92_HB2426 LRB9205516MWmg 1 AN ACT concerning emergency telephone services. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Emergency Telephone System Act is amended 5 by changing Sections 15.5 and 15.6 and by adding Section 2.20 6 as follows: 7 (50 ILCS 750/2.20 new) 8 Sec. 2.20. Telecommunications carrier. 9 "Telecommunications carrier" means the same as in Section 10 13-203 of the Public Utilities Act. 11 (50 ILCS 750/15.5) 12 Sec. 15.5. Private residential switch service 9-1-1 13 service. 14 (a) After June 30, 1995, a telecommunications carrieran15entitythat provides or operates private residential switch 16 service and provides telecommunications facilities or 17 services to residents shall provide to those residential end 18 users the same level of 9-1-1 service as the public agency 19 and the telecommunications carrier are providing to other 20 residential end users of the local 9-1-1 system. This 21 service shall include, but not be limited to, the capability 22 to identify the telephone number, extension number, and the 23 physical location that is the source of the call to the 24 number designated as the emergency telephone number. 25 (b) The private residential switch operator is 26 responsible for forwarding end user automatic location 27 identification record information to the 9-1-1 system 28 provider according to the format, frequency, and procedures 29 established by that system provider. 30 (c) This Act does not apply to any PBX telephone -2- LRB9205516MWmg 1 extension that uses radio transmissions to convey electrical 2 signals directly between the telephone extension and the 3 serving PBX. 4 (d) An entity that violates this Section is guilty of a 5 business offense and shall be fined not less than $1,000 and 6 not more than $5,000. 7 (e) Nothing in this Section shall be construed to 8 preclude the Attorney General on behalf of the Commission or 9 on his or her own initiative, or any other interested person, 10 from seeking judicial relief, by mandamus, injunction, or 11 otherwise, to compel compliance with this Section. 12 (Source: P.A. 88-604, eff. 9-1-94; 89-222, eff. 1-1-96; 13 89-497, eff. 6-27-96.) 14 (50 ILCS 750/15.6) 15 Sec. 15.6. Enhanced 9-1-1 service; business service. 16 (a) After June 30, 2000, or within 18 months after 17 enhanced 9-1-1 service becomes available, any 18 telecommunications carrierentitythat installs or operates a 19 private business switch service and provides 20 telecommunications facilities or services to businesses shall 21 assure that the system is connected to the public switched 22 network in a manner that calls to 9-1-1 result in automatic 23 number and location identification. For buildings having 24 their own street address and containing workspace of 40,000 25 square feet or less, location identification shall include 26 the building's street address. For buildings having their 27 own street address and containing workspace of more than 28 40,000 square feet, location identification shall include the 29 building's street address and one distinct location 30 identification per 40,000 square feet of workspace. Separate 31 buildings containing workspace of 40,000 square feet or less 32 having a common public street address shall have a distinct 33 location identification for each building in addition to the -3- LRB9205516MWmg 1 street address. 2 (b) Exemptions. Buildings containing workspace of more 3 than 40,000 square feet are exempt from the multiple location 4 identification requirements of subsection (a) if the building 5 maintains, at all times, alternative and adequate means of 6 signaling and responding to emergencies. Those means shall 7 include, but not be limited to, a telephone system that 8 provides the physical location of 9-1-1 calls coming from 9 within the building. Health care facilities are presumed to 10 meet the requirements of this paragraph if the facilities are 11 staffed with medical or nursing personnel 24 hours per day 12 and if an alternative means of providing information about 13 the source of an emergency call exists. Buildings under this 14 exemption must provide 9-1-1 service that provides the 15 building's street address. 16 Buildings containing workspace of more than 40,000 square 17 feet are exempt from subsection (a) if the building 18 maintains, at all times, alternative and adequate means of 19 signaling and responding to emergencies, including a 20 telephone system that provides the location of a 9-1-1 call 21 coming from within the building, and the building is serviced 22 by its own medical, fire and security personnel. Buildings 23 under this exemption are subject to emergency phone system 24 certification by the Illinois Commerce Commission. 25 Buildings in communities not serviced by enhanced 9-1-1 26 service are exempt from subsection (a).200027 (c) This Act does not apply to any PBX telephone 28 extension that uses radio transmissions to convey electrical 29 signals directly between the telephone extension and the 30 serving PBX. 31 (d) An entity that violates this Section is guilty of a 32 business offense and shall be fined not less than $1,000 and 33 not more than $5,000. 34 (e) Nothing in this Section shall be construed to -4- LRB9205516MWmg 1 preclude the Attorney General on behalf of the Commission or 2 on his or her own initiative, or any other interested person, 3 from seeking judicial relief, by mandamus, injunction, or 4 otherwise, to compel compliance with this Section. 5 (f) The Commission shall promulgate rules for the 6 administration of this Section no later than January 1, 2000. 7 (Source: P.A. 90-819, eff. 3-23-99; 91-518, eff. 8-13-99; 8 revised 10-20-99.) 9 Section 99. Effective date. This Act takes effect upon 10 becoming law.
