92_HB3128 LRB9201522DJcsA 1 AN ACT in relation to support. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Public Aid Code is amended by 5 changing Sections 10-10.5, 10-11.2, and 10-27 as follows: 6 (305 ILCS 5/10-10.5) 7 Sec. 10-10.5. Information to State Case Registry. 8 (a) In this Section: 9 "Order for support", "obligor", "obligee", and "business 10 day" are defined as set forth in the Income Withholding for 11 Support Act. 12 "State Case Registry" means the State Case Registry 13 established under Section 10-27 of this Code. 14 (b) Each order for support entered or modified by the 15 circuit court under Section 10-10 shall require that the 16 obligor and obligee (i) file with the clerk of the circuit 17 court the information required by this Section (and any other 18 information required under Title IV, Part D of the Social 19 Security Act or by the federal Department of Health and Human 20 Services) within 5 business days after entry or modification 21 of the order for support and (ii) file updated information 22 with the clerk within 5 business days of any change. 23 (c) The obligor shall file the following information: 24 the obligor's name, date of birth, social security number, 25 and mailing address. 26 If either the obligor or the obligee receives child 27 support enforcement services from the Illinois Department 28 under Article X of this Code, the obligor shall also file the 29 following information: the obligor's telephone number, 30 driver's license number, and residential address (if 31 different from the obligor's mailing address), and the name, -2- LRB9201522DJcsA 1 address, and telephone number of the obligor's employer or 2 employers. 3 (d) The obligee shall file the following information: 4 (1) The names of the obligee and the child or 5 children covered by the order for support. 6 (2) The dates of birth of the obligee and the child 7 or children covered by the order for support. 8 (3) The social security numbers of the obligee and 9 the child or children covered by the order for support. 10 (4) The obligee's mailing address. 11 (e) In cases in which the obligee receives child support 12 enforcement services from the Illinois Department under 13 Article X of this Code, the order for support shall (i) 14 require that the obligee file the information required under 15 subsection (d) with the Illinois Department for inclusion in 16 the State Case Registry, rather than file the information 17 with the clerk, and (ii) require that the obligee include the 18 following additional information: 19 (1) The obligee's telephone and driver's license 20 numbers. 21 (2) The obligee's residential address, if different 22 from the obligee's mailing address. 23 (3) The name, address, and telephone number of the 24 obligee's employer or employers. 25 The order for support shall also require that the obligee 26 update the information filed with the Illinois Department 27 within 5 business days of any change. 28 (f) The clerk shall provide the information filed under 29 this Section, together with the court docket number and 30 county in which the order for support was entered, to the 31 State Case Registry within 5 business days after receipt of 32 the information. 33 (g) In a case in which a party is receiving child 34 support enforcement services under Article X of this Code, -3- LRB9201522DJcsA 1 the clerk shall provide the following additional information 2 to the State Case Registry within 5 business days after entry 3 or modification of an order for support or request from the 4 Illinois Department: 5 (1) The amount of monthly or other periodic support 6 owed under the order for support and other amounts, 7 including arrearage, interest, or late payment penalties 8 and fees, due or overdue under the order. 9 (2) Any such amounts that have been received by the 10 clerk, and the distribution of those amounts by the 11 clerk. 12 (h) Information filed by the obligor and obligee under 13 this Section that is not specifically required to be included 14 in the body of an order for support under other laws is not a 15 public record and shall be treated as confidential and 16 subject to disclosure only in accordance with the provisions 17 of this Section, Section 10-27 of this Code, and Title IV, 18 Part D of the Social Security Act. 19(a) When an order for support is entered or modified by20the circuit court under Section 10-10, the clerk of the21circuit court shall, within 5 business days, provide to the22Illinois Department's State Case Registry established under23Section 10-27 of this Code the court docket number and county24in which the order is entered or modified and the following25information, which the parties shall disclose to the court:26(1) The names of the custodial and non-custodial27parents and the child or children covered by the order.28(2) The dates of birth of the custodial and29non-custodial parents and of the child or children30covered by the order.31(3) The social security numbers of the custodial32and non-custodial parents and of the child or children33covered by the order.34(4) The residential and mailing addresses for the-4- LRB9201522DJcsA 1custodial and non-custodial parents.2(5) The telephone numbers for the custodial and3non-custodial parents.4(6) The driver's license numbers for the custodial5and non-custodial parents.6(7) The