Act, no reimbursement by the State is required 27 for the implementation of any mandate created by this 28 amendatory Act of the 92nd General Assembly. 29 Section 999. Effective date. This Act takes effect upon 30 becoming law.
