92_HB2027 LRB9206149DJgc 1 AN ACT in relation to housing. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Act on the Aging is amended by 5 adding Section 4.02c as follows: 6 (20 ILCS 105/4.02c new) 7 Sec. 4.02c. Transitional housing assistance. The 8 Department shall administer a program of transitional housing 9 assistance for aged persons who are eligible for that 10 assistance under Section 3-903.5 or 4-706.5 of the Mental 11 Health and Developmental Disabilities Code. The Department 12 may arrange for the assistance to be provided through local, 13 community-based not-for-profit organizations that provide 14 services for aged persons or persons with disabilities. To 15 the extent possible, the Department shall coordinate its 16 implementation of this Section with the Department of Human 17 Services. 18 Section 10. The Department of Human Services Act is 19 amended by adding Section 10-30 as follows: 20 (20 ILCS 1305/10-30 new) 21 Sec. 10-30. Transitional housing assistance. The 22 Department shall administer a program of transitional housing 23 assistance for persons other than aged persons, as defined in 24 the Illinois Act on the Aging, who are eligible for that 25 assistance under Section 3-903.5 or 4-706.5 of the Mental 26 Health and Developmental Disabilities Code. The Department 27 may arrange for the assistance to be provided through local, 28 community-based not-for-profit organizations that provide 29 services for persons with disabilities. To the extent -2- LRB9206149DJgc 1 possible, the Department shall coordinate its implementation 2 of this Section with the Department on Aging. 3 Section 15. The Mental Health and Developmental 4 Disabilities Code is amended by adding Sections 3-903.5 and 5 4-706.5 as follows: 6 (405 ILCS 5/3-903.5 new) 7 Sec. 3-903.5. Transitional housing assistance. 8 (a) Upon a recipient's discharge from a facility, the 9 recipient is entitled to transitional housing assistance as 10 provided in this Section to help the recipient make the 11 transition from residing in a facility to residing in the 12 community. 13 (b) Transitional housing assistance shall include, but 14 need not be limited to, the following: 15 (1) Rent. 16 (2) First month's rent deposit. 17 (3) Security deposit. 18 The amount of assistance provided to a recipient shall be 19 based on the fair market rent for the community in which the 20 recipient intends to reside. Assistance shall be provided in 21 an amount such that a recipient is not required to spend more 22 than one-third of his or her income for rent. 23 (c) In addition to the assistance described in 24 subsection (b), a recipient is entitled to referrals for 25 locating housing and for training regarding fair housing 26 rights. 27 (d) Transitional housing assistance shall be provided to 28 recipients without regard to a recipient's age or the nature 29 of a recipient's disability. 30 (e) A recipient is entitled to transitional housing 31 assistance under this Section until he or she obtains 32 long-term assistance to enable him or her to reside in the -3- LRB9206149DJgc 1 community. 2 (405 ILCS 5/4-706.5 new) 3 Sec. 4-706.5.