name, address, and telephone number of each7parent's employer or employers.8(b) When a child support order is entered or modified9for a case in which a party is receiving child and spouse10support services under Article X of this Code, the clerk11shall provide the State Case Registry with the following12information:13(1) The information specified in subsection (a) of14this Section.15(2) The amount of monthly or other periodic support16owed under the order and other amounts, including17arrearages, interest, or late payment penalties and fees,18due or overdue under the order.19(3) Any amounts described in subdivision (2) of20this subsection (b) that have been received by the clerk.21(4) The distribution of the amounts received by the22clerk.23(c) A party shall report to the clerk of the circuit24court changes in information required to the disclosed under25this Section within 5 business days of the change.26(d) To the extent that updated information is in the27clerk's possession, the clerk shall provide updates of the28information specified in subsection (b) of this Section29within 5 business days after the Illinois Department's30request for that updated information.31 (Source: P.A. 91-212, eff. 7-20-99.) 32 (305 ILCS 5/10-11.2) 33 Sec. 10-11.2. Administrative support order information -5- LRB9201522DJcsA 1 for State Case Registry. 2 (a) In this Section, "business day" is defined as set 3 forth in the Income Withholding for Support Act. 4 (b) Each administrative support order entered or 5 modified under Section 10-8.1 or Section 10-11 shall require 6 the following: 7 (1) That the non-custodial parent file with the 8 Illinois Department the information required by 9 subsection (c) of this Section (and any other information 10 required under Title IV, Part D of the Social Security 11 Act or by the federal Department of Health and Human 12 Services) within 5 business days after entry or 13 modification of the administrative support order, and 14 that the parent file updated information with the 15 Illinois Department within 5 business days of any change. 16 (2) That the custodial parent file with the 17 Illinois Department the information required by 18 subsection (d) of this Section (and any other information 19 required under Title IV, Part D of the Social Security 20 Act or by the federal Department of Health and Human 21 Services) within 5 business days after entry or 22 modification of the administrative support order (unless 23 the custodial parent already filed the information during 24 the child support case intake process), and that the 25 parent file updated information with the Illinois 26 Department within 5 business days of any change. 27 (c) The non-custodial parent shall file the following 28 information: 29 (1) The name and date of birth of the non-custodial 30 parent. 31 (2) The non-custodial parent's social security 32 number, driver's license number, and telephone number. 33 (3) The mailing address (and the residential 34 address, if different from the mailing address) of the -6- LRB9201522DJcsA 1 non-custodial parent. 2 (4) The name, address, and telephone number of the 3 non-custodial parent's employer or employers. 4 (d) The custodial parent shall file the following 5 information: 6 (1) The names and dates of birth of the custodial 7 parent and the child or children covered by the 8 administrative support order. 9 (2) The social security numbers of the custodial 10 parent and the child or children covered by the 11 administrative support order. 12 (3) The custodial parent's driver's license number 13 and telephone number. 14 (4) The custodial parent's mailing address (and 15 residential address, if different from the mailing 16 address). 17 (5) The name, address, and telephone number of the 18 custodial parent's employer or employers. 19 (e) The information filed with the Illinois Department 20 under this Section shall be included in the State Case 21 Registry established under Section 10-27 of this Code. 22 (f) Information filed by the non-custodial parent and 23 custodial parent under this Section that is not specifically 24 required to be included in the body of an administrative 25 support order under other laws or under rules of the Illinois 26 Department shall be treated as confidential and subject to 27 disclosure only in accordance with the provisions of this 28 Section, Section 10-27 of this Code, and Title IV, Part D of 29 the Social Security Act.When the Illinois Department enters30an administrative support order under Section 10-8.1 or31Section 10-11, or modifies such an order, the custodial32parent and the non-custodial parent shall provide to the33Illinois Department, and update as appropriate, the following34information to be included in the State Case Registry-7- LRB9201522DJcsA 1established under Section 10-27:2(1) The names of the custodial and non-custodial3parents and of the child or children covered by the4order.5(2) The dates of birth of the custodial and6non-custodial parents and of the child or children7covered by the order.8(3) The social security numbers of the custodial9and non-custodial parents and of the child or children10covered by the order.11(4) The residential and mailing addresses for the12custodial and non-custodial parents.13(5) The telephone numbers for the custodial and14non-custodial parents.15(6) The driver's license numbers for the custodial16and non-custodial parents.17(7) The name, address, and telephone number of each18parent's employer or employers.19(8) Any other information that may be required20under Title IV, Part D of the Social Security Act or21regulations promulgated thereunder.22 (Source: P.A. 91-212, eff. 7-20-99.) 