The Election Code is amended by changing 5 Sections 3-1.2, 7-10, 8-8, 10-4, 12-5, and 28-3 as follows: 6 (10 ILCS 5/3-1.2) (from Ch. 46, par. 3-1.2) 7 Sec. 3-1.2. Eligibility to sign or circulate petition. 8 For the purpose of determining eligibility to sign or 9 circulate a nominating petition or a petition proposing a 10 public question the terms "voter", "registered voter", 11 "qualified voter", "legal voter", "elector", "qualified 12 elector", "primary elector" and "qualified primary elector" 13 as used in this Code or in another Statute shall mean a 14 person who is registered to vote at the address shown 15 opposite his signature on the petition or was registered to 16 vote at such address when he signed the petition. Any person, 17 otherwise qualified under this Section, who has not moved to 18 another residence but whose address has changed as a result 19 of implementation of a 9-1-1 emergency telephone system shall 20 be considered a "voter", "registered voter", "qualified 21 voter", "legal voter", "elector", "qualified elector", 22 "primary elector", and "qualified primary elector". -2- LRB9105846PTpkam04 1 (Source: P.A. 90-664, eff. 7-30-98.) 2 (10 ILCS 5/7-10) (from Ch. 46, par. 7-10) 3 Sec. 7-10. Form of petition for nomination. The residence address required 21 to be written or printed opposite each qualified primary 22 elector's name shall include the street address or rural 23 route number of the signer, as the case may be, as well as 24 the signer's county, and city, village or town, and state. 25 However the county or city, village or town, and state of 26 residence of the electors may be printed on the petition 27 forms where all of the electors signing the petition reside 28 in the same county or city, village or town, and state. 29 Standard abbreviations may be used in writing the residence 30 address, including street number, if any. At the bottom of 31 each sheet of such petition shall be added a statement signed 32 by a registered voter of the political division, who has been 33 a registered voter at all times he or she circulated the 34 petition, for which the candidate is seeking a nomination, -4- LRB9105846PTpkam04 1 stating the street address or rural route number of the 2 voter, as the case may be, as well as the voter's county, and 3 city, village or town, and state; and certifying that the 4 signatures on that sheet of the petition were signed in his 5 presence; and either (1) indicating the dates on which that 6 sheet was circulated, or (2) indicating the first and last 7 dates on which the sheet was circulated, or (3) certifying 8 that none of the signatures on the sheet were signed more 9 than 90 days preceding the last day for the filing of the 10 petition, or more than 45 days preceding the last day for 11 filing of the petition in the case of political party and 12 independent candidates for single or multi-county regional 13 superintendents of schools in the 1994 general primary 14 election; and certifying that the signatures on the sheet are 15 genuine, and certifying that to the best of his knowledge 16 and belief the persons so signing were at the time of signing 17 the petitions qualified voters of the political party for 18 which a nomination is sought. Such statement shall be sworn 19 to before some officer authorized to administer oaths in this 20 State. 21 No petition sheet shall be circulated more than 90 days 22 preceding the last day provided in Section 7-12 for the 23 filing of such petition, or more than 45 days preceding the 24 last day for filing of the petition in the case of political 25 party and independent candidates for single or multi-county 26 regional superintendents of schools in the 1994 general 27 primary election. 28 The person circulating the petition, or the candidate on 29 whose behalf the petition is circulated, may strike any 30 signature from the petition, provided that; 31 (1) the person striking the signature shall initial 32 the petition at the place where the signature is struck; 33 and 34 (2) the person striking the signature shall sign a -5- LRB9105846PTpkam04 1 certification listing the page number and line number of 2 each signature struck from the petition. Such 3 certification shall be filed as a part of the petition. 4 Such sheets before being filed shall be neatly fastened 5 together in book form, by placing the sheets in a pile and 6 fastening them together at one edge in a secure and suitable 7 manner, and the sheets shall then be numbered consecutively. 8 The sheets shall not be fastened by pasting them together end 9 to end, so as to form a continuous strip or roll. All 10 petition sheets which are filed with the proper local 11 election officials, election authorities or the State Board 12 of Elections shall be the original sheets which have been 13 signed by the voters and by the circulator thereof, and not 14 photocopies or duplicates of such sheets. Each petition must 15 include as a part thereof, a statement of candidacy for each 16 of the candidates filing, or in whose behalf the petition is 17 filed. Whoever forges the name of a signer 4 upon any petition required by this Article is deemed guilty 5 of a forgery and on conviction thereof shall be punished 6 accordingly. 7 Petitions of candidates for nomination for offices herein 8 specified, to be filed with the same officer, may contain the 9 names of 2 or more candidates of the same political party for 10 the same or different offices. 