1 AMENDMENT TO SENATE BILL 188
2 AMENDMENT NO. . Amend Senate Bill 188 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The Criminal Code of 1961 is amended by
5 adding Section 17-23 as follows:
6 (720 ILCS 5/17-23 new)
7 Sec. 17-23. Counterfeit retail sales receipt and
8 Universal Price Code Label.
9 (a) A person who, with intent to defraud a merchant,
10 possesses, uses, transfers, makes, sells, reproduces,
11 tenders, or delivers a false, counterfeit, altered, or
12 simulated retail sales receipt or a Universal Price Code
13 Label is guilty of a Class 4 felony.
14 (b) A person who possesses more than one false,
15 counterfeit, altered, or simulated retail sales receipt or
16 more than one false, counterfeit, altered, or simulated
17 Universal Price Code Label or who possesses a device the
18 purpose of which is to manufacture false, counterfeit,
19 altered, or simulated retail sales receipts or Universal
20 Price Code Labels is guilty of a Class 3 felony.
21 (d) Definitions. In this Section:
22 "Universal Price Code Label" means a unique symbol that

1 consists of a machine readable code and human readable
2 numbers.
3 "Merchant" has the meaning ascribed to it in Section
4 16A-2.4 of this Code.
5 "Intent to defraud" has the meaning ascribed to it in
6 paragraph (iii) of subsection (A) of Section 17-1 of this
7 Code.".