23 (305 ILCS 5/10-27) 24 Sec. 10-27. State Case Registry. 25 (a) The Illinois Department shall establish an automated 26 State Case Registry to contain records concerning child 27 support orders for parties receiving child support 28 enforcement services under this Article X, and for all child 29 support orders entered or modified on or after October 1, 30 1998. The State Case Registry shall include (i) the 31 information filed with the Illinois Department, or filed with 32 the clerk of the circuit court and provided to the Illinois 33 Department, under the provisions of Sections 10-10.5 and -8- LRB9201522DJcsA 1 10-11.2 of this Code, Section 505.3 of the Illinois Marriage 2 and Dissolution of Marriage Act, Section 30 of the 3 Non-Support Punishment Act, and Section 14.1 of the Illinois 4 Parentage Act of 1984, and (ii) any other information 5 required under Title IV, Part D of the Social Security Act or 6 by the federal Department of Health and Human Services.The7Illinois Department shall establish an automated State Case8Registry to contain records concerning child support orders9for parties receiving child and spouse support services under10this Article X, and for all child support orders entered or11modified on or after October 1, 1998, and pursuant to12Sections 10-10 and 10-11 of this Code, and pursuant to the13Illinois Marriage and Dissolution of Marriage Act, the14Non-Support of Spouse and Children Act, the Uniform15Interstate Family Support Act, or the Illinois Parentage Act16of 1984.17 (b) (Blank).The Illinois Department shall maintain the18following information in the Registry for all cases described19in subsection (a):20(1) the names of the custodial and non-custodial21parents, and of the child or children covered by the22order;23(2) the dates of birth of the custodial and24non-custodial parents, and of the child or children25covered by the order;26(3) the social security numbers of the custodial27and non-custodial parents and, if available, of the child28or children covered by the order;29(4) the residential and mailing addresses for the30custodial and non-custodial parents;31(5) the telephone numbers for the custodial and32non-custodial parents;33(6) the driver's license numbers for the custodial34and non-custodial parents;-9- LRB9201522DJcsA 1(7) the name, address, and telephone number of each2parent's employer or employers;3(8) the case identification number;4(9) the court docket number, if applicable; and5(10) any other information that may be required6under Title IV, Part D of the Social Security Act or7regulations promulgated thereunder.8 (c) The Illinois Department shall maintain the following 9 payment information on child support orders for parties 10 receiving childand spousesupport enforcement services under 11 this Article X: 12 (1) the amount of monthly or other periodic support 13 owed under the order and other amounts, including 14 arrearages, interest or late payment penalties, and fees, 15 due or overdue under the order; 16 (2) any amounts described in subdivision (1) of 17 subsection (d) that have been collected; 18 (3) the distribution of the collected amounts; and 19 (4) the amount of any lien imposed with respect to 20 the order pursuant to Section 10-25 or Section 10-25.5 of 21 this Code. 22 (d) The Illinois Department shall establish, update, 23 maintain, and monitor case records in the Registry of parties 24 receiving childand spousesupport enforcement services under 25 this Article X, on the bases of: 26 (1) information on administrative actions and 27 administrative and judicial proceedings and orders 28 relating to paternity and support; 29 (2) information obtained from comparison with 30 federal, State, and local sources of information; 31 (3) information on support collections and 32 distribution; and 33 (4) any other relevant information. 34 (e) The Illinois Department shall use the automated -10- LRB9201522DJcsA 1 State Case Registry to share and compare information with, 2 and receive information from, other data bases and 3 information comparison services in order to obtain (or 4 provide) information necessary to enable the Illinois 5 Department (or the federal Department of Health and Human 6 Services or other State or federal agencies) to carry out the 7 requirements of the child support enforcement program 8 established under Title IV, Part D of the Social Security 9 Act. Such information comparison activities shall include 10 the following: 11 (1) Furnishing to the Federal Case Registry of 12 Child Support Orders (and updating as necessary, with 13 information including notice of expiration of orders) the 14 information specified by the federal Department of Health 15 and Human Services in regulations. 16 (2) Exchanging information with the Federal Parent 17 Locator Service for the purposes specified in Section 453 18 of the Social Security Act. 19 (3) Exchanging information with State agencies (of 20 this State and of other states) administering programs 21 funded under Title IV, Part A and Title XIX of the Social 22 Security Act and other programs designated by the federal 23 Department of Health and Human Services, as necessary to 24 perform responsibilities under Title IV, Part D of the 25 Social Security Act and under such other programs. 