 1                    AMENDMENT TO HOUSE BILL 3210

 2        AMENDMENT NO.     .  Amend House Bill 3210 as follows:

 3    by replacing everything after the enacting  clause  with  the
 4    following:

 5        "Section  5.   The  Illinois  Vehicle  Code is amended by
 6    changing Section 15-107 as follows:

 7        (625 ILCS 5/15-107) (from Ch. 95 1/2, par. 15-107)
 8        Sec. 15-107.  Length of vehicles.
 9        (a)  The maximum  length  of  a  single  vehicle  on  any
10    highway  of  this  State  may  not exceed  42 feet except the
11    following:
12             (1)  Semitrailers.
13             (2)  Charter or regulated route buses may be  up  to
14        45   feet  in  length,  not  including  energy  absorbing
15        bumpers.
16        (a-1)  A motor home as defined in Section 1-145.01 may be
17    up to 45 feet  in  length,  not  including  energy  absorbing
18    bumpers.  The length limitations described in this subsection
19    (a-1) shall be exclusive of energy-absorbing bumpers and rear
20    view mirrors.
21        (b)  On  all  non-State  highways,  the maximum length of

 1    vehicles in combinations is as follows:
 2             (1)  A  truck  tractor   in   combination   with   a
 3        semitrailer may not exceed 55 feet overall dimension.
 4             (2)  A  truck  tractor-semitrailer-trailer  may  not
 5        exceed 60 feet overall dimension.
 6             (3)  Combinations  specially  designed  to transport
 7        motor vehicles or boats may not exceed  60  feet  overall
 8        dimension.
 9        Vehicles    operating    during   daylight   hours   when
10    transporting poles, pipes, machinery, or other objects  of  a
11    structural  nature  that  cannot  readily  be dismembered are
12    exempt  from  length limitations, provided that no object may
13    exceed 80 feet in length and the  overall  dimension  of  the
14    vehicle  including  the  load may not  exceed 100 feet.  This
15    exemption does not apply to operation on a Saturday,  Sunday,
16    or legal holiday.  Legal holidays referred to in this Section
17    are  the days on which the following traditional holidays are
18    celebrated: New Year's Day; Memorial Day;  Independence  Day;
19    Labor Day; Thanksgiving Day; and Christmas Day.
20        Vehicles  and loads operated by a public utility while en
21    route to make emergency repairs to public service  facilities
22    or  properties  are  exempt from length limitations, provided
23    that  during night operations every vehicle and its load must
24    be equipped with a sufficient number of  clearance  lamps  on
25    both  sides  and  marker  lamps  on  the  extreme ends of any
26    projecting load to clearly mark the dimensions of the load.
27        A tow truck in combination with  a  disabled  vehicle  or
28    combination  of  disabled  vehicles, as provided in paragraph
29    (6) of subsection (c) of this Section, is exempt from  length
30    limitations.
31        All  other combinations not listed in this subsection (b)
32    may not exceed 60 feet overall dimension.
33        (c)  Combinations of vehicles may not exceed a total of 2
34    vehicles except the following:

 1             (1)  A  truck  tractor  semitrailer  may  draw   one
 2        trailer.
 3             (2)  A   truck  tractor  semitrailer  may  draw  one
 4        converter dolly.
 5             (3)  A  truck  tractor  semitrailer  may  draw   one
 6        vehicle  that  is  defined in Chapter 1 as special mobile
 7        equipment, provided the overall dimension does not exceed
 8        60 feet.
 9             (4)  A truck in transit may draw 3 trucks in transit
10        coupled together by the triple saddlemount method.
11             (5)  Recreational vehicles consisting of 3 vehicles,
12        provided the following:
13                  (A)  The  total  overall  dimension  does   not
14             exceed 60 feet.
15                  (B)  The   towing   vehicle   is   a   properly
16             registered vehicle capable of towing another vehicle
17             using a fifth-wheel type assembly.
18                  (C)  The  second  vehicle in the combination of
19             vehicles is a recreational vehicle that is towed  by
20             a   fifth-wheel  assembly.   This  vehicle  must  be
21             properly  registered  and  must  be  equipped   with
22             brakes, regardless of weight.
23                  (D)  The  third vehicle must be the lightest of
24             the 3 vehicles  and  be  a  trailer  or  semitrailer
25             designed   or   used   for   transporting   a  boat,
26             all-terrain   vehicle,   personal   watercraft,   or
27             motorcycle.
28                  (E)  The towed vehicles may be only for the use
29             of the operator of the towing vehicle.
30                  (F)  All vehicles  must  be  properly  equipped
31             with  operating brakes and safety equipment required
32             by  this   Code,   except   the   additional   brake
33             requirement  in subdivision (C) of this subparagraph
34             (5).