11 Such petitions for nominations shall be signed: 12 (a) If for a State office, or for delegate or 13 alternate delegate to be elected from the State at large 14 to a National nominating convention by not less than 15 5,000 nor more than 10,000 primary electors of his party. 16 (b) If for a congressional officer or for delegate 17 or alternate delegate to be elected from a congressional 18 district to a national nominating convention by at least 19 .5% of the qualified primary electors of his party in his 20 congressional district, except that for the first primary 21 following a redistricting of congressional districts such 22 petitions shall be signed by at least 600 qualified 23 primary electors of the candidate's party in his 24 congressional district. 25 (c) If for a county office (including county board 26 member and chairman of the county board where elected 27 from the county at large), by at least .5% of the 28 qualified electors of his party cast at the last 29 preceding general election in his county. However, if 30 for the nomination for county commissioner of Cook 31 County, then by at least .5% of the qualified primary 32 electors of his or her party in his or her county in the 33 district or division in which such person is a candidate 34 for nomination; and if for county board member from a -8- LRB9105846PTpkam04 1 county board district, then by at least .5% of the 2 qualified primary electors of his party in the county 3 board district. In the case of an election for county 4 board member to be elected from a district, for the first 5 primary following a redistricting of county board 6 districts or the initial establishment of county board 7 districts, then by at least .5% of the qualified electors 8 of his party in the entire county at the last preceding 9 general election, divided by the number of county board 10 districts, but in any event not less than 25 qualified 11 primary electors of his party in the district. 12 (d) If for a municipal or township office by at 13 least .5% of the qualified primary electors of his party 14 in the municipality or township; if for alderman, by at 15 least .5% of the voters of his party of his ward. In the 16 case of an election for alderman or trustee of a 17 municipality to be elected from a ward or district, for 18 the first primary following a redistricting or the 19 initial establishment of wards or districts, then by .5% 20 of the total number of votes cast for the candidate of 21 such political party who received the highest number of 22 votes in the entire municipality at the last regular 23 election at which an officer was regularly scheduled to 24 be elected from the entire municipality, divided by the 25 number of wards or districts, but in any event not less 26 than 25 qualified primary electors of his party in the 27 ward or district. 28 (e) If for State central committeeman, by at least 29 100 of the primary electors of his or her party of his or 30 her congressional district. 31 (f) If for a candidate for trustee of a sanitary 32 district in which trustees are not elected from wards, by 33 at least .5% of the primary electors of his party, from 34 such sanitary district. -9- LRB9105846PTpkam04 1 (g) If for a candidate for trustee of a sanitary 2 district in which the trustees are elected from wards, by 3 at least .5% of the primary electors of his party in his 4 ward of such sanitary district, except that for the first 5 primary following a reapportionment of the district such 6 petitions shall be signed by at least 150 qualified 7 primary electors of the candidate's ward of such sanitary 8 district. 9 (h) If for a candidate for judicial office, by at 10 least 500 qualified primary electors of his or her 11 judicial district, circuit, or subcircuit, as the case 12 may be. 13 (i) If for a candidate for precinct committeeman, 14 by at least 10 primary electors of his or her party of 15 his or her precinct; if for a candidate for ward 16 committeeman, by not less than 10% nor more than 16% (or 17 50 more than the minimum, whichever is greater) of the 18 primary electors of his party of his ward; if for a 19 candidate for township committeeman, by not less than 5% 20 nor more than 8% (or 50 more than the minimum, whichever 21 is greater) of the primary electors of his party in his 22 township or part of a township as the case may be. 23 (j) If for a candidate for State's Attorney or 24 Regional Superintendent of Schools to serve 2 or more 25 counties, by at least .5% of the primary electors of his 26 party in the territory comprising such counties. 27 (k) If for any other office by at least .5% of the 28 total number of registered voters of the political 29 subdivision, district or division for which the 30 nomination is made or a minimum of 25, whichever is 31 greater. 32 For the purposes of this Section the number of primary 33 electors shall be determined by taking the total vote cast, 34 in the applicable district, for the candidate for such -10- LRB9105846PTpkam04 1 political party who received the highest number of votes, 2 state-wide, at the last general election in the State at 3 which electors for President of the United States were 4 elected. For political subdivisions, the number of primary 5 electors shall be determined by taking the total vote cast 6 for the candidate for such political party who received the 7 highest number of votes in such political subdivision at the 8 last regular election at which an officer was regularly 9 scheduled to be elected from that subdivision. For wards or 10 districts of political subdivisions, the number of primary 11 electors shall be determined by taking the total vote cast 12 for the candidate for such political party who received the 13 highest number of votes in such ward or district at the last 14 regular election at which an officer was regularly scheduled 15 to be elected from that ward or district. 