26 (4) Exchanging information with other agencies of 27 this State, agencies of other states, and interstate 28 information networks, as necessary and appropriate to 29 carry out (or assist other states to carry out) the 30 purposes of Title IV, Part D of the Social Security Act. 31 (5) Disclosing information to any other entities as 32 required under Title IV, Part D of the Social Security 33 Act. 34 (f) The Illinois Department shall adopt rules -11- LRB9201522DJcsA 1 establishing safeguards, applicable to all confidential 2 information included in the State Case Registry, that are 3 designed to protect the privacy rights of persons concerning 4 whom information is on record in the State Case Registry. 5 Such safeguards shall include, but not be limited to the 6 following: 7 (1) Prohibitions against the release of information 8 on the whereabouts of one party or the child to another 9 party against whom a protective order with respect to the 10 former party or the child has been entered. 11 (2) Prohibitions against the release of information 12 on the whereabouts of one party or the child to another 13 party if the Illinois Department has reasonable evidence 14 of domestic violence or child abuse (that is, allegations 15 of domestic violence or child abuse, unless the Illinois 16 Department has an independent, reasonable basis to find 17 the person making the allegation not credible) to the 18 former party or child by the party requesting 19 information. 20 (3) Prohibitions against the release of information 21 on the whereabouts of one party or the child to another 22 person if the Illinois Department has reason to believe 23 the release of information to that person may result in 24 physical or emotional harm to the party or child. 25 (Source: P.A. 90-790, eff. 8-14-98.) 26 Section 10. The Illinois Marriage and Dissolution of 27 Marriage Act is amended by changing Section 505.3 as follows: 28 (750 ILCS 5/505.3) 29 Sec. 505.3. Information to State Case Registry. 30 (a) In this Section: 31 "Order for support", "obligor", "obligee", and "business 32 day" are defined as set forth in the Income Withholding for -12- LRB9201522DJcsA 1 Support Act. 2 "State Case Registry" means the State Case Registry 3 established under Section 10-27 of the Illinois Public Aid 4 Code. 5 (b) Each order for support entered or modified by the 6 circuit court under this Act shall require that the obligor 7 and obligee (i) file with the clerk of the circuit court the 8 information required by this Section (and any other 9 information required under Title IV, Part D of the Social 10 Security Act or by the federal Department of Health and Human 11 Services) within 5 business days after entry or modification 12 of the order for support and (ii) file updated information 13 with the clerk within 5 business days of any change. 14 (c) The obligor shall file the following information: 15 the obligor's name, date of birth, social security number, 16 and mailing address. 17 If either the obligor or the obligee receives child 18 support enforcement services from the Illinois Department of 19 Public Aid under Article X of the Illinois Public Aid Code, 20 the obligor shall also file the following information: the 21 obligor's telephone number, driver's license number, and 22 residential address (if different from the obligor's mailing 23 address), and the name, address, and telephone number of the 24 obligor's employer or employers. 25 (d) The obligee shall file the following information: 26 (1) The names of the obligee and the child or 27 children covered by the order for support. 28 (2) The dates of birth of the obligee and the child 29 or children covered by the order for support. 30 (3) The social security numbers of the obligee and 31 the child or children covered by the order for support. 32 (4) The obligee's mailing address. 33 (e) In cases in which the obligee receives child support 34 enforcement services from the Illinois Department of Public -13- LRB9201522DJcsA 1 Aid under Article X of the Illinois Public Aid Code, the 2 order for support shall (i) require that the obligee file the 3 information required under subsection (d) with the Illinois 4 Department of Public Aid for inclusion in the State Case 5 Registry, rather than file the information with the clerk, 6 and (ii) require that the obligee include the following 7 additional information: 8 (1) The obligee's telephone and driver's license 9 numbers. 10 (2) The obligee's residential address, if different 11 from the obligee's mailing address. 12 (3) The name, address, and telephone number of the 13 obligee's employer or employers. 14 The order for support shall also require that the obligee 15 update the information filed with the Illinois Department of 16 Public Aid within 5 business days of any change. 17 (f) The clerk shall provide the information filed under 18 this Section, together with the court docket number and 19 county in which the order for support was entered, to the 20 State Case Registry within 5 business days after receipt of 21 the information. 