92_HB2492sam001 LRB9205024LBgcam01 1 AMENDMENT TO HOUSE BILL 2492 2 AMENDMENT NO. . Amend House Bill 2492, on page 1, 3 after line 3, by inserting the following: 4 "Section 5. The Hospital Licensing Act is amended by 5 adding Section 6.19 as follows: 6 (210 ILCS 5/6.19 new) 7 Sec. 6.19. Use of restraints. Each hospital licensed 8 under this Act must have a written policy to address the use 9 of restraints and seclusion in the hospital. The Department 10 shall establish, by rule, the provisions that the policy must 11 include, which, to the extent practicable, should be 12 consistent with the requirements for participation in the 13 federal Medicare program. Each hospital policy shall include 14 periodic review of the use of restraints or seclusion in the 15 hospital. 16 In hospitals, restraints or seclusion may only be ordered 17 by (1) a physician licensed to practice medicine in all its 18 branches, or (2) a registered nurse with supervisory 19 responsibilities as authorized by the medical staff. The 20 medical staff of a hospital may adopt a policy specifying the 21 requirements for the use of restraints or seclusion and 22 identifying whether a registered nurse with supervisory -2- LRB9205024LBgcam01 1 responsibilities may order restraints or seclusion in the 2 hospital when the patient's treating physician is not 3 available. 4 Registered nurses authorized to order restraints or 5 seclusion shall have appropriate training and experience as 6 determined by medical staff policy. The treating physician 7 shall be notified when restraints or seclusion are ordered by 8 a registered nurse. Nothing in this Section requires that a 9 medical staff authorize a registered nurse with supervisory 10 responsibilities to order restraints or seclusion."; and 11 on page 1, line 4, by replacing "Section 5" with "Section 12 10".
