Amend House Bill 2161 as follows: 3 by replacing everything after the enacting clause with the 4 following: 5 "Section 5. The Illinois Vehicle Code is amended by 6 adding Section 6-108.1 as follows: 7 (625 ILCS 5/6-108.1 new) 8 Sec. 6-108.1. Notice to Secretary; denial of license; 9 persons under 18. 10 (a) The State's Attorney must notify the Secretary of 11 the charges pending against any person younger than 18 years 12 of age who has been charged with a violation of this Code or 13 the Criminal Code of 1961 arising out of an accident in which 14 the person was involved as a driver and that caused the death 15 of or a type A injury to another person. A "type A injury" 16 includes severely bleeding wounds, distorted extremities, and 17 injuries that require the injured party to be carried from 18 the scene. The State's Attorney must notify the Secretary on 19 a form prescribed by the Secretary. 20 (b) The Secretary, upon receiving notification from the 21 State's Attorney, may deny any driver's license to any person -2- LRB9206152DHmbam05 1 younger than 18 years of age against whom the charges are 2 pending. 3 (c) The State's Attorney must notify the Secretary of 4 the final disposition of the case of any person who has been 5 denied a driver's license under subsection (b). 6 (d) The Secretary must adopt rules for implementing this 7 Section. 8 Section 99. Effective date. This Act takes effect upon 9 becoming law.".