22 (g) In a case in which a party is receiving child 23 support enforcement services under Article X of the Illinois 24 Public Aid Code, the clerk shall provide the following 25 additional information to the State Case Registry within 5 26 business days after entry or modification of an order for 27 support or request from the Illinois Department of Public 28 Aid: 29 (1) The amount of monthly or other periodic support 30 owed under the order for support and other amounts, 31 including arrearage, interest, or late payment penalties 32 and fees, due or overdue under the order. 33 (2) Any such amounts that have been received by the 34 clerk, and the distribution of those amounts by the -14- LRB9201522DJcsA 1 clerk. 2 (h) Information filed by the obligor and obligee under 3 this Section that is not specifically required to be included 4 in the body of an order for support under other laws is not a 5 public record and shall be treated as confidential and 6 subject to disclosure only in accordance with the provisions 7 of this Section, Section 10-27 of the Illinois Public Aid 8 Code, and Title IV, Part D of the Social Security Act. 9(a) When an order for support is entered or10modified under this Act, the clerk of the circuit court11shall, within 5 business days, provide to the State Case12Registry established under Section 10-27 of the Illinois13Public Aid Code the court docket number and county numbers for the custodial and28non-custodial parents.29(6) The driver's license numbers for the custodial30and non-custodial parents.31(7) The name, address, and telephone number of each32parent's employer or employers.33(b) When a child support order is entered or modified34for a case in which a party is receiving child and spouse-15- LRB9201522DJcsA 1support services under Article X of the Illinois Public Aid2Code, the clerk shall provide the State Case Registry with3the following information:4(1) The information specified in subsection (a) of5this Section.6(2) The amount of monthly or other periodic support7owed under the order and other amounts, including8arrearages, interest, or late payment penalties and fees,9due or overdue under the order.10(3) Any amounts described in subdivision (2) of11this subsection (b) that have been received by the clerk.12(4) The distribution of the amounts received by the13clerk.14(c) A party shall report to the clerk of the circuit15court changes in information required to the disclosed under16this Section within 5 business days of the change.17(d) To the extent that updated information is in the18clerk's possession, the clerk shall provide updates of the19information specified in subsection (b) of this Section20within 5 business days after the Illinois Department of21Public Aid's request for that updated information.22 (Source: The Non-Support Punishment Act is amended by 24 changing Section 30 as follows: 25 (750 ILCS 16/30) 26 Sec. 30. Information to State Case Registry. 27 (a) In this Section: 28 "Order for support", "obligor", "obligee", and "business 29 day" are defined as set forth in the Income Withholding for 30 Support Act. 31 "State Case Registry" means the State Case Registry 32 established under Section 10-27 of the Illinois Public Aid -16- LRB9201522DJcsA 1 Code. 2 (b) Each order for support entered or modified by the 3 circuit court under this Act shall require that the obligor 4 and obligee (i) file with the clerk of the circuit court the 5 information required by this Section (and any other 6 information required under Title IV, Part D of the Social 7 Security Act or by the federal Department of Health and Human 8 Services) within 5 business days after entry or modification 9 of the order for support and (ii) file updated information 10 with the clerk within 5 business days of any change. 11 (c) The obligor shall file the following information: 12 the obligor's name, date of birth, social security number, 13 and mailing address. 14 If either the obligor or the obligee receives child 15 support enforcement services from the Illinois Department of 16 Public Aid under Article X of the Illinois Public Aid Code, 17 the obligor shall also file the following information: the 18 obligor's telephone number, driver's license number, and 19 residential address (if different from the obligor's mailing 20 address), and the name, address, and telephone number of the 21 obligor's employer or employers. 22 (d) The obligee shall file the following information: 23 (1) The names of the obligee and the child or 24 children covered by the order for support. 25 (2) The dates of birth of the obligee and the child 26 or children covered by the order for support. 27 (3) The social security numbers of the obligee and 28 the child or children covered by the order for support. 29 (4) The obligee's mailing address. 30 (e) In cases in which the obligee receives child support 31 enforcement services from the Illinois Department of Public 32 Aid under Article X of the Illinois Public Aid Code, the 33 order for support shall (i) require that the obligee file the 34 information required under subsection (d) with the Illinois -17- LRB9201522DJcsA 1 Department of Public Aid for inclusion in the State Case 2 Registry, rather than file the information with the clerk, 3 and (ii) require that the obligee include the following 4 additional information: 5 (1) The obligee's telephone and driver's license 6 numbers. 