 1             (6)  A tow truck  in  combination  with  a  disabled
 2        vehicle or combination of disabled vehicles, provided the
 3        towing vehicle:
 4                  (A)  Is  specifically  designed  as a tow truck
 5             having a gross vehicle weight  rating  of  at  least
 6             18,000 pounds and equipped with air brakes, provided
 7             that  air  brakes  are  required  only if the towing
 8             vehicle  is  towing  a  vehicle,   semitrailer,   or
 9             tractor-trailer  combination  that  is equipped with
10             air brakes.  For the  purpose  of  this  subsection,
11             gross  vehicle  weight  rating,  or  GVWR, means the
12             value specified by the manufacturer  as  the  loaded
13             weight of the tow truck.
14                  (B)  Is  equipped  with  flashing, rotating, or
15             oscillating amber lights, visible for at  least  500
16             feet in all directions.
17                  (C)  Is  capable  of utilizing the lighting and
18             braking  systems  of   the   disabled   vehicle   or
19             combination of vehicles.
20                  (D)  Does not engage a tow exceeding 50 highway
21             miles from the initial point of wreck or disablement
22             to a place of repair. Any additional movement of the
23             vehicles   may   occur   only   upon   issuance   of
24             authorization for that movement under the provisions
25             of Sections 15-301 through 15-319 of this Code.
26        The  Department  may  by  rule  or  regulation  prescribe
27    additional  requirements  regarding  length limitations for a
28    tow truck towing another vehicle.
29        For purposes of this Section,  a  tow-dolly  that  merely
30    serves  as  substitute  wheels  for  another legally licensed
31    vehicle is considered part of the licensed vehicle and not  a
32    separate vehicle.
33        (d)  On  Class  I  highways  there  are no overall length
34    limitations  on  motor  vehicles  operating  in  combinations

 1    provided:
 2             (1)  The length of a semitrailer,  unladen  or  with
 3        load,  in combination with a truck tractor may not exceed
 4        53 feet.
 5             (2)  The distance between the kingpin and the center
 6        of the rear axle of a semitrailer longer than 48 feet, in
 7        combination with a truck tractor, may not exceed 45  feet
 8        6 inches.
 9             (3)  The length of a semitrailer or trailer, unladen
10        or     with     load,     operated     in     a     truck
11        tractor-semitrailer-trailer  combination,  may not exceed
12        28 feet 6 inches.
13             (4)  Maxi-cube combinations, as defined  in  Chapter
14        1, may not exceed 65 feet overall dimension.
15             (5)  Combinations  of vehicles specifically designed
16        to transport motor vehicles or boats may  not  exceed  65
17        feet   overall   dimension.   The  length  limitation  is
18        inclusive of front and rear bumpers but exclusive of  the
19        overhang  of  the  transported  vehicles,  as provided in
20        paragraph (i) of this Section.
21             (6)  Stinger steered semitrailer vehicles as defined
22        in Chapter 1, specifically designed  to  transport  motor
23        vehicles  or  boats,  may  not  exceed  75  feet  overall
24        dimension.  The  length  limitation is inclusive of front
25        and rear bumpers but exclusive of  the  overhang  of  the
26        transported  vehicles,  as  provided  in paragraph (i) of
27        this Section.
28             (7)  A  truck  in  transit  transporting  3   trucks
29        coupled together by the triple saddlemount method may not
30        exceed 75 feet overall dimension.
31        Vehicles    operating    during   daylight   hours   when
32    transporting poles, pipes, machinery, or other objects  of  a
33    structural  nature  that  cannot  readily  be dismembered are
34    exempt from length limitations, provided that no  object  may