16 A "qualified primary elector" of a party may not sign 17 petitions for or be a candidate in the primary of more than 18 one party. 19 (Source: P.A. 87-1052; 88-89; revised 1-26-99.) 20 (10 ILCS 5/8-8) (from Ch. 46, par. 8-8) 21 Sec. 8-8. Form of petition for nomination. The name of 22 no candidate for nomination shall be printed upon the primary 23 ballot unless a petition for nomination shall have been filed 24 in his behalf as provided for in this Section. Each such 25 petition shall include as a part thereof the oath required by 26 Section 7-10.1 of this Act and a statement of candidacy by 27 the candidate filing or in whose behalf the petition is 28 filed. (Official Character) 25 (Seal if officer has one.) 26 All petitions for nomination for the office of State 27 Senator shall be signed by 1% or 600, whichever is greater, 28 of the qualified primary electors of the candidate's party in 29 his legislative district, except that for the first primary 30 following a redistricting of legislative districts, such 31 petitions shall be signed by at least 600 qualified primary 32 electors of the candidate's party in his legislative 33 district. 34 All petitions for nomination for the office of -12- LRB9105846PTpkam04 1 Representative in the General Assembly shall be signed by at 2 least 1% or 300, whichever is greater, of the qualified 3 primary electors of the candidate's party in his or her 4 representative district, except that for the first primary 5 following a redistricting of representative districts such 6 petitions shall be signed by at least 300 qualified primary 7 electors of the candidate's party in his or her 8 representative district. 9 Opposite the signature of each qualified primary elector 10 who signs a petition for nomination for the office of State 11 Representative or State Senator such elector's residence 12 address shall be written or printed. The residence address 13 required to be written or printed opposite each qualified 14 primary elector's name shall include the street address or 15 rural route number of the signer, as the case may be, as well 16 as the signer's county and city, village or town. 17 For the purposes of this Section, the number of primary 18 electors shall be determined by taking the total vote cast, 19 in the applicable district, for the candidate for such 20 political party who received the highest number of votes, 21 state-wide, at the last general election in the State at 22 which electors for President of the United States were 23 elected. 24 A "qualified primary elector" of a party may not sign 25 petitions for or be a candidate in the primary of more than 26 one party. 27 In the affidavit at the bottom of each sheet, the 28 petition circulator, who shall have been a registered voter 29 at all times he or she circulated the petition, shall state 30 his street address or rural route number, as the case may be, 31 as well as his county and city, village or town. 32 In the affidavit at the bottom of each petition sheet, 33 the petition circulator shall either (1) indicate the dates 34 on which he or she circulated that sheet, or (2) indicate the -13- LRB9105846PTpkam04 1 first and last dates on which the sheet was circulated, or 2 (3) certify that none of the signatures on the sheet were 3 signed more than 90 days preceding the last day for the 4 filing of the petition. No petition sheet shall be 5 circulated more than 90 days preceding the last day provided 6 in Section 8-9 for the filing of such petition. 7 All petition sheets which are filed with the State Board 8 of Elections shall be the original sheets which have been 9 signed by the voters and by the circulator, and not 10 photocopies or duplicates of such sheets. 11 The person circulating the petition, or the candidate on 12 whose behalf the petition is circulated, may strike any 13 signature from the petition, provided that:;14 (1) the person striking the signature shall initial 15 the petition at the place where the signature is struck; 16 and 17 (2) the person striking the signature shall sign a 18 certification listing the page number and line number of 19 each signature struck from the petition. Such 20 certification shall be filed as a part of the petition. 21 (Source: P.A. 86-867; 86-875; 86-1028; 86-1348; 87-1052; 22 revised 10-20-98.) 23 (10 ILCS 5/10-4) (from Ch. 46, par. 10-4) 24 Sec. 10-4. Form of petition for nomination. All 25 petitions for nomination under this Article 10 for candidates 26 for public office in this State, shall in addition to other 27 requirements provided by law, be as follows: Such petitions 28 shall consist of sheets of uniform size and each sheet shall 29 contain, above the space for signature, an appropriate 30 heading, giving the information as to name of candidate or 31 candidates in whose behalf such petition is signed; the 32 office; the party; place of residence; and such other 33 information or wording as required to make same valid, and -14- LRB9105846PTpkam04 1 the heading of each sheet shall be the same. Such petition 2 shall be signed by the qualified voters in their own proper 3 persons only, and opposite the signature of each signer his 4 residence address shall be written or printed. The residence 5 address required to be written or printed opposite each 6 qualified primary elector's name shall include the street 7 address or rural route number of the