91_SB0026 LRB9101069SMtm 1 AN ACT regarding property, which may be referred to as 2 the Property Owners Protection Amendments of 1999. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Code of Civil Procedure is amended by 6 changing Section 7-122 as follows: 7 (735 ILCS 5/7-122) (from Ch. 110, par. 7-122) 8 Sec. 7-122. Reimbursement. Where the State of Illinois, 9 a political subdivision of the State or a municipality is 10 required by a court to initiate condemnation proceedings for 11 the actual physical taking of real property, the court 12 rendering judgment for the property owner and awarding just 13 compensation for thesuchtaking shall determine and award or 14 allow to thesuchproperty owner, as part of thesuch15 judgment or award, such further sums, as will in the opinion 16 of the court, reimburse thesuchproperty owner for the 17 owner's reasonable costs, disbursements and expenses, 18 including reasonable attorney, appraisal and engineering fees 19 actually incurred by the property owner in thesuch20 proceedings. 21 (Source: P.A. 82-280.)