 1    exceed  80  feet  in  length and the overall dimension of the
 2    vehicle including the load may not  exceed  100  feet.   This
 3    exemption  does not apply to operation on a Saturday, Sunday,
 4    or legal holiday.  Legal holidays referred to in this Section
 5    are the days on which the following traditional holidays  are
 6    celebrated:  New  Year's Day; Memorial Day; Independence Day;
 7    Labor Day; Thanksgiving Day; and Christmas Day.
 8        Vehicles and loads operated by a public utility while  en
 9    route  to make emergency repairs to public service facilities
10    or properties are exempt from  length  limitations,  provided
11    that  during night operations every vehicle and its load must
12    be equipped with a sufficient number of  clearance  lamps  on
13    both  sides  and  marker  lamps  on  the  extreme ends of any
14    projecting load to clearly mark the dimensions of the load.
15        A tow truck in combination with  a  disabled  vehicle  or
16    combination  of  disabled  vehicles, as provided in paragraph
17    (6) of subsection (c) of this Section, is exempt from  length
18    limitations.
19        The  length  limitations  described in this paragraph (d)
20    shall be exclusive of safety and energy conservation devices,
21    such as bumpers, refrigeration units or air  compressors  and
22    other devices, that the Department may interpret as necessary
23    for  safe  and  efficient  operation;  except  that no device
24    excluded under this paragraph shall have by its design or use
25    the capability to carry cargo.
26        Section 5-35 of the Illinois Administrative Procedure Act
27    relating to procedures for rulemaking shall not apply to  the
28    designation of highways under this paragraph (d).
29        (e)  On  Class  II  highways  there are no overall length
30    limitations on  motor  vehicles  operating  in  combinations,
31    provided:
32             (1)  The  length  of  a semitrailer, unladen or with
33        load, in combination with a truck tractor, may not exceed
34        53 feet overall dimension.

 1             (2)  The distance between the kingpin and the center

 3        combination with a truck tractor, may not exceed 45  feet
 4        6 inches.
 5             (3)  A truck tractor-semitrailer-trailer combination
 6        may not exceed 65 feet overall dimension.
 7             (4)  The length of a semitrailer or trailer, unladen
 8        or     with     load,     operated     in     a     truck
 9        tractor-semitrailer-trailer  combination,  may not exceed
10        28 feet 6 inches.
11             (5)  Maxi-cube combinations, as defined  in  Chapter
12        1, may not exceed 65 feet overall dimension.
13             (6)  A   combination   of   vehicles,   specifically
14        designed  to  transport  motor vehicles or boats, may not
15        exceed 65 feet overall dimension.  The length  limitation
16        is  inclusive  of front and rear bumpers but exclusive of
17        the overhang of the transported vehicles, as provided  in
18        paragraph (i) of this Section.
19             (7)  Stinger   steered   semitrailer   vehicles,  as
20        defined in Chapter 1, specifically designed to  transport
21        motor  vehicles  or boats, may not exceed 75 feet overall
22        dimension. The length limitation is  inclusive  of  front
23        and  rear  bumpers  but  exclusive of the overhang of the
24        transported vehicles, as provided  in  paragraph  (i)  of
25        this Section.
26             (8)  A   truck  in  transit  transporting  3  trucks

