91_SB0147 LRB9101808JMcsB 1 AN ACT creating the Criminal Law and Corrections 2 Commission, amending a named Act. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Legislative Commission Reorganization Act 6 of 1984 is amended by changing Sections 1-3 and 1-5 and 7 adding Article 3B as follows: 8 (25 ILCS 130/1-3) (from Ch. 63, par. 1001-3) 9 Sec. 1-3. Legislative support services agencies. The 10 Joint Committee on Legislative Support Services is 11 responsible for establishing general policy and coordinating 12 activities among the legislative support services agencies. 13 The legislative support services agencies include the 14 following: 15 (1) Joint Committee on Administrative Rules; 16 (2) Illinois Economic and Fiscal Commission; 17 (3) Illinois Commission on Intergovernmental 18 Cooperation; 19 (4) Legislative Information System; 20 (5) Legislative Reference Bureau; 21 (6) Legislative Audit Commission; 22 (7) Space Needs Commission; 23 (8) Legislative Printing Unit; 24 (9) Legislative Research Unit; 25 (10) Citizens Assembly;and26 (11) Pension Laws Commission; and.27 (12) Criminal Law and Corrections Commission. 28 (Source: P.A. 89-113, eff. 7-7-95.) 29 (25 ILCS 130/1-5) (from Ch. 63, par. 1001-5) 30 Sec. 1-5. Composition of agencies; directors. -2- LRB9101808JMcsB 1 (a)(1) Each legislative support services agency listed 2 in Section 1-3 is hereafter in this Section referred to as 3 the Agency. 4 (2) The Citizens Assembly shall consist of the 14 5 co-chairpersons of the Citizens Councils created under 6 Article 11A. 7 (2.1) The Pension Laws Commission shall consist of 8 8 members of the General Assembly, of whom 2 shall be appointed 9 by the President of the Senate, 2 shall be appointed by the 10 Minority Leader of the Senate, 2 shall be appointed by the 11 Speaker of the House of Representatives, and 2 shall be 12 appointed by the Minority Leader of the House of 13 Representatives; plus 8 public members with knowledge of 14 privately funded and operated pension plans, of whom 2 shall 15 be appointed by the President of the Senate, 2 shall be 16 appointed by the Minority Leader of the Senate, 2 shall be 17 appointed by the Speaker of the House of Representatives, and 18 2 shall be appointed by the Minority Leader of the House of 19 Representatives. All appointments shall be in writing and 20 filed with the Secretary of State as a public record. 21 Legislative members of the Pension Laws Commission shall 22 be appointed during the month of January in each odd-numbered 23 year for 2-year terms beginning February 1. Any vacancy on 24 the Commission shall be filled by appointment for the balance 25 of the term in the same manner as the original appointment. 26 A vacancy exists when a legislative member ceases to hold the 27 elected legislative office held at the time of appointment. 28 The initial legislative members of the Commission shall be 29 appointed as soon as practicable after the effective date of 30 this amendatory Act and shall serve until January 31, 1997. 31 (2.5) The Criminal Law and Corrections Commission 32 consists of 8 legislative members and 8 public members. 33 Legislative members are members of the General Assembly 34 appointed 2 each by the Speaker and Minority Leader of the -3- LRB9101808JMcsB 1 House of Representatives and the President and Minority 2 Leader of the Senate. Public members are appointed 2 each by 3 the Speaker and Minority Leader of the House of 4 Representatives and the President and Minority Leader of the 5 Senate. The Commission also includes 24 advisors appointed 6 one each by the following: 7 (i) Supreme Court of Illinois. 8 (ii) Attorney General. 9 (iii) Department of Corrections. 10 (iv) Division of Mental Health of Department of 11 Human Services. 12 (v) Chief Judge of Cook County. 13 (vi) Cook County State's Attorney. 14 (vii) Cook County Public Defender. 15 (viii) Chief Judge of DuPage County. 16 (ix) DuPage County State's Attorney. 17 (x) DuPage County Public Defender. 18 (xi) Illinois State's Attorneys Association. 19 (xii) Illinois Sheriffs Association. 20 (xiii) Illinois Public Defenders Association. 21 (xiv) Illinois Judges Association. 22 (xv) Chief Judges Conference. 23 (xvi) Illinois Probation and Court Services 24 Association. 25 (xvii) State Victims' Rights Organization. 26 (xviii) Illinois State Bar Association. 27 (xix) Chicago Bar Association. 28 (xx) Cook County Judicial Advisory Council. 29 (xxi) Criminal Justice Information Authority. 30 (xxii) Illinois Juvenile Justice Commission. 31 (xxiii) Illinois State Crime Commission. 32 (xxiv) Chicago Crime Commission. 33 Appointments must be in writing and filed with the 34 Secretary of State as a public record. -4- LRB9101808JMcsB 1 Legislative and public members of the Criminal Law and 2 Corrections Commission are voting members. Advisors may not 3 vote. Members and advisors are appointed in January of each 4 odd-numbered year for 2-year terms beginning February 1, 5 except that initial members and advisors must be appointed as 6 soon as possible after the effective date of this amendatory 7 Act of the 91st General Assembly and will serve through 8 January 31, 2001. 