Amend Senate Bill 26, AS AMENDED, 3 with reference to page and line numbers of House Amendment 4 No. 1, on page 2, by replacing lines 20 through 30 with the 5 following: 6 "(b) In counties with a county executive form of 7 government as defined in Section 2-5003 of the Counties Code 8 or any forest preserve district established after July 1, 9 1999, an owner-occupied residence that qualifies as homestead 10 property under Section 15-175 of the Property Tax Code or an 11 owner-operated farm as a farm is defined in Section 1-60 of 12 the Property Tax Code may not be taken for recreational 13 purposes by a forest preserve district except with the 14 consent of the owner. The restriction in this subsection (b) 15 does not apply if the owner is a willing seller. The 16 restriction in this subsection (b) does not apply to takings 17 of property by a public utility authorized by a grant of 18 authority issued under Article VIII of the Public Utilities 19 Act.".
