91_SB1076 LRB9103314ACtmA 1 AN ACT to amend the Illinois Nuclear Facility Safety Act 2 by changing Sections 5 and 7. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Nuclear Facility Safety Act is 6 amended by changing Sections 5 and 7 as follows: 7 (420 ILCS 10/5) (from Ch. 111 1/2, par. 4355) 8 Sec. 5. Program for Illinois nuclear power plant 9 inspectors. 10 (a) Consistent with federal law and policy statements of 11 and cooperative agreements with the Nuclear Regulatory 12 Commission with respect to State participation in health and 13 safety regulation of nuclear facilities, and in recognition 14 of the role provided for the states by such laws, policy 15 statements and cooperative agreements, the Department shall 16 develop and implement a program for Illinois resident 17 inspectors that, when fully implemented, shall provide for 18 one full-time Departmental Illinois resident inspector at 19 each nuclear power plant in Illinois. The owner of each of 20 the2nuclear power plants to which they are assigned shall 21 provide, at its expense, office space and equipment 22 reasonably required by the resident inspectors while they are 23 on the premises of the nuclear power plants. The Illinois 24 resident inspectors shall operate in accordance with a 25 cooperative agreement executed by the Department and the 26 Nuclear Regulatory Commission and shall have access to the 27 nuclear power plants to which they have been assigned in 28 accordance with that agreement; provided, however, that the 29 Illinois resident inspectors shall have no greater access 30 than is afforded tobya resident inspector of the Nuclear 31 Regulatory Commission. -2- LRB9103314ACtmA 1 (b) The Department may also assign an inspector 2 qualified as an Illinois resident inspector to each licensed 3 nuclear power plant in the State that has permanently ceased 4 operations. The inspector need not be resident at the power 5 plant. Such inspectors shall operate in accordance with a 6 cooperative agreement executed by the Department and the 7 Nuclear Regulatory Commission and shall have access to the 8 nuclear power plants to which they have been assigned in 9 accordance with that agreement; provided, however, that the 10 Illinois inspectors shall have no greater access than is 11 afforded to inspectors of the Nuclear Regulatory Commission. 12 The owner of each of the nuclear power plants to which 13 inspectors are assigned shall provide, at the plant's 14 expense, office space and equipment reasonably required by 15 the inspectors while they are on the premises of the nuclear 16 power plants. 17 (c) The Illinois resident inspectors and inspectors 18 assigned under subsection (b) shall each operate in 19 accordance with the security plan for the nuclear power plant 20 to which they are assigned, but in no event shall they be 21 required to meet any requirements imposed by a nuclear power 22 plant owner that are not imposed on resident inspectors and 23 inspectors of the Nuclear Regulatory Commission. The Department shall not engage in any program 29 of Illinois resident inspectors or inspectors assigned under 30 subsection (b) of Section 5 at any nuclear power plant in 31 Illinois except as specifically directed by law. 32 (Source: P.A. 86-1376; 87-897.) -3- LRB9103314ACtmA 1 Section 99.