9 A vacancy on the Criminal Law and Corrections Commission 10 must be filled by appointment of the original appointing 11 authority for the balance of the unexpired term. Except in 12 the case of initial legislative members, a vacancy exists 13 when a legislative member ceases to hold the elected 14 legislative office he or she held at the time of appointment. 15 16 (3) The other legislative support services agencies 17 shall each consist of 12 members of the General Assembly, of 18 whom 3 shall be appointed by the President of the Senate, 3 19 shall be appointed by the Minority Leader of the Senate, 3 20 shall be appointed by the Speaker of the House of 21 Representatives, and 3 shall be appointed by the Minority 22 Leader of the House of Representatives. All appointments 23 shall be in writing and filed with the Secretary of State as 24 a public record. 25 Members shall serve a two year term, and must be 26 appointed by the Joint Committee during the month of January 27 in each odd-numbered year for terms beginning February 1. 28 Any vacancy in an Agency shall be filled by appointment for 29 the balance of the term in the same manner as the original 30 appointment. A vacancy shall exist when a member no longer 31 holds the elected legislative office held at the time of the 32 appointment or at the termination of the member's legislative 33 service. 34 (b) (Blank). -5- LRB9101808JMcsB 1 (c) Every two years the members of each Agency shall 2 elect, during the month of February of each odd-numbered 3 year, 2 co-chairmen and such other officers as they deem 4 necessary. If members of the Agency cannot agree on the 5 co-chairmen by March 1 of the odd-numbered year, the 6 co-chairmen shall be selected from among the members by the 7 Joint Committee on Legislative Support Services. The 8 co-chairmen of each Agency shall serve for a two-year term, 9 beginning February 1 of the odd-numbered year, and the 2 10 co-chairmen shall not be members of or identified with the 11 same house or the same political party. If a co-chairman of 12 the Citizens Assembly is not a member of the General 13 Assembly, he shall be considered to be identified with the 14 house and the political party of the legislative leader by 15 whom he was appointed. The co-chairmen of the Pension Laws 16 Commission and the Criminal Law and Corrections Commission 17 shall be legislative members of the commissionsCommission. 18 Each Agency shall meet twice annually or more often upon 19 the call of the chair or a majority of the votingany 920 members. A quorum of the Agency shall consist of a majority 21 of the appointed members. 22 (d) Members of each Agency shall serve without 23 compensation, but shall be reimbursed for expenses incurred 24 in carrying out the duties of the Agency pursuant to rules 25 and regulations adopted by the Joint Committee on Legislative 26 Support Services. 27 (e) Beginning February 1, 1985, and every two years 28 thereafter, the Joint Committee shall select an Executive 29 Director who shall be the chief executive officer and staff 30 director of each Agency. The Joint Committee shall select an 31 Executive Director of the Criminal Law and Corrections 32 Commission as soon as possible after the effective date of 33 this amendatory Act of the 91st General Assembly. The 34 Executive Director shall receive a salary as fixed by the -6- LRB9101808JMcsB 1 Joint Committee and shall be authorized to employ and fix the 2 compensation of necessary professional, technical and 3 secretarial staff and prescribe their duties, sign contracts, 4 and issue vouchers for the payment of obligations pursuant to 5 rules and regulations adopted by the Joint Committee on 6 Legislative Support Services. The Executive Director and 7 other employees of the Agency shall not be subject to the 8 Personnel Code. 9 (Source: P.A. 89-113, eff. 7-7-95.) 10 (25 ILCS 130/Art. 3B heading new) 11 ARTICLE 3B 12 (25 ILCS 130/3B-1 new) 13 Sec. 3B-1. Criminal Law and Corrections Commission. 14 (a) The Criminal Law and Corrections Commission is 15 established as a legislative support services agency. The 16 Commission is subject to the provisions of this Act. It has 17 the powers and duties delegated to it under this Act and must 18 perform any other functions that may be provided by law. 19 (b) It is the duty of the Criminal Law and Corrections 20 Commission to study and make recommendations concerning the 21 recodification of the laws pertaining to criminal law and 22 corrections as necessary. 23 (c) The Commission must report to the General Assembly 24 annually or as it deems necessary or useful on the results of 25 the performance of its duties. 26 (d) The Commission may request assistance from any other 27 entity as necessary or useful for the performance of its 28 duties.
