92_HB2161enr HB2161 Enrolled LRB9206152DHmb 1 AN ACT in relation to vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by adding 5 Section 6-108.1 as follows: 6 (625 ILCS 5/6-108.1 new) 7 Sec. 6-108.1. Notice to Secretary; denial of license; 8 persons under 18. 9 (a) The State's Attorney must notify the Secretary of 10 the charges pending against any person younger than 18 years 11 of age who has been charged with a violation of this Code or 12 the Criminal Code of 1961 arising out of an accident in which 13 the person was involved as a driver and that caused the death 14 of or a type A injury to another person. A "type A injury" 15 includes severely bleeding wounds, distorted extremities, and 16 injuries that require the injured party to be carried from 17 the scene. The State's Attorney must notify the Secretary on 18 a form prescribed by the Secretary. 19 (b) The Secretary, upon receiving notification from the 20 State's Attorney, may deny any driver's license to any person 21 younger than 18 years of age against whom the charges are 22 pending. 23 (c) The State's Attorney must notify the Secretary of 24 the final disposition of the case of any person who has been 25 denied a driver's license under subsection (b). 26 (d) The Secretary must adopt rules for implementing this 27 Section. 28 Section 99. Effective date. This Act takes effect upon 29 becoming law.
