91_SB1104eng SB1104 Engrossed LRB9101921KScs 1 AN ACT to amend the Carnival and Amusement Rides Safety 2 Act. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Carnival and Amusement Rides Safety Act 6 is amended by changing Section 2-6 as follows: 7 (430 ILCS 85/2-6) (from Ch. 111 1/2, par. 4056) 8 Sec. 2-6. Promulgation of rules and regulations by the 9 Board; public hearing. The Board shall promulgate and 10 formulate definitions, rules and regulations for the safe 11 installation, repair, maintenance, use, operation and 12 inspection of all amusement rides and amusement attractions 13 as the Board finds necessary for the protection of the 14 general public using amusement rides and amusement 15 attractions. The rules shall be based upon generally accepted 16 engineering standards and shall be concerned with, but not 17 necessarily limited to, engineering force stresses, safety 18 devices, and preventive maintenance. Whenever such standards 19 are available in suitable form they may be incorporated by 20 reference. The rules shall provide for the reporting of 21 accidents and injuries incurred from the operation of 22 amusement rides or amusement attractions. In addition to the 23 permit fee herein provided, the Board may promulgate rules to 24 establish a schedule of fees for inspections. 25 Before adopting, modifying or amending any rule 26 consistent with and necessary for the enforcement of this 27 Act, the Director or Board shall hold a public hearing on the 28 proposed rule, modification or amendment to a rule. Any 29 interested person may appear and be heard at the hearing, in 30 person or by agent or counsel. The Director shall give the 31 news media notice of each hearing at least 30 days in advance SB1104 Engrossed -2- LRB9101921KScs 1 of the hearing date and shall make available a copy of the 2 proposed rule, or modification or amendment to a rule to any 3 person requesting same. The provisions of this Section are in 4 addition to all other existing requirements pertaining to the 5 promulgation of administrative rules and regulations. 6 (Source: P.A. 83-1240.)
