1 AN ACT regarding property, which may be referred to as
2 the Property Owners Protection Amendments of 1999.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Code of Civil Procedure is amended by
6 changing Section 7-122 as follows:
7 (735 ILCS 5/7-122) (from Ch. 110, par. 7-122)
8 Sec. 7-122. Reimbursement. Where the State of Illinois,
9 a political subdivision of the State or a municipality is
10 required by a court to initiate condemnation proceedings for
11 the actual physical taking of real property, the court
12 rendering judgment for the property owner and awarding just
13 compensation for the such taking shall determine and award or
14 allow to the such property owner, as part of the such
15 judgment or award, such further sums, as will in the opinion
16 of the court, reimburse the such property owner for the
17 owner's reasonable costs, disbursements and expenses,
18 including reasonable attorney, appraisal and engineering fees
19 actually incurred by the property owner in the such
20 proceedings.
