 1        AN ACT concerning real estate.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 1.  Short title.  This Act may be  cited  as  the
 5    Savanna Army Depot Retrocession Law.

 6        Section 5.  Authorization to accept retrocession.
 7        (a)  Under  the provisions of Section 2683 of Title 10 of
 8    the  United  States  Code,  the  State of Illinois authorizes
 9    acceptance of retrocession by the United States of America of
10    concurrent legislative jurisdiction over lands consisting  of
11    the U.S. Army Depot Activity Savanna Military Reservation, Jo
12    Daviess  County  and  Carroll  County,  Illinois,  being more
13    particularly described as follows:
14        Situate in the State of Illinois, Jo Daviess  County  and
15        Carroll County, in sections 1, 2, 3, 4, 5, 10, 11, and 12
16        of  Township  25 north, Range 2 east and sections 18, 19,
17        20, 28, 29, 30, 31, 32, 33, and 34 of Township 26  north,
18        Range  2 east and Sections 3, 4, 5, 8, 9, 10, 11, 12, 13,
19        14, 15, 16, 21, 22, 23, 24, 25, 26, 27,  35,  and  36  of
20        Township  26  north,  Range  1  east,  and  section  6 of
21        Township 25 north,  Range  3  east,  all  of  the  Fourth
22        Principal  Meridian,  and  more particularly described as
23        follows.
24        Beginning at a concrete monument at the  intersection  of
25        the east bank of the Mississippi River and the north line
26        of  section  5,  Township  26 north, Range 1 east; thence
27        with said north line
28        Easterly 3,141 feet to a  buggy  axle  at  the  northeast
29        corner  of  section  5;  thence  with  the  north line of
30        section 4
31        Easterly 2,640 feet to a 2 inch  shafting  at  the  north

 1        quarter corner of Section 4; thence
 2        Easterly  1,002  feet  to  a  monument  on  the  westerly
 3        right-of-way  line  of  the  Burlington Northern Santa Fe
 4        Railroad;   thence   crossing   section   4   with   said
 5        right-of-way line as it generally follows a southeasterly
 6        direction
 7        Southeasterly 2,335 feet, more or less, to point  on  the
 8        west  line  of  Section 3, said point being located South
 9        1,588 feet from the northwest corner of section 3; thence
10        crossing a portion of section 3
11        Southeasterly 2,845 feet, more or less, to a monument  on
12        the  boundary of the village of Blanding; thence with the
13        common boundary of the U.S. Army Depot  Activity  Savanna
14        and village of Blanding
15        South 43°  50' West 372 feet to a monument
16        South 46°  10' East 131 feet to a monument
17        North  60°   30'  East  387  feet  to  a  monument on said
18        westerly  railroad  right-of-way  line;  thence  crossing
19        section 3 with said right-of-way  line  as  it  generally
20        follows a southeasterly direction
21        Southeasterly  2,430 feet, more or less to a point on the
22        north line of Section 10, said point being  located  West
23        1,332  feet  from  a  monument at the northeast corner of
24        Section 10; thence crossing Section 10 and a  portion  of
25        Section 11
26        Southeasterly  5,010 feet, more or less, to a monument on
27        the north and south quarter line through Section 11, said
28        point being located North 3,102 feet from a stone on  the
29        south line of Section 11; thence crossing Section 11
30        Southeasterly  3,000 feet, more or less, to a monument on
31        the east line of Section 11, said monument being  located
32        North  2,277  feet  from  the  southeast  corner  of said
33        Section 11; thence crossing Section 12

 6        the east and west quarter line in Section 18, Township 26
 7        north, Range 2 east, said monument being located East 452
 8        feet from a stone at the west quarter corner  of  Section
 9        18; thence crossing Section 18
10        Southeasterly  3,585 feet, more or less, to a monument on
11        the north line of Section 19, said monument being located
12        West 2 feet from the north quarter corner of Section  19;

14        Southeasterly  4,320 feet, more or less, to a monument on
15        the west line of Section 20; thence crossing Section 20
16        Southeasterly 2,787 feet, more or less, to a monument  on
17        the north line of Section 29; thence crossing Sections 29

19        Southeasterly 7,180 feet, more or less, to a point on the
20        north  line of Section 33, said point being located North
21        86°  45' East 731.3 feet from a  stone  at  the  northwest
22        corner  of  Section  33;  thence  crossing  a  portion of
23        Section 33
24        Southeasterly 4,170 feet, more or less, to a point on the
25        east and west quarter line through said Section 33,  said
26        point  being  located  East 1,141 feet from the center of
27        said Section 33; thence crossing Sections 33 and 34
28        Southeasterly 4,740 feet, more or less, to a point on the
29        north line of Section 3, Township 25 north, Range 2 east;
30        thence crossing said right-of-way with said north line of
31        Section 3
32        Easterly 305 feet to a  monument  on  the  north  quarter
33        corner  of  Section  3; thence continuing with said north
34        line of Section 3

