Amend House Bill 3695, AS AMENDED, 3 by replacing everything after the enacting clause with the 4 following: 5 "Section 1. Short title. This Act may be cited as the 6 Emergency Evacuation Plan for People with Disabilities Act. 7 Section 5. Scope of the Act. This Act does not apply 8 within a municipality with a population of over 1,000,000 9 that, before the effective date of this Act, has adopted an 10 ordinance establishing emergency procedures for high rise 11 buildings. 12 Section 10. Emergency evacuation plan for persons with 13 disabilities required. By January 1, 2004, every high rise 14 building owner must establish and maintain an emergency 15 evacuation plan for disabled occupants of the building who 16 have notified the owner of their need for assistance. As used 17 in this Act, "high rise building" means any building 80 feet 18 or more in height. The owner is responsible for maintaining 19 and updating the plan as necessary to ensure that the plan 20 continues to comply with the provisions of this Act. -2- LRB9210763DHgcam07 1 Section 15. Plan requirements. 2 (a) Each plan must establish procedures for evacuating 3 persons with disabilities from the building in the event of 4 an emergency, when those persons have notified the owner of 5 their need for assistance. 6 (b) Each plan must provide for a list to be maintained 7 of persons who have notified the owner that they are disabled 8 and would require special assistance in the event of an 9 emergency. The list must include the unit, office, or room 10 number location that the disabled person occupies in the 11 building. It is the intent of this Act that these lists must 12 be maintained for the sole purpose of emergency evacuation. 13 The lists may not be used or disseminated for any other 14 purpose. 15 (c) The plan must provide for a means to notify 16 occupants of the building that a list identifying persons 17 with a disability in need of emergency evacuation assistance 18 is maintained by the owner, and the method by which occupants 19 can place their name on the list. 20 (d) In hotels and motels, each plan must provide an 21 opportunity for a guest to identify himself or herself as a 22 person with a disability in need of emergency evacuation 23 assistance. 24 (e) The plan must identify the location and type of any 25 evacuation assistance devices or assistive technologies that 26 are available in the building. 27 If the plan provides for areas of rescue assistance, the 28 plan must provide that these areas are to be identified by 29 signs that state "Area of Rescue Assistance" and display the 30 international symbol of accessibility. Lettering must be 31 permanent and must comply with Americans with Disabilities 32 Act Accessibility Guidelines. 33 (f) Each plan must include recommended procedures to be 34 followed by building employees, tenants, or guests to assist -3- LRB9210763DHgcam07 1 persons with disabilities in need of emergency evacuation 2 assistance. 3 (g) A copy of the plan must be maintained at all times 4 in a place that is easily accessible by law enforcement or 5 fire safety personnel, such as in the management office of 6 the high rise building, at the security desk, or in the 7 vicinity of the fireman's elevator recall key, the life 8 safety panel, or the fire pump room. 9 Section 20. Implementation. 10 (a) The plan must be made available to local law 11 enforcement and fire safety personnel upon request. 12 (b) The plan must provide the names of and contact 13 information regarding any building personnel to be contacted 14 by law enforcement or fire safety personnel in the event of 15 an emergency requiring implementation of the plan. 16 (c) The plan must provide for dissemination or 17 availability of the appropriate evacuation procedures of the 18 plan to building employees, tenants, or guests. 19 (d) The plan must identify the roles and 20 responsibilities of building personnel in carrying out the 21 evacuation plan. The plan must provide for appropriate 22 training for building personnel regarding their roles and 23 responsibilities. 24 (e) The plan must provide for drills regarding 25 evacuation procedures not less than once per year. A written 26 record of the date of the drill must be kept with the 27 evacuation plan. 28 Section 25. Penalty. Failure to comply with any Section 29 of this Act is a petty offense punishable by a fine of $500. 30 Section 905. The State Mandates Act is amended by adding 31 Section 8.26 as follows: -4- LRB9210763DHgcam07 1 (30 ILCS 805/8.26 new) 2 Sec. 8.26. Exempt mandate. Notwithstanding Sections 6 3 and 8 of this Act, no reimbursement by the State is required 4 for the implementation of any mandate created by this 5 amendatory Act of the 92nd General Assembly. 6 Section 999. Effective date. This Act takes effect upon 7 becoming law.".