13        A  tow  truck  in  combination with a disabled vehicle or
14    combination of disabled vehicles, as  provided  in  paragraph
15    (6)  of subsection (c) of this Section, is exempt from length
16    limitations.
17        Local authorities and road district  commissioners,  with
18    respect to streets and highways under their jurisdiction, may
19    also  by  ordinance or resolution allow length limitations of
20    this subsection (e).
21        The length limitations described in  this  paragraph  (e)
22    shall be exclusive of safety and energy conservation devices,
23    such  as  bumpers, refrigeration units or air compressors and
24    other devices, that the Department may interpret as necessary
25    for safe and  efficient  operation;  except  that  no  device
26    excluded under this paragraph shall have by its design or use
27    the capability to carry cargo.
28        (e-1)  Combinations  of  vehicles  not  exceeding 65 feet
29    overall length are allowed access as follows:
30             (1)  From any  State  designated  highway  onto  any
31        county,  township, or municipal highway for a distance of
32        5 highway miles for the purpose of loading and unloading,
33        provided:
34                  (A)  The vehicle does not exceed 73,280  pounds

 1             in gross weight and 8 feet 6 inches in width.
 2                  (B)  There is no sign prohibiting that access.
 3                  (C)  The   route   is   not  being  used  as  a
 4             thoroughfare between State  designated highways.
 5             (2)  From any  State  designated  highway  onto  any
 6        county  or  township  highway for a distance of 5 highway
 7        miles or onto any municipal highway for a distance of one
 8        highway mile for the purpose of food, fuel, repairs,  and
 9        rest, provided:
10                  (A)  The  vehicle does not exceed 73,280 pounds
11             in gross weight and 8 feet 6 inches in width.
12                  (B)  There is no sign prohibiting that access.
13                  (C)  The  route  is  not  being   used   as   a
14             thoroughfare between State designated highways.
15        (e-2)  Except    as   provided   in   subsection   (e-3),
16    combinations of vehicles over 65  feet  in  length,  with  no
17    overall  length  limitation except as provided in subsections
18    (d) and (e) of this Section, are allowed access as follows:
19             (1)  From a Class  I  highway  onto  any  street  or
20        highway  for  a  distance  of  one  highway  mile for the
21        purpose of loading, unloading, food, fuel,  repairs,  and
22        rest, provided there is no sign prohibiting that access.
23             (2)  From  a  Class  I  or Class II highway onto any
24        State highway or any locally  designated  highway  for  a
25        distance  of  5 highway miles for the purpose of loading,
26        unloading, food, fuel, repairs, and rest.
27        (e-3)  Combinations of vehicles over 65  feet  in  length
28    operated  by household goods carriers, with no overall length
29    limitations except as provided in subsections (d) and (e)  of
30    this  Section, have unlimited access to points of loading and
31    unloading.
32        Section 5-35 of the Illinois Administrative Procedure Act
33    relating to procedures for rulemaking shall not apply to  the
34    designation of highways under this paragraph (e).

 1        (f)  On   Class   III   and  other  non-designated  State
 2    highways, the length limitations for vehicles in  combination
 3    are as follows:
 4             (1)  Truck  tractor-semitrailer  combinations,  must
 5        comply  with  either a maximum 55 feet overall wheel base
 6        or a maximum 65 feet extreme overall dimension.
 7             (2)  Semitrailers, unladen or  with  load,  may  not
 8        exceed 53 feet overall dimension.
 9             (3)  No       truck      tractor-semitrailer-trailer
10        combination may exceed 60 feet extreme overall dimension.
11             (4)  The distance between the kingpin and the center
12        axle of a semitrailer longer than 48 feet, in combination
13        with a truck tractor, may not exceed 42 feet 6 inches.
14        (g)  Length limitations in the preceding  subsections  of
15    this Section 15-107 do not apply to the following:
16             (1)  Vehicles  operated  in  the  daytime, except on
17        Saturdays, Sundays, or legal holidays, when  transporting
18        poles,  pipe, machinery, or other objects of a structural
19        nature that cannot readily be dismembered,  provided  the
20        overall  length  of  vehicle  and load may not exceed 100
21        feet and no object exceeding 80 feet  in  length  may  be
22        transported   unless   a  permit  has  been  obtained  as
23        authorized in Section 15-301.
24             (2)  Vehicles and loads operated by a public utility
25        while en  route  to  make  emergency  repairs  to  public
26        service   facilities  or  properties,  but  during  night
27        operation every vehicle and its  load  must  be  equipped
28        with a sufficient number of clearance lamps on both sides
29        and  marker lamps upon the extreme ends of any projecting
30        load to clearly mark the dimensions of the load.
31             (3)  A tow truck  in  combination  with  a  disabled
32        vehicle or combination of disabled vehicles, provided the
33        towing vehicle meets the following conditions:
34                  (A)  It is specifically designed as a tow truck