 1        Easterly 2,678 feet to the northwest corner of Section 2;
 2        thence with the north line of Section 2
 3        Easterly 2,181.5 feet to a monument on the westerly  bank
 4        of the Apple River; thence with said westerly bank
 5        Southerly  to  a  point 100 feet north of and parallel to
 6        the east and west quarter line of Section 2; thence  with
 7        a  line  100  feet  north of and parallel to the east and
 8        west quarter line of Section 2
 9        Easterly 80 feet,  more  or  less,  to  a  point  on  the
10        centerline  of  the  Apple  River,  said  point being the
11        northwest corner of U.S. Tract No. S-10; thence with  the
12        north  boundary of U.S. Tract No. S-10 (north line of the
13        access road to the U.S. Army Depot Activity Savanna)
14        Easterly 824.7 feet, more or less, to a point on the west
15        line of Section 1; thence crossing Section 1 with a  line
16        100  feet  north  of  and  parallel  to the east and west
17        quarter line of Section one
18        Easterly along a line comprising the northern  boundaries
19        of  U.S.  Tract  Nos.  S-7,  S-6, S-5, S-4, S-3, and S-2,
20        respectively, passing the east line of Section 1, to  the
21        southwest  right-of-way  line  Illinois  Highway  No. 84;
22        thence with said right-of-way line
23        Southeasterly 115 feet, more or less, to a point  on  the
24        extended  east  and  west  quarter  line  of  Section  1,
25        Township  25  north,  Range  2  east;  thence  with  said

27        Westerly  to  the  east  quarter  corner  of  Section  1,

14        No.  2  in  Section  8,  9  and  16; and Island No. 1, in
15        Section 5; all  in  Township  26  north,  Range  1  east,
16        excepting  that  portion  of the railroad right-of-way in
17        Sections 2, 3, and 11, Township 25 north, Range  2  east,
18        and  also  the  following, lying 15 feet on both sides of
19        the following described centerline:
20        Beginning at the aforesaid Point "A" said point being  on
21        the  centerline  of  a  strip  of  land 30 feet in width,
22        thence with said centerline and an angle of 116°   07'  to
23        the right with said east and west quarter line of Section
24        1
25        Southwesterly  387.8 feet; thence with a deflection angle
26        to the right of 04° 
27        Southwesterly 190 feet; thence with a deflection angle to

32        line of Section 2, Township 25 north, Range 2 east, being

 2        Westerly 578.4 feet to a point on  the  centerline  of  a
 3        strip  of  land  100 feet in width, lying 50 feet on both
 4        sides of the following described centerline; thence  with
 5        a deflection angle to the right of 12°  34'
 6        Westerly  499.3 feet to the east bank of the Apple River,
 7        containing a total of 13,060.94 acres, more or less,  for
 8        all of the above described lands.
 9        Further,  the  State  of Illinois accepts retrocession of
10    and  authorizes  acceptance  of  retrocession  of  concurrent
11    legislative jurisdiction over all those lands  owned  by  the
12    United  States  that  may  subsequently  be identified by the
13    Department of the  Army  as  part  of  the  U.S.  Army  Depot
14    Activity  Savanna  Military Reservation, Jo Davies County and
15    Carroll County, Illinois, although not  included  within  the
16    legal description contained in this subsection, to the extent
17    concurrent jurisdiction has not previously been retroceded to
18    the  State  of  Illinois.  Any additional land over which the
19    State accepts retrocession of concurrent  jurisdiction  shall
20    be  identified  in a notice filed by the Governor as provided
21    in subsection (d).
22        (b) Pursuant to concurrent legislative jurisdiction, both
23    State and federal laws  are  applicable.   Since  most  major
24    crimes  violate  both federal and State laws, both may punish
25    an offender for an offense committed in the area.  The  State
26    of   Illinois,  subject  to  the  exemption  of  the  federal
27    government, has the right to tax.  The regulatory  powers  of
28    the  State  of Illinois may be exercised in the area, but not
29    in such a manner as  to  interfere  with  federal  functions.
30    Persons  residing  on  the  area under concurrent legislative
31    jurisdiction are ensured important rights and  privileges  of
32    citizenship,  such  as  the  right  to vote and access to the
33    Illinois courts.
34        (c) Subject to subsection  (b),  the  State  of  Illinois

 1    accepts  cession  of concurrent legislative jurisdiction from
 2    the United States.
 3        (d) The Governor of the State of Illinois  is  authorized
 4    to   accept   the   retrocession  of  concurrent  legislative
 5    jurisdiction over the subject lands by  filing  a  notice  of
 6    acceptance with the Illinois Secretary of State.
 7        (e)  Upon  transfer  by deed of the subject lands, or any
 8    portion  thereof,  by  the  United  States  of  America,  the
 9    concurrent jurisdiction  retained by the United States  shall
10    expire as to the particular property transferred.

11        Section  99.  Effective  date. This Act takes effect upon
12    becoming law.