7 (2) The obligee's residential address, if different 8 from the obligee's mailing address. 9 (3) The name, address, and telephone number of the 10 obligee's employer or employers. 11 The order for support shall also require that the obligee 12 update the information filed with the Illinois Department of 13 Public Aid within 5 business days of any change. 14 (f) The clerk shall provide the information filed under 15 this Section, together with the court docket number and 16 county in which the order for support was entered, to the 17 State Case Registry within 5 business days after receipt of 18 the information. 19 (g) In a case in which a party is receiving child 20 support enforcement services under Article X of the Illinois 21 Public Aid Code, the clerk shall provide the following 22 additional information to the State Case Registry within 5 23 business days after entry or modification of an order for 24 support or request from the Illinois Department of Public 25 Aid: 26 (1) The amount of monthly or other periodic support 27 owed under the order for support and other amounts, 28 including arrearage, interest, or late payment penalties 29 and fees, due or overdue under the order. 30 (2) Any such amounts that have been received by the 31 clerk, and the distribution of those amounts by the 32 clerk. 33 (h) Information filed by the obligor and obligee under 34 this Section that is not specifically required to be included -18- LRB9201522DJcsA 1 in the body of an order for support under other laws is not a 2 public record and shall be treated as confidential and 3 subject to disclosure only in accordance with the provisions 4 of this Section, Section 10-27 of the Illinois Public Aid 5 Code, and Title IV, Part D of the Social Security Act. 6(a) When an order for support is entered or modified7under Section 20 of this Act, the clerk of the court shall,8within 5 business days, provide to the State Case Registry9established under Section 10-27 of the Illinois Public Aid10Code the court docket number and county in which the order is11entered or modified and the following information, which the12parents involved in the case shall disclose to the court:13(1) the names of the custodial and noncustodial14parents and of the child or children covered by the15order;16(2) the dates of birth of the custodial and17noncustodial parents and of the child or children covered18by the order;19(3) the social security numbers of the custodial and20noncustodial parents and, if available, of the child or21children covered by the order;22(4) the residential and mailing address for the23custodial and noncustodial parents;24(5) the telephone numbers for the custodial and25noncustodial parents;26(6) the driver's license numbers for the custodial27and noncustodial parents; and28(7) the name, address, and telephone number of each29parent's employer or employers.30(b) When an order for support is entered or modified31under Section 20 in a case in which a party is receiving32child and spouse support services under Article X of the33Illinois Public Aid Code, the clerk shall provide the State34Case Registry with the following information within 5-19- LRB9201522DJcsA 1business days:2(1) the information specified in subsection (a);3(2) the amount of monthly or other periodic support4owed under the order and other amounts, including5arrearages, interest, or late payment penalties and fees,6due or overdue under the order;7(3) any amounts described in subdivision (2) of this8subsection (b) that have been received by the clerk; and9(4) the distribution of the amounts received by the10clerk.11(c) A party shall report to the clerk of the circuit12court changes in information required to be disclosed under13this Section within 5 business days of the change.14(d) To the extent that updated information is in the15clerk's possession, the clerk shall provide updates of the16information specified in subsection (b) within 5 business17days after the Illinois Department of Public Aid's request18for that updated The Illinois Parentage Act of 1984 is 21 amended by changing Section 14.1 as follows: 22 (750 ILCS 45/14.1) 23 Sec. 14.1. Information to State Case Registry. insert 4 24 (a) In this Section: 25 "Order for support", "obligor", "obligee", and "business 26 day" are defined as set forth in the Income Withholding for 27 Support Act. 28 "State Case Registry" means the State Case Registry 29 established under Section 10-27 of the Illinois Public Aid 30 Code. 31 (b) Each order for support entered or modified by the 32 circuit court under this Act shall require that the obligor -20- LRB9201522DJcsA 1 and obligee (i) file with the clerk of the circuit court the 2 information required by this Section (and any other 3 information required under Title IV, Part D of the Social 4 Security Act or by the federal Department of Health and Human 5 Services) within 5 business days after entry or modification 6 of the order for support and (ii) file updated information 7 with the clerk within 5 business days of any change. 8 (c) The obligor shall file the following information: 9 the obligor's name, date of birth, social security number, 10 and mailing address. 