Amend Senate Bill 149 by replacing 3 the title with the following: 4 "AN ACT to amend the Emergency Telephone System Act by 5 changing Section 15.6."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Emergency Telephone System Act is 9 amended by changing Section 15.6 as follows: 10 (50 ILCS 750/15.6) 11 Sec. 15.6. Enhanced 9-1-1 service; business service. 12 (a) After June 30, 2000, or within 18 months after 13 enhanced 9-1-1 service becomes available, any entity that 14 installs or operates a private business switch service and 15 provides telecommunications facilities or services to 16 businesses shall assure that the system is connected to the 17 public switched network in a manner that calls to 9-1-1 18 result in automatic number and location identification. For 19 buildings having their own street address and containing 20 workspace of 40,000 square feet or less, location 21 identification shall include the building's street address. -2- LRB9102274MWmbam01 1 For buildings having their own street address and containing 2 workspace of more than 40,000 square feet, location 3 identification shall include the building's street address 4 and one distinct location identification per 40,000 square 5 feet of workspace. Separate buildings containing workspace of 6 40,000 square feet or less having a common public street 7 address shall have a distinct location identification for 8 each building in addition to the street address. 9 (b) Exemptions. Buildings containing workspace of more 10 than 40,000 square feet are exempt from the multiple location 11 identification requirements of subsection (a) if the building 12 maintains, at all times, alternative and adequate means of 13 signaling and responding to emergencies. Those means shall 14 include a telephone system that provides the physical 15 location of 9-1-1 calls coming from within the building. 16 Buildings under this exemption must provide 9-1-1 service 17 that provides the building's street address. 18 Buildings containing workspace of more than 40,000 square 19 feet are exempt from subsection (a) if the building 20 maintains, at all times, alternative and adequate means of 21 signaling and responding to emergencies, including a 22 telephone system that provides the location of a 9-1-1 call 23 coming from within the building, and the building is serviced 24 by its own medical, fire and security personnel. Buildings 25 under this exemption are subject to emergency phone system 26 certification by the Illinois Commerce Commission. 27 Buildings in communities not serviced by enhanced 9-1-1 28 service are exempt from subsection (a).Private business29switch service 9-1-1 service.30(a) After June 30, 1996, an entity that installs or31operates a new private business switch service or replaces an32existing private business switch service and provides33telecommunications facilities or services to businesses shall34provide to those business end users the same level of 9-1-1-3- LRB9102274MWmbam01 1service as the public agency and the telecommunications2carrier are providing to other business end users of the3local 9-1-1 system. This service shall include, but not be4limited to, the capability to identify the telephone number,5extension number, and the physical location that is the6source of the call to the number designated as the emergency7telephone number. After June 30, 1999, all entities8providing or operating a private business switch service9shall be in compliance with this Section.10(b) The private business switch operator is responsible11for forwarding end user automatic location identification12record information to the 9-1-1 system provider according to13the format, frequency, and procedures established by that14system provider.15 (c) This Act does not apply to any PBX telephone 16 extension that uses radio transmissions to convey electrical 17 signals directly between the telephone extension and the 18 serving PBX. 19 (d) An entity that violates this Section is guilty of a 20 business offense and shall be fined not less than $1,000 and 21 not more than $5,000. 22 (e) Nothing in this Section shall be construed to 23 preclude the Attorney General on behalf of the Commission or 24 on his or her own initiative, or any other interested person, 25 from seeking judicial relief, by mandamus, injunction, or 26 otherwise, to compel compliance with this Section. 27 (f) The Commission shall promulgate rules for the 28 administration of this Section no later than January 1, 2000. 29 30 (Source: P.A. 88-604, eff. 9-1-94; 89-222, eff. 1-1-96; 31 89-497, eff. 6-27-96.) 32 Section 99. Effective date. This Act takes effect upon 33 becoming law.".