 1             having  a  gross  vehicle  weight rating of at least
 2             18,000 pounds and equipped with air brakes, provided
 3             that air brakes are  required  only  if  the  towing
 4             vehicle   is   towing  a  vehicle,  semitrailer,  or
 5             tractor-trailer combination that  is  equipped  with
 6             air brakes.
 7                  (B)  It is equipped with flashing, rotating, or
 8             oscillating  amber  lights, visible for at least 500
 9             feet in all directions.
10                  (C)  It is capable of  utilizing  the  lighting
11             and  braking  systems  of  the  disabled  vehicle or
12             combination of vehicles.
13                  (D)  It does not engage in a tow  exceeding  50
14             miles   from   the   initial   point   of  wreck  or
15             disablement.
16        The  Department  may  by  rule  or  regulation  prescribe
17    additional requirements regarding length  limitations  for  a
18    tow truck towing another vehicle.
19        For  the purpose of this subsection, gross vehicle weight
20    rating, or GVWR,  shall  mean  the  value  specified  by  the
21    manufacturer  as  the  loaded  weight of the tow truck. Legal
22    holidays referred to in this Section shall  be  specified  as
23    the  day  on  which  the  following  traditional holidays are
24    celebrated:
25        New Year's Day;
26        Memorial Day;
27        Independence Day;
28        Labor Day;
29        Thanksgiving Day; and
30        Christmas Day.
31        (h)  The load upon any vehicle  operated  alone,  or  the
32    load  upon  the  front  vehicle of a combination of vehicles,
33    shall not extend more than 3 feet beyond the front wheels  of
34    the  vehicle  or  the  front  bumper  of the vehicle if it is

 1    equipped  with  a  front  bumper.  The  provisions  of   this
 2    subsection  (h) shall not apply to any vehicle or combination
 3    of vehicles specifically  designed  for  the  collection  and
 4    transportation  of  waste,  garbage,  or recyclable materials
 5    during the vehicle's operation in the  course  of  collecting
 6    garbage,  waste,  or  recyclable  materials if the vehicle is
 7    traveling at a speed not in  excess  of  15  miles  per  hour
 8    during   the   vehicle's  operation  and  in  the  course  of
 9    collecting garbage, waste, or recyclable materials.  However,
10    in no instance shall the load extend more than 7 feet  beyond
11    the  front  wheels  of the vehicle or the front bumper of the
12    vehicle if it is equipped with a front bumper.
13        (i)  The load upon the front vehicle of a combination  of
14    vehicles  specifically  designed  to transport motor vehicles
15    shall not extend more than 3 feet beyond the foremost part of
16    the  transporting  vehicle  and  the  load  upon   the   rear
17    transporting vehicle shall not extend more than 4 feet beyond
18    the  rear  of the bed or body of the vehicle.  This paragraph
19    shall  only  be  applicable  upon  highways   designated   in
20    paragraphs (d) and (e) of this Section.
21        (j)  Articulated   vehicles   comprised  of  2  sections,
22    neither of which exceeds a length of 42  feet,  designed  for
23    the carrying of more than 10 persons, may be up to 60 feet in
24    length, not including energy absorbing bumpers, provided that
25    the vehicles are:
26             1.  operated  by  or  for  any  public body or motor
27        carrier   authorized   by   law   to    provide    public
28        transportation services; or
29             2.  operated  in local public transportation service
30        by any other person and the  municipality  in  which  the
31        service  is  to be provided approved the operation of the
32        vehicle.
33        (j-1) (Blank).
34        (k)  Any  person  who  is  convicted  of  violating  this

 1    Section is subject to the penalty as  provided  in  paragraph
 2    (b) of Section 15-113.