signer, as the case may 8 be, as well as the signer's county, and city, village or town 9 , and state. However, the county or city, village or town, 10 and state of residence of such electors may be printed on the 11 petition forms where all of the such electors signing the 12 petition reside in the same county or city, village or town, 13 and state. Standard abbreviations may be used in writing the 14 residence address, including street number, if any. No 15 signature shall be valid or be counted in considering the 16 validity or sufficiency of such petition unless the 17 requirements of this Section are complied with. At the bottom 18 of each sheet of such petition shall be added a statement, 19 signed by a registered voter of the political division, who 20 has been a registered voter at all times he or she circulated 21 the petition, for which the candidate or candidates shall be 22 nominated; stating the street address or rural route number 23 of the voter, as the case may be, as well as the voter's 24 county, and city, village or town, and state certifying that 25 the signatures on that sheet of the petition were signed in 26 his presence; certifying that the signatures are genuine; and 27 either (1) indicating the dates on which that sheet was 28 circulated, or (2) indicating the first and last dates on 29 which the sheet was circulated, or (3) certifying that none 30 of the signatures on the sheet were signed more than 90 days 31 preceding the last day for the filing of the petition, or 32 more than 45 days preceding the last day for filing of the 33 petition in the case of political party and independent 34 candidates for single or multi-county regional -15- LRB9105846PTpkam04 1 superintendents of schools in the 1994 general primary 2 election; and certifying that to the best of his knowledge 3 and belief the persons so signing were at the time of signing 4 the petition duly registered voters under Articles 4, 5 or 6 5 of the Code of the political subdivision or district for 6 which the candidate or candidates shall be nominated, and 7 certifying that their respective residences are correctly 8 stated therein. Such statement shall be sworn to before some 9 officer authorized to administer oaths in this State. No 10 petition sheet shall be circulated more than 90 days 11 preceding the last day provided in Section 10-6 for the 12 filing of such petition, or more than 45 days preceding the 13 last day for filing of the petition in the case of political 14 party and independent candidates for single or multi-county 15 regional superintendents of schools in the 1994 general 16 primary election. Such sheets, before being presented to the 17 electoral board or filed with the proper officer of the 18 electoral district or division of the state or municipality, 19 as the case may be, shall be neatly fastened together in book 20 form, by placing the sheets in a pile and fastening them 21 together at one edge in a secure and suitable manner, and the 22 sheets shall then be numbered consecutively. The sheets 23 shall not be fastened by pasting them together end to end, so 24 as to form a continuous strip or roll. All petition sheets 25 which are filed with the proper local election officials, 26 election authorities or the State Board of Elections shall be 27 the original sheets which have been signed by the voters and 28 by the circulator, and not photocopies or duplicates of such 29 sheets. A petition, when presented or filed, shall not be 30 withdrawn, altered, or added to, and no signature shall be 31 revoked except by revocation in writing presented or filed 32 with the officers or officer with whom the petition is 33 required to be presented or filed, and before the presentment 34 or filing of such petition. Whoever forges any name of a -16- LRB9105846PTpkam04 1 signer upon any petition shall be deemed guilty of a forgery, 2 and on conviction thereof, shall be punished accordingly. 3 The word "petition" or "petition for nomination", as used 4 herein, shall mean what is sometimes known as nomination 5 papers, in distinction to what is known as a certificate of 6 nomination. The words "political division for which the 7 candidate is nominated", or its equivalent, shall mean the 8 largest political division in which all qualified voters may 9 vote upon such candidate or candidates, as the state in the 10 case of state officers; the township in the case of township 11 officers et cetera. Provided, further, that no person shall 12 circulate or certify petitions for candidates of more than 13 one political party, or for an independent candidate or 14 candidates in addition to one political party, to be voted 15 upon at the next primary or general election, or for such 16 candidates and parties with respect to the same political 17 subdivision at the next consolidated election. 18 (Source: P.A. 87-1052; 88-89.)"; and 19 on page 4, below line 30, by inserting the following: 20 "(10 ILCS 5/28-3) (from Ch. 46, par. 28-3) 21 Sec. 28-3. Form of petition for public question. 