91_SB0043 LRB9101592PTpk 1 AN ACT concerning cancer research. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Civil Administrative Code of Illinois is 5 amended by adding Section 55.91 as follows: 6 (20 ILCS 2310/55.91 new) 7 Sec. 55.91. Prostate Cancer Research Fund; grants. From 8 funds appropriated from the Prostate Cancer Research Fund, a 9 special fund created in the State treasury, the Department of 10 Human Services shall make grants to public or private 11 entities in Illinois, which may include the Illinois Prostate 12 Cancer Coalition, for the purpose of funding research that 13 will result in therapy for prostate cancer patients. The 14 grant funds may not be used for institutional overhead costs, 15 indirect costs, other organizational levies, or costs of 16 community-based support services. 17 Section 10. The State Finance Act is amended by adding 18 Section 5.490 as follows: 19 (30 ILCS 105/5.490 new) 20 Sec. 5.490. The Prostate Cancer Research Fund. 21 Section 15. The Illinois Income Tax Act is amended by 22 adding Section 507U and changing Sections 509 and 510 as 23 follows: 24 (35 ILCS 5/507U new) 25 Sec. 507U. Prostate Cancer Research Fund checkoff. The 26 Department shall print on its standard individual income tax 27 form a provision indicating that if the taxpayer wishes to -2- LRB9101592PTpk 1 contribute to the Prostate Cancer Research Fund, as 2 authorized by this amendatory Act of the 91st General 3 Assembly, he or she may do so by stating the amount of the 4 contribution (not less than $1) on the return and that the 5 contribution will reduce the taxpayer's refund or increase 6 the amount of payment to accompany the return. Failure to 7 remit any amount of increased payment shall reduce the 8 contribution accordingly. This Section shall not apply to any 9 amended return. 10 (35 ILCS 5/509) (from Ch. 120, par. 5-509) 11 Sec. 509. Tax checkoff explanations. All individual 12 income tax return forms shall contain appropriate 13 explanations and spaces to enable the taxpayers to designate 14 contributions to the Child Abuse Prevention Fund, to the 15 Community Health Center Care Fund, to the Illinois Wildlife 16 Preservation Fund as required by the Illinois Non-Game 17 Wildlife Protection Act, to the Alzheimer's Disease Research 18 Fund as required by the Alzheimer's Disease Research Act, to 19 the Assistance to the Homeless Fund as required by this Act, 20 to the Heritage Preservation Fund as required by the Heritage 21 Preservation Act, to the Child Care Expansion Program Fund as 22 required by the Child Care Expansion Program Act, to the Ryan 23 White AIDS Victims Assistance Fund, to the Assistive 24 Technology for Persons with Disabilities Fund, to the 25 Domestic Violence Shelter and Service Fund, to the United 26 States Olympians Assistance Fund, to the Youth Drug Abuse 27 Prevention Fund, to the Persian Gulf Conflict Veterans Fund, 28 to the Literacy Advancement Fund, to the Ryan White Pediatric 29 and Adult AIDS Fund, to the Illinois Special Olympics 30 Checkoff Fund, to the Breast and Cervical Cancer Research 31 Fund, to the Korean War Memorial Fund, to the Heart Disease 32 Treatment and Prevention Fund, to the Hemophilia Treatment 33 Fund, to the Mental Health Research Fund, to the Children's -3- LRB9101592PTpk 1 Cancer Fund, to the American Diabetes Association Fund, to 2 the Women in Military Service Memorial Fund, to the Prostate 3 Cancer Research Fund, and to the Meals on Wheels Fund. Each 4 form shall contain a statement that the contributions will 5 reduce the taxpayer's refund or increase the amount of 6 payment to accompany the return. Failure to remit any amount 7 of increased payment shall reduce the contribution 8 accordingly. 9 If, on October 1 of any year, the total contributions to 10 any one of the funds made under this Section do not equal 11 $100,000 or more, the explanations and spaces for designating 12 contributions to the fund shall be removed from the 13 individual income tax return forms for the following and all 14 subsequent years and all subsequent contributions to the fund 15 shall be refunded to the taxpayer. 16 (Source: P.A. 89-230, eff. 1-1-96; 89-324, eff. 8-13-95; 17 90-171, eff. 7-23-97; revised 10-31-98.) 18 (35 ILCS 5/510) (from Ch. 120, par. 5-510) 19 Sec. 510. Determination of amounts contributed. The 20 Department shall determine the total amount contributed to 21 each of the following: the Child Abuse Prevention Fund, the 22 Illinois Wildlife Preservation Fund, the Community Health 23 Center Care Fund, the Assistance to the Homeless Fund, the 24 Alzheimer's Disease Research Fund, the Heritage Preservation 25 Fund, the Child Care Expansion Program Fund, the Ryan White 26 AIDS Victims Assistance Fund, the Assistive Technology for 27 Persons with Disabilities Fund, the Domestic Violence Shelter 28 and Service Fund, the United States Olympians Assistance 29 Fund, the Youth Drug Abuse Prevention Fund, the Persian Gulf 30 Conflict Veterans Fund, the Literacy Advancement Fund, the 31 Ryan White Pediatric and Adult AIDS Fund, the Illinois 32 Special Olympics Checkoff Fund, the Breast and Cervical 33 Cancer Research Fund, the Korean War Memorial Fund, the Heart -4- LRB9101592PTpk 1 Disease Treatment and Prevention Fund, the Hemophilia 2 Treatment Fund, the Mental Health Research Fund, the 3 Children's Cancer Fund, the American Diabetes Association 4 Fund, the Women in Military Service Memorial Fund, the 5 Prostate Cancer Research Fund, and the Meals on Wheels Fund; 6 and shall notify the State Comptroller and the State 7 Treasurer of the amounts to be transferred from the General 8 Revenue Fund to each fund, and upon receipt of such 9 notification the State Treasurer and Comptroller shall 10 transfer the amounts. 11 (Source: P.A. 89-230, eff. 1-1-96; 89-324, eff. 8-13-95; 12 90-171, eff. 7-23-97.) 13 Section 99. Effective date. This Act takes effect upon 14 becoming law.
