1 AN ACT to amend the Criminal Code of 1961 by adding
2 Section 17-23.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Criminal Code of 1961 is amended by
6 adding Section 17-23 as follows:
7 (720 ILCS 5/17-23 new)
8 Sec. 17-23. Counterfeit retail sales receipt and
9 Universal Price Code Label.
10 (a) A person who, with the intent to cheat or defraud
11 another, possesses, uses, utters, transfers, makes, alters,
12 counterfeits, or reproduces a retail sales receipt or a
13 Universal Price Code Label, is guilty of a Class 4 felony,
14 and, in addition to any other penalty imposed, may be fined
15 not exceeding 3 times the value represented on the retail
16 sales receipt or the Universal Price Code Label.
17 (b) A person who possesses more than one fraudulent
18 retail sales receipt or more than one fraudulent Universal
19 Price Code Label or who possesses a device that manufactures
20 fraudulent retail sales receipts or Universal Price Code
21 Labels is guilty of a Class 3 felony.
22 Section 99. Effective date. This Act takes effect upon
23 becoming law.