22 Petitions for the submission of public questions shall 23 consist of sheets of uniform size and each sheet shall 24 contain, above the space for signature, an appropriate 25 heading, giving the information as to the question of public 26 policy to be submitted, and specifying the state at large or 27 the political subdivision or district or precinct or 28 combination of precincts or other territory in which it is to 29 be submitted and, where by law the public question must be 30 submitted at a particular election, the election at which it 31 is to be submitted. In the case of a petition for the 32 submission of a public question described in subsection (b) 33 of Section 28-6, the heading shall also specify the regular -17- LRB9105846PTpkam04 1 election at which the question is to be submitted and include 2 the precincts included in the territory concerning which the 3 public question is to be submitted, as well as a common 4 description of such territory in plain and nonlegal language, 5 such description to describe the territory by reference to 6 streets, natural or artificial landmarks, addresses or any 7 other method which would enable a voter signing the petition 8 to be informed of the territory concerning which the question 9 is to be submitted. The heading of each sheet shall be the 10 same. Such petition shall be signed by the registered voters 11 of the political subdivision or district or precinct or 12 combination of precincts in which the question of public 13 policy is to be submitted in their own proper persons only, 14 and opposite the signature of each signer his residence 15 address shall be written or printed, which residence address 16 shall include the street address or rural route number of the 17 signer, as the case may be, as well as the signer's county, 18 and city, village or town, and state; provided that the 19 county or city, village or town, and state of residence of 20 such electors may be printed on the petition forms where all 21 of the such electors signing the petition reside in the same 22 county or city, village or town, and state. Standard 23 abbreviations may be used in writing the residence address, 24 including street number, if any. No signature shall be valid 25 or be counted in considering the validity or sufficiency of 26 such petition unless the requirements of this Section are 27 complied with. 28 At the bottom of each sheet of such petition shall be 29 added a statement, signed by a registered voter, who has been 30 a registered voter at all times he or she circulated the 31 petition, of the political subdivision or district or 32 precinct or combination of precincts in which the question of 33 public policy is to be submitted, stating the street address 34 or rural route number of the voter, as the case may be, as -18- LRB9105846PTpkam04 1 well as the voter's county, and city, village or town, and 2 state certifying that the signatures on that sheet of the 3 petition were signed in his presence and are genuine, and 4 that to the best of his knowledge and belief the persons so 5 signing were at the time of signing the petition registered 6 voters of the political subdivision or district or precinct 7 or combination of precincts in which the question of public 8 policy is to be submitted and that their respective 9 residences are correctly stated therein. Such statement shall 10 be sworn to before some officer authorized to administer 11 oaths in this State. 12 Such sheets, before being filed with the proper officer 13 or board shall be bound securely and numbered consecutively. 14 The sheets shall not be fastened by pasting them together end 15 to end, so as to form a continuous strip or roll. All 16 petition sheets which are filed with the proper local 17 election officials, election authorities or the State Board 18 of Elections shall be the original sheets which have been 19 signed by the voters and by the circulator, and not 20 photocopies or duplicates of such sheets. A petition, when 21 presented or filed, shall not be withdrawn, altered, or added 22 to, and no signature shall be revoked except by revocation in 23 writing presented or filed with the board or officer with 24 whom the petition is required to be presented or filed, and 25 before the presentment or filing of such petition, except as 26 may otherwise be provided in another statute which authorize 27 the public question. Whoever forges any name of a signer upon 28 any petition shall be deemed guilty of a forgery, and on 29 conviction thereof, shall be punished accordingly. 30 In addition to the foregoing requirements, a petition 31 proposing an amendment to Article IV of the Constitution 32 pursuant to Section 3 of Article XIV of the Constitution or a 33 petition proposing a question of public policy to be 34 submitted to the voters of the entire State shall be in -19- LRB9105846PTpkam04 1 conformity with the requirements of Section 28-9 of this 2 Article. 3 If multiple sets of petitions for submission of the same 4 public questions are filed, the State Board of Elections, 5 appropriate election authority or local election official 6 where the petitions are filed shall within 2 business days 7 notify the proponent of his or her multiple petition filings 8 and that proponent has 3 business days after receipt of the 9 notice to notify the State Board of Elections, appropriate 10 election authority or local election official that he or she 11 may cancel prior sets of petitions. If the proponent 12 notifies the State Board of Elections, appropriate election 13 authority or local election official, the last set of 14 petitions filed shall be the only petitions to be considered 15 valid by the State Board of Elections, appropriate election 16 authority or local election official. If the proponent fails 17 to notify the State Board of Elections, appropriate election 18 authority or local election official then only the first set 19 of petitions filed shall be valid and all subsequent 20 petitions shall be void. 21 (Source: P.A. 86-867; 87-1052.)"; and 22 on page 18, line 28, after "general", by inserting "or 23 consolidated".