11 If either the obligor or the obligee receives child 12 support enforcement services from the Illinois Department of 13 Public Aid under Article X of the Illinois Public Aid Code, 14 the obligor shall also file the following information: the 15 obligor's telephone number, driver's license number, and 16 residential address (if different from the obligor's mailing 17 address), and the name, address, and telephone number of the 18 obligor's employer or employers. 19 (d) The obligee shall file the following information: 20 (1) The names of the obligee and the child or 21 children covered by the order for support. 22 (2) The dates of birth of the obligee and the child 23 or children covered by the order for support. 24 (3) The social security numbers of the obligee and 25 the child or children covered by the order for support. 26 (4) The obligee's mailing address. 27 (e) In cases in which the obligee receives child support 28 enforcement services from the Illinois Department of Public 29 Aid under Article X of the Illinois Public Aid Code, the 30 order for support shall (i) require that the obligee file the 31 information required under subsection (d) with the Illinois 32 Department of Public Aid for inclusion in the State Case 33 Registry, rather than file the information with the clerk, 34 and (ii) require that the obligee include the following -21- LRB9201522DJcsA 1 additional information: 2 (1) The obligee's telephone and driver's license 3 numbers. 4 (2) The obligee's residential address, if different 5 from the obligee's mailing address. 6 (3) The name, address, and telephone number of the 7 obligee's employer or employers. 8 The order for support shall also require that the obligee 9 update the information filed with the Illinois Department of 10 Public Aid within 5 business days of any change. 11 (f) The clerk shall provide the information filed under 12 this Section, together with the court docket number and 13 county in which the order for support was entered, to the 14 State Case Registry within 5 business days after receipt of 15 the information. 16 (g) In a case in which a party is receiving child 17 support enforcement services under Article X of the Illinois 18 Public Aid Code, the clerk shall provide the following 19 additional information to the State Case Registry within 5 20 business days after entry or modification of an order for 21 support or request from the Illinois Department of Public 22 Aid: 23 (1) The amount of monthly or other periodic support 24 owed under the order for support and other amounts, 25 including arrearage, interest, or late payment penalties 26 and fees, due or overdue under the order. 27 (2) Any such amounts that have been received by the 28 clerk, and the distribution of those amounts by the 29 clerk. 30 (h) Information filed by the obligor and obligee under 31 this Section that is not specifically required to be included 32 in the body of an order for support under other laws is not a 33 public record and shall be treated as confidential and 34 subject to disclosure only in accordance with the provisions -22- LRB9201522DJcsA 1 of this Section, Section 10-27 of the Illinois Public Aid 2 Code, and Title IV, Part D of the Social Security Act. 3(a) When an order for support is entered or modified4under this Act, the clerk of the circuit court shall, within55 business days, provide to the State Case Registry6established under Section 10-27 of the Illinois Public Aid7Code the court docket number and county in which the order8is entered or modified and the following information,9which the parties shall disclose to the court:10(1) The names of the custodial and non-custodial11parents and of the child or children covered by the12order.13(2) The dates of birth of the custodial and14non-custodial parents and of the child or children15covered by the order.16(3) The social security numbers of the custodial17and non-custodial parents and of the child or children18covered by the order.19(4) The residential and mailing addresses for the20custodial and non-custodial parents.21(5) The telephone numbers for the custodial and22non-custodial parents.23(6) The driver's license numbers for the custodial24and non-custodial parents.25(7) The name, address, and telephone number of each26parent's employer or employers.27(b) When a child support order is entered or modified28for a case in which a party is receiving child and spouse29support services under Article X of the Illinois Public Aid30Code, the clerk shall provide the State Case Registry with31the following information:32(1) The information specified in subsection (a) of33this Section.34(2) The amount of monthly or other periodic support-23- LRB9201522DJcsA 1owed under the order and other amounts, including2arrearages, interest, or late payment penalties and fees,3due or overdue under the order.4(3) Any amounts described in subdivision (2) of5this subsection (b) that have been received by the clerk.6(4) The distribution of the amounts received by the7clerk.8(c) The parties affected by the order shall inform the9clerk of court of any change of address or of other condition10that may affect the administration of the order.11(d) To the extent that updated information is in the12clerk's possession, the clerk shall provide updates of the13information specified in subsection (b) of this Section14within 5 business days after the Illinois Department of15Public Aid's request for that updated information.